Before we go into the pull list I will recognize our mayor for some quick remarks . >>mayor cava: you MR. Chair, I want you to know we passed a significant item which is the new terminal k, concourse k, the first new terminal since 2007 we've prepared some special invitations for all of you which we will now has out and hope you can join us on JUNE 24 at 9:30 for the groundbreaking . >>chair: thank you mme. Mayor we look forward to joining you and all our colleagues for that groundbreaking terminal k. All right, on the pull list, commissioner from district 8, you hold 2b2 . >>commissioner cohen higgins: 2b2 requests are administration look into creating an assistance program for homeowners applying for zoning applications on their property, if you recall there was an application in my district of an individual single homeowner faced quite the uphill battle in getting the simple zoning application passed before this board and I appreciate the reports of the administration, appreciate the level of detail but there's no real lines and no real course specific enough for me so my request on this report is similar to the homeowner and the business permitting assistance program that was officially created by rer, I'd like an assistance program created in a similar light and the deadline for that program to be created. The data provided in this report reveals there are quite a number of homeowners in miami date county applying for zoning applications and our zoning laws are aduous, dense and a lot of people can't afford lobbyists to represent them when they come before the board and this warrants an official program created internally within rer to help our homeowners navigate their zoning applications though if it is okay with the administration I would like an official program created within rer similar to the small business assistance program for those homeowners seeking zoning applications. >>chair: mme. Mayor. >>mayor cava: thank you MR. Chair and thank you for pulling this out, it sounds reasonable . I don't have anybody here specifically, here is lourdes, our director of rer. >>chair: perfect, I will go to the commissioner for a second. Actually, you did ask questions of the administration so go ahead. Your microphone, that's me actually, go ahead. >> I apologize, I did not hear the question can you briefly repeat it? >>mayor cava: >>commissioner cohen higgins: there's a lot of detail which I appreciate greatly and there's comparison to our homeowners assistance program and discussion about the idea of creating and implementing procedures similar to that program, I would like for you to take it one step further and create an assistance program similar to that program as opposed to having policies implemented in like fashion. To have a program created so our homeowners when they are seeking to have a zoning application filed deal with those arduous laws. We don't have money to have lawyers or lobbyists that they can have a place within rer specifically where they can receive the guidance to navigate that process. >> that was the intent and I apologize if the language was infusing in any way . >>commissioner cohen higgins: thank you for clarifying that. >>chair: commissioner regalado . >>commissioner regalado: I think it's a great idea, my only concern is there is a legal dfference between helping someone with a permit and helping them with zoning so I just want to be clear that we're not providing them with legal assistance and there has to be a document that establishes that because one thing is to provide advice on a permit, it's an administrative issue. The other thing is to provide advice on zoning. I think in this case we would be looking at mainly residential so we're not going to be adding other things. It's important because there's a lot of state statutes that have nothing to do with us that would constitute a legal opinion so as long as we have a form that specifically says the county is not providing a legal opinion or making a recommendation because different than a permit a permit is you have to option a you either do it or you don't do it, zoning you MAY have multiple options. So my only concern is when they have multiple options we ae not giving them any legal advice as to which option they should consider. We are just telling them what their options are, correct? >> we are in agreement, we simply provide avice on the range of options but those decisions they would need professionals anyway to advise them on, financial impact and that so absolutely . >>commissioner regalado: the last thing I want to put on the record is the tax implications so there MAY be changes to their home state, there MAY be changes to property taxes because if there were modeling triggers there is a series of triggers, we do not give legal advice or tax advice on whatever zoning changes anyone should want to make though I want to make sure moving forward we have those writers who everyone is signing off and they don't come back and say we told them to do x, y, and z because I think it's great tell people but in this case different than permitting . >>chair: we are not giving any advice, lourdes, no advice and with that commissioner chen higgins moves the item, seconded by commissioner gonzalez, all in favor say aye, show 2b2 past. The commissioner from district 12 you are recognized on 2b5 . >>commissioner bermudez: I think everybody's got a copy of what I'm going to speak briefly about, this report deals with primarily the properties that were conveyed but the implementing order that was passed before , it's properties leased or conveyed by the county which are not in compliance and I think it makes sense for us as we saw last meeting to have a report on properties we are leasing that MAY not be in compliance so essentially my motion would basically moving forward make sure we when we get this report we also have not just properties but also leases we MAY have and if there's somebody we need to know that we don't get surprised years later and we have two sides to the story so my motion essentially is to extend that to properties leased by