North Bay Village VILLAGE COMMISSION BUDGET WORKSHOP MINUTES July 26, 2024, | 10:00 A.M. ZOOM/VIRTUAL ONLY MEETING ID: 892 0353 8420 | PASSCODE: 658811 1. Opening Items A. Call to Order: The meeting called to order at 10:01 a.m. B. Roll Call: Present at the meeting were the following: • Mayor Brent Latham • Vice Mayor Richard Chervony • Commissioner Goran Cuk • Commissioner Rachel Streitfeld • Christopher Wallace, Finance Consultant • Commissioner Andrew Rotondaro (Absent) C. Pledge of Allegiance: • The Pledge of Allegiance was recited. D. Invocation: None 2. Discussion Items 2A. Discussion and Review of the Village Proposed Budget for Fiscal Year 2024-2025 – Village Manager, Ralph Rosado, Ph.D., AICP Vice Mayor Chervony made the following preliminary observations before the presentation began: • The tax base has increased by $826,000, with most funds going towards employee raises and Cost of Living Allocations [COLA]. • He noticed very little change was made to expenses/costs, and almost $300,000 in reserve funds have been used to balance the budget. • All employee salaries listed have an increase of 3.5 percent hidden in another line, preventing the Commission from seeing actual salaries. The staff's proposed salaries for the whole FY are incomplete. • The Village’s retirement benefits vary by individual; that percentage increase is also a hidden line item/missing. • The comparison salary study was based on job titles, but scope-of-work, job descriptions, and job performance must also be considered.

Village Commission Budget Workshop July 26, 2024 Page 2 • The Capital Improvement Projects [CIP] section does not align with the data presented at the last budget workshop. In response to Vice Mayor Chervony’s comments/questions, Village Manager Rosado responded COLA was set at 3.5 percent by South Florida CPI. This amount was applied to everyone [Union/Non-Union], and merit raises were applied at 4 percent. Some of the revised salaries reflect the compensation study results, average salaries in South Florida, and suggestions from the Commission to increase salaries based on an employee's longevity. The COLA increase will take effect on October 1, and all other increases will be on the employee's anniversary date of hire. Mayor Latham made the following preliminary observations before the presentation began: • The turnaround time between the submitted budget report and the meeting time was too tight to evaluate the numbers presented properly. • He is thankful the millage rate remained flat, but $826,000 of tax revenue plus reserves is being spent in addition to an increase of $1 million dollars in spending. Much of this amount is going to salary increases • The proposed employee salary adjustments were too high, and merit increases must be based on performance, not job titles. He needs further clarification on how and why such significant increases are justified based on the flawed compensation study that lacked thoroughness. • He provided an example: The Communications Director oversees marketing, sponsorships, and events. These additional duties unique to the Village are not properly showcased in the compensation study and can lead to inadequate pay in certain circumstances. • The Capital Improvement Projects [CIP] budget was not updated. He noticed many outdated details, indicating that many approved and funded projects were incomplete. He said some items on the breakdown are no longer relevant. Commissioner Cuk made the following preliminary observations before the presentation began: • There have been positions that have been awarded considerable jumps in pay, and these specific cases need more expanded explanations as to why they should receive additional increases when the budget is finalized. • He echoed the concerns regarding the compensation study lacking a proper performance measurement tool. In response to Mayor Latham’s and Commissioner Cuk’s comments/questions, Village Manager Rosado said the compensation study included a “comparison of duties by titles in other comparable positions in Florida.” The salaries indicated on the Village’s report are the maximum of what an individual can earn. It is a figure to indicate how much a particular employee can expect if performance standards are met/exceeded. Three separate evaluation tools were sent to the Commission a few months ago.

Village Commission Budget Workshop July 26, 2024 Page 3 Christopher Wallace responded the following to the Commission’s comments: • Employee salaries do drive up the budget. Employee merit raises are calculated from the date of the anniversary. The budget was prepped to show a step increase as it is common practice across government positions. • The largest portion of your General Funds is allocated to Police per the Collective Bargaining Agreement. • The CPI considers economic inflation at 3.5 percent for sworn and civilian personnel. • The Village should want the tax base to grow; otherwise, you will experience pressure in your tax rate. There is a constitutional cap on the millage rate, and the voted debt service millage rate will decrease next year, declining the overall millage rate. • The Vice Mayor’s point on pension costs needs an evaluation to properly assess employee contributions vs. employer contributions. • The prior CFO has a record of each employee’s base salary, expected increases, and benefits packet attached to each position. Commissioner Streitfeld wants a more robust and transparent process for employee evaluations, deliverables, key performance indicators, and goals. She urged the Village Manager to consider hiring a full-time Human Resources Director. The Village Manager said interviews for the Human Resources Director are ongoing, and the position is included in the budget. The Fund Balance Chart: The FY 2023 audit is incomplete. The figures used were from FY 2022 because they contained a complete audit. The unreserved/undesignated fund balance was estimated at $1.9 million dollars. Mr. Wallace provided a line-by-line overview of the items. • 20 percent of the overall operating budget for emergency reserves of $2,351,004 has been established. • Development contributions funds will be transferred out of the General Operation fund. Mayor Latham concurred with the recommendation to move developer contributions out of the General Operation Fund and instructed that this should be done. He asked for a reasonable time frame to determine the General Operation Fund balance. Mr. Wallace replied that the fund balance should be easily obtained with certainty at any time. Subsequent fiscal years can complicate the process because forecasted expenses can take time to calculate.

