Do you have a contractor? You do have a contractor. >> You come out and the company, the company to contract the name okay. >> Yeah. I would just touch base with your contractor because we the zoning division sent out some comments that need some responses. So maybe just check in with your contractor to see where he's at and make sure that he's on target to keep this project moving. >> Okay. we look to you know, I think that I think that that defending champ. When I see the violation, call on the TV. I opened the app to public by my on 9. I think January this year. That and that I don't have the contracting. So I think what we're what we're trying to attempt to do today is continue this out to give you a chance to talk to your contractor about giving the city the information they've requested. And so we can complete the inspection process and closed the case out. OK? So, OK place August 20 August 27th at one 30 kind find violations at 105, 0.1 of can use it may to 26. >> No, we don't really have hearings on Thursdays. MS, only cities. We'll go next to City of Sarasota Scott W Pratt and Jamiel Bruschi. It's case number 2026 0, 0, 2, 1, 7, And for the record, no one's here on behalf of the respondents. So is the city's position on this case? >> Well, this is a continue case that we have for violation of our city code section 16 dash. 54 an inoperable unlicensed vehicle 16 dash. 49 skews May 16 dash. 49 be for overgrowth. 16 Dash 47 for the accumulation of junk rubbish and trash. And finally violation of our standard housing code. 3 of 5.1, 1, 0.2 for an exterior door that's in disrepair. Back on April. The 30th you imposed rather large fine and then we increase you increase the daily running fine to 2 50 back in June. And we've had no further contact or progress on these violations. So today we're just asking you to confirm the prior order and then to the case can be brought back at the request of either party. >> I'll do exactly that will confirm that my my prior orders and indicate the case >> I'll do exactly that will confirm that my my prior orders and indicate the case will be rescheduled. At the request of the respondents of the City of Sarasota. So to Metal close out on this case. All right. We're on record for city of Sarasota versus happy Rentals, Greater Sarasota LLC is case number 2026, 0, 1, 0, 4, 0, and for the record, your name, please. My name is Christine from Hunger. Well, the last and please. >> On second word H E C k e. And hacking. >> Sure. Mispronouncing now spend procedurally. always start with the City of Sarasota, Miss Kennedy Center for the city this morning and chill explain the city's position on this and they'll come right back to you, OK? Alright, MS Kelly. Whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of our Florida building code. One of 5.1 front interior renovation that was completed without permits, a proper permits. We do have building application permit application that was received back on June. The 30th and it looks like we received a trans middle on July. The 20th that still need some review. just looking to see if this pandemic has any sort of updates on the movement of the permit to get it approved and on track to working on this. believe, yes, use a little what he what do you do about the situation at this point? >> So I'm trying to get it resolved on, you know, via contractor. I think it took a little while to find a contractor who actually understood what needed to be dumb. Apparently this is fairly unusual. What happened was I was doing a rental turnover during that time, the pipes burst that created a whole bunch of issues with the house where it became, let's just do a complete turnover. I asked every single sub does this work require a permit and requires a permit. You need to pull a permit and apparently the plumbing sub forgot to include the water heater and on the HVAC ductwork sub did not pull a permit. I don't know why. And so then it became well. This requires a complete interior permit. But now the bathrooms need to be included. Whereas it had been my understanding and also the substance or standing because we didn't move anything and we didn't take a shower pan out that we did and remove a bathtub. were only doing tile and fixtures that this didn't require permits and then it at some point in the past before you bought this house, the garage was converted it without the permits. And clearly the kitchen has at some point in time being updated since 1972. So I was a little confused to say the on, you know why this is suddenly all coming up and same thing with contractors. I finally found the contractor. He remains a bit confused trying to resolve it. He had a meeting with Larry, I guess, hit a building department. There's some things last week because in the last transmission back from the city. They asked for things that are already there. So that is something about like a landing or a stoop outside of the door of the former garage. But it's already present. And and also there was an issue with they get insisting that the smoke alarm had to be moved because it was within 3 feet of the backed up in the smoke. Alarms are outside of the the, you know, the bathroom. So it's not within 3 feet of the bathtub. So there was a lot of can fusion him back and forts. And every time we need to have a revision and I have to as the