Our police and fire departments have very full access to mental health services through our partnership with doctor Benson and Tampa Bay psychology Associates. As I walked up to they found hospital last night. And saw many police officers standing outside of the emergency room. I spotted doctor Benson. She is someone that I've gotten to know over right time on Council and she's become I'm extremely important person to me. Knowing that she is providing such great care for our first responders and seeing her made me feel. I just said at a little bit better it just sort of changed my. Way of looking at this in a in a very difficult situation and I can only imagine the feeling our first responders get with her presence so I wanted to just take a moment I want to pull the item I just want to thank doctor Benson. Approval of a couple of items on the 40th Avenue bridge and our director of engineering should be coming into the meeting Mister Bush ash. Premier. >> Good morning Mister >> We the presentation to come up. You'll need to book you need. >> Thanks again for the opportunity to present plenty of that new bridge, it's been around a long road. But it's been be interesting rule. Now I will have to say that this is probably one of the well it is the longest bridge within the city. I would give a very short presentation on what we can expect during the construction phase and the sequencing and just a few run-ins of the bridge itself. Next slide please. So just over a look at what the bridge is located, it's looking into the low 40 or haven't you and it's the loss is the bridge crossing to from the man to actual sure sure because. Yeah this is the running of the bridge during the day you want is the areas this was approved last week and after year to use a new crash treated burial will be utilizing standard but with no structures. You'll also notice that there's Senate how the British an optical turns shifted slightly to the West which allowed us to have to get to be. But the vote there is an increase in from folks would be defeated beaten. Also within potential Elmer's increasing with the lighting off the decorative light cool consistent is starring on this. Next slide. This is a typical section of the bridge. Again keeping consistent with city policies This is the complete streets on us to have been implemented. You see the wind will re what we see traffic, calming features such as the center median as well as I have bicycle section included within and even within the section you would see the potential lights as well as the primaries. So what can we expect during. Construction. This is a major construction project as mentioned it's along this bridge within the city. Noticeable work we can expect to start probably within the March train frame that will be welcome the construction phase will earlier than that the actual mobilization a natural noticeable construction probably won't start until leads on and the spring. Again because we do have to go to that shop trying period. Material ordering once we get reviewed and approved. Some key elements to take note of this is a residential area. But it's an important drove to a commuting as well as back to the nation. You do have school buses. You have that it's the thing that can see access. So we schedule as much as we can to maintain good. Any traffic they are going to be times that we will have to have schedule shutdowns and their attention on me so. I was some some would really be required to be done right due to it just being have been just and traffic volumes which will allow us to safety before the services of night touch on that turned up he's struck shun. And how we can actually implement construction means shifting. Now the overall bridge will be constructed He is the implementation and I will touch on that when the next bus lines. I like to touch on right now is dust. We have meet our requirements within the contract for vibration as well as cern. With its dust as an example. It is Florida the contractor is required to speed on a key material time to Blowing in the wind. A little bit as it is for it is going to dry probably faster than the contract. They can you know cyclical true. Rain down we will we will be pushing them to keep on top of it. Me and we not happen. I'll the vibration monitoring. We do have requirements within the contract to buy Russian monitoring doing that right. Right now the islands. Well she vows to monitor the same as it gets within a safe range. Construction will be stopped. So that will be Mourning tent and that's also why we do have the kids special a c I said this is what this country. Now with regards to the construction. Phasing that will be short periods of complete all to you. The intention is to keep troops. One lane open open at all times. Fees Hoosiers will be required just food delivery of materials rules changing sequence of wood. And I can go through that as an example of the next to slice of hope they're actually phase of construction will be completed. So if you good to the next site. Within this phase within this line you see on the top image is a representation very close to what the bridge is right now. When you travel in one direction. The economy. The bridge from you have to move around that blue section and that was going to be armed if using of the bridge to allow us to set up for them with your traffic control learn as we move into the construction phase. This time just to clarify this image is taken from a website. So we do have all these images on the Web site that's current and we continue to see up to. So what will essentially do is if you look at that bridge and will be going straight down that bridge and that recounting in in homs. One side of the bridge. I am that's the second image and we construct that then we'll be able to ship the logo traffic lanes the law and Order section to the new a bridge. And during that sort of sequence that's when you expect a statue shut the lanes done probably overnight because it see it from. To shift the lanes across I mean take one or 2 days because we do have a lot of jersey barriers to move to implemented see if the to me really design standards for safety which of those lanes across and then we'll start the demolition of the next side of the bridge the little and a little dissension so if you mean why if we move to the next slide. At this point we've actually I love the to do list, thank you. Then we'd all the section constructed a new section and know which is connecting that joint in between. So that's what we are at that point. Once we do that we'll have to find restoration will be some back and forth you in to mediate shifting as we do would. But it is shifting will be since we already have pulled sections already constructed. That's what