WE NOW MOVE ON TO PUBLIC HEARINGS. ITEM 4.1, KUMON LEARNING CENTER CONDITIONAL USE PERMIT , CUP 2025-02 , MR. GORMAN. >> THANK YOU CHAIR AND COMMISSIONERS. GIVE ME ONE MOMENT TO LOAD THE PRESENTATION. ALL RIGHT. PERFECT. THANK YOU. MY NAME IS EVAN GORMAN, I'M ASSOCIATE PLANNER FOR THE CITY OF OAKLEY AND TONIGHT OUR FIRST APPLICATION IS KUMON LEARNING CENTER CONDITIONAL USE PERMIT 2025-02. FIRST WE WANT TO START WITH THE LAY OF THE LAND. HERE IS AN OVERVIEW OF OUR CITY. THE STAR SHOWS WHERE OUR PROJECT LOCATION IS TONIGHT AND IT IS THERE ON THE WEST SIDE AND NORTHWEST AT THE CYPRUS SQUARE SHOPPING CENTER. HERE IS A CLOSER LOOK AT THAT AREA. WE ARE THE TENANT SPACE FOR THE PROPOSED PROJECT HIGHLIGHTED IN THAT YELLOW BOX. WE ARE AT THE NORTHWEST CORNER OF MAIN STREET AND CAROL LANE ON THE SOUTHERN SIDE OF THE CYPRUS SQUARE SHOPPING CENTER. THIS PROPERTY IS ZONED COMMERCIAL. TONIGHT APPLICATION IS A CONDITIONAL USE PERMIT APPLICATION. SOME BACKGROUND , ON SEPTEMBER 25th 2018 THE CITY COUNCIL ADOPTED RESOLUTION NUMBER 119-18 APPROVING A CONDITIONAL USE PERMIT ALLOWING OPERATION OF A KUMON EDUCATIONAL FACILITY AT A ROUGHLY 1000 SQUARE FOOT COMMERCIAL TENANT SPACE . THE ITEM WAS APPROVED UNANIMOUSLY BY THE COUNCIL AND THERE WERE NO PUBLIC COMMENTS PROVIDED AT THE MEETING. KUMON IS A GLOBAL BRAND OF FRANCHISED AFTERSCHOOL LEARNING CENTERS OFFERING SUPPLEMENTAL MATHEMATICS AND READING PROGRAMS FOR YOUNG STUDENTS. EXISTING KUMON AT 4520 MAIN STREET CURRENTLY OPERATES CLASSES ON MONDAYS AND THURSDAYS FROM 3:00 P.M. TO 7:00 P.M. AND TUESDAYS FROM 3:00 P.M. TO 6:00 P.M. THE SPACE IS USED AS AN OFFICE FOR OPERATIONS AS WELL AS FOR CLASS PREPARATION OUTSIDE OF THOSE HOURS. FOR SOME BACKGROUND ON HOW OUR MUNICIPAL CODE SEES THIS TYPE OF USE, THIS IS DEFINED IN OUR CODE AS AN EDUCATIONAL FACILITY WHICH INCLUDES SMALL, GENERALLY LESS THAN 2000 SQUARE FEET , SPACES DESIGNED TO AUGMENT THE LEARNING PROCESS OF STUDENTS. IT REQUIRES THE APPROVAL OF A CONDITIONAL USE PERMIT IN THIS ZONE THE GENERAL COMMERCIAL DISTRICT. WHAT ARE CONDITIONAL USE PERMITS ? THE PURPOSE IS TO ALLOW CITIES TO REVIEW AND REGULATE USES THAT MAY BE APPROPRIATE IN SOME LOCATIONS BUT MAY NOT BE APPROPRIATE AND OTHERS. THEY MAY ONLY BE APPROPRIATE IF THEY ARE OPERATED IN A CERTAIN WAY SO WE WANT TO REVIEW THAT. CONDITIONS CAN BE IMPOSED THROUGH THE PUBLIC HEARING PROCESS TO MINIMIZE NEGATIVE IMPACTS ON NEIGHBORING PROPERTIES OR THE COMMUNITY. FINALLY, A CONDITIONAL USE PERMIT REQUIREMENT ALSO PROVIDES AN OPPORTUNITY FOR NEIGHBORS AND STAKEHOLDERS TO RECEIVE NOTICE AND PROVIDE PUBLIC COMMENT DURING A PUBLIC HEARING. FOR TONIGHT APPLICATION, THIS KUMON LEARNING CENTER HAS BEEN OPERATING SINCE 2018. IT IS OPERATED BY A FAMILY AND THEY WOULD LIKE TO MOVE TO RELOCATE TO THE CYPRUS SQUARE SHOPPING CENTER. THEY WANT THE SAME OPERATIONS, THE SAME CLASS SCHEDULE . THEIR CLASS SCHEDULE IS SUBJECT TO CHANGE BUT THEY HAVE NO PLANS TO CHANGE IT AT THIS TIME. JUST A MOVE. ALL RIGHT. JUST WANT TO TAKE ONE MORE SECOND. I WANT TO TAKE ONE SECOND TO LOOK AT THESE IMAGES. WE HAVE ADDITIONAL AT THIS PROPERTY. IT'S A LITTLE BIT OF A LARGER SPACE. THIS IS 1200 SQUARE FEET. WE HAVE NEIGHBORING USES LIKE THE RAILINGS TO THE RIGHT OF THIS IMAGE AND TO THE LEFT IS BLUEFIN SUSHI. STAFF PROVIDES AN ANALYSIS OF ALMOST EVERY APPLICATION. FIRST, WHAT ARE THE THRESHOLDS AND BENCHMARKS FOR THIS TYPE OF APPLICATION TO GRANT A CONDITIONAL USE PERMIT PLANNING COMMISSION MUST MAKE A SERIES OF