Village Commission Budget Workshop July 26, 2024 Page 4 I. Revenues: It is based on the taxable value and can be amended based on 95 percent of collections; it also considers a 4 percent discount. III Millage Rate: Under Florida Law, minimum votes must be obtained depending on the desired millage rate. A Majority vote [at least 3] can adopt a 5.4668 maximum A two-thirds vote [at least 4] can adopt a 6.0135 maximum. A unanimous vote is required for anything higher. IV General Fund Departments Village Commission: Vice Mayor Chervony stated that the Chief of Staff position has already received a salary adjustment this year. A salary adjustment and title change were approved to retain the individual, shifting the annual salary from $50,000 - $55,000 to $75,000. He expressed discomfort in awarding another increase to $88,400 plus the COLA before the employee’s 1-year anniversary. He asked to see the most recent evaluation and list of responsibilities because the position generally does not serve the whole Commission panel. Village Manager Rosado explained that research had been done in other cities. He felt the $88,000 annual salary average was more reasonable for the duties related to this position. Additionally, the individual has met expectations satisfactorily. The Mayor stated that the title/salary change resulted in him losing an administrative assistant who only serves the Mayor; therefore, administrative responsibilities for the Chief of Staff position have decreased. The new structure of the position seems to work directly for and with the Village Manager rather than the Commission. He offered the Village Manager an option to reclassify the Chief of Staff again to a direct assistant to the Village Manager and/or allow the Commission to decide if they want a Legislative Aid or Assistant. Commissioner Cuk suggested that this position remain as Legislative Aid to support the Village Commission. Supporting the Village Manager is acceptable if the individual has additional bandwidth. He felt that the double-digit salary increase twice in one year was excessive. IV General Fund Departments Village Manager: • The Human Resources [HR] Director was added as a stand-alone position. The Village would offer a competitive salary to attract applicants. • The Chief of Staff to the Village Manager's proposed salary must also be competitive.

Village Commission Budget Workshop July 26, 2024 Page 5 Vice Mayor Chervony compared current HR's proposed salaries to previous years and highlighted the difference. He said salary should be commiserated based on experience. Commissioner Streitfeld recommended that the Human Resources Director prepare a memo outlining the next budget cycle's recommendation for employees' salaries. IV General Fund Departments Village Clerk: • Request to increase the Scanning Project to $30,000 from the Building Fund. There was a consensus to increase the budget to $30,000 for the Building Department’s files. • Explore the public notice software. Village Clerk requested between $5,000 - $10,000 to cover costs relating to implementing the new public notice system and Miami-Dade County’s advertising platform. Commissioner Streitfeld would like a more detailed explanation of the proposed software and why there are upfront costs. IV General Fund Departments Finance: The Village Manager seeks a competitive salary for the Chief Financial Officer. Commissioner Streitfeld suggested a national search for the CFO position. Village Manager Rosado ensured the opportunity was broadcasted as broadly as possible. IV General Fund Departments Legal Services: Vice Mayor Chervony stated how abnormally costly legal fees have been this fiscal year. • The Village Attorney agreed with the proposed budget. IV General Fund Departments Information Technology Services: Vice Mayor Chervony requested that the Information Technology [IT] Director's salary be increased to $135,000. There was a consensus to increase the salary to $135,000 or $140,000 and change the title to Chief Information Officer [CIO]. IV General Fund Departments General Government: • The Village Manager explained that the General Government Fund provided the proposed budget and salaries for the first-floor staff, lobbyist fees, and Village Planner. • The Village Planner’s budget has been reduced by $30,000 due to re-zoned and cleaned up ULDC. The property owners will cover the costs of the significant review conducted by the Village Planning Department. • Improved food quality and larger quantities when meetings/events need catering, resulting in a higher expense within this category.