you can generally expect as far as impacts on traffic. You know I was going to process we we do have the website which will put notification out on you know major shifts major traffic control. Any such major shift in fees in traffic control we will always have to go to the school's emergency operations. Most of the game of the website. The into media group publishes goes me happy, it's very short periods of time concrete pools or you know delivery of material. Maybe schedules. Very quickly. We'll try to Courtney do his best as we can to outside of the. Ice is much traffic impacts as we can. We May move on to the next slide. This bridge again under long as brittle as a whole it is going in. That you would see written in the council members such as glass fiber serious deal. A couple of fiber. It's a very interview to French it group much less gruesome. Along the service life I will be shuns is designed with all. The city initiatives taken into consideration, complete streets sustainability resiliency. Residents quality of life. Image and see with that I also one. If or food pccs construction engineering and b 12. Was design services. Thank Mister Mister Freeman. For the presentation. Outgoing district start First of all it's. Did have one question before we voted on these 3 items you mentioned that there would be the closures. And my question was what is the longest closure of the un to said. We still have to go through the detail construction schedule with a Once we actually execute that contract with them but since the we've done the media work of actually setting it up but to 2 sections already. It was just pretty much shifting those virus which we we'll probably try to limit to wanted to be to the sequence. And again this goes to that North that it is a residential but it's also a major traffic route. We'll try to Courtney that look as much as we can outside of people humans unity to some of the night time book since we can do that quicker. Over tonight period. That May be that timeframe so you're looking at very short control. But well not to fight fear. It's that will do little shutdowns. So just so one to 2 days. You know the range, we'll still be confirming with the Again. We have to go through those details schedules. Would that once we exceeded those contracts. But the public will be fully aware as well as emergency and transit. >> No other requests to speak, I'll entertain a motion to approve. Ca one ca for and cb 12. We have a motion a second to approve ca one ca for cb 12 Mister Clerk we have any members of the public wish to speak. Clerk please open machine for voting. More you're changing that profession thank you for the presentation. Thank you for that it's important bridge the 40th Avenue is one of the busiest. Busiest roads believe it or not in the city closing that pretty now. Will be a big deal for. Thank you for the update. Council members please cast your vote. Seeing a President Members of Council. Council members have voted by the clerk please tally announced. Thank you Mister Prime an we'll move now to open for him can have the clerk please read the rules are open. >> It was listed on the agenda as police and it Since from one has. >> Item on the agenda. You May only speak one, it's doing the open for him. >> Thank you. Madam Clerk can you call the first speaker. Can you guys hear me, ok. All right good morning. My name's car look around and I'm with the Tampa Bay branch of the party for socialism and liberation. I want to ask the council a question. What does the city value. Why is it that when a 20 year-old black community member dies at the hands of the police, no one cares. Last night when this incident happened. Mayor kriseman focus solely on the injuries of the Police Department tweeting one of our cp police. Officers was shot late this afternoon. I spent a moment with the officer at the hospital and one will continue to pray for his full recovery. The counties use of deadly force invest investigation is conducting an investigation. Later that night we lost Dominique Harris, which prize man had nothing to say about all he did was sweet an article. Citing the dais with the caption an update. That's what we get when our youth is murder on the streets by the state as kriseman continuously denounces gun violence in our community. He fails time and time again to hold police accountable for the violence that they perpetuate at the vigil for gun violence just 2 weeks ago. Kriseman urged our cities use youth to solve problems with words and not weapons. Why should we not hold our police who are sworn to protect and serve to the same standard. Why is it that. All right why is it that they can't de escalate a situation without someone ending up dead. City Council are you ready to listen to us now. The police do not make our community safe. I'm imploring you to look at Minneapolis as an example and I urge you all to pledge to disband the city's Police Department and re imagine public safety rick kriseman will side with the police. Every time but you don't have to our efforts at reform are failing time and time again over the summer the St. Petersburg Police Department brag that they had all the policies in the 8 can't wait reform one of these policies says that cops will de-escalate situations. And it also requires police to exhaust all alternatives before shooting as we saw from that disturbing video and article this is not what happened. Police claim that Dominique Harris rolled up his window while they were questioning him so their response was to break the window, do the some of the people do do some of the type of people whose task is to protect and serve to me it sounds like people who don't know how to control themselves. The police are threat to public safety in the city. And the only rational step from here is to make serious changes to the city and how we imagine public safety. Last night did not have to and in another death and we cannot let another one happened. Enough is enough, but does he actually needed. I urge City Council to take this life loss seriously. That what happened yesterday will not be forgotten by the community of Saint Pete. Last night a 20 year-old was murdered by cp Police Department he was shot and killed and yet the way the mayor addresses this is simply as an update. The young man's name was Dominique Harris. He was a person and we will not let this be something that the city can move on from you do not need a whole squad of armed police officers to address these kinds of situations. The way this was handled proves how racist the system we are in works. Nobody should have been shot, nobody should have been killed. We need trained people who know how to handle themselves who will not reach to their gun. The first chance they