Note: The Planning Commission, at the request of the Planning Department, continued this agenda item from the October 2, 2024 meeting. There were no public speakers on this items, so a motion was made by Commissioner Strong and seconded by Commissioner Banks, to continue the agenda item to the October 23, 2024 special Planning Commission meeting. PROJECT DESCRIPTION: The Applicant (Catt Road, LLC; dba The Cake House East) is proposing to establish a retail cannabis business within an approved 3,936 square-foot retail lease space (Catt Crossings Retail Center) within the C-P-S zone located at 23825 Catt Road. The proposed Cannabis project requires the following applications for review by the Planning Commission with a recommendation to the City Council: 1 ) Adoption of a Categorical Exemption - The proposed project meets the findings for a Categorical Exemption in accordance with Section 15301 (Existing Facilities, Class1) of CEQA. Class 1 consists of the operation or minor alteration of existing structures involving negligible expansion of the existing space. 2 ) Conditional Use Permit No. 24-0035 - In accordance with Section 17.315.040 of the Wildomar Municipal Code (WMC), the proposal to establish a retail cannabis business within an approved 3,936 square-foot retail lease space (Catt Crossings Retail Center) within the C- P-S zone located at 23825 Catt Road requires approval of a Conditional Use Permit. 3 ) Development Agreement No. 24-0035 - In accordance with Section 17.315.040 of the WMC, the proposal to establish a retail cannabis business within an approved 3,936 square- foot retail lease space (Catt Crossings Retail Center) within the C-P-S zone located at 23825 Catt Road requires approval of a Development Agreement. Project Location/Vicinity: The proposed cannabis use will be located in an approved multi-tenant commercial/retail building known as Catt Crossings located in the C-P-S zone at 23825 Catt Road. The subject property is about 0.66 acres +/- in size and the lease space is 3,936 square feet in size and located immediately west of the Chevron gas station at the NEC of I-15 freeway and Clinton Keith Road. Refer to Attachment E for vicinity/location map and land use table. Local Cannabis License No. 24-0035: In accordance with Chapter 5.76 (Commercial Cannabis Licensing / Ordinance No. 188) of the WMC, the proposal to establish a retail cannabis business first requires the review and approval of a Local Cannabis License. Review of the local license is an administrative review procedure not subject to the Planning Commission or City Council approval, and does not require a public hearing. The Applicant submitted their local license application on April 23, 2024. The local license cannabis package was distributed to city staff, including the Riverside County Fire department and Riverside County Sherriff's Office. A local license cannabis package requires elements of the proposal, including but not limited to, a detailed statement of qualifications, business/operations plan, fire protection plan, safety/security plan, waste disposal plan, odor abatement plan and visitor requirement plan. In addition the Applicant is required to submit the following (which they did in compliance): The Applicant shall submit proof that the he/she is, or will be, entitled to possession of the premises for which application is made. Evidence of lawful possession consists of 13

properly executed deeds of trust, leases, evidence of ownership of the licensed premises, or other written documents acceptable to the City. This information must be submitted concurrently with the Local License application or the application will not be processed. An Authorization Letter from the Applicant and Property Owner (separate letter attachment) for the City to seek verification of the information contained within this application. Proof of the nature of the cannabis business's organizational status, such as articles of incorporation, by-laws, organizational minutes, partnership agreements, or such other documentation acceptable to the city. An authorization letter (signed) from the property owner and/or property management company (if proposed in a multi-tenant retail center) acknowledging submittal of the Local License Application. Based on Staff's review of the Local License cannabis package, the City approved Local License No. 24-0035, subject to conditions on June 24, 2024. While the local license cannabis package does not require Commission or Council approval, the information within it is very informative for the Commission and Council’s understanding of how this cannabis business will operate. The Local License is good for two (2) years and must be renewed prior to the expiration date of