FINDINGS INCLUDING THAT THE PROPOSED USE IS APPROPRIATE FOR THIS IN TERMS OF ITS SIZE, SHAPE AND DESIGN AND SERVED BY ADEQUATE STREETS AND INFRASTRUCTURE THAT IS COMPATIBLE WITH THE CHARACTER OF THE SURROUNDING AREAS CONSISTENT WITH THE GENERAL PLAN AND SUPPORTS THE GROWTH OF THE COMMUNITY AND COMPLIES WITH THE CALIFORNIA ACT. WHEN WE REVIEWED FOR PERFORMANCE WE FOUND THE PROPOSED KUMON LOCATION CONFORMED TO THE REQUIRED FINALS FOR THEIR APPROVAL. IN PART DUE TO ITS LIMITED SCOPE AND THE FACT THE FINDINGS FOR CONDITIONAL USE PERMITS ARE PRIMARILY DEALING WITH NEWER DEVELOPMENT AND ENSURING THERE IS QUALITY SITE DEVELOPMENT WHEN WE TALK ABOUT ROADWAYS AND THINGS LIKE THAT. WE FIND THIS IT'S LARGE ENOUGH FOR THE USE. IT HAS ACCESS TO EVEN MORE PARKING THAN IT PREVIOUSLY DID AND WE DON'T HAVE RECORD OF ANY COMPLAINTS FROM THE PREVIOUS LOCATION. THE ADJACENT STREETS ARE MORE THAN ENOUGH TO HANDLE ANY TRAFFIC GENERATED. WE FOUND IT DID MEET THE FINDINGS FOR APPROVAL. FOR THE ENVIRONMENTAL REVIEW , CEQA HAS THIS IN SECTION 15 31 EXISTING FACILITIES. THAT EXEMPTS PROJECTS WHEN A PROPOSED PROJECT INVOLVES ONLY NEGLIGIBLE OR NO USE BEYOND THAT EXISTING AT THE TIME OF THE LEAD AGENCY'S DETERMINATION. THIS IS A COMMERCIAL SHOPPING CENTER SUBJECT TO CEQA WHEN IT WAS BUILT AND THIS IS A COMMERCIAL USE GOING INTO A COMMERCIAL TENANT SPACE. IT IS NOT AN EXPANSION OF THE USE SO IT IS EXEMPT FROM CEQA. FINALLY, FOR STAFF RECOMMENDATION, GIVEN THAT IT MET THE FINDINGS FOR APPROVAL FOR AS STAFF RECOMMENDS THE PLANNING COMMISSION ADOPTED A RESOLUTION APPROVING KUMON LEARNING CENTER CONDITIONAL USE PERMIT 2025-02 AS CONDITIONED. I'M HAPPY TO ANSWER ANY QUESTIONS YOU HAVE . WE HAVE THE OPERATORS HERE TONIGHT. THEY DON'T HAVE A PRESENTATION TONIGHT, THEY FEEL THIS APPLICATION SPEAKS FOR ITSELF BUT THEY ARE ABSOLUTELY HAPPY TO ANSWER ANY QUESTIONS YOU MAY HAVE. THANK YOU VERY MUCH. >> THANK YOU. AT THIS TIME , IS THERE ANY QUESTIONS FROM THE PLANNING COMMISSION? YES. WHAT WOULD HAPPEN TO THE ORIGINAL LOCATION? >> THE ORIGINAL LOCATION , BECAUSE THIS IS A RELOCATION , THE ORIGINAL LOCATION WILL GO UP FOR LEASE AGAIN AND HOW IT WORKS IN REALITY I KNOW THIS MUCH DEPTH AS FOLKS LOOK AT THAT SPACE THEY CALL US TO SEE IF THE ZONING IS APPROPRIATE FOR THE NEXT USE. IF IT IS APPROPRIATE TO JUST GET A BUSINESS LICENSE AND MOVE IN. IF THEY NEED A CONDITIONAL USE PERMIT YOU WILL SEE THAT SOON THAT'LL BE IT. >> IT'S QUITE LITERALLY MOVING , CHANGING THEIR LEASE FROM ONE LOCATION. THANK YOU. >> ACTUALLY HE ANSWERED ONE OF THE QUESTIONS I HAD. OTHERWISE I'M EXCITED FOR KUMON . THANK YOU. >> ANY OTHER QUESTIONS FROM THE PLANNING COMMISSION? >> AT THIS TIME I WILL OPEN THE PUBLIC HEARING AND RECEIVE COMMENTS FROM THE APPLICANT IF THERE ARE ANY COMPLIMENTS OR QUESTIONS TO THE APPLICANT. SEEING NONE , I WILL RECEIVE COMMENTS FROM THE PUBLIC. I DO NOT HAVE ANY COMMENTS FOR THIS AGENDA ITEM SO AT THIS TIME I WILL CLOSE THE PUBLIC HEARING AND CALL FOR DELIBERATION. >> I WOULD LIKE TO MAKE A MOTION TO APPROVE THE CONDITIONS . OKAY I HAVE A FIRST AND SECOND. I WILL CALL FOR A VOTE. ALL IN FAVOR OF SUPPORTING THIS RESOLUTION PLEASE SAY AYE . ANY OPPOSED? NO OPPOSED OR EXTENSIONS. THIS PASSES UNANIMOUSLY. MOVING ON TO ITEM 4.2 WHICH IS ADOPTED A RESOLUTION RECOMMENDING THE CITY COUNCIL ADOPT ZONING TEXT AMENDMENTS RELATED TO THE HOUSING ELEMENT ACTION IMPLEMENTATION OF POLICY ACTIONS 1.1, 3.5 AND 3.6. MR. CORTEZ. >> GOOD EVENING. THE NEXT ITEM ON TONIGHT'S AGENDA