get and take someone's life so willingly we need reform and we need change because this cannot continue to happen. We need to hold our police officers accountable. The city committed murder last night. We have murderers working in our Police Department. These are the people that are meant to protect us and they are killing us. And although they will not say his name and they will continue to brush this under the rug. It will not be forgotten Dominique Harris, you will not be forgotten. >> So 3 minutes isn't enough by a long shot. So in case they get cut off. Let me be clear. Yesterday represents a systems failure. Police failure and a community failure. What happened at the food Max something we should be horrified and that raised by many officials and community leaders I've spoken to have urged me to be patient. And wait for the facts to come out to not rush to judgment. I hope this dais is considering the same advice. What it offers well wishes for the officers involved, but no condolences. The family or community that lost the show. I certainly have questions that I think deserve to be answered. How do yesterday make our community safer. Made our Where was the body camera footage. Why fire for nearly 20 seconds reload and then fired again for another sustained period of time. All of this for a fistfight with the teenager. Cops running on the tops of cars like characters out of grand theft auto. What consideration for the lives of bystanders remain as bullets were riddled across public corridor. What our community look like a military occupation last night. Why are you always expected to be accountable. But never the police are the leaders of the city. Dominique Harris was 20 years old. Ernie few Milton was 23 years old. Deontay these Ramsey was 26 years old. These are the same youth that were raised in school for the Tampa Bay times called failure factories. But I've got up in front of City Council every year for the better part of the last decade, begging you for support. Some of you were here but some of you sot me when I was we do urge of community activists you all are just people and every year we make excuse after excuse for why we can't fill the gap. Been out their cameras in the community talking about problems we're facing a time and time again our children are named as the number one problem over lack of jobs. Housing food and other issues our children are seen as the problem. As wild it out of control and law but who lost them. Up to do something. Let's to act quickly actually can do something. We can arrest her police are way out of this. We must stop treating our youth has a problem to solve instead of treasures to protect. Let's start relying on activists and organizers like myself to fill the gap. We must stand up and fight like help. Be here next year with another slogan with another excuse. With another justification. For watch someone has to bury their child. >> Mayor will pay the murder victim has a child abuser. Often the police through the word child abuse or out. See that firsthand when my fellow protester friend got a felony child abuse for bringing her children to a protest in from the mayor's House this summer. The narrative is important and if you spin it right to keep people from questioning why black people are getting murdered in the street. Right in front of our eyes because he was a child abuser right nothing to see here. Let's move on. There is something to see another traumatic video to watch another family grieving the loss of their brother son and friend. I'm here asking why when the cuts keep getting away with murder. Right now in America, there are a group of people that can approach you and obedience and if you don't comply is punishable by death. We repeat that right now in America. There's a group of people they can and obedience and if you do not comply, it's punishable by death. That's what happened to Mister Harris. In broad daylight. Many police officers. I'm going to play a clip of the brothers video of the murder. I don't know if you've all seen it. I was going to say is a trigger warning to everyone to cover their heirs. If you are able to listen to that and not feel. Look deeper into yourself. This murder was preventable. Clearly de escalation training is not working. We need big conversation. Big change big Healy. >> Close open form and move move to our public hearings and take up. And d 2 Mister Clerk do we have any. Entertain a motion to approve the wanted it to. We have a motion in the second to approve d one and d 2 seeing no request to speak with the clerk please open machine for voting. Council members please cast your votes. They all council members voted by the clerk please tally announce the vote. Thank you we'll move to d 3 for the clerk please read the title. >> In section 12 dash 6. Of the city code to lower fees for community garden in roadside vending permits ending the use major it's in section 16 point in 0 20.1, allowing as a permitted use commercial gardens and greenhouses industrial zoning categories amending section 40016.0 3060.1. Pertaining to landscape standards for edible plants amending section 50016.0 4020.1 pertaining to assist the storage structures creating a new section 50016.0 7, 5, establishing new specific development standards for commercial gardens and greenhouses amending section 50016.0 8, 5, pertaining to the community gardens creating new section 50016.1 8, 5, Establishing new specific development standards for home produce sales, amending section 50016.4 60 to broaden the low location now allowance for roadside vending markets. It to produce sales amending section 60016.0 50.2 regulating encroachments since it nice for certain gardening structures amending section 70016.0 1030.13 pertaining to the community gardens and permits amending section 90016.0 20.3 to add new definitions providing for severability and providing an effective date. We do have 4 speakers for this item. The public hearing date is Jan. 21th. >> When we hear a report first. Abernathy and Mystics from. Okay okay, very good. >> Are you able to hear me. >> The culture related amendments for a number of years and we have some propose it is to help to facilitate. Production and sale. Produce in our city. Where could you please bring my presentation. Next slide please. He ending our code provisions to allow community gardens. And then in 2011. We added a commercial garden use to our use made tracks to provide for. Gardens and industrial districts with a special exception approve all. A good example of this In 33 staff continue to research urban agriculture why while working with stakeholders including the sustainable agriculture coalition. Bonds, the Corps edible peach action the local. Expanded to education restaurants and. Sorry