the county . >>chair: should I take up the item as a separate motion? I think that's the right posture so commissioner bermudez moves 2b5, you pulled it to sen., any comments so moved by commissioner bermudez, seconded by commissioner garcia, all in favor signify by saying aye, commissioner bermudez takes a motion to expand the report to include all leases on county properties. Do you ned to read it officially? >> I think the commissioner summarized it . >>chair: I understood it, moved by commissioner bermudez, seconded by the vice chair, all in favor signify by saying aye, congratulations. Commissioner from district 8 on 2b6 . >>commissioner cohen higgins: this is a report I asked them to generate , when a contract is approved by the sport how long does it take for it to be executed by the administration and moreover how long does it take for prchase orders to be issued under those contracts so to our procurement department I have a specific question on page 3 of the report. Specifically as it pertains to aviation. Two of the contracts here just stand out to me because it is no secret that our airport and this board desperately desires improvement and repairs at miami international airport as quickly as possible but two of the contracts listed here the first is the contract for $602 million and it said services under this contract were not needed in the first 60 days. how is that even remotely possible ? Where that schindler contract was the source of so much topic of discussion here at the board and and issued with a sense of urgency because of the elevator as a leader and moving walkway repairs that were and still are so desperately needed at miami international airport, how is it possible after passing this board it is being communicated that services under the $602 million contract were not needed in the first 60 days? >>chair: director. >> namida, chief procurement officer. Before I answer the question I want to understand every once the contract is awarded is entered into the system and then the allocations approved by the board are entered by department and then each department is responsible for issuing the purchase orders . I don't control that. Specifically with regards to this question there are many times when we come to the board we get the contract awarded but the existing contracts are still in place and we have not terminated them. Secondly depending on which contract, which existing contracts this was replacing there might be badging, staff might be going through the badging process at the airport to the airport needs to mke sure there is appropriate ramp-up time, equipment needed as well as the staff is badged so this is a system each department would take, should we terminate the contract right now or is the new company ready because the time the board has approved contract we have a six-month ramp up period and we've let the board know up front. So ralph is here, director gutierrez is here but based on my dscussions it is, we want to make sure when we issue the purchase order the company is ready to go and they have the appropriate tools and people ready to go. >>chair: director can you approach and complete the response? >> so commissioner, namida is 100% right. >>chair: ralph gutierrez, director . >> commissioner what drove this is what namida said, once the contract is awarded there are certain things that have to happen before they start, one of the biggest things is getting te employees badged. Our staff does everything possible to expedite that process but that goes through the department of homeland security and sometimes that can take months so I can tell you on the side note schindler has done a tremendous job over the last year and a half since this contract was awarded we've gone from 85% operational to 95% operational so we've gotten tremendous traction and made a lot of progress on the project, 30 modernizations on the way and our numbers are way better than one the contract was awarded so the contract has made a huge difference, that $600 million investment has paid dividends and continues to do so so we're establishing that cadence at 30 miles per year so the first 60 days that will consider a ramp-up period and that's why that's reflected in this report. >>commissioner cohen higgins: is that true as well for the baggage handling system at miami international where it's a contract, thank you for that explanation and anything you need from us in order to shrink that ramp-up period particularly at our airport as pertains to improvements let us know, I'm happy to help so we can get these contracts out as quickly as possible. >> director two seconds to save me a phone call I've been meaning to. Did we get the new janitorial company already started at the airport? >> they start MAY 31 or JUNE 1, they will be starting the end of this month, they've already hired about 95% of cnw's employees as they committed to and we've had several meetings both in person and virtually so they're ready to start up and running at the end of this. >> got their badges set up. >> they started that process early on so we will work on that, some employees are badged . >> I want to thank commissioner cohen higgins for bringing this up because I had similar questions regarding this and I don't know if this is something for namida or the department but I do feel that perhaps the wording is a little misleading. What we are saying is not needed, it's not that is not needed, where having a ramp-up period so perhaps the proper terminology to use in the future would be a ramp-up period instead it's not needed so to the commissioners good point, it just seems when I read not needed it seems like a lot of these contracts are coming to us with urgency and then we approve these contracts and it's reflecting in a report that the contracts were not needed for 60 days and I know that wasn't the intent and you guys do a wonderful job but perhaps for future purposes we can use a little bt more descriptive language. >>chair: with that commissioner cohen higgins moves 2b6, seeing no further discussion all in favor say aye. And commissioner