IS THE ZONING TEXT AMENDMENTS RELATED TO THE HOUSING ELEMENT ACTION IMPLEMENTATION OF POLICY ACTIONS 1.1, 3.5 AND 3.6. THIS IS A CITY INITIATED APPLICATION REQUESTING APPROVAL OF A REZONING APPLICATION 2025-02 CONSISTING OF ZONING TEXT AMENDMENTS THAT ARE PROPOSED TO AMEND WHEN VARIOUS SECTIONS WITHIN OAKLEY MUNICIPAL CODE PERTAINING TO THE HOUSING ELEMENT ACTION IMPLEMENTATION INCLUDING COMPLIANCE WITH POLICY ACTIONS 1.1, 3.5 AND 3.6 AND TO INTRODUCE A FORMAL PROCEDURE FOR REASONABLE ACCOMMODATION REQUESTS. THE PLANNING COMMISSION IS CONSIDERING A PROPOSED RESOLUTION THAT RECOMMENDS A CITY COUNCIL ADOPT ORDINANCES APPROVING THE PROPOSED REZONING CONSISTING OF THE ZONING TEXT AMENDMENTS. THE HOUSING ELEMENT IS REQUIRED PART OF THE GENERAL PLAN. THE SIX CYCLE HOUSING ELEMENT WAS ADOPTED ON MAY 9th 2023 AND CERTIFIED ON MAY 24th, 2023. SINCE ADOPTION OF THE HOUSING ELEMENT THE CITY HAS WORKED TOWARDS IMPLEMENTATION OF THE GOALS AND POLICY ACTIONS OF THE HOUSING ELEMENT. IDENTIFIED IN CHAPTER 8, TITLED HOUSING PLAN. THE HOUSING PLAN IDENTIFY SPECIFIC GOALS AND ACTIONS TO ADDRESS HOUSING NEEDS AND MEET STATUTORY REQUIREMENTS. IT IDENTIFIES THREE CORE GOALS, PRODUCTION OF NEW HOUSING, PRESERVATION AND CONSERVATION OF EXISTING HOUSING STOCK AND INCREASED ACCESS TO HOUSING OPPORTUNITIES. TO IMPLEMENT THESE GOALS WE HAVE DEVELOPED POLICY ACTIONS, SEVERAL OF WHICH REQUIRE AMENDMENTS TO THE MUNICIPAL CODE. POLICY ACTIONS SPECIFIED OBJECTIVES, PRIMARY RESPONSIBILITY AND AN ESTIMATED TIME FRAME FOR ACCOMPLISHMENTS. COMPLIANCE WITH POLICY ACTIONS 1.1, 3.5 AND 2.6 REQUIRE VARIOUS ZONING TEXT AMENDMENTS TO THE OAKLEY MUNICIPAL CODE. THE ZONING TEXT AMENDMENTS WILL BRING APPLICABLE SECTIONS OF THE OAKLEY MUNICIPAL CODE INTO COMPLIANCE WITH STATE LAW AND IN CONFORMANCE WITH THE HOUSING ELEMENT ACTIONS. POLICY 1.1 TITLED THE ZONE ADEQUATE SITES TO MEET REMAINING NEED. AS PART OF POLICY ACTION ONE POINT ONE , IT INCLUDES CHANGES TO EXISTING AFFORDABLE HOUSING OVERLAY , AHO DISTRICT AND THE OAKLEY MUNICIPAL CODE. THESE AMENDMENTS ONLY DRESS PORTIONS RELATED TO MODIFYING LANGUAGE IN THE EXISTING AHO. REZONING OF THE SITES AS A SEPARATE ITEM AND WILL BE PRESENTED TO THE CITY COUNCIL AND UPCOMING MEETINGS. THE PRIMARY PROPOSED MODIFICATIONS REFLECT THE DECISION FROM THE MARTINEZ VERSUS CLOVIS CASE . KEY CHANGES WE MADE TO THE AHO ARE THAT THE HL MAY APPLY TO COMMERCIAL ZONES THAT ALLOW HOUSING , THE AHO USE IS LIMITED TO UNDER 50% OF TOTAL AFFORDABLE UNITS . THE HL USED TO HAVE A BASE DENSITY OF 24 DWELLING UNITS PER ACRE, THAT HAS BEEN MODIFIED TO INCLUDE 20 TO 30 DWELLING UNITS PER ACRE . OTHER UPDATES INCLUDE SIMPLE FIGHT LANGUAGE, REMOVING OUTDATED PROVISIONS AND CLARIFYING AFFORDABILITY REQUIREMENTS. THE NEXT ACTION THAT REQUIRES CHANGES TO THE OAKLEY MUNICIPAL CODE IS POLICY ACTION 3.5 WHICH REQUIRED THE CITY TO REINTRODUCE REASONABLE ACCOMMODATION PROCEDURES . THIS WOULD BE A NEW SECTION IN THE OAKLEY MUNICIPAL CODE. 9.1 POINT 1614 ESTABLISHES A FORMAL PROCESS FOR REQUESTING REASONABLE ACCOMMODATIONS TO ZONING AND LAND-USE REGULATIONS. KEY FEATURES OF THE REASONABLE ACCOMMODATION PROCEDURE INCLUDES A STREAMLINED APPLICATION PROCESS WITH A 45 DAY DECISION WINDOW , NO FEES FOR FILING A REQUEST OR AN APPEAL , IT OUTLINES A CLEAR APPEAL PROCESS AND SUPPORT FOR INDIVIDUALS NEEDING ASSISTANCE AND FILING AN APPLICATION. THIS AMENDMENT ALIGNS WITH OAKLEY'S REGULATIONS AND WITH FEDERAL AND STATE FAIR HOUSING LAWS. THE LAST POLICY