that didn't fly to smoothly. Those were changed to allow them as accessory uses to the education restaurants and houses of worship. We eliminated the restriction on use of power tools and our noise ordinance and added on site sales of produce and value added products and non residential districts. We made an amendment to a lot. That's restore said. Compliance language to our community garden provisions. Next slide please. And we've been continuing to coordinate with companion projects such as our health in all policies program. You not be this you farm project. Participating in our regional food policy council. Next slide please. For you this morning are intended to reduce regulatory barriers on the production and sale of produce in our city. 10 sections in our land development code chapter, 16 and amendment to our the coach after 12 as well. Those amendments include changes to our community garden section by eliminating one c 3 requirement. He's engine sales be and basis and to extend the initial permit period until after the first season of produce production. Next slide please. Changes include adding commercial gardens and greenhouses as a permitted use in the industrial zoning districts, eliminating the special exception public hearing process. Bricks tree farms isn't it. An example of a project that went through the special exception process. In lieu of this review process use specific standards are included so that staff an administrative leave review for similar compatibility criteria to address maintenance environmental compliance, storage of materials and any noise or older concerns are required. That's and that's very similar to our community garden standards that slide please. Currently retail sales are not allowed in our residential zoning districts with the exception of garage sales which are allowed 4 times a year. So these proposed amendments include a new section to allow sale of grow does, including value added and honey bee products in single family and multi-family >> So we didn't include an amendment the landscape section of the code will provide for her minutes taking of plants. And we included language about height allowance of edible plants. And the front and street side yards. Now after we had for the cancer Council Taishan with the Department of Agriculture. >> And the last week or so we've determined that there is a preemption language on vegetable gardens could conflict with this in language about limiting height or allowing for height in the front yard and we are going to propose to delete that amended language and we would propose to make that change to the ordinance for our second reading in January. And this does not change the title of the ordinance so that is something that you could consider today. Next slide please. It provides design exemptions for one accessory structure up to a 100 square feet the area and allows for an encroachment into setbacks for that's for one structure and this amendment would extend those provisions to include gardening structures such as who houses called rains greenhouses and vertical structures. Next slide please. So we added definitions for those terms including that houses in the cold frames and the vertical vertical vegetable structures to the code. Next slide please. Roadside market vending provisions allow for sale of food in the enterprise zone at certain intersections and so to expand opportunities for the sale of produce in our city we're proposing modifications to this section of code it would allow Prodi sales from vehicles and on begin wants. In all non residential zoning distracts and or our corridor residential traditional and quarter residential suburban districts. And this would require consent of the property owner before somebody started selling arms. Next slide please. Lastly we're looking for consideration of reduction in some of the fees associated with. Community garden per money in those roadside vending permits so we were proposing to reduce the initial fee from a 100 to $50 and the annual renewal fee from 50 to $10. We're also proposing a change to reduce the fee. 4 modifying approved site plan to add a community garden. So that is a situation where we might have an existing church or school that has approved site plan because they're in a residential zoning district and they would like to add a community garden and that needs to be reviewed by our zoning team through the site plan process. We wanted to reduce that fee again to help incentivize the stab lish and of community gardens in our city. Next slide please. Not in your staff you will see are finding of consistency with our com. He has a plan. Goals objectives and policies. Next slide please. And on Nov. This was heard by our development review Commission and a public hearing and they voted 7 to 0 to find the amendments consistent with the comprehensive plan recommends City Council approved the amendments. The drc commissioners did have some comments related to the fees. The height of the edible plants which I had mentioned we're going to remove from consideration. Irrigation of commercial gardens and duration of the home produce sales. The commissioners did note that this was a positive step toward sustainable and healthy living in this in the city of Saint Pete. Subsequent to the drc hearing we did make 3 changes to the draft ordinance and that revised ordinance was provided to you. >> The some of the public comments that we heard during the drc hearing and I think some of these folks May be back again to speak with you today. There are some general For the community to be able to grow fresh produce. The production to improve the health of residents. And there was some discussion. There was some discussion about to the intent of the amendment to reduce regulatory barriers related to the production and sale of produce. >> And I talked a little bit about the provision for the honeybee sales a number of speakers at drc they wanted to speak to ability to provide for sale of honey bee products in in our residential neighborhood. Last I last by please. >> So today is a public hearing this is this has 2 public hearings because we are changing the eu's made tracks. So today, we're recommending that you go ahead and conduct the first reading and public hearing of the ordinance. Toward the amendment to this action related to. i lost my notes here related to the height of. The. >> And we'll plant in the front yard that be removed from consideration. I do have Michael the man here to help me out today on any of the legal issues were available for questions thank you. >> Thank you, Liz for the presentation. I'm not quite sure what the position is here. It appears that this is the first hearing according to the report, but we had a hearing a