from district , who do I go with first. Commissioner from district 8 on hp three. I'll start with commissioner from district 5. Eileen higgins. You still represent district 5. >> welcome to district 5 . We appreciate your visit. On 8 p3 . >> I watched the committee and it looks like there was an amendment proffered to change the awardees so I'm kind of referencing, I don't see an amendment yet because I presume it's coming because commissioner cohen higgins you ran that meeting but I wanted to ask a question of the administration, in the group be, the award for group be, is anyone going to come here and help me? Okay. So my understanding as we all know none of you were on the commission on the early days of the horrors of miami international airport where we were on national television and I ended up being dragged to washington for a congressional hearing on the poor state of affairs at our gas first, the mistreatment of workers, the lack of drinking water, lack of paid time off, vehicles without seatbelts, vehicles filled with cockroaches, on and on. These were low-wage workers working rough jobs that keep our airport ticking but they were being mistreated by the companies, one of the companies in particular. So with a lot of great effort in my first two years on the commission and also with the help of now our mayor, we really transformed the airport's reputation around how our low-wage workers are working on baggage handling, working at security, all these folks in the gaspers are treated and big progress has been made and I've had no phone calls and none of us have been hauled up to washington to explain what's going on at miami international airport. One of the achievements in doing that even though for our gaspers it's not a requirement that living wage be paid , that all these folks in group b have voluntarily signed agreements that say they will pay a living wage , that they will provide some paid time off, usually it's for six days or if someone needs to do something personal and for some of these employees it is expensive to park at the airport, they help offset some of the parking contracts so I'm wondering if you can confirm all the companies in group b, that would be swiss course, triangle, menzies, they've all signed those agreements with those three things, correct? >> it's my step understanding they've agreed, I have to look up if they shot signed agreements but that's my understanding. >>commissioner higgins: namida, is that your understanding? >> commissioner, the rfp required a very strong criteria for employee satisfaction and part of that criteria was what are going to be your wages, what are you going to be, do you basic time, paid time off, other how do you make sure that employees are not at risk so employee working conditions were evaluated and whatever they property each company proffered set of wages and benefits, those are included in the contract for each company. And like for example I have menzies here, that's on the top, I'm picking them so they proffered wages with $21-$25 so that's obviously higher than living wage. All the wages they proffered or incorporated in the contract . >>commissioner higgins: including paid time off and parking, my understanding is they all have separate agreements to help employees with that as well . >> any benefit they proffered is incorporated so we can make sure since they were selected based on those benefits they are obligated now to provide those benefits to employees . >> break rooms, keys, that things will be clean, I'm not going to be seeing any cockroaches when I go there or have some time to try to throw me out of our own airport. Me. So colleagues, should we , my understanding at commission is two of these companies are going to merge into one which is fine. That happens which would open up another slot in our gaspers and on the fly without complete negotiations we were going to add the next highest company, the company does not have a great reputation around the company or how it treats its workers so I am not opposed to adding them as long as it is completely negotiated in advance that these same conditions that the other companies are agreeing to are met. And if that is not done then respectfully I will be voting against this item and certainly against adding a company that is not going to be providing the same workers standards, worker benefits and working conditions including wages, thank you. >>chair: commissioner from district 8. >> I pulled the item because committee there was a friendly amendment that was made and I said at the time that I was not comfortable amending the item because the sponsoring commissioner was not present at that committee hearing alive all the item for today so that the sponsoring commissioner could address the amendment that was proposed. So separate from that regarding the comments made by commissioner higgins unconcerned by what you said, I remember you testifying in congress, not sure if I was sitting on the board at that time but I remember that whole situation and you handled it elegantly and beautifully. My concern is regarding the company that you mentioned, does it have a great reputation around the country that they are already in our airport. This is not a new company being introduced, this is a company that is already a part of our community and family so I want to make my position clear on this potential merger. I think it creates an opportunity for one license to drop down to the next highest ranking better of fairness of the process of procedure not to add another license to the list and that merger has not yet happened. So there's a lot of contingencies and I asked for specific things to be done a the airport committee between then and now and I'd love for someone from either b or the ministration to give me an update on request that the airport committee because we needed some clarification before we move forward. But I guess before you do that to the sponsoring commissioner I'd love to hear whether or not they are amenable to the amendment proposed that our airport committee. >>chair: commissioner gilbert