Village Commission Budget Workshop July 26, 2024 Page 6 • Contingency: Village Manager Rosado said Commissioner Rotondaro asked for $25,000 related to the Island Walk to assist buildings currently in the process of opening the Walk. Commissioner Streitfeld suggested for Island Walk expenses to be a separate line item. o Village Manager Rosado added a Contingency line expense to IV General Fund Departments Village Commission section of the budget. o Commissioner Streitfeld wants to consider what support the residents can receive regarding the Island Walk. She also mentions that having Island Walk-related costs separate can clarify how much is needed for the proper marketing and maintenance of the Walk. o Mayor Latham reminded the Commission to be mindful about taking a preference over residents needing assistance and the reluctance to use public funds on private property projects. o Vice Mayor Chervony stated the actual property must also cover costs related to maintaining Island Walk. IV General Fund Departments Police: Village Manager Rosado explained that salary adjustments for the Chief and Deputy Chief of Police must be increased to match the pay rate other municipalities offer for the same positions. • A Commander's salary was adjusted to $138,000. • Deputy Chief Behar said a new lieutenant position was created to manage the accreditation process going forward, which is currently in process. • Commissioner Streitfeld asked if overtime was being addressed to mitigate such large charges. Deputy Chief Behar said increased staffing will decrease overtime costs. • Marine Time Officer – Part-Time/Line Item 17: Commissioner Streitfeld asked if changing the position from part-time to full-time would be possible. • Mayor Latham said to strive towards a goal where maritime patrol can be a priority and no longer compromised due to staff shortages. He wants long-term planning with the increased budget to stabilize the Police Department with staff and resources. Deputy Chief Behar: The line item needs to be adjusted to $57,000. Chief Noriega clarified that the goal would be a full-time position and 5-day coverage once the Marine assets are moved to the new dock. IV General Fund Departments Recreation & Human Resources: • Reclassify Special Events Coordinator to Assistant Director. • Budgeted expenses related to Treasure Island Elementary School [TIES]. • International Baccalaureate Program negotiated funds to a more modest amount. • Mayor Latham suggested negotiating with the City of Miami Beach for after-school tutoring costs.

Village Commission Budget Workshop July 26, 2024 Page 7 V Governmental Fund Debt Service: Mr. Wallace said these are general obligations outstanding for the General Obligation Bond. VI Special Revenue Funds Building Fund: Village Manager Rosado said that immediately after the completion of the audit, he will assess ways these funds can be used to fund the construction of Village Hall. Due to an influx of large-scale projects, this account is well funded. Commissioner Streitfeld suggested weekly or biweekly meetings with all ongoing construction sites. She urged building officials and project owners to expedite the permitting process. VI Special Revenue Funds Street Maintenance Fund: • Public Works personnel – maintenance staff. • Vehicle Lease fees • People Ready outsourcing fees/costs. • Landscape maintenance contract o Additional landscaping for various areas in the Village. • Miscellaneous repairs/maintenance and replacements. • Cost for lighting. o West entry sign VI Special Revenue Funds Transportation CITT: Vice Mayor Chervony recommended deferring discussion on this section because it does not reflect the sheets and figures from the previous Chief Financial Officer [CFO]. VIII Enterprise Funds Utility Fund: • Pass-through cost (tipping and pass-through fees from Miami Beach). Commissioner Streitfeld said residents complained that the inlet drain filters were clogged. An internal decision was made to remove the drains to allow water to flow, but the drains were never reinstalled. She was frustrated that this project was reversed. She recognized that Public Works was working to incorporate more advanced technology into Village drains to allow water to flow despite debris. Removing the drains resulted in a negative impact on the community. Vice Mayor Chervony commented on how street-sweeping efforts were unsuccessful. He said a vac-truck was budgeted. A more proactive approach must be introduced to reduce/minimize the debris clogging drains. In the most recent rainstorms, property damage occurred due to flooding. Vice Mayor Chervony said to focus on preventing flooding by keeping drains clear instead of hastily clearing clogged drains once flooding has occurred.

Village Commission Budget Workshop July 26, 2024 Page 8 Mayor Latham shared that most community feedback was negative when discussing street sweeping. The current drain systems are hazardous. We must balance protecting property and maintaining the integrity of Biscayne Bay during rainy months. The discussion will resume during the September Regular Commission Meeting. Enterprise Funds Stormwater Fund: After seeing rising costs, the Commission requested a Community Rating System update [CRS] on the September agenda. Village Manager Rosado said a lot of the reporting and work on the CRS are done in- house. Commissioner Streitfeld reminded the Village Manager that someone had been hired to advance the project and that she had not received any progress reports. No votes are taken during a workshop meeting. The Commission’s comments will be executed by appropriate staff and revisited in September. Overall, Mayor Latham suggested a “dip down in budget from top to bottom.” Vice Mayor Chervony stated that last year's millage rate was 5.7021. He asked how we could maintain the same rate without removing services. The millage rate cannot be raised; it can only be lowered. It was now 5.7062 on state forms. The employee salaries were significantly increased, but no other line items were removed/reduced to offset the cost, and the millage rate approved by the Commission [5.7021] was not the same as the figure submitted to Florida [5.7062]. Mayor Latham stated that the tax value increased. Reserves are also being tapped to cover the preliminary projected costs. 3. Public Comment: None 4. Adjournment ACTION: Commissioner Streitfeld made a motion to adjourn the meeting. Commissioner Daro seconded the motion, and it passed by unanimous voice vote. There being no further business to discuss, the meeting adjourned at 12:47 p.m. Accepted this 10th day of September 2024.