couple weeks ago. I don't what happened to that one is that no one no longer count. >> That but that was the developed development review Commission this is the St. Petersburg City Council this is the first of 2 public hearings. >> I believe 6 times by a mile. What problems you're trying to solve by nice Isles to the toll, 36 rule. She declined to on set. I made a proposal that. Honey sales by registered beekeepers be exempted from any limitations as I showed very clearly and the sales on not a traffic problem and she could not give any other reason for bringing up these rules. As is all on the record here. And now now you Mister Chairman do you have an onset why we want to limit and the sales to 1236. >> I would redirect that question to Miss Abernathy. If you want to finish your. I'm looking for an on so right now as I stand here because until I get it on Sir I don't know how to address the issue. i feel that I have been silenced. But down. That is very important to get in on Sun. Talking on Sir, I cannot address the onset by giving a response to it. It appears that the annual logic to have here is they doing it because they can because they won control. And I would just remind you that fundamentally government from I-four thought the statement is by the people for of the people by the people for the people. She has no reason then why the rule. Why the limitation on how the cells on the record here. I have shown extensively why. There's no traffic problem. Can anybody give me an on sec, anybody give me a statement of any sort that I can respond to. >> Mister Our you you. >> Any sales in our residential district as I had previously noted and as I have. Tried to explain to Mister Lewis and the proposed amendment will allow for such sales up to 12 times per year. 12 events for years so that would be 3 days per event. We are proposing to add language to allow something that is not currently allowed. So we're certainly happy to discuss with Council the number of days or that provision and Mister Dean I would like to add. That's my response. Thank you. >> Thank you for that Rivas Mister The money and I just add to that I have nothing. >> So the land development regulations, on-site sales. Any edible plants. And with outline the ways in which attending the roll that out and that's negotiable now. >> This is exactly the same response I received 5 times from her getting. No reason at all for limit taking limiting the amount of time allowed for sales. I have explained in detail that's all on the records I want to get a game here. But I believe that this is merely a matter of overreach. By the council by whether it is heaven at the. Of an attempt to control something which does not need control. You know she has declined now 7 times on the record here to respond directly to my question. I feel that this is a black. We May get into this. When we go into executive session. Thank you. Mister Lewis next speaker please. >> Ordinance full 48 h also known as El Dr. 2020 5. I'd like to thank brandy and Tina for spearheading is very important. Ordinance here in the city of Saint Pete, a longtime activists in the food system movement and policy work in Washington dc New York City, an Atlanta and northern Virginia in Anacostia area, Washington d c I have a lot of experience in working with community gardens in urban agriculture and also studying black land loss and studying the use of these programs in economic The Tuna tease. This is a very important ordinance for the city in light of people of color of fighting. Adil crisis a pandemic and systemic racism in addition to economic crisis. And this will allow for regulations to be loose end around development standards for home produce sales, which is very important and if people are allowed to grow produce presidential Lee that will also allow them an op tuna Tia mc Lee to provide for their families as the chair of the Florida food policy council. Our role is to identify gaps in the food systems through mapping education diversity equity and inclusion. Food insecurity is a real thing in this city and just because we live in a beach front community does not mean that residents are not suffering from hunger. And food insecurity, so I would employ you support the efforts coming out of this. And ldr. There's of food policy council being created that I think we should embrace and involvement in in such as myself and activists that are on the ground doing this work to help formulate their ideas and the future and the movement of this very important project. A lot happening throughout the state of Florida right now after the election the change in demographics. We the justice for black farmers act of 2020 which I'm hoping and praying passes. We have him a good fall. >> So asking you to consider increasing the number of. Need to be sold and they need to be consumed. I was waiting for the next opportunity for a resident to be allowed to host a sale. Nutrition in security in our city. I used to work at Saint Anthony's hospital as a registered dietician. I was assigned to the cardi and the stroke floors and I can tell you quite simply that my patients did not. Chronic diseases of diabetes. The food does not exist in my community for me to go to the grocery store, it's a 4. What they sell which only puts more nutrient dense foods into the community. Highly encourage you to. And to consider these and changes that we are. >> My name is Carla birth Phil I live it. 76 19th Avenue South. And I'm here to speak in favor of. I spoke with the drc a couple of weeks ago about this and I strongly advocate for it the collaboration manager of the St. Petersburg youth from one of the our goals is to in fact teach the community about food growth and this is an excellent way. Assisting in the food insecurity in our community. So I first of course one applied you for even considering this this is a major step in advancement of how we grow food, how we look at it. One of the things that i did speak about at the drc meeting was the importance of them. The way it's set up now it would be 12 occurrences. A total of 3 days for a total of 36. I think offering more flexibility on that. So that number of days instead of the 12 occurrences. So I would really appreciate it if it was considered at more of a 36 occurrences like single. So somebody with a bunch 3 together for a whole weekend so be it. I don't think that the need for food, stocks are only occurs 12 times a year. So if we're growing food, let's provide opportunities for it to be distributed. Right where it's grown I think it's going to create healthier habits for our community to see where and how food is grown and to have. So many people within the community growing food. I also thought the height restrictions with limiting because