you are recognized. >>commissioner gilbert: I did not watch the airport committee, I was traveling internationally I'm not familiar, I did speak with representatives from the company and told them I didn't have a problem with it, the challenge I'm having is I don't necessarily have a problem with the conditions that commissioner higgins started to mention came to me late last night so I think we need to have a meaningful conversation about not just this item but the standards we want for our employees and for not just our employees but people who work at the airport ought t be not just something you can optionally opt in in the contract, that ought to be a condition of our rfp, this is what we want so you can't legally require you to pay a living wage but we can say we want you to pay this much and actually scale it. We can do some other things so what I am concerned about when I heard this is an obligation were going to have six licensees. And if we allow someone who can come in and not pay comfortable benefits, you actually have a competitive advantage to the other folks. So I'm open to the amendment, I just think representatives for the companies are here and we need to have a conversation with them about the benefits they plan on paying and giving to the employees. >>chair: if the representative will, and while you're coming up feel free to stand at the podium. Jenny, you want to say something? >> the commissioner has asked us to provide an update based on comments made this committee, jimmy morales. We indicated while we had heard through third parties that the companies I think it was menzies that was seeking to merge with g2, we've not received anything in writing from any companies indicating what that transaction will look like, will it take place? Morning we are still despite having said that committee we still as guilty ministration have not received documentation. That said to address the point commissioner gilbert was making, to the extent any company was added as a permittee they are subject to the same conditions as the other properties so anybody who holds this permit will have to hold living wage and all the other conditions of our contract. Correct me if I'm wrong on that one but they are subject, this rfp or procurement adds conditions to it they would have to abide by that we don't know if it's going to be a merger or not, we don't know whether it will be one permittee, two permittees, we don't have that information at this point so we can provide any formal view on that. >>chair: I was also under the impression I remember somebody telling me verbally there were two licensees that were merging . I'm sorry? That was my understanding. But it's just not official I guess. This MAY not be the way this works so to the attorneys can we move something forward today contingent on that merger? If we are giving an additional license, were not getting seven licenses I guess in is the thing, we're only getting six if this is what this board wants, I don't know but from what I'm gathering and I will go and see if I have hands up I don't know to the attorneys , I'll go around the room. I just think we were told something and it hasn't transpired yet. It hasn't happened so commissioner regalado you are recognized . >>commissioner regalado: thank you. This rfp has been in the works for a very long time. And I know that we try and committee t move things along because we want them to go to the bcc but it concerns me when we get to the bcc and we are making amendments and then talking about I received information last night and then the administration is saying they don't have information which is probably why some items should not make it ot of committee without being fully vetted. So if you can't make an amendment there then maybe you just defer it for the next time so you could figure it out. I would like to hear from the folks but I just feel like this is happening a lot where an item makes it out of committee and then we're like we will amend it at the bcc and that the bcc we get these 11th hour accusations and information and if there's this or that. Then we're forced to make a decision on a few representations. So I would just caution everyone that I really think that at the committee level we should finalize this stuff and if a deferment is what that means, then it would be easier for the board. That is the purpose of the committees, like the purpose of the committees is to do this work so I want to hear from the folks that are here because there's a lot of stuff being thrown around and we've now got to vet it in real time. >> I think that's what the committee process is meant to be but I did follow this item because I anticipated it MAY get some discussion and it seems pretty benevolent that's why I moved it to the next bcc which is where whereas today. And I think it is even with the amendment, there's just one caveat is we were told one thing and I was under the impression that was worked out, there's no way we have done all that because it's a private business, that's not something outlined in the item nor will it ever be outlined in the item . So with that you are recognized. >> let me start by saying I agree with both commissioner menzies, what's disconcerting is first of all I'm not even sure that we can make the decision on something that hasn't happened yet. This merger hasn't happened technically yet. Mergers go belly up al the time and if they do what are we going to do then? That's number two , I agree with the commissioner higgins obviously that we want everybody to play by the same rules of the game and as commissioner gilbert says you can see if that happens so unless there's a sense of clarity I don't think these items should, in the form that could bring a not another employer into the process at the last second MAY not play by the same rules. That makes me feel very uncomfortable. And I think the commissioner is correct that that's part of the process of the committees but if there's this item has been sitting around for a long time, I understand that. But when you get an item that there are valid