REQUIRED TO THE OAKLEY MUNICIPAL CODE IS POLICY ACTION 3.6 WHICH REQUIRE ZONING AMENDMENTS FOR SPECIAL NEEDS HOUSING. THIS WAS THE LARGER OF THE ACTIONS THAT REQUIRE CHANGES TO THE OAKLEY MUNICIPAL CODE. SOME KEY CHANGES REQUIRED WERE TRANSITIONAL AND SUPPORTIVE HOUSING IS NOW ALLOWED IN THE A.L. ZONE. LOW BARRIER NAVIGATION CENTERS ARE ALLOWED BY RIGHT IN MIXED-USE AND COMMERCIAL ZONES. EMERGENCY SHELTER PARKING IS NOW BASED ON THE NUMBER OF EMPLOYEES . SUPPORTIVE HOUSING PROJECTS THAT ARE 100% AFFORDABLE ARE ALLOWED BY RIGHT IN ZONES THAT ALLOW MULTIFAMILY OR MIXED-USE. RESIDENTIAL CARE FACILITIES , SIX PEOPLE OR MORE ARE NOW PERMITTED IN ALL RESIDENTIAL ZONES BUT MUST COMPLY WITH STANDARDS OUTLINED IN OAKLEY MUNICIPAL CODE SECTION 9.1 12.28. MANUFACTURED HOMES ON PERMANENT FOUNDATIONS ARE ALLOWED SIMILAR TO OTHER SINGLE-FAMILY DWELLINGS AND WE ADDED AN INCLUSIVE AND BROAD DEFINITION OF FAMILY TO ALIGN WITH FAIR HOUSING LAWS. THESE ZONING TEXT AMENDMENTS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO CEQA GUIDELINE SECTION 15061 B3 WHICH IS THE COMMON SENSE EXEMPTION . AS SUCH , STAFF RECOMMENDS A PLANNING COMMISSION ADOPT THE PROPOSED RESOLUTION RECOMMENDING THE CITY COUNCIL ADOPT ORDINANCES AMENDING THE OAKLEY MUNICIPAL CODE PURSUANT TO POLICY ACTIONS 1.1 , 3.5 AND 3.6 AND FINDING THAT THE ACTION IS EXEMPT FROM CEQA PURSUANT TO CEQA GUIDELINES SECTION 15061 B3. THANK YOU. >> THANK YOU. ARE THERE ANY QUESTIONS FROM THE PLANNING COMMISSION? >> I HAVE ONE. ON THE TRANSITIONAL AND SUPPORTIVE HOUSING PEACE IS THERE DATA AROUND THE PERCENTAGE OF INDIVIDUALS THAT QUALIFY FOR THESE SERVICES? DO WE ANTICIPATE A WAITING LIST AND WILL THERE BE A PLAN TO ADD MORE TRANSITIONAL SUPPORTIVE HOUSING? >> IS PART OF THE ZONING TEXT AMENDMENTS WE ARE REQUIRED AS PART OF THE HOUSING ELEMENT TO ALLOW FOR THEIR USES. WE DON'T HAVE ANY PROVIDERS THAT ARE APPLYING FOR THIS KIND OF PROJECT AT THE MOMENT BUT THE CODE WOULD ALLOW FOR 100% AFFORDABLE PROJECT THAT WOULD INCLUDE THIS TYPE OF USE , BUT AS OF NOW WE DON'T HAVE A POTENTIAL PROJECT. >> MY FOLLOW-UP AS I WAS READING IT, IT STATES THERE IS GOING TO BE A REZONING SIDE ACCOMMODATION OF THE REMAINING 430 LOWER INCOME UNITS. IS THIS TIED TO THE SECTION WHERE IT SAYS THE CITY WILL IDENTIFY NEW SITES FOR THE COMPANY PROCESS? >> IS PART OF POLICY ACTION 1.1 IT INCLUDED ADDITIONAL REQUIREMENTS. RIGHT NOW WE JUST HAVE THE MODIFICATIONS TO AHO ITSELF. WE WILL BE BRINGING THEM TO THE CITY COUNCIL . NEXT WEEK WE WILL BE HAVING A WORK SESSION TO DISCUSS POTENTIAL SITES THAT WE MAY BE ABLE TO INCLUDE. WE WILL ALSO BE CREATING A NEW ZONING DISTRICT THAT WILL ALLOW FOR ADDITIONAL UNITS . >> ANY OTHER QUESTIONS? >> WHAT ARE THE STANDARDS IN 9.1. 1228 ? THE STANDARDS ALREADY EXISTED IN THE MUNICIPAL CODE. WHAT STAFF DID WAS WE ADDED TWO ADDITIONAL . THEY ARE STANDARDS THAT WOULD TAKE THE RESIDENTIAL CARE FACILITY SHALL MEET APPROPRIATE USE CLASSIFICATION OCCUPANCY REQUIREMENTS AS REQUIRED BY THE CALIFORNIA BUILDING CODE AND THE RESIDENTIAL CARE FACILITY SHALL MEET ALL CURRENT AND LOCAL FIRE DEPARTMENT REQUIREMENTS APPLICABLE BUT THE STANDARDS THAT CURRENTLY EXIST ARE STANDARDS RELATED TO PARKING, THINGS OF THAT SORT. THOSE ARE IN THE OAKLEY MUNICIPAL CODE. WE JUST CONVERT THEM TO BE MORE OBJECTIVE . THAT'S WHAT WE DID. >> ANY OTHER QUESTIONS FROM THE PLANNING COMMISSION? SO, I GUESS THE KEY POINT TO ALL OF THESE AMENDMENTS WERE TO TRY TO ESSENTIALLY MIMIC THE TEXT OR ESSENTIALLY WHAT THE