one of the things we're planning to do it to you from it's certainly have area that's more like a food forest. When you think of a banana tree is the simplest one. Right. Surely that's more than 40 inches. So I think was really considered back. And I love the economic impact that this would provide to our community. So for so many people and every meeting more and more people within the community. It has a history of funny. In there just in their blood and so to have them transfer that down generations and to be able to use this to create economic growth for the family, I think it's beautiful. Pretty much all ahead, thank you so much for your time this morning. Thank you. Thank you for coming in. >> Close the public hearing go to ic ig's active cent sent into us executive sessions start with council member. >> Or needed win. Operated needed. But essentially we are asking that we strike that change from the code because there is a good sketch reporting language. At the basically preempts and rain which related to height. Limits for vegetable. We are asking as part of your motion today to revise the language related to the height of edible plants. >> That's and 16 Got 3.1 d. So that essentially takes a lot the table. Because we are not going to be adding any language regarding hypothetical planet. >> Thank you councilmember Gabbert will go next to vice chair to school. >> So diligently for so long to get it right. First reading I really wanted to just address today, any specific changes. The For days allowed I believe that was originally created said that we would. Be able to avoid possible resistance from neighborhoods to have concerns about traffic and 12 days a year can be any 12 days to make it flexible for growth. There've been a lot of questions about the number of days and so Liz if you could give us some examples of how those 12 days could be used. Then maybe that will help us. >> I'd be I'd be happy to him and let me backup thing kind of start with the logic of of where we are. Why we propose that the 12 events per year up to 3 days. So as we previously noted, retail set are not allowed. So we looked at. Garage sales being allowed up to 4 events per year and clearly recognize the need with Prodi is to have more than 4. What we proposed or or. 12 events per year up to 3 days prevents that from Sat. Sun. And they could be consecutive we get. So if you had a growing season. Spring and then and all you could have. 6 weekends in a row in the spring and 6 weekends in a row and also it does provide some when those 12 minutes take place. But it but it Limit so it's not. Every weekend all year. >> and that is the language that we sent to move Kona and all the neighborhood associations and September. Again in November and we did not receive the back. Or concern about that new provision to allow the retail sales and we did receive support. From states for the proposed We have an e-mail that's in the package. >> based on that feedback. Kept that proposed 12 events per year up to 3 days. And that's noted there further discussion about whether further flexibility should be provided for. And we wanted that to discussion today with you. >> So. Barring going back through the neighborhood Association and proposing something different we wanted to bring that discussion to you today. Thank you. Thank you. >> Another thing I want to keep in mind is that one of the things I like about this. Like salsa. So we can get together. Making it easier to create a push current vending situation. Into the community into other areas. We get some real. So I think there are some other ways like. We could look at doing this it's per. Make those changes as needed I think if we can identify that. That's a that's a change that we could get on board with that I'd like to start just being a little bit careful. About how much. Having said that I would just leave it up to my colleagues to determine. Is this something different I'm not. Hoping that you know what this gentleman was referring to and if it was looked into I want to make sure that he was hurt. >> Certain certainly so has changes that we're making to the excess restructure section of the code. Do allow for those drugs types of structures up to a 100 square feet to be Within setbacks and not have any design standards apply. You know what this the examples that he sent these structures essentially covered the entire locked. So they May have been by 40 feet in size. That basically would take up the entirety of the single family lot. That is not something that we thought would be appropriate at this time for consideration because it would go beyond to be. Commercial I'm sorry the community garden permission we have now which is basically an open area for vegetables. Providing for that type of structure that would cover the entirety of a single-family not why. Maybe felt like a little bit too much of an intrusion into a single family neighborhood. Okay, so it's sort of. >> Are definitely more of a. Commercial type of operation. Yeah. That is something then again we allow. Industrial districts and they said these proposed changes as well make that a little bit easier in those areas because it will remove the requirement for a public hearing, so it's just an administrative review, so. We are getting more opportunities for. The type of operation. This gentleman was looking at but just not considering it in our. Residential neighborhoods at this time. >> I'm specifically asking about another e-mail we received asking about. Florida native and or Florida friendly be and other pollinators a tree. To the list of what's allowed. Is this something. I really didn't see anything approach vents that are prohibits that so we're ok there right. Yes, I would agree with that there's nothing that does not allow those types of plants in our city we have. In our landscape coat, a list of prohibited species. >> They tend to be. He nuisance exotic type Lance that we don't want but there certainly is nothing to limit. Flowers and plants that attract. >> Driscoll for. >> That was Abernathy and Michael I have put into this I think this is really exciting. And I'm of really in support of the direction that we're headed in. I would also like to start off by thanking our lives and Michael for. Working on the issue of how to resolve. Dealing with community gardens houses of worship that are in residential zones which are probably most of the churches in the city. And thank you for what working to help bring that fee down. I need to make a modification to their special exception permit. $500 just really seems like a lot in 50 The new price which certainly a much more acceptable. So. Thank you thank you for listening to us and in working on that. Councilmember gathered I have up my mom's