reasons sometimes on an emergency basis to change things, I don't have a problem with that but when there's not enough clarity as to what's going to happen i don't think, I think we should move forward with what we have but after a minutes are proper and come back and we will know by that time whether this new entity or additional entity whichever one you want to add within areed to play by the same rules so to speak. So that's my thought process, I think it would be a lot easier to do it that way. I think we have to protect workers obviously from what we can do because legally we have limitations but we can ask and as both my colleagues have said to make it fair and it seems like there's been positive agreements. But we don't know , our new entity is a new entity and if there is no new legal entity right now, then I feel a little uncomfortable . >>chair: commissioner garcia . >>senator garcia: based on the conversation I followed this issue but I feel comfortable with the idea and notion of moving forward contingent on the fact that there would be this merger we've been hearing about happening. And along with that if there's a motion to be made I'd be happy to make that motion. >>chair: is that something we can do MR. Attorney? >> yes MR. Chair you could award a directive to the mayor pursuant to oder a follow-up permit to the next highest rank responsible . >>chair: I would defer to the sponsor of the item but I would feel comfortable with that. I think at some point it would be fair to give the opportunity to one of the permit applicants which would be that one affected. The 61 if you would say which is the well. So what are your thoughts on the conversation and would that be amenable to the company, what would be I don't know if I have any clarity I would be happy to clarify. >> good morning members of the commission, thank you for having us here and giving me the opportunity to speak on behalf of my company which is nti. I am vice PRESIDENT At agi, my name is sarah andrews. We have been working at miami-dade 1989 and have probably been headquartered here in commissioner regalado's district since that time. We have operated out of the first cargo building that was open on the western since 1989 and since the inception of the living wage ordinance. Have followed those rules, we paid our employees according to the living wage and in fact our employees in miami that have been for your for a long time management shares equity with us in the company though they have a great employee base and we have under 1000 and we do make it our mission to pay them according to the living wage ordinance. We have also lobbied for this in airports around the country to have a living wage ordinance, we were one of the few los angeles recently that didn't push back on the living wage ordinance increase. We've done the same, we've been supportive of it in miami, we think it's important our airport workers have a living wage and have done everything in our power to make it so be it in terms of the timing of this it's difficult to for the airlines as they issue rfps, it's difficult to have sort of something hanging in the balance and not settled. So as airlines and they've made it clear they want additional options for gaspers, we've been asked multiple times if we can serve as the serve as a passenger. They're looking to issue new rfps to the gas for permit holders so I would just put that out there as a caveat that we understand the two companies are merging, that has been documented all in the news and there is some timing considerations to think about. >>chair: just to get clarity because we had a lot going on, gasper licenses we are essentially giving them a permit to operate a our airport, the airlines will have to decide who they want to work with . >> the gasper's get the permits and then they contract directly with the airlines for services they provide meaning the wing services, cabin cleaning, that type of thing. >>chair: we don't expense anything. >> they get paid from airlines. The contract improvement was with the airlines. >>chair: I see no harm but this is your item. >>commissioner gilbert: I don't see a harm going forward with the item with the caveat the merger, this is what I would say. I find more comfort in that motion if was it agi? Thank you for being here. If agi wuld commit to the things the other folks committed to. That's paying a living wage, the parking and the paid time off. I'd be more comfortable with it then because no then I know I wouldn't be giving a competitive disadvantage to someone bidding on the other stuff so I don't have a problem commissioning this and moving forward today. I will say commissioner regalado I agree with you but that's not the committee chairpersons fault, I was traveling internationally and I couldn't be there in committee, I apologize for that and I will try to make sure that doesn't happen so we can resolve tings in committee next time though I apologize but those are things we are looking at. >>chair: commissioner, I see her nodding her head but I hear jimmy or the chief mentioned that they have to abide by the same guidelines. That's what I heard. >>commissioner gilbert: legally we can't require them to do that. >>chair: would you go on the record and add to the contract that you will? >> I will commit to pay our employees regarding living wage ordinance. >>commissioner gilbert: 40 hours of pto and assist with parking allowances. So we could make the adjustment and the administration could work with that, I would love to hear what the committee CHAIRMAN Would say . >>chair: the only thing I would mention I'll go to the CHAIRWOMAN As well but based on the comments if you captured that part is when we make the motion where this body wants to go is are we doing it with that caveat I mentioned or not because to her point the airlines aren't going to feel comfortable awarding a contract based on a potential acquisition or merger. >>commissioner gilbert: uncomfortable going forward now with the understanding if the other two do merge we don't subsequently see it as having another empty