Board of Education Regular Meeting – April 15, 2021 228 That the Board of Education adopt Resolution 37 proclaiming the week of May 3, 2021 through May 7, 2021, as Substitute Teacher Appreciation Week, as presented. It was moved by Steve Ferguson, and seconded by Armond Aghakhanian, that the Board of Education approve the item as recommended. The motion carried unanimously with the following roll-call vote: AYES – Frintner, Tabet, Ferguson, Weisberg, and Aghakhanian. 12.g Adoption of Resolution 38 for the Elimination or Reduction of Services for Certificated Children's Center Positions That the Board of Education adopt Resolution 38 for the Elimination or Reduction of Services of Certificated Children's Center positions, as presented. Resolution 38-Reduction in Force Certificated.pdf (OF 28,684) Clerk Ferguson said that this was a difficult decision as the Board and staff have worked hard to try to find budget solutions for the Mann childcare program for many years. He was grateful that the YMCA is willing to assume the responsibility to ensure that employees continue to be employed. This was one of the hardest votes to take and he apologized to those employees who are being impacted, as other options are not available. Vice President Tabet agreed and thanked those employees for their services and hoped for the best. Sarah Niemann reported that approximately 40 employees will be affected due to the recommended proposal to allow the Burbank YMCA to operate the Horace Mann Child Care program. The current positions will need to be eliminated as a standard process to allow the YMCA to offer jobs to these employees. She and staff will continue to work with the YMCA to look at employment options. If these employees wish to remain as District employees, bumping rights with similar positions will take place. She is working to ensure a smooth transition, as the YMCA will take over the program and staff effective July 1, 2021. Resolution 38 and 39 is required to be able to continue the process. Member Weisberg asked if employees wanting to stay was part of the agreement. Ms. Niemann noted that it was part of the agreement and that bumping rights with similar positions were based on seniority. The YMCA is looking at compensation, which is a significant employment decision.

Board of Education Regular Meeting – April 15, 2021 229 12.h Adoption of Resolution 39 for the Elimination or Reduction of Services for Classified Positions That the Board of Education adopt Resolution 39 for the Elimination or Reduction of Services for Classified positions, as presented. Resolution 39-Reduction in Force Classified.pdf (OF 28,685) It was moved by Steve Ferguson, and seconded by Armond Aghakhanian, that the Board of Education approve the item as recommended with the following roll-call vote: AYES – Frintner, Tabet, Ferguson, Weisberg, and Aghakhanian. 12.i Approval of Extension of Probationary Period for Extracurricular and Cocurricular Activities Assembly Bill 908 That the Board of Education approve the extension of the probationary period for 37 student athletes for the remainder of the school year as allowed through the provision in Assembly Bill 908, as presented. AB_908.doc.pdf (OF 28,686) John Paramo used a PowerPoint to guide his report. Assembly Bill 908 authorizes the governing board of each school district the ability to adopt a policy that would allow a probation period to exceed one semester in length through the completion of the 2020-2021 school year due to the impact of COVID-19. Student Athletes combined at BHS and JBHS = 1,363, ineligible student = 168, Student Athletes with 3 or more F's = 93 out of 168 Ineligible athletes, Student Athletes with 2 F's = 38 out of 168 ineligible athletes, Student Athletes have 1F = 37 out of 168 ineligible athletes. The recommendations included 1) Extend the probationary period for students who have 1 F grade as they can safely make the credit up in summer school. 2) Students with 2 F grades could make up both classes in summer school and be ok. However, the data for BUSD over the last 5 years has shown that the number of F's increases in the spring, not decreases. Therefore, it is not recommended that the probationary period be extended. 3) Students with 3 or more F's have already exceed the number of credits that can be made up in the summer. These students are already going to start the new school year credit deficient. It is not recommended that the probationary period for these students be extended. Member Weisberg asked for grade level breakdowns for the 168 students. Dr. Paramo noted that approximately 18 seniors that received 1 or 2 F's. Vice President Tabet would like to help all 168 students by extending the requirement and including specific criteria such as, attending all morning virtual instruction for the rest of the semester and all afternoon in-person instruction, and must attend summer school. President Frintner noted that instructional offer choices can be made; however, it cannot be a requirement for next semester. Superintendent Hill clarified that the current provisions only applied to the semester ending in May 2021. The approval tonight allows the students to play for the remaining 6-weeks of instruction. The old regulations will be applied for the next 2021-2022 school year and beyond. Member Weisberg asked about negative impact to the District to allow 168 students to participate. Dr. Paramo said that students who have more than 3 Fs=15 credits and it is more difficult to make up work during the second semester. In addition, summer school only allows for 10 credits, which will allow a particular student to recover three summers from now assuming lower grade students. Vice President Tabet felt that the options could be provided to encourage the athletes to improve their grades. Parents want kids to play sports and wants to help and support all students. Clerk Ferguson noted that the District's mission is to graduate students. In this situation he felt that the human factor will need to be applied. He would like to entertain a hybrid model, but he also understands