STATE ALREADY PROVIDES, CORRECT? SO WE ARE MORE OR LESS JUST DOING THE SAME THING CORRECT? >> THESE POLICY ACTIONS WERE CREATED IN COMPLIANCE WITH STATE LAW. WE WERE REQUIRED TO IMPLEMENT THEM AS PART OF OUR HOUSING ELEMENT. WE DO HAVE TO REPORT THAT TO THE STATE OF HOW WE ARE PROGRESSING ON ITEMS THAT YOU SAID YOU WOULD DO. A LOT OF IT IS COMING UP TO CODE WHY SO MANY STATE REGULATIONS. >> DOING THIS WILL COMPLY WITH EVERYTHING FEDERALLY AND STATEWIDE CORRECT ? >> WE ARE CLOSE TO IT. >> CLOSE TO IT . YES. THAT IS THE INTENT. >> THANK YOU. ALL RIGHT. ANY OTHER QUESTIONS FROM THE PLANNING COMMISSION? OKAY. AT THIS TIME I WILL OPEN THE PUBLIC HEARING . I DO NOT HAVE ANY COMMENTS FROM THE PUBLIC. WITH THAT, I WILL CLOSE THE PUBLIC HEARING. I WILL CALL FOR DELIBERATION. WOULD ANY COMMISSION OR LIKE TO MAKE A MOTION TO ADOPT THE RESOLUTION? >> I MOVED TO ADOPT THE RESOLUTION. >> I HAVE A FIRST AND SECOND. I WILL CALL FOR A VOTE. ALL IN FAVOR OF ADOPTING THE RESOLUTION AS PROPOSED SAY AYE. ANY OPPOSED? NO OPPOSED OR EXTENSIONS, THIS PASSES UNANIMOUSLY. CLAIMANT OKAY. WE MOVE ON TO REGULAR CALENDAR ITEMS. ADOPT A RESOLUTION FINDING THAT THE PROPOSED 2025 TO 2030 CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GENERAL PLAN OF THE CITY OF OAKLEY AS REQUIRED BY SECTIONS 65401 AND 65402 OF THE GOVERNMENT CODE. THANK YOU. GOOD EVENING. KEVIN ROHANI IS NOT HERE TONIGHT, HOWEVER WE HAVE OUR ENGINEERING MANAGER AND SHE WILL GIVE A QUICK SUMMARY OF WHAT THIS IS ALL ABOUT AND IF THE COMMISSION HAS ANY QUESTIONS SHE WILL ALSO BE ABLE TO ANSWER THOSE. GOOD EVENING. MY NAME IS, ENGINEERING MANAGER AT PUBLIC WORKS AND ENGINEERING DEPARTMENT. HERE TONIGHT I HAVE HERE FOR THE PUBLIC WORKS DIRECTOR. ITEM THIS EVENING IS TO ADOPT THE RESOLUTION FINDING THE PROPOSED 2025 , 2030 PROGRAM IS CONSISTENT WITH THE CITIES ADOPTED GENERAL PLAN. FURTHERMORE CITY COUNCIL HAS CAPITAL IMPROVEMENT PROGRAM BUDGET IN THE MAY 27 CITY COUNCIL MEETING. PROJECTS PROPOSED REFLECT MAJOR NEEDS AND OTHER COMMUNITY FACILITIES FOR THE NEXT FIVE YEARS OF OUR CITY. A FEW PROJECTS TO HIGHLIGHT FOR FISCAL YEAR 25-26, ARE FIVE SIGNAL RELATED IMPROVEMENTS , ONE OF WHICH IS WE PLAN TO DESIGN THAT IN THE UPCOMING YEAR. THE CARPENTER ROAD SIGNAL MODIFICATION HAS BEEN DESIGNED AND WE PLAN TO CONSTRUCT THAT IN THE COMING YEAR. THE THIRD SIGNAL WE ARE WORKING ON IS MAIN STREET AND ROSE AVENUE CIVILIZATION. WE PLAN THAT IN THE COMING YEAR. THE TWO OTHER RELATED PROJECTS ARE THE MAIN STREET SMART SIGNALS PROJECT, THE CITY OF OAKLEY HAS AND WORKING WITH CCT EIGHT TO IMPROVE THE SIGNALIZED INTERSECTIONS ON MAIN STREET. AS MANY KNOW, THESE SIGNALS USED TO BE BEFORE MAINTAINED WHICH IS -- CIP 324 IS THE ANNUAL TRAFFIC SIGNAL MODERNIZATION PROJECT TO UPGRADE AND OTHER PARTS OF OUR CITY. THE PROGRAM ALSO INCLUDES FIVE PARK UPGRADES . TWO OF WHICH ARE RESURFACING PROJECTS AT MAGNOLIA PARK . THAT IS EXISTING IN THE CITY. ONE MUCH-NEEDED INFRASTRUCTURE FOR THE BASIN RESTROOM CONSTRUCTION IS ALSO IN THE BOOKS AND ONE EXCITING ONE IS TO BUILD AND HAS ALREADY BEEN AWARDED AND WILL REPRINT HERE VERY SHORTLY. THE PROGRAM ALSO ACCOUNTS FOR AT LEAST NINE DRIVEN PROJECTS. SOME TO HIGHLIGHT IS THE CIP PROJECT THAT'S ALREADY IN CONSTRUCTION AND STARTING . THE IMPROVEMENTS OF THE CANAL CROSSING , THIS IS TO THE WHINING PROJECT AND THE EAST CYPRESS ROAD WINDING ROAD TO IMPROVE IT FOR ARTERIAL WHICH IS A THIRD SEGMENT OF THE CYPRESS ROAD AND THAT COMPLETE THE OVERALL EAST CYPRESS PROJECT. OTHER