spot. That's the challenge. I'm told what's preventing the merger now is not being prevented, the other things we heard previously were things that were approved. >>chair: CHAIRWOMAN. >>commissioner cohen higgins: I want to be clear on the motion before the body, the award to the next rank better is not contingent on the merger? Or it is contingent on the merger? >>commissioner gilbert: is an interesting question because I wouldn't use the word contingent because if we approve it today before the murder there will be seven. What I'm saying is there's going to be seven now but because they are active at the airport and they already have space most of the times we limit these things because of space and they already have space so it is no practical effect. What I'm hesitant about is where awarding and technically we would be awarding seven right now. I don't want when that merger does occur I don't want us to view that empty spot as a , another spot to fill. I want it to be actually we are contracting back dwn to the natural six positions that we intended . >>commissioner cohen higgins: so where issuing seven with an understanding once the murder occurs it would revert back to six and what happens if the merger does not occur? >>commissioner gilbert: what happens if the merger does not occur we are stuck with seven but because they already have space at the airport, it doesn't actually , let me do it a different way. If we did seven, let me do it a different way. If we did 7 1/7 person and it wasn't done it was a brand-new person we have a problem. We would have a problem because we simply don't have the space to accommodate but having seven because they are already there operationally doesn't make a difference. >>commissioner cohen higgins: so if there is no merger they keep their license, I want to be clear. >>chair: mdm. Chair bstien. >>commissioner bastien: MR. Chair ido echo some of the concerns of my colleagues, especially commissioner higgins and last night and this morning I also heard from some workers in our community. My concerns are I agree. I understand that you today agree to abide by some of the requests stated by some of my colleagues but my question to the administration is how do we hold her accountable? Because I've been hearing some stories lately especially from last night about people working, airport workers sleeping in their cars because they're not making enough money to pay for rent and at times are tough for people. I hear what you said about the requests made but my question is and I don't know if it's ralph or who can answer that, how do we make sure that the rights of the workers will be protected, how do we make sure we don't have so many of our miami-dade county workers working two jobs sometimes, we have to members working sleeping in cars, how do we hold folks accountable. >>chair: director they will have to sign a new contract . >> once the terms are negotiated they have to comply with the same terms everybody else does, once the contract is executed it will fall on us to make sure that enforced working with the airlines . >>commissioner bastien: it's a go through a process with me because I've had some of these concerns before and I will be meeting with you to discuss some of them but what is the process? Let's say they get this contract, this contract is awarded, when do they get an assessment, what happens? >> once it's awarded then we will sit with them, get the contract executed, they have to submit their assurance bonds once the contract is executed and signed they are duty-bound legally to be held to the terms of the contract. So our team will make sure that contract is in force and we have a team that will verify that and if there's an issue our staff will follow up to make sure we done that in the past where they had issues and we brought them in, got the issues corrected and they nw are working with employers. We've done that in the past. >>commissioner bastien: and in the report you submit you will apprise us . >> of course, we will reach out to them. >>chair: thank you drector, seeing no further debate, you have debate on this? >>vice chair: thank you MR. CHAIRMAN. I seem to echo the concerns that commissioner bermudez raised and listening to the conversation back and forth I'm not quite sure if there's going to be a motion to amend the motion so that clarity can be brought. >>chair: commissioner gilbert, you are recognized . >>commissioner gilbert: I'm speaking with the attorneys and go ahead and read what we have . >> the item will be amended to award an additional permit to agi that proposal includes paid time off and parking lots for employees and in addition to the event our permittee ceases operations the county cannot back such action without prior approval of the other commissioners . >>chair: that covers what you said so commissioner gilbert moves the item as amended, seconded by, sorry. >>commissioner bermudez: is my amendment. >>commissioner gilbert: know because , yeah. We talked about the amendment that I wasn't here to hear. So but this should , I would accept this and make it part of my original item and what this does is it makes it part of their proposal all the terms that we need them to agree to for their employees . >>chair: saw amendment to the amendment and the item is moved as amended, moved by commissioner gilbert, seconded by commissioner orbis, seeing no further discussion all in favor signify by saying aye. All opposed day. Show the item past, is that it's for my pull list? I believe that is a yes. So alright guys, I have a motion that's been distributed to cancel two meetings in JUNE. So the bcc meeting on JUNE 17 and the cgmp, quiet as you exit please, the meeting on JUNE 18 . So the JUNE 18 one we are rescheduling until the following week, JUNE 26 . And obviously there's reasons why these have to be canceled. But there JUNE 17 bcc meeting was originally I was thinking we would do it in JULY, I will have a packed agenda, we will have the millage and potentially a solid waste system that we can also push that to the following week. It is at the will of this for