Board of Education Regular Meeting – April 15, 2021 230 the credit recovery issue. He would grant the 1 and 2F exemption to under classmen (no seniors) and process to be appealed through the counselor, which allows site discretion, as all students situation are unique. Member Weisberg asked if there are any other group of students dependent on a GPA outside of sports. President Frintner and Dr. Paramo explained that it applies universally to all extra-curricular activities. She felt that if students were not allowed to play sports for the remaining of the school year, students may be encouraged to improve on their grades. Superintendent Hill noted that students are eligible to practice, but not allowed to compete during games, which is the reason the State has allowed to waive the provision for the remaining of the school year. Member Weisberg was conflicted with deciding, if it were not a COVID year. Vice President Tabet agreed that this has been a tough year for all. President Frintner noted that grades are a graduation requirement. He felt that students who received 3 or more Fs shows that these students have failed to engage and that the credit deficit cannot be reached. He agreed with the hybrid decision for the 37 students with one F and felt that it would be difficult for those students with 3 or more Fs. Member Weisberg agreed and felt comfortable with waiving the provisions for students with 1 or 2 Fs. Member Ferguson noted that students with more than 3Fs were not engaged. He suggested that counselors meet with these students individually. Two or three Fs must be approved by the site, with 3 Fs being a rare exemption. President Frintner asked if it was possible staff would be able to assume the suggested process. Superintendent Hill and Dr. Paramo felt that Counselors, as well as students with 2 or more Fs, would be able to meet to discuss available options. He clarified that a decision for those students with 1 or 2 Fs would need to be made tonight to allow students to play at the JBHS/BHS game on April 16, 2021. He also highlighted that site and District staff have offered interventions to these students during the year to try to encourage learning engagement. It was moved by Steve Ferguson, and seconded by Armond Aghakhanian, that the Board of Education approve the item as amended to include site specific to review students with 2 or more Fs, consistent at both Burbank and John Burroughs high schools. The motion carried unanimously with the following roll-call vote: AYES – Frintner, Tabet, Ferguson, Weisberg, and Aghakhanian. 12.j Approval of Proposal between Burbank Unified School District and Burbank Community YMCA That the Board of Education approve the recommendation to award A Request for Proposal (RFP) to the Burbank Community YMCA, to provide child care services, effective July 1, 2021, as presented. Horace Mann and YMCA RFP 041521.pdf (OF 28,687) Peter Knapik reported that for several years, there has been a conversation about whether the District should continue to run the Horace Mann Child Care Center, which is a State of California licensed child care facility. The typical enrollment is about 110 - 120 children; however, during the 2020-2021 school year enrollment is at approximately 40 students. In 2019-2020, the infant room ages 3 months to 1 year of age was closed. Over the past three years, weekly fees were increased to reflect market rates. Rates had not been increased for more than seven years and District employees receive a reduced rate at the Center. The Center has annually run a deficit that has been offset by the District. As a result, The District had an interest in finding a new operator for the Horace Mann Child Care Center. A Request for Proposal (RFP) process ensued on February 1, 2021. The RFP was posted on the District's website and then mailed to child care centers within Burbank, including the RFP eligibility and programmatic requirements with similar State requirements. The District would provide the facility consisting of a school office, health

Board of Education Regular Meeting – April 15, 2021 231 office, staff lounge, supply room, up to 8 classrooms including an infant room, an auditorium, a playground, a boys and girls restroom, and an adult restroom. Current Center staff would be offered the opportunity to migrate as a District employee to the outsourcing organization employee. Salary and benefits will be determined by the selected organization. The first day of the program would be mutually agreed upon. The Burbank USD program would be operated through Wednesday, June 30, 2021. Further, the Center will have its own entrance. The Center has a parking lot available for use. The facilities at the Center will be maintained by the District including maintenance and grounds. Custodial services will be detailed in the memorandum of understanding that will be presented to the Board on May 6, 2021, for approval. Two proposals were subsequently submitted. An RFP review team evaluated the submitted proposals, held a meeting to review ratings, and then made a recommendation to the Superintendent to allows contracting with the Burbank Community YMCA to operate the child care program at the Horace Mann Children's Center. Clerk Ferguson requested that the formal Memorandum of Understanding include a statement requesting that the YMCA provide quarterly program and financial reports.