side the family who go back generations in Florida. You know they're back Anderson farming gardening. Rubbed off on me and my brother I was in my 20's, I had commercial nursery growers license and I love plants, I love gardening it's my hobby and my. My therapy and my brother is a is a beekeeper in North Carolina, my brother sells the hops he grows and his honey to local breweries. >> Totally love this totally support this. I think especially one of things it was getting at is I never realized how much. To be able to go and visit my grandparents. There's a lot of younger children now that don't see that whole cycle and how. Don't just come from the grocery bag there's a holes. I like to see that there is language and this plan so far to incur reduced use of pesticides herbicides and fungicides. If there was a lot of heavy use of those chemicals that would tend to kind of undo some of the good local work we're doing side liked first always continue to focus on reducing the use of those chemicals. >> pretty open about how many. >> When I read this inside was originally proposed for 12 events up to 3 days. I was thinking that sounded pretty reasonable visits about once a month. We have one speaker suggest going up to 36 events which I guess would be an average of one and a half. And I'm I'm open to that I I a lot of the speakers here today and a lot of the people working on this are from my district. The flexibility that we can provide on that. It did I hear correctly that we're going to do away with the height increases okay great great. That's smart because Oprah cherry tomatoes, a lot of varieties of beans sunflowers don't shoot up over 4 feet in no time. Question for Liz Abernathy I wanted to know how we contemplated. Eggs and dairy because we do have of ordinances that allow 4. I mean who can forget the council discussions on many goats in many sheep. Herb and areas. But we also have I think city and county wide laws that allow for a backyard chickens. Chickens doing what chickens do I could see where people would want to solar provide acts. So did we contemplate that. >> So it was certainly something that we discussed. But there are preemptions the sale and. I I see Michael team is ready to speak to that as well. So I'm going to let Michael help me out here and maybe provide a little more of the details. >> Eggs and dairy. There's we have to go through said sure that's the area's pasteurized eggs, suitable for human sumption so at this point in time. >> We would differ. Health regulations and. So as not to not create a conflict. >> That's very helpful. Thank you for that. Michael also. >> We had mentioned some. Other food products that would be okay like pickles and jams would basically anyone who is really into home canning also be able to sell just basically any type of basic vegetable that's been canned. >> And that the quick answer is yes, so there is. Some language about it's. And looking it up now about the value added process so they pull that out. It does add simply references value added products such as pickles and jams so its products grown on site so whatever product, whatever value added product they create from the products grown on site so and that could include the tanning of those vegetables. Michael would you agree. Pacific Leon even prior. I think that you might seem. Thank you for answering my very supportive of the best in all certainly keep an open mind to an increasing the number of events per year. I'm looking forward to hearing what my other colleagues have to say about that. >> Council member fix Sanders and the moment follow up with you council member. >> Today's East is 36 days. >> Languages 12 events per year up to 3 days per event. >> Whenever I look >> So I I'd like to get this staffs, >> if you have an idea I you know what whatever your comfort level If that's if that's the preference or if you want to. Biden other alternative. I'm trying to think of other other options but that's probably they then. The most direct way to change what we're already proposing. >> As online with. I thought if you want to consider a Max. Conceivably somebody can run. But that's something you want to consider but besides that it doesn't she the flexibility and. >> Well as a reminder and that's only allowed Fri. Sat. Sun., so right now prohibiting Mon. Through Thu.. >> Okay, so we would continue to hold on to that. >> I think we would recommend. >> I could live live with that eye. If any council member has my question and I'm I'm a fan or what before us. On on the table there. In bold font. If I that that's new language. >> Those are that's just the header of the column, this falls under. So for example, this is this is a much larger table that encompasses and number I have some setbacks. That in this particular instance proposing any encroachment into the water front yard. So this would not allow these items to be in the water front yard. It's it's it's again it's simply the header of the table that encompasses a much larger section in the code. >> If that's confusing and I. I don't know that we want to show the entirety of that table because it's really quite it's multiple pages long so if we don't pull out the one row of the table. It might be kind of Michael do you have other. >> What we're missing here is some of the other. This one line item here. And if you are to see the entirety of the table unc where. >> Reading this table it. Ruptures within 5 feet of so and what what this is saying is those encroachments are. Only allowed in the street side and the rear. Closer to those property lines and 5 feet and again it's a little hard to see it out of context of the entirety of the table so it would be for the staff report for the next hearing we can kind of put down as an addendum. That might be helpful rather than putting it in the entirety of the ordinance and that will help to show you the overall context. Happy to follow up and send that to you. >> Thanks to the interest of brevity. Ok and the only other the thing that I haven't. Don't make that language. And then we would come back. The cleanup organics for second. Reading second here. We're going to entertain a motion. Did you have a comment on this. Council members please cast your vote. Thing all council members have voted with the clerk please tally announce the vote. That does it for my question is will go next to council member covered. We have a motion to we have a second. Seeing no further request to speak. Clerk please open machine for both. Council members please cast your votes. Thing all council members voted with the clerk piece placed alley announce the vote. We have a motion a second to approve the ordinance for 48 dash h seeing no further request to speak the clerk please open the machine. Council members please cast your vote. Thing all council members have voted with the clerk place tallying and. Council what we take we'll take a short recess and reconvene. When we take a short their recess. Reconvene 1120. >> So we're to week average is 257 cases a day. This also is rising per day or average cases per day so we're to week averages about it 105 cases a day. So you know we can see the suspect. That we are seeing a slight increase again we have 49 additional deaths. This past 2 weeks which was an increase. So this is the last 4 days per. A steady trend all that cold there are rising. The zip codes the more populated zip codes have hired by. The top 5 zip codes with the most new cases in the last 14 days at 3, 3, 7, 1, 0 137 new cases. 