PUBLIC HEARING: 1. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA, DEDICATING A PORTION OF LAND AS PUBLIC RIGHT OF WAY FOR NW 127TH STREET, AS DESCRIBED IN THE ATTACHED LEGAL DESCRIPTION AND SKETCH; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR RECORDATION; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.

City of Opa-locka, Florida Planning and Zoning Board September 1, 2026 Page 2 Planning and Community Development Director Gay read the Ordinance into the record. Zoning Official Lee presented the item. The request was to dedicate a portion of land as public right-of-way. The legal description covered part of Tract 8, Block 300 of Nile Gardens, Sections 1 and 2, proposed as NW 127th Street. The title search report in the packet showed the City of Opa-locka was the final owner, so the City was dedicating property it already owned. Proximal owners had donated the land, which the City accepted by legislation, believed to be in the 1980s, but never officially dedicated as a street. Zoning Official Lee noted full street could not be dedicated at once, so staff proposed to begin with the ready segment and work westward in the I-4 district. The dedication was consistent with the transportation element of the Comprehensive Plan and would improve east-west travel over time. Zoning Official Lee stated staff recommended approval. In response to a Board Member's question about future access along the corridor, Zoning Official Lee stated he was not aware of a plan to remove the median. The long-range plan was a route from Cairo Lane to 32nd Avenue, beginning with this already-dedicated property. Motion made by Acting Chair Dominguez, seconded by Board Member Hibbert Smith, to approve the Ordinance. In a roll call vote, the motion passed unanimously (4-0). 2. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA ADOPTING AMENDMENTS TO ORDINANCE 15-31, THE LAND DEVELOPMENT REGULATIONS / ZONING CODE ORDINANCE, ARTICLE V, SECTION 22-134. WALLS, FENCES AND HEDGES; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR CODIFICATION AND SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Planning and Community Development Director Gay read the Ordinance into the record. Zoning Official Lee presented the item. The amendment updated the Land Development Regulations on walls, fences, and hedges across all districts, responding to public inquiry, prior Board recommendations, and enforcement challenges. Its main provisions set permitted materials, prohibited hazardous fencing such as barbed wire, razor wire, and electric fencing, clarified height limits by district, required landscaping to screen chain link, and added standards for recess fencing along the public right-of-way, temporary screening in industrial districts, drainage and easement protections, and outward-facing finished surfaces.

City of Opa-locka, Florida Planning and Zoning Board September 1, 2026 Page 3 Citing rising variance requests, inconsistent installations, and enforcement problems around chain link and hazardous materials, Zoning Official Lee stated the amendment modernized standards, improved neighborhood compatibility, and aided enforcement. Zoning Official Lee stated staff recommended approval. In response to a Board Member Bryant’s question, Zoning Official Lee confirmed grandfathering was automatic. Existing permitted fences could remain, while new work would follow the updated code, which expanded options rather than restricting them. Planning and Community Development Director Gay added the amendment furthered the City's beautification efforts, noting a properly landscaped chain link fence improved both the property and the community while still letting an owner secure it tastefully and safely. Asked about chain link, Zoning Official Lee explained the amendment enhanced rather than eliminated it, allowing it around an entire property if screened by front landscaping, and confirmed it remained a permitted material. Discussion followed on front-yard height limits, past six-foot front-yard installations, and landscaping options such as bougainvillea. Motion made by Board Member Mangham, seconded by Board Member Bryant, to approve the Ordinance. In a roll call vote, the motion passed unanimously (4-0). 6. ADJOURNMENT Planning and Community Development Director Gay advised staff had been unable to advertise additional items in time. He stated staff intended to hold a second Planning and Zoning Board meeting on September 22, 2026, and polled the Board for availability. The Board members present indicated they were generally available, and staff would proceed to set and advertise the meeting. It was moved by Acting Chair Dominguez, seconded by Board Member Hibbert Smith, to adjourn the meeting. There being no further business to come before the Planning and Zoning Board, the meeting was adjourned at 6:23 PM [Minutes prepared by T. Baclawski, Prototype-Inc.]