PROJECTS TO HIGHLIGHT THAT IS EXCITING IS THE CIP PROJECT. THIS IS THE ROAD EXTENSION PROJECT THAT WE ARE THINKING AHEAD . LAUREL ROAD ALSO NEEDS AN EXTENSION DESPERATELY ALL THE WAY AND WE ARE HOPING TO WORK ON THE DESIGN IN THE UPCOMING YEAR FOR THAT PROJECT AND REALLY DIAL IN ON HOW MUCH THE PROJECT COSTS AND GET FUNDING FOR CONSTRUCTION. ONE OTHER THING I WOULD LIKE TO HIGHLIGHT IS THE SELLERS AVENUE ROADWAY. I KNOW IT'S BEEN A ROUGH RIDE OVER THE LAST FEW MONTHS HERE. WE ARE NEARING THE END AND WORKING WITH THE DEVELOPER TO BASICALLY DO A FULL DECLARATION FOR THAT PAVEMENT IMPROVING THE LIFESPAN OF THAT ROADWAY FOR THE WHOLE SEGMENT BETWEEN EAST CYPRESS ROAD WHICH WILL BE A GREAT AMENITY AND IMPROVEMENT TO OUR INFRASTRUCTURE AND THINGS TO COME. THAT CONCLUDES MY PRESENTATION TONIGHT. AVAILABLE FOR ANY QUESTIONS. >> THANK YOU. ARE THERE ANY QUESTIONS FROM THE PLANNING COMMISSION? >> I HAVE A QUESTION ON THE PARK UPGRADES. I'VE NOTICED MOST PARKS DON'T HAVE A LOT OF SHADE AND IT'S VERY HOT HERE. IS A PART OF THE UPGRADES OF ADDING SOME ADDITIONAL SHADE BESIDES THE PICNIC AREA ACTUALLY AROUND THE PLAYGROUND? CERTAINLY. THAT IS A COMMON COMMENT I'VE HEARD. ME AS A MOTHER MYSELF BRINGING MY VOICE TO THE PARK AND HAVING EXPERIENCE THAT. UNFORTUNATELY FOR THE UPCOMING YEAR WE DON'T HAVE ANY SHADE IMPROVEMENTS SLATED FOR OUR PARK BUT IF THERE IS A SPECIFIC PARK YOU'RE INTERESTED IN FEEL FREE TO SEND US THE INFORMATION AND WE CAN DEFINITELY LOOK FOR THAT IN THE FUTURE YEARS AS BUDGET ALLOWS. >> IS THE PARK ON CARPENTER THE NEW ONE? >> CARPENTER AND ROSE . >> THAT DOESN'T HAVE AN UPGRADE SHADE PART OF THE BUDGET AT ALL? >> THE FEATURES DOES INCLUDE SOME SHADE . DETAILS OF THE PARK IN THE PRELIMINARY DESIGN IS AVAILABLE ON OUR WEBSITE . OKAY, THANKS. >> YOU MENTIONED WE HAD RECEIVED SOME GRANT FUNDING FOR SOME SIGNAL PROJECT. HOW DOES THAT COME ABOUT, DO WE HAVE AN IN-HOUSE PERSON THAT APPLIES FOR THOSE? >> IT'S A GREAT QUESTION. WE CERTAINLY KEEP OUR EYE OPEN ON OPPORTUNITIES. I DO HAVE A GRANT WRITER ON BOARD WHEN WE FEEL THE PROJECT IS A GOOD FIT FOR A GRANT. WE SEE IF WE CAN GO AFTER THOSE. >> THANK YOU. ANY OTHER QUESTIONS FROM THE PLANNING COMMISSION? >> WILL THIS BRING US INTO A.D.A. COMPLIANCE? >> FOR THE TWO I MENTIONED , THE RESURFACING DOES INCLUDE IMPROVEMENTS OF A.D.A. ACCESSIBILITY. >> BATHROOMS? >> NO BATHROOMS AT THIS POINT. JUST THE BASIN. >> AS MY FELLOW COMMISSIONERS HAVE ALREADY BEEN ASKING, FOR ME PERSONALLY, TWO KEY THINGS IS APPARENT. SHADE DEFINITELY I THINK IT'S SOMETHING MUCH-NEEDED IF WE CAN RETROFIT SOME EXISTING PLAYGROUNDS BECAUSE IT GETS REALLY HOT . MORE IMPORTANTLY , RESTROOM CONSTRUCTION . I UNDERSTAND THE PROJECT WAS 331, THAT'S VERY IMPORTANT HOWEVER THE EMERSON RANCH COMMUNITY AROUND THERE, THERE IS A LOT OF GAMES THAT LEAGUES PLAY ON WEEKENDS RIGHT NOW. I DON'T KNOW WHAT TO SAY. I MEAN WHERE DO ALL THESE POOR CHILDREN GO TO THE BATHROOM ? IT IS SOMETHING I WOULD LIKE US AS A CITY TO CONSIDER WHEN WE BUILD THESE NEW PARKS AND WE'RE OBVIOUSLY VERY PROUD OF OUR PARKS A LOT OF THE TIMES WE CANNOT USE THOSE AMENITIES BECAUSE YOU WOULD WANT TO TAKE YOUR CHILDREN , WHERE THEY GOING TO USE THE BATHROOM? JUST SOMETHING MAYBE WE CAN ALL CONSIDER IN OUR FUTURE PROJECTS AND PLANNING. >> CERTAINLY. >> YEAH. THAT IS A CONSIDERATION. THAT'S NOT THE FIRST I'VE HEARD THAT COMMENT. WHEN WE DO DEVELOP THESE PROJECTS THERE IS A THRESHOLD AS FAR AS REBUILDING A PARK OR A LARGER COMMUNITY PARK