Final Resolution: Motion Carries Aye: Erick Carter, Stephanie Lucarelli, Jen Mitchell, Roy Terry, Jory Westberry Consent Agenda - Facilities Subject C59 GMP Direct Material Purchase and Sales Tax Reduction No.1 –Replace Buildings 1, 2 and 6 Air Handling Units – Tommie Barfield Elementary School Meeting Mar 5, 2019 - Regular School Board Meeting Type Action (Consent) Fiscal Impact Yes Budgeted Yes Budget Source Capital Outlay Funds Recommended Action Approve the GMP Direct Material Purchase and Sales Tax Reduction No.1 for the Replace Buildings 1, 2 and 6 Air Handling Units at Tommie Barfield Elementary School project. FEDERAL STATUTE: n/a FLORIDA STATUTE: 212.08(6) SCHOOL BOARD POLICY: 6345 EXECUTIVE SUMMARY: Florida Statute 212.08(6) is a general exemption of tax on sales made directly to government entities. Florida Administrative Code 12A–1.094(4)(a) exempts tax on direct material purchases made by government entities and provides the criteria to make those purchases. Direct material purchasing is a cost saving measure that is performed throughout the state by many school districts and other tax-exempt organizations. In order to realize the sales tax savings on this project, the guaranteed maximum price (GMP) contract needs to be reduced by the amount of the product purchase price and amount of the sales tax. This change order reduces the GMP contract price so the District will realize savings from a sales tax exempt purchase on the Replace Buildings 1, 2 and 6 Air Handling Units at Tommie Barfield Elementary School project. In order to realize the sales tax savings on this project, the GMP contract needs to be reduced by $264,788.00, the amount of the product purchase price and the amount of the sales tax. In this case, the product’s purchase price is $249,800.00 and the amount of the sales tax is $14,988.00. The District will purchase the project's air handling units from the supplier in the amount of $249,800.00 and will realize a sales tax savings of $14,988.00. For Board information, a summary of the requested revision to the contract is attached. This adjustment of $249,800.00 includes a sales tax savings of $14,988.00 and will reduce the total Guaranteed Maximum Price contract amount from $1,800,693.64 to $1,535,905.64. This reduction will be applied to the project capital budget. Final Resolution: Motion Carries Aye: Erick Carter, Stephanie Lucarelli, Jen Mitchell, Roy Terry, Jory Westberry Consent Agenda - Facilities Subject C60 Guaranteed Maximum Price – Resurface Playground and Improve Drainage – Naples Park Elementary School Meeting Mar 5, 2019 - Regular School Board Meeting Type Action (Consent) Fiscal Impact Yes Dollar Amount $105,600.66 Budgeted Yes Budget Source Capital Outlay Funds Recommended Action Approve the Guaranteed Maximum Price (GMP) contract for the Resurface Playground and Improve Drainage at Naples Park Elementary School project. FEDERAL STATUTE: n/a FLORIDA STATUTE: 1013.45 SCHOOL BOARD POLICY: 6340 EXECUTIVE SUMMARY: Naples Park Elementary School's (NPE) primary playground and kindergarten playground have poor drainage and become inaccessible and unusable to students after heavy rain. Additionally, both playground surfaces are covered with sand, which is not consistent with the District’s playground surface standard. In order to improve the drainage of the playgrounds and upgrade the playground surface to the District standard, this project will install an underground drainage system and replace the sand with certified playground mulch. The scope of work includes: Primary playground – remove and legally dispose 12” of sand from primary playground; furnish and install approximately 300 linear-feet of new 4’’ ADS perforated dual wall pipe with sock and encased in trench with #57 stone. FEDERAL STATUTE: n/a FLORIDA STATUTE: 1013.45 SCHOOL BOARD POLICY: 6340 EXECUTIVE SUMMARY: Hurricane Irma caused the river, adjacent to Everglades City School (EVG), to overflow its banks; this caused significant flood damage to the interior of buildings 5, 6 and 7. Also, the river water back-flowed through the storm water pipe that drains the campus courtyard (this pipe drains to the river), causing inundation to the campus interior. The cost of repairs and clean-up to all buildings was significant. In order to prevent flooding from the adjacent river in the future, an effective flood proof measure must be installed. This project will construct two systems to prevent flooding from the river in the future: (1) a contiguous floodwall with access points called floodgates and (2) a storm water lift station. The floodwall and floodgate elevation will be one-foot above the base flood elevation (BFE). The BFE is the elevation to which floodwater is anticipated to rise during the base flood and is the regulatory requirement for flood proofing structures. A base flood is a flood having a 1% chance of being equaled or exceeded in any given year. The floodwall and floodgates will form a barrier between the river and the campus. It will connect to the corner of building 8, whose finished floor elevation is above the BFE, and wrap around buildings 4, 6 and 7, connecting to the corner of building 3, the administrative building, whose finished floor elevation is above the BFE. This will protect the interior of the campus from inundation and the interior fence; remove and replace approximately 40 linear feet of 3’ high chain link fence adjacent to ballfield; remove and reinstall two black vinyl gates for concrete modifications; apply stucco finish on approximately 80 linear feet new tie beams; paint flood wall and new stucco tie beam at front of school; perform final grading of site; repair approximately 20,000 square-feet of Bahia sod and 10,000 square-feet of Floratam sod; provide site survey and utilities locates during construction. In accordance with Florida Statute 287.055, the Board approved Owen-Ames-Kimball Company as a construction management services vendor.