engineer, it takes 2 to 3 weeks before he comes back with new has built drawing. So this is why this has been taking a little while the contractors. SOT or hit guy. You know, superintendent currently on leave. He's back next week. And I think the last thing that remains to be done is to add electrical outlets to the former garage conversion. And that should be done. Then they should be calling for an inspection and hopefully because the drawings have already been read them. Now. So you think you push this out? 30 days will be finished? I sure hope so. What about 38? Yeah. And then I just like to clarify since I did my notes yesterday, the plan is approved. So it's ready. It's will soon be issued. The permit will soon be issued. So you're moving right along better because that's great on But yeah, as soon as it's issued, then we can call an inspection. Basically the last thing they need to do is add those and I think they need. They said they may or may not need to replace the >> former back door to the garage. In which case, you know, they need to order that. So I don't know how long that takes. I think it's pretty standard So do we want to get 30 days? We find 30 okay. August the 27th to come back and hopefully close out the case that work for you. >> look, what time of day is better for you. Mornings or afternoons. On Thursday >> look, what time of day is better for you. Mornings or afternoons. On Thursday morning. 6 mornings. Okay. I have an 8.45 ahead have a 9.15. I even have an 8.30. >> Do 8.45. 45? Okay. We're going to go next. The city of Sarasota versus Sunny Robinson's trustee of CCS, our group. >> Lover, vocal. Trust UTV 4/25/2024 case. We have case numbers. 2026 0, 0, 2, 9, 4, And 2026 0, 0, 2, 9, 7, the record. The respondent. know, once you're on behalf of the respondents so city's position on these 2 cases. >> Thank you, your honor. This is a continue. These are both continue cases today for a >> Thank you, your honor. This is a continue. These are both continue cases today for a violation of the standard unsafe building abatement Code 3, a 1.4, >> Demolition of the structures on the property. >> 16 Dash 47 of the city code >> Demolition of the structures on the property. >> 16 Dash 47 of the city code for the accumulation of junk rubbish and trash. 3 of 5.1, 5 for a fence that's in disrepair. The demolition of the House. They have demolished the structure. So that current that by those violations, the first 5 violations are corrected as of July. The 21st. So we're good there, but we still have some trash debris from the demolition as well as the fence that's out of compliance right now for the second case, 2026, 0, 0, 2, 9, 7, That's 4.16, Dash 47 of the city code for the accumulation of junk rubbish and trash. That violation was corrected inspection on July. The 21st and then 16 dash. 49 see for overgrowth. 16 Dash 50 for an inoperable unlicensed vehicle and then section 7, 2, 0, 7, of our city zoning code for storage of vehicles on a vacant lot. So the only one that's correct it out of that one is the 16 Dash 47. I was hoping somebody would be here today to give us some sort of idea as far as the cleanup and the removal of these vehicles and things. But unfortunately, that's not the case. We'd be willing to push out the first one to give them another opportunity to clean up the rest of the trash and either repair or remove the fence. And then on the second one, I think we're They clean up the trash to maybe just continuing both of these out one more time to give them the opportunity to bring it into compliance. So we're looking at August the 27th at 8.30. Go ahead and adopt your outline of the violations. And I will continue both cases out to August 27th at 8.30. >> And maybe I shouldn't Representative for the responders required to attend the hearings. Hearings now take us off the record. >> I would go next. The city of Sarasota versus Gussie him case number 2026, 0, 0, 1, 2, >> I would go next. The city of Sarasota versus Gussie him case number 2026, 0, 0, 1, 2, 5, >> For the record does Jesse Lee is not president once you're on, does he leaves behalf so whats the city's position on this case? >> Well, this is a new case today for violation of our city Code. Section 16 Dash 47 >> Well, this is a new case today for violation of our city Code. Section 16 Dash 47 for the accumulation of junk rubbish and trash. 16 dash. 54 inoperable. Unlicensed vehicles. We also kind of think maybe they're selling cars out of the home. There's rotating cars frequently. So. I was hoping somebody would be here because both violations are out of compliance at this time to give us some sort of idea as to the time it's going to take to clean up. But unfortunately, that's not the case. And we do have an affidavit prepared since there's no one here that reflects an initial inspection of November. 3rd of 2025, the notice was mailed November 7 notice was served November 10th by Certified Mail. Compliance was set for November. 15th. The property is not currently in compliance. Civil fine began running on. November. The 16th of 2025. Through July 22nd of 2026. That's 249 days that $100 per day for $24,900.3, inspections at $390. The city is asking that you enter this affidavit into evidence as exhibit number one and the notice of today's hearing as exhibit 2 and to impose the fines and costs shown they're in. >> OK, admit one in and fund 60. 