June 24, 2026. A copy of the approved Local License cannabis package is provided in Attachment E. Conditional Use Permit No. 24-0035: In accordance with Section 17.315.040 of the WMC, the proposal to establish a retail cannabis business within an approved 3,936 square-foot retail lease space within the C-P-S zone requires approval of a Conditional Use Permit (CUP). The Applicant submitted their application for a CUP on April 23, 2024. The proposed cannabis use and CUP were evaluated by Staff and Riverside County Fire Department. Review of the proposed cannabis use was conducted in accordance with Chapter 17.315 (Ordinance No. 187) of the Wildomar Municipal Code. The CUP cannabis package requires elements of the proposal, including but not limited to, a statement of qualifications, project description, neighborhood compatibility plan, security plan, and parking analysis. Each of these elements are addressed in the Analysis section of this staff report. In addition, the CUP Cannabis package includes interior floor plans, and detailed information about the Catt Road, LLC business model. A copy of the proposed CUP cannabis package is provided in Attachment A-Exhibit 2. Cannabis Use Exhibits: The exhibits reflected in Attachment C and D illustrate the interior and exterior “elevations” exhibits as well as the 100’ and 600’ buffer area maps exhibits. Public Email Comment Email Letter (Ms. Veronica Langworthy): Prior to the October 2, 2024 Commission meeting, staff received an email from Ms. Veronica Langworthy that was forwarded to the Commission (refer to Attachment H). The letter outlines several concerns itemized below. Staff has provided responses to each. 1) City staff and fire dept weighed in on the business but there does not appear to be law enforcement/sheriff dept report. 14

Response: This was an oversight on Staff’s part which lead to the request for a continuance. The Riverside Sheriff’s Office (RSO) has since reviewed the proposed cannabis package focusing on Chapters 5, 6, & 8 of the Local License cannabis package and Chapter 7 of the CUP cannabis package. These chapters describe the safety and security measures being proposed by the Applicant. The RSO (Captain Rayls) completed their review of these items and notified the planning department that the proposed safety and security are consistent with their policies and they have “cleared” this cannabis proposal. 2) Ms. Langworthy is requesting a formal report from sheriff’s dept. from May 2020 to present about public safety issues — increases in DUI, illegal grow, theft, battery, assault, etc. drug-related crimes. Response: It is Staff’s opinion that this information is unrelated to the specific retail cannabis CUP/DA being proposed as it’s a more of a “global/general” issue to be coordinated with the RSO. Staff does not recommend holding up the CUP/DA but will help coordinate this report with RSO and Ms. Langworthy. 3) Neighbors/commuters in proximity to Cake House West mention traffic incidents — the proposed location for Cake House East is at the I-15 / Clinton-Keith gateway to our city — an important corridor for emergency vehicles and commuters and shoppers. Response: Staff is not in receipt of any complaints or incident reports about the Applicant’s current operations at the Cake House on CKR/Palomar. The proposed cannabis use will be part of a Planning Commission approved retail center (Catt Crossings) which is conditioned to provide full on-site and off-site public street improvements. The Riverside County Fire Department reviewed the Catt Crossings retail center and found it in compliance with all fire standards and requirements. In addition, they have reviewed the proposed retail cannabis use and determined it to be in compliance. 4) Although not a park, there is a sensitive environmental mitigation area within 600 feet of the site. Response: Comment noted but not applicable to the proposed CUP/DA. 5) How many cannabis businesses already are established in the city? Response: The City Council has approved four (4) retail cannabis businesses (Culture Club, Stiizzy, Cake House and Element 7 (now Buzz Cannabis). Culture Club has recently ceased their operations so the city has not renewed their local license. Buzz Cannabis is going through the Tenant Improvement (TI) process and may open their business shortly after the new year. 6) how many properties have been inquired about? Response: Staff has received numerous calls regarding retail cannabis proposals since 2020 when Ordinance No. 187 & 188 were adopted. We do not keep accounting of how many calls we receive. 7) city said that to fund the District Attorney’s Task Force, the city projected 10 businesses would be needed for that purpose? How is over tax
