Police Chief Melanie Bevan, and Captain Brian Thiers, shared videos depicting recent fights and acts of violence along Main Street after 2:00 a.m. Mayor Brown said several business owners wanted work together to curb the violence happening late at night. He stressed the need for the City to protect the citizens and its police officers. Councilwoman Coachman was concerned that the law enforcement presence needed downtown may hinder the safety for the rest of the City. Captain Thiers and Chief Bevan agreed and gave examples of when officers were needed downtown and were not able to serve other areas of the community. Vice Mayor Barnebey voiced concerns with regulations in the City that allow bars to stay open until 2:30 a.m., as opposed to the rest of Manatee County where bars must close at 2:00 a.m. Councilwoman Kocher felt the City must make a statement that clearly that this type of behavior was not acceptable in Bradenton. She preferred to mandate the bars close earlier than 2:30 a.m. Councilwoman Gonzalez Moore also agreed that the City should mirror the County as far as mandating the closing time at 2:00 a.m. Paul Driscoll, Police Legal Advisor, announced the City would need to create policies and procedures to implement the ordinance. Mayor Brown recommended that City Council allow existing businesses to be grandfathered in and not charge them a permit fee. Chief Bevan added the Police Department wanted this process to be collaborative with business owners and residents. The public hearing was opened. Those that wished to speak were invited to the podium. James Miller, Owner of Cork’s Cigar Bar, said business owners wanted a safe downtown and suggested a new bar owner brought the element downtown. Larry Connor, downtown business owner, said in his ten years as a business owner downtown, he was very happy with the Police Department’s response to issues. He felt the permit could be a good thing, however, to fix the problem, the bar causing the problems should be held accountable. Joseph Bennett, owner of Pour Decisions, Craftails Speakeasy, and Bam Boozer, requested the Council to continue the public hearing to a future meeting so business owners could meet with City staff to discuss permitting requirements and costs of the permit. He felt the process was rushed and inquired about the permit fee. Nicole McKinnis, Attorney for Mr. Bennett, asked Council to fully develop the process prior to passing Ordinance 4047. She voiced concerns about the potential loss of revenue and information related to the Business Impact Statement.

City Council Minutes – 8-14-2024 – M. Whalen Page 4 of 9 The public hearing was closed. In response to Ms. McKinnis, Mr. Perry noted the cost to taxpayers related to all of the police presence needed downtown, including overtime and equipment needed for crowd control. There was a brief discussion regarding a grace period and fee resolution. MOTION TO APPROVE ORDINANCE 4047 WITH THE UNDERSTANDING THAT THERE WOULD BE UP TO A 35 DAY GRACE PERIOD AFTER THE ORDINANCE WAS APPROVED FOR STAFF TO CREATE PROGRAM REQUIREMENTS AND THAT CLOSING TIME BE CHANGED TO 2:00 AM WITH NO FEE FOR THE EXISTING BUSINESSES was made by Vice Mayor Barnebey and seconded by Councilman Cramer. Councilwoman Kocher reiterated that she would like to see changes sooner rather than later. Chief Bevan requested a longer grace period so that officers could educate business owners and create procedures for the program. Councilwoman Kocher inquired as to when the regulation would be in effect that businesses serving alcohol must close at 2:00 a.m. Scott Rudacille, City Attorney, said the grace period would begin when the ordinance was passed, however, the public hearing was not advertised as changing the 2:30 a.m. closing time. He suggested bringing a new ordinance forward, to revise the closing time for establishments serving alcohol. Vice Mayor Barnebey amended the motion to MOTION TO APPROVE ORDINANCE 4047 WITH A PROVISION THAT PROVIDES A 60 DAY GRACE PERIOD FOR ESTABLISHMENTS TO APPLY FOR A PERMIT, WAVE THE FEES FOR EXISTING ESTABLISHMENTS, AND THE UNDERSTANDING THAT AN ADDITIONAL ORDINANCE WILL COME FORWARD TO CHANGE THE CLOSING TIME FOR ESTABLISHMENTS SERVING ALCOHOL TO 2:00 A.M.