47 in 16, 50 the city code or continuing violations based on the affidavit, all and pose a civil fine of up to date of $24,900 in cost to date of 3.90, I'll start $100 per day daily running finds violation is corrected. a K through the dusty leaders required to attend the next hearing. What's available for us? >> August, the 27th at 9.15. >> All right. To out. August 27th at 9.15, am. think it's off the record. >> All right. To out. August 27th at 9.15, am. think it's off the record. We're gonna go back on the record for city of Sarasota versus gusty. Emily and ma'am, are you feeling? Got Okay, sir. New name rain on me. But but spell your first name our a E a R d. Bernardin hardly okay. All right. So we you hear now. So we want to go back on the record here with Typically what it is. I start with the City of Sarasota. This kid is going to explain the city's position on this and then I'll come right back to whoever wants to be the spokesperson. Okay. Okay. All right. This county whenever you're ready. >> Yes, your honor. This is a new case today for a violation of our city Code. Section 16 Dash 47 for the accumulation of junk rubbish and trash. And then 16 dash 50 4 inoperable unlicensed vehicles. As stated before that both of these violations remain out of compliance. And I'm so happy that this Lee is here this morning to give us maybe some kind of time frame as to when the property property can be brought into compliance. >> Marlee. You want to the talking here? We want see mislead doing. >> Well Yeah. do. Look at There aren't tag almost struck the vehicle, but now we finna get rid vehicles. Now, without that, I just lost my brother, the 17th of this month. So sorry, we're getting all that. All that go in that room. Trailing got to go on the stand and you have, you know, you had >> tag. Well, your vehicles you can put office. >> got hangs on that. But we >> tag. Well, your vehicles you can put office. >> got hangs on that. But we need to get him gone. Okay. So this year you're working on that. you may give me a timetable. How much more time you think you need about 30 days? I would do that. And that's why we had scheduled before. do. A had taken up the issue, fines and costs because no one was here. I thought so skip that. Part of was continued out to August 27th 9.15. The View Chance to do that if you can get it done. I think we're at the case up when you come back and rep relatively painless way. Okay. All right. Good to see you guys. They take here. think right? I want to go next to a city of Sarasota versus Sarasota Springs LLC and FT, Construction LLC that. >> Case numbers. A 2026, 0, 0, 1, 1, 0, and for the record doesn't respond. Know what your behalf of the respondents. So look that maybe there is a Jack doles and he remarked Mr. Clarke previously, today. So today cities a case that position on this. >> Well, this is our 4th hearing is to continue case today for a violation of our city Zoning Code section 7 dash 3.16, for the removal of 5 slash pines and then also section 7, 3, 25, which is the penalty for the removal without the permit, which came to $22,275. We've just been sitting waiting and it's my understanding that the mitigation plan that they submitted did not meet the city requirements. So we've been waiting on them to get a supervised plans so that we can move forward with this permit. And I know that they did have to get another contractor midway through. So it's it's been kind of a thing. But we haven't had any movement since it looks like March. So today I'm asking you to start $100 daily running fine to in the hopes that will get some movement on this. exactly what all do last >> $100 per day daily running fine to the violation is corrected by the violation of 7, 3.16, of the zoning code and 7, 3, 2, 5 rock continuing violations. indicator representatives required to attend the next hearing. Alright, so procedurally, what I was just always start with the city. Okay. I Kennedy's here for the city and then I'll come right back to Jokic. You explain it city's position today. Well, come right back to some. This can whenever you're ready. Thank you, Mr. Allison. >> Continue case that we have for violation of our city Code. Section 16 Dash 47 for >> Continue case that we have for violation of our city Code. Section 16 Dash 47 for the accumulation of junk rubbish and trash. That violation remains in compliance. As of our inspection on March. 5th, 3rd, 16 Dash 50 of city code for an inoperable unlicensed vehicle that remains in compliance as of our inspection on July, the 21st. So that was recently corrected. Then we have one of 5.1 of the Florida building code for a fence that was installed without a permit it looks like the permit was applied for back in 2025. July of 2025. >> And we've been waiting corrections for quite some time since July of really last year. So I just be looking and with that since we've had no movement. I did have the inspector prepare an affidavit and updated affidavit to give everyone an idea of where we're at on the fines and cost the potential civil fine and costs. Right now we're sitting at $28,500 and then 7 inspections at $690. So it's really important that we get this fence permit moving so we can get this closed out. So the that's his permit, the fence permit is the is the remaining