THAT HAS LARGER GATHERINGS? AT SOME POINT IN TIME THERE WERE TALKS ABOUT INSTALLING A RESTROOM . I WILL CERTAINLY BRING THAT UP TO OUR DIRECTOR TO SEE IF THAT IS SOMETHING AVAILABLE. AS EASY AS IT SOUNDS TO BUILD A RESTROOM IT COMES WITH A FEW OTHER ISSUES THAT ARE COSTLY . >> I GET IT. >> YEAH. THANK YOU. >> ANY OTHER QUESTIONS FROM THE PLANNING COMMISSION? PROJECT 176 AT OAKLEY REGIONAL PARK , I'VE BEEN HERE SINCE 2016 AND ATTENDED A COUPLE OF SESSIONS. I'LL BE FORECASTING ANOTHER FROM THE COMMUNITY AND WILL WE CONTINUE TO STILL GET GRANTS? THERE WAS A DECLINE ON STATE PROPOSITION , WHAT OTHER FORMATS OR OTHER WAYS ARE YOU LOOKING TO GET MORE GRANTS? IS IT GOING TO BE ANOTHER DECADE? IT'S BEEN A LONG TIME. >> IT'S A LOADED QUESTION AND DEFINITELY ONE WE ALL WANT TO SEE COME TO FRUITION. UNFORTUNATELY, THE PRICE TAG OF THE PARK IS ASTRONOMICAL. THERE IS A PLAN FOR IT WHICH IS ALSO AVAILABLE ON OUR WEBSITE . THAT HAS GONE THROUGH THE APPROVAL PROCESS . WE ARE CONTINUING TO SEEK GRANT FUNDING AND LOOKING OUT FOR ALL THOSE OPPORTUNITIES. >> ONE MORE QUESTION. I'M SPEAKING AS A PARENT . IN THE FUNDING WILL ALSO BE CAMERAS FOR THE PARKS THAT WILL BE INSTALLED? IS THAT ALSO PART OF THE BUDGET? >> CAMERAS ARE SOMETHING WE HAVE ADDED INTO OUR EXISTING PARKS OVER THE YEARS AND CONTINUOUSLY HAVE GROWN NETWORK . OUR PARKS MANAGER HAS GROWN TO INCLUDE THAT. VANDALISM AND THINGS WE SEE AROUND OUR PARKS . FOR THE FIVE PARKS MENTIONED I DON'T BELIEVE CAMERAS ARE INCLUDED BUT I CAN CERTAINLY SEE THE RESTROOM AREA HAVING SOMETHING SO I WILL BRING THAT UP TO OUR PUBLIC WORKS. >> ANY OTHER QUESTIONS? OKAY. NO FURTHER QUESTIONS. I ALSO DON'T HAVE ANY PUBLIC COMMENTS ON THIS ITEM. WOULD ANY COMMISSION OR PREFER TO DISCUSS THE ITEM FURTHER OR MAKE A MOTION? >> I MAKE A MOTION TO MOVE FORWARD. >> I SECOND THIS MOTION. >> ALL IN FAVOR OF ADOPTING THE RESOLUTION AS PROPOSED PLACE A AYE. ANY OPPOSED? NO OPPOSER EXTENSION, THIS PASSES UNANIMOUSLY. THANK YOU SO MUCH. WE HAVE NO WORK SESSION SO WE WILL MOVE ON TO WORDS. ITEM 7.1 , REPORTS FROM STAFF. THE STAFF AND IF ANY REPORTS? >> I DO. JUNE IS QUITE AN EVENTFUL MONTH FOR THE CITY OF OAKLEY. THERE'S A FEW THINGS TO GO THROUGH. FINALLY, ON TUESDAY JULY 1st, OUR NEXT REGULAR SCHEDULED PLANNING COMMISSION MEETING. THANK YOU. >> OKAY. ITEM 7.2, OAKLEY PLANNING COMMISSION REPORTS FROM THE PLANNING COMMISSIONERS? I HAVE ONE. I WILL BE UNAVAILABLE NEXT MONTH FOR THE MEETING. >> LAST MONTH I WAS ABLE TO ATTEND THE TRANSPLANT . IT WAS REALLY GREAT, WONDERFUL TO HEAR EVERYONE AND ALL THE REPRESENTATION. THANK YOU. FROM ALL THE CITIES. WE HAD A GOOD CONVERSATION OVERALL OVER PUBLIC OUTREACH AND PROJECT ANALYSIS. SOME QUESTIONS WERE ABOUT SAFETY WITH PEDESTRIANS AND WE ARE STILL TRYING TO DO MORE. WITH CYCLISTS AND DRIVERS AND WHAT HAVE YOU. THE NEXT MEETING WILL TAKE PLACE JUNE 12. THEY HAVE A MAYORS CONFERENCE COMING UP ON JULY 10th. >> I SAW SOMETHING. I FORGOT WHERE I SAW IT. PAIR PILOTING A PROGRAM WHERE THEY WILL OFFER FREE RIDE . I THOUGHT THAT WAS PRETTY COOL. THANK YOU. ANY REQUESTS FOR FUTURE AGENDAS? >> NO, BUT I HAVE A QUESTION. ON JUNE 11th IS THAT THE FIRST TIME THEY'VE DONE THIS OR IT'S BEEN DONE? >> WHAT WAS THAT? >> THE JUNE 11th OAKLEY PD , IS THAT SOMETHING THAT'S BEEN DONE BEFORE OR IS THIS THE FIRST TIME? >> I CAN'T SAY WITH CONFIDENCE, BUT I THINK THIS IS THE FIRST TIME THEY ARE DOING SOMETHING LIKE THIS. YEAH. I WILL GET BACK TO YOU ON THAT. >> OKAY. THANKS. ANYTHING ELSE?