what you wish to do, commissioner regalado. >>commissioner regalado: thank you MR. Chair and I appreciate everyone as scheduling issues but the JULY meeting is our last meeting before we take a break. This would put us at two committee cycles into the JULY meting caused there were a lot of items that didn't make it into this meeting. I would request if we could have our bcc meeting you and 25th since we're having our comp plan on JUNE 26. This month we cancel, plan so it is important to have the JUNE 26 one and to have attendance we have a lot to cover in JULY. And I really think it's important for us to have our second JUNE meeting. If not I'm fine, I will pack a lunch, I will pack dinner but the issue is the bandwidth of covering all these items in JULY because we're going to have a lot of public hearing in JULY, we have the millage, have all the waste items. I'm available whenever but my suggestion is JUNE 25 if that works for everyone for the bcc. I guess we could kick around other dates right now. But I just think we would have to many items going to the JULY 16 meeting. >>chair: yes commissioner higgins. >>commissioner higgins: maybe I'm confused, this happens often. JULY 1 I have written down as bcc, is that correct? Then I have also JULY 16 as bcc . So we do have two meetings that are bcc in JULY, I can't make the week of the 24th but my question to you MR. CHAIRMAN is if we as committee chairs are seeing things that are either, that maybe need to be accelerated and skip committee to come forward, could we do that on the first meeting in JUNE? And I realize I'm not going to make everything but every now and then a department might say if we don't execute this contract it would be delayed so maybe there's a chance committee chairs could review our agendas and prioritize a few things to go early without committee review rather than waiting all the way till JULY 1 so I toss that out. Or you could make a nice little light agenda and for those of us that happen to be here JUNE 17 we could do the easy stuff and save the harder stuff for JULY 1, it's up to you. >>chair: I'm open to either option. The question comes down to and commissioner you alluded to it, do we want a long meeting in JULY or do we want to meetings? Do you want to be dragged down town? >>commissioner gilbert: are those the only options? Myself available . >>commissioner regalado: we could do both, we could do bcc and comp plan, that's another option. JUNE 26, sorry. >>commissioner gilbert: uncomfortable with whatever date you determine, I have travel things so I think that's like right after. I think we should be fine. I can accommodate whatever . >> that is three days before the JULY 1 meeting so three working days before. >>chair: we are moved JUNE 21 for the cdmp and we can bundle in a bcc meeting there . >>commissioner higgins: are we meeting three days later for bcc? >>chair: you're not confused, the concern is population of items so we are not here until five or 6 o'clock . >>commissioner higgins: are not your JULY 26 but if everybody wants to be here I will be able to help with quorum. >> sometimes wickedness meetings but I am intending to different meetings so we could have JUNE 26 one I think that would be appropriate, we can have more in JULY 1 as well. >>chair: would that work can we have cdmp on the same day? So I amend my motion to have the regular board meeting scheduled for JUNE 17 , also rescheduled for JUNE 26 . Along with cdmp and zoning from JUNE 18 until JUNE 26 so I amended my motion. Rather than JUNE 17 were going to have it on the 26 . Both bcc for that last meeting in JUNE. And cdmp and zoning . >>commissioner gonzalez: I would prefer JUNE 17 but if it's the will of everybody else. >>chair: we are not here but we're going to do the 26, if you need to leave early it's going to be a short agenda, I'm not going to . >>commissioner regalado: obviously to your discretion but for the things that are time sensitive we would put them on that JUNE 1 and it would be shorter and the stuff more complicated we could lead to JULY but that way we could lighten the agenda. >>chair: we MAY not have quorum, i will send out a memo, right now we're moving everything JUNE 26. >>commissioner regalado: can everybody will be here JUNE 26 raise their hand? Why do we have to set a memo? Be one we will have quorum. >>commissioner regalado: we can set these items for JUNE >>commissioner regalado: we can set these items for JUNE 1. >>chair: with that the vice chair makes a motion, all in favor signify by saying aye. Show those dates moved. Not an attorney any further business outside of emotions by commissioners? Couple more motions. >>chair: go ahead. >>chair: commissioner bermudez you are recognized . >>commissioner bermudez: this is brief, I will let melanie read it just to give you background we have a library , county library and there's one in downtown doral, this is a space we rent and it's going to be a couple months late and we need to have an agreement to extend that lease at the existing site for month-to-month because we don't know how many months it will be . If melanie could read. >> authorize and direct the county mayor's designee to upon review by the county attorney's office execute a documents necessary to effectuate a month-to-month extension of the existing lease agreement with downtown the ralph regional holdings incorporated for space for the library located 8551 north east 53rd quarter, the lease agreement was approved by resolution are 369 b 22, the monthly lease extension is 2000 $2177.44, $59 $2177.44, $59.70 per square foot and will enable the library to continue through the completion of the library under construction. >>chair: moved by commissioner bermudez, seconded by commissioner higgins, seeing no discussion all those in favor signify by saying aye, opposed nay, show the item past, commissioner hardemon, commissioner orbis, bastien you are recognized. >>commissioner bastien: I raised my hands for 26 JUNE that I will not be here. >>chair: we should be good with quorum, that's okay, thank you for that, commissioner regalado. >>commissioner