THE FOLLOWING COUNCIL GOALS ARE BEING ACHIEVED: Operate in a Businesslike Manner FISCAL IMPACT: The proposed fee increases are projected to generate $3.7 million for Fiscal Year 2026-27. The Fiscal Year 2026-27 Proposed Budget includes revenues in the General Fund for the various City Agencies (Community Life & Culture, Community Development, Fire Department, and Public Works) related to the proposed fee increases. RESOLUTION NO. ________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ONTARIO, CALIFORNIA, ADOPTING UPDATES TO THE CITYWIDE FEE SCHEDULE ESTABLISHING AND AMENDING CERTAIN SERVICE AND DEVELOPMENT-RELATED FEES FOR CITY SERVICES. RECITALS WHEREAS, the City of Ontario (“City”) is authorized to adopt and implement fees and charges for certain municipal services (“Services”), provided the same do not exceed the estimated reasonable cost of providing such Services pursuant to the California Constitution (Section 7 to Article XI) and the California Government Code (Sections 51287 and 66000 et. seq.); and WHEREAS, the City Council previously established fees, rates, and charges (“Fees”) for specified Services; and WHEREAS, the City Council previously approved and adopted Resolution No. 2004-065 dated June 21, 2004, which updated and modified certain Fees from prior resolutions and incorporated them into a document titled “Schedule of Service Fees” for ease of reference; and WHEREAS, the City periodically reviews its Fees to determine whether they are reasonably related to the cost of providing Services; and WHEREAS, as such, certain Fees under Resolution No. 2004-065 have been updated and modified by ordinance and resolution over the subsequent years (the most recent being Ordinance No. 3295 dated February 4, 2025, and Resolution No. 2025-060 dated June 18, 2025); and WHEREAS, Resolution No. 2025-060 was based on a 2025 comprehensive review of the current Fees administered by several City agencies (Community Life & Culture, Community Development, Information Technology, Police Department, and miscellaneous Citywide providers), which was conducted to determine if the then-current Fee amounts were reflective of the costs to provide such Services, and were consistent with best practices and statutory requirements (“Fee Review”); and WHEREAS, the City determined to increase the Fees in accordance with the Fee Review, but further determined not to set the Fees at full cost recovery as supported by the Fee Review; and WHEREAS, accordingly, the current Fee amounts do not cover the actual costs of certain Services provided by the City based upon the Fee Review; and 8

WHEREAS, the City Council wishes to update and modify the Fee amounts and categories to facilitate the recovery of the City’s actual costs of providing such Services, up to the amounts supported by the 2025 Fee Review. NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Incorporation of Recitals. The above recitals are true and correct, and are incorporated herein by this reference. SECTION 2. Adoption. The City Council hereby adopts the updated Citywide Fee Schedule as set forth in Exhibit “A”, attached hereto and incorporated herein by reference. SECTION 3. Repeal of Prior Resolution Conflicting Provisions. Any and all conflicting provisions of prior resolutions establishing, adjusting, or modifying Fees as set forth in Exhibit “A” are hereby repealed and replaced as of the effective date of the Fees set forth in Exhibit “A”; provided however such repeal shall not excuse or affect the failure of any person or entity to pay any Fee heretofore imposed upon such person or entity. SECTION 4. Survivability of Prior Resolutions. The non-conflicting provisions of prior resolutions amended by this Resolution shall not be affected, and shall remain in effect to the extent not inconsistent herewith. SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications; and to this end the provisions of this Resolution are declared to be severable. SECTION 6. Effective Date. The schedule of development-related fee increases established hereunder in Exhibit “A” shall be imposed and collected effective August 22, 2026 (greater than sixty (60) days from the date of adoption of this Resolution); the increase represents a one hundred percent cost recovery of each reviewed fee. In addition, effective July 1, 2026, the schedule of development-related fee increase will represent one hundred percent full cost recovery based on the 2025 Citywide Fee Study Report. All other new fees and fee increases shall take effect on July 23, 2026 (thirty (30) days from the date of adoption of this Resolution). Any decrease to existing fees shall be effective July 1, 2026. PASSED, APPROVED, AND ADOPTED this 23rd day of June 2026. _____________________________________ PAUL S. LEON, MAYOR 9
