CITY COUNCIL STAFF REPORT TO: Honorable Mayor and Council Members DATE: April 18, 2023 FROM: Cathy Mathews, Director of Administrative Services THROUGH: Kathleen Salguero Trepa, City Manager SUBJECT: Resolution 2023-22 Initiating Proceedings for the Annual Levy and Collection of Assessments Within the City of Winters City-Wide Maintenance Assessment District for Fiscal Year 2023/2024 and Ordering the Preparation of Annual Engineer’s Report RECOMMENDATION: Adopt Resolution 2023-22 initiating the proceedings for the annual levy and collection of the annual assessments within the City of Winters City-Wide Maintenance Assessment District for Fiscal Year 2023-24 and ordering the preparation of the annual Engineer’s Report. BACKGROUND: The assessments from the City's landscape maintenance district are used to maintain the City's parks, landscape areas, and electricity for street lighting. Under the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code, beginning with Section 22500 (hereinafter referred to as the "Act"), annual assessments levied after the District is formed must follow certain procedures. The City Council is required to take three distinct steps to proceed with the annual levy of assessments. First, the City Council must formally initiate the proceedings and direct the preparation of an engineer's report. Second, the City Council must take formal action to either approve or modify and approve the proposed engineer's report, formally declare its intention to provide for the annual levy of assessments and provide notice of a public hearing. Finally, the City Council must hold the public hearing and provide for the annual levy of assessments. This item takes the first step in the annual assessment process. The City has retained Willdan Financial Services to prepare the Engineer’s Report for Fiscal Year 2023/2024 and file it with the City Clerk who shall then submit the report to the City Council for consideration in accordance with Streets and Highways Code Section 22623. The City Council will consider the second step – the approval of the proposed engineer's report, a 10

declaration of its intention to provide for the annual levy of assessments, and the noticing of a public hearing – at the May 16, 2023, City Council meeting. ALTERNATIVES: None. The City-wide Assessment provides critical ongoing funding for parks, landscape areas and street lighting. FISCAL IMPACT: Last year, the City-Wide Assessment provided approximately $233,900 or 66% of the annual cost of maintaining the facilities within the district. While revenues increase as new homes are occupied, the revenue generated by the Assessment District does not fully cover the cost of maintenance services. ATTACHMENT: Resolution 2023-22 2 11

New Improvements or Substantial Changes in Existing Improvements. No new improvements are proposed to be added to the improvements to be maintained or serviced and no substantial changes in the existing improvements are proposed to be made for Fiscal Year 2023/2024. Section 3. Annual Engineer’s Report. Willdan Financial Services is hereby ordered to prepare and file with this City Council an Annual Engineer’s Report for the District relating to such annual assessment and levy in such District in accordance with the provisions of the Act, Article XIII D of the Constitution of the State of California (“Article XIII D”) and the Proposition 218 Omnibus Implementation Act (Government Code Section 12

53750 and following) (the “Implementation Act”) (the Act, Article XIII D and the Implementation Act are referred to collectively as the “Assessment Law”). Section 4.