issue. >> All right. let me to you and get your response here. And, yes, we've working on the permit. >> Delay was because the company for serving. The delay for some reason, they say to trying to get some information from the city and the city didn't send and the back and forward looking for. So finally, we have all the papers on hand right now. We're going to go get peak Haitian. We have all the papers they request. So we're going to right now some meat that the commission for permit. >> You how you feel how much time you think you've got a need to get submitted. >> We're going right now. They already have a permit applied for its just that we were needing something inside. The U.S. are all information mission. Some papers. >> So, so it's not 30 days or 30 days. You think go to 30 days, okay. All right. We've got August the 27th and I have a 10 to 15 that works. you just want to. >> Well, that's Can we a mother? Can we do it? That those violations remain in compliance. As of our inspection on December 23rd and then section 2, 3, or 4 be one of our city zoning code which defines household living as periods of tenancy greater than one week. And in Section 6 to be for permitted use any Tennessee less than one week is considered transient nature. And it's not a permitted use in the single-family zone district. Both of those violations were corrected with our inspection on July, the 21st. We're not being here on time or and appreciate your granting rehearing. This case is a torrid affair. A lot of Graham, a lot a lot of a lot of things going on, some targeting we've we honestly believe there some discrimination going on here as well. There's no question that. I believe back in February of. 26, there was it was a complaint that was filed by one of the neighbors. Know we there's a whole bunch of neighborhood drama and extort. It was then the neighbor to Kayla's right? Had a major confrontation with one of the inspectors based on on a complaint. And and I don't know how it transformed over to kill his property, but in any event killer, his and her family is that has been in this property for 10 years. There are 3 generation family. They've been excellent. I mean, they have father, Kayla and her husband and their 3 children all reside in this property. They have been excellent standing. Members of the community also And while they're not rich and all rest, that stuff, the rich unleavened and they've been great people, this particular property is a very unique property where it is. It was built pushback. We've been behind this property is a green space and there approximately only. And feet easement between the back of the property itself building and where the where the where the population there is no backyard. And with young children. She uses the side yard and the front yard with for them to play in all the rest of that stuff. And sometimes, you know, sometimes they leave their toys out a niche or ship things that sort of thing. So in any event in after the altercation of the inspector had with a neighbor other neighbors was building whole remodel without a without a permit. And it was a offer altercation. There. And we have a similar per Very ornery person across the street. We'll just call her miss a scratch. It because, you know, she's has more time looking on her front window and and complaining about the noise of the children than anything else. In any event. All of this drama is going on in the property itself. Kayla has not disturbed area family, not disturb anyone. There was a complaint with regards to then there's the property line whatever. And there was some milk crates on the one side and a little bit a fronds and things of which came from the neighbors from the neighbor's tree's. In any event, got a notification she approached at her door. She section do to fight of the of the of the violation. She says she would get to it or whatever the case may be and that that there's trampoline and some children's toys and there's a little fire pit with a sitting area in the front. Now, as I say, the Berkshire not rich people, but they but they use, you know, the toys are not brand new. And what has complained to be junk for some is what they have. It's what they can afford its what they. You know. So yes, sometimes the children lately them scattered or whatever. But, you know, Kayla, you know, has been notified. So we went ahead and did that. Now I've been very, very on it. out there all the time, trying to make sure you keep it nice. >> So in any event I I didn't get notified anybody. And I think the inspectors, one of the inspectors names was an A in any event. She called me she called me. I believe in March. And she said, well, okay, I'm calling you because there's still some, you know, we had approached the tenant the months before whatever the case may be. >> And there's still some milk crates onto that are parked on the side of the house and said, well, those are kind of like the sand things that the kids used to play with, right? So she well, we consider them junk and and you have, you know, you have to remove them. And I said that's no problem at all. I went the very that very day. I drove up can help me. Logano creates into that into my pickup truck. I called them night and I took them away. I then phoned back notified her that, hey, listen, I'm all done that. I sent her