MINUTES – OCTOBER 2, 2025 Page 3 of 66 REGULAR BCC AGENDA – Continued 8. Written Communication. I. Environmental Code Enforcement Lien Relief for Property Located at 1000 North "Q" Street Recommendation: That the Board review and consider the Lien Relief Request made by Charles Charbonneau of Clear Sight Properties, LLC, for the property located at 1000 North "Q" Street. On August 21, 2014, the Board amended the "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy, Section Ill, H2. Staff were instructed to review all requests for forgiveness and allow the County Administrator to act on the Board's behalf if set criteria are met. After reviewing the request for forgiveness of liens, staff made the determination that the request does not fall within the criteria that would allow the County Administrator to act on the Board's behalf and grant relief, in accordance with the Board's policy, "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy, Section III, H2. Specifically, for this particular request, in accordance with Section Ill, H.2., D., relief is not available to the requester because relief is not available to properties that are not free from any code violations. The requestor is seeking partial relief from 2315 West Gonzalez Street. This property at 1000 North "Q" Street is located in District 3. Motion: Move to accept $250 in exchange for a partial release on the “Q” Street property; the funds will be applied toward the General Fund and not the violating property For Information: County Attorney Rogers provided information about the Board’s options for action and Commissioner May advised that those comments were his motion. He later modified the motion to provide some narrative about how the collected funds would be applied. Commissioner Barry advised that providing lien relief is a courtesy and not intended to be a business model for future purchases. The Board also discussed potential changes in the practice of granting relief and their options for doing so. Made by: Commissioner May Seconded by: Commissioner Hofberger Disposition: Carried unanimously Speaker(s): Charles Charbonneau