regalado: I have an item, a motion if the attorneys could read it please. >>chair: you are recognized MR. Attorney . >> the budget motion, commissioner regalado? >>commissioner regalado: yes. >> commissioner regalado directs the county mayor's designee to provide the auditor with copies of all budget files and documents the sub line item detail submitted for this upcoming fiscal year and for any line items funded by the general fund ejected by the county mayor to include a change in revenue expenditure for the fiscal year, county mayor's designee to provide the auditor within seven days with information that provides an explanation including qualitative and quantitative information to support the projected budget change that is sufficiently detailed to substantiate review of the estimated deficit at the mayfield 14th meeting of the appropriations committee. >>commissioner regalado: the reason I'm bringing this item and I know the administration has issues with it is I only have the JUNE 11 and JULY 9 appropriations meeting before we set the millage ally 16th. The mayor bylaw has till JULY 15 to provide us with a budget and that's usually when she does it. That does not give us enough time to drill down. Before the break. The committee we were talking with on the record with commissioner bermudez about potentially doing a joint meeting of appropriations and get so that we could drill down on the budget. Obviously everyone is invited to attend but I need more information, yank and needs more information than we are being given. In order to do some sort of analysis before we set the millage because when we set the millage that die is cast. So I'm stopping everything I'm doing to work on this and I need more information from the administration. I know they're not happy with this request but I asked you to support me as much as possible in terms of getting the information so we can provide this board with options and we are not left at the last minute struggling to try to figure out what we can do on the 16th. >>chair: my staff was speaking so I missed the motion but I do agree and I went with the mayor to review this week. They're very, they would be very cooperative and collaborative with the commission auditors office but if there is something you need to be able to complete your task as the chair . >>commissioner regalado: this is a request from the commission auditor but we need more specificity in terms of sub line items. I know that this has come up before, there was an item before appropriations that was deferred but that would have been for the next budget, not necessarily for this one. We met with the auditor yesterday, we've met with staff on different issues. We had the department's present but without the information on the sidelines. >>chair: I think that's reasonable and they're willing to provide that from our conversation though that is a non-adversarial motion to my extent so it's been moved, it's been seconded . I think the administration is okay with that, I support that obviously. Moved and seconded, commissioner cohen higgins. >>commissioner cohen higgins: this motion is a replica of an ordinance passed at first meeting before the appropriations committee last week and it was deferred at the request of the administration for very very specific reasons articulated to me that it would place such an incredible burden and onus on the administration so if it's going to go from an ordinance that last week was deferred at the appropriations committee and brought before the board as a floor motion I need an explanation from the administration as to why it is I motion was requested to be deferred indefinitely because it was so arduous and onerous on the dministration and now it is before the board as a floor motion I need to get clarity on this because we work collaboratively, we prepare items, we work to bring items before the board and we're constantly working with the administration in a collaborative effort. This directly usurps that process so I need clarification either from the administration or from yenka because now the information I have is crossing and not making much sense. >>chair: you're welcome to respond but the information would not be something that's difficult to provide, right? But let's get the mayor to respond . >>mayor cava: thank you MR. Chair. We certainly want to work collaboratively with you. We are in a budget a year like we've never seen before. We are looking at every opportunity to close the gap in our budget. An ordinance that was proposed would have required us to on an ongoing basis provide more detail for that line item and would have been burdensome and arduous. We want to provide more information so that the board can assist us in making difficult choices. What we will provide what's available, the problem is MR. Chair and to the maker of the motion, we are in the middle of crunching all these numbers. There isn't anything definitive to share. So as we discussed in each of our meetings with the commissioners and with you yesterday MR. Chair, what was submitted by departments earlier in the year is not what is going to be the final version of the budget, of course not because it reflects a gap between revenues and expenses. So we are here, we, david klodfelter can speak more to this as budget director, when they are working to provide information on a timely basis but two different things are being asked, one is the question is why are we projecting the gap that we are and how do we support that? Is information david can provide. The next question is what exactly are we proposing to balance the budget? Don't have that information and cannot yet provide it and we did tell each of the commissioners we would come back to you before JULY after we get the projections from the property appraiser, after we had an opportunity to look at all the available options and we received the additional budget request from the fourth constitutional officer that we will come back to discuss what we are contemplating putting into our proposed budget. Higgins you still have the floor. >>commission