3, 3, 7, 1, 3, with a 115 cases. 3, 3, 7, of 7 with a 150 new cases. 3, 3, 7, 0, 1, a 112 and 3, 3, 7, 0, 2, with a 110. This is looking a little better. So you can see there the red lines the goal. In 2 week average, so every day we take the average of the last 2 weeks and we put it up on the grass. Before when I presented to you this line was increasing steadily every day. Yesterday's positivity was at 5 point. And they continue to be disproportionately affected. 60% of them all. But all the cases and fun in Pinellas County, only 14% of them. So since our last update there's been a 191 new cases and 27 new deaths. This just shows you the difference between. Facility cases in the general population cases so they make up a small portion. I'm covid hospitalizations steadily rise eyes. The full bed capacity, 14. 16 excuse me percent or covid occupied. I'm an up note there's 279 ventilators available. This is our icu church. That availability there. This is a little more then our last update so when we presented 2 weeks ago we were 0.2% covid occupy. Your visits for influenza-like. Visits have decreased by 20%. Below that covid like illness has decreased by 33%. And just to share with you some other up. Testing still going well traffic Hannah have some extra staff out there now which is really increase throughput so they're seeing anywhere from 1200 to 1400 a day. We're getting everybody through. Now some aceptables to to the 14 day. Any symptoms and you don't get attacked. If locally we're going to adopt. So we'll wait for that. Cdc's advisory Committee for immunization practices met. Conditions for when the vaccine comes to that first priority is. Of course that's a recommendation from the cdc's advisory group. But I just wanted to cover these quickly just to think they came up last week and I didn't the answers last week. So right now we have 2 vaccine candidates that have emerged from the face 3 Michael trials and they both applied. That's Pfizer and Moderna they both have meeting scheduled with fda's advisory group. No questions will be asked to discuss it and and once those meetings wrap up. So Pfizer's meetings on Dec. 10th the Moderna. Before those companies can start distributing vaccines pretty quickly after the is author. So it's possible that vaccines could be available. And so 40 million doses will vaccinate 20 million people. So this isn't the recap which I briefly talked about. Cdc strategy. Their advisory committee met. Splitting the first phase into 3 sections of phase. One a is the recommendation for the health care workers and the residents of long-term care facilities. And phase one b and one c will most likely be essential workers. All that's made in the state's going to. Which is 2 doses 21 days apart. Also 2 doses which is 28 days apart. And they're 94% effective and they're saying a 100% effective against severe covid. We have no control which vaccine we will get or. But it is important to know that whatever doshi get the first time. >> We have a second of the covid 19 update. Amber if you can just stand by for. We've a real estate and property management director Alford windler in to give us a just an overview of how Council chambers. >> So you basically what we have this every evening we have a cleaning crew coming through the facility. And then on that days that we did in the you know hard surfaces well-acted and just to the general cleaning up the normally do, but we asked him to focus on ensuring that they do wipe down of all hard surfaces and all the contact areas within here and then additionally what we're doing is on the days that we have public meetings that evening. Cleaning crews coming in after hours every evening, Friday's weak. After the a public meeting days will be having a lecture static spray gun that's present disinfectant with a really fine particulate matter it can clings to everything comes in contact with as opposed to just wiping down. Surfaces so use that on the days following any public meetings so those are the 2 you know shes his routine cleaning and then additional cleaning on all the hard surfaces. In addition to that but I can give you guys an idea of this this room has its own standalone hpc system. The registers. They return air and everything goes up to near handler that specific to this room only and in that system we've installed iser's we're working on getting throughout the rest of the buildings, I work on it just there's a backlog. Equipment and everything else but this particular room was covered with iser's and I have been shown to be very effective. In killing the covid virus. So what we're relying on is the circulation of air every time to go through the air handlers is getting exposed and iser's which mitigates the amount of the covid virus float in the air. As well as we're going to put Merv 13 filtration which is the filtration. Suggested by the cdc. It was an impression is ready and it has just informed yesterday that thing soon as we get that and hopefully in the next week or 2. We'll be installing that filtration so due to the fact that there's nobody in here in between the meetings that allows the stand-alone h back to cycle air several times change up there several times passing the air through those that hire filtration and expose it to the iser's along with the electrostatic guns which you know is is the cleaning protocol that we rely on for the specific room. >> We do have some questions will go first to councilmember Blackmon. I want to say 50,000 something hospitalizations and 18,000 deaths. So basically one in 3 people who are. >> It's something I can research by think it's also a great question. You know draw conclusions from from those 2 stats right now. >> Thank you councilmember Blackman councilmember gather. >> Possible surge income. The questions today amber just things for. >> And comprehensive education back about the vaccine. Starting with a survey. How they're feeling about it which will inform us largely of where we need to focus our education what b