a picture of the milk crates being gone. She goes okay. That's great. She goes well, we'll go back and re-inspect, OK, traffic. I didn't hear anything out anything else. Again. Then another day they appeared. Obviously they're still complaints going back and forth between a strawman, the neighborhood misses scratch and all the rest of these people that people next-door building without a permit and trying to claim half of the front yard for Kayla's work analysts because of got the paver whose not licensed to go ahead and re. Do the survey put fake survey stakes and to try to claim and kicker, you know, get all of flags on property. and so all of this is going on sure enough the next day. 2 more inspectors appear at the at the property and I believe there was some another confrontation between the neighbors and the inspector. Anyway, we knew we were doing done for. In any event. >> Long, long. Behold. >> You know, I again another call from and talked and again, a shovel. What's the >> You know, I again another call from and talked and again, a shovel. What's the issue is said, is it about property line because they're claiming half of our front yard is being their property line week. I said that's how what is going on here. She says why we can't say we're not at liberty to say who's filing the complaint. But were there and they were training another individual or whatever the case may be in and hits at the can we go to break up all the leaves and all the rest of and complied with everything and it's not like we haven't been trying to do everything but every time that sent and then and then and I said, well, Kayla, can you please take some photographs? Just that the yard, you know, because we got all of this. She asked this inspector she could have 2 or 3 weeks with which to clean up, you know, leaves and all the rest this stuff because it was there's there's some oak trees then they all could accumulate on the yard. We went ahead and did that in April. She went ahead took some photographs in fact, there's the the photographs here and the date stamps on because she had sent them to me and then I forward them on to the. On to the inspectors. Well, and they said they would go ahead and do that. This is back in April, the beginning of April February. This is April after clean the and >> and so in any of it and not with those review that those trampoline. >> All that stuff is completely gone. >> And that was at the very beginning and not and those weren't after. What you're seeing there is march. >> And in any event, it was stroller is on everything's gone. So and then show nobody you didn't hear anything again. And then sometime in May. I believe we've got a notice that there was going to be hearing. >> kind of going you know, he's everyone's doing their best. I mean there. They've >> kind of going you know, he's everyone's doing their best. I mean there. They've got 3 generations working. >> They've been amazing people. They've been good members of tea. yeah, I get it that that were caught in the crosshairs of a neighborhood. You know, feuds all the rest of that stuff. But honestly, you know that we in, of course, and we got the adjudication. You know, results because I was in the hospital at the time to say there was going to be an $8400 fine. And I'm sitting here going well. So we're penalizing the people that can least afford it for what per se just think. To me. It's a travesty. I really feel that, you know, granted, if the city has got expenses, could we have to pay for the inspectors and we have to comply and we have $390. have no problem. You know, picking that have out. I think that there should be a fine levied against no, I don't think so. And that's that's our position because it's just. At some point there's to be some bonus of people trying to do the right thing and and look at. They are limited. They have, you know, did they have time period there where it was that they had to actually clean up in life was overwhelming for a few for a few weeks for them. Yes, I believe yes, absolutely. But did did they comply early and were our request for going back for re inspections ignored? Yes, they work, which confrontations between the city and the other neighbors that put us in the crosshairs. Yes, all of these things and I think it's led to just a travesty here. >> I personally did all the cleaning myself. So, yeah, it did take some time. It was >> I personally did all the cleaning myself. So, yeah, it did take some time. It was just me. So I did what I could as much as I could. And but now it looks much better. And I just, you know, and I just want to do it every in so far as the photograph of of what was on the screen with regards to. the. >> Our unit for Sammy the father who a good line share of the rent there. But he from time to time every every Thursday he would instead of trying to make the drive from Miami through Jacksonville, he would park his truck in the driveway, scrub a few hours, the state and then move the power unit out just because it was just convenient. It just so happens that on one of the days of the inspection that power unit was there. But it's not there on a regular occurrence and and it's just something which subsequently found another place for him to park. I just really hope that we throw this at the mercy of the city to say, hey, please, can you work