STAFF REPORT CITY HALL | 3231 Main Street, Oakley, CA 94561 O (925) 625-7000 | F (925) 625-9859 | www.oakleyca.gov DATE: June 3, 2025 TO: Joshua McMurray, City Manager FROM: Evan Gorman, Associate Planner SUBJECT: Kumon Learning Center Conditional Use Permit (CUP 2025-02) – Request for a Conditional Use Permit to relocate the existing Kumon Learning Center tutoring facility. Summary An application by Maria Shin ("Applicant") representing the Oakley Kumon Learning Center, requesting approval of a Conditional Use Permit (CUP 2025-02) to facilitate the relocation of the business from 4520 Main Street to 2081 Main Street (“Project”). The Kumon Learning Center has operated under a Conditional Use Permit at its current location since 2018, and the owners intend to continue the same operations at the new site. Kumon provides tutoring in math and reading for young students. The new location is within the Cypress Square Shopping Center, which is zoned C (General Commercial) District. (APN 037-110-026). STAFF REPORT 2CITY HALL | 3231 Main Street, Oakley, CA 94561 O (925) 625-7000 | F (925) 625-9859 | www.oakleyca.gov Background GENERAL PLAN Commercial (CO) – provides for neighborhood, community, and regional-serving retail and service uses; limited office uses; restaurants; service stations; highway- oriented and visitor-serving commercial and lodging; auto-serving and heavy commercial uses; public and semi-public uses; public gathering facilities, and similar and compatible uses. ZONING C (General Commercial) District – The purpose of the C District is to create and maintain major commercial centers accommodating a broad range of commercial uses (e.g., office, retail, and personal services) of community-wide or regional significance typically found adjacent to or along major travel corridors, such as Main Street, O’Hara Avenue, Laurel Avenue and Empire Avenue. Typical uses will vary widely in size and purpose. PROJECT SITE The project site consists of a commercial tenant space within Cypress Square, an approximately 11.46-acre shopping center situated along Main Street. The shopping center has a variety of businesses within it, including a Raley’s grocery store as its major tenant. The proposed location is an approximately 1,200 square foot commercial space that used to be a part of the former Providence Bar and Eatery. The neighboring tenants to the space are Raley’s Grocery Store and Blue Fin Sushi. There is a large parking lot for the shopping center between the tenant space and Main Street. Carol Lane runs along the south side of the commercial center. Figure 2 – Cypress Square Shopping Center (Proposed Location in Yellow) 8

STAFF REPORT 3CITY HALL | 3231 Main Street, Oakley, CA 94561 O (925) 625-7000 | F (925) 625-9859 | www.oakleyca.gov ENTITLEMENT HISTORY On September 25, 2018, the City Council adopted Resolution No. 119-18 approving a Conditional Use Permit (CUP 01-16) allowing operation of a Kumon Education Facility at a 1,031 square foot commercial tenant space at 4520 Main Street. The item was approved unanimously by the Council and there were no public comments provided at the meeting. Figure 3 – Existing Kumon Location Project Description The operator of the Kumon Learning Center at 4520 Main Street is seeking to move the business to 2081 Main Street, located in the Cypress Square Shopping Center. Kumon is a global brand of franchised after-school learning centers offering supplemental mathematics and reading programs for young students. The existing Kumon at 4520 Main Street currently operates classes on Mondays and Thursdays from 3PM-7PM and Tuesdays from 3:30PM to 6PM. The space is used as an office for operations as well as for class preparation outside of those hours. The operator states that although class hours are subject to change, they intend to maintain the same operations as at the existing location. CONDITIONAL USE PERMIT The proposed use, defined as an "Educational facility including small (generally less than 2,000 square feet) designed to augment the learning process of elementary and secondary students", requires the approval of a Conditional Use Permit in the General Commercial District. The purpose of Conditional Use Permits is to allow cities to review and regulate uses that may be appropriate in some locations but not others, or appropriate only if operated in a certain manner. Conditions can be imposed through the public hearing process to minimize negative impacts on neighboring properties or the community. A Conditional Use Permit requirement also 9

STAFF REPORT 4CITY HALL | 3231 Main Street, Oakley, CA 94561 O (925) 625-7000 | F (925) 625-9859 | www.oakleyca.gov provides an opportunity for neighbors and stakeholders to provide public comment during a public hearing. Analysis To grant a Conditional Use Permit, the Planning Commission must make a series of findings for approval, including that the proposed use is appropriate for the site in terms of size, shape, and design; is served by adequate streets and infrastructure; is compatible with the character of the surrounding area and consistent with the General Plan; supports the orderly growth of the community; and complies with the California Environmental Quality Act. The proposed Kumon location conforms to the required findings for approval, in part due to its limited scope and the fact that the findings for conditional use permits are primarily intended to ensure quality site development when a new building is constructed. The proposed tenant space is found to be large enough for the use and it has access to extensive parking, consistent with the first required finding for approval. The adjacent streets have widths and pavement types that can easily handle the limited traffic to the learning center. The proposed operations are typical for a commercial tutoring center and are compatible with the intended character of the shopping center. The use of the property as a learning center would also not be detrimental to the continued growth and orderly development of Oakley, a key required finding for conditional use permits. Environmental Review The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 – Existing Facilities of the State of California CEQA Guidelines. Section 15301 of the State CEQA Guidelines exempts projects when the proposed project involves only negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The proposed commercial use is appropriately occupying an existing commercial space. Findings Draft findings for the Conditional Use Permit application can be found in the proposed resolution. Consistency with the Oakley Strategic Plan 27+ Approval of this application would be consistent with the goals in the section of the Oakley Strategic Plan 27+ entitled, “Community and Economic Development Goal”. Careful consideration of the project in relation to the findings for approval and the proposed conditions of approval ensure the use meets community service demands while remaining compatible with Oakley’s neighborhoods. 10

A. Regarding the application requesting approval of a Conditional Use Permit for “Kumon Learning Center Conditional Use Permit (CUP 2025-02)”, the Planning Commission finds that: 1. The site for the proposed use is adequate in size and shape to accommodate the use in a manner complementary with the land and uses in the area in that the site is approximately 11.5-acres and the General Commercial (C) Zoning District allows for the proposed use with the approval of a Conditional Use Permit; and 2. The site for the proposed use relates to streets and highways adequate in width and pavement type to carry the quantity and kind of traffic generated by the proposed use in that the site is accessible by public rights-of-way such as Main Street and Carol Lane, which are designed to handle project generated traffic; and 3. The proposed use will be arranged, designed, constructed, operated, and maintained so as to be compatible with the intended character of the area and will not change the essential character of the area that is intended by the General Plan and the applicable zoning ordinances in that the proposed use is permitted in the General Commercial (C) Zoning District with the approval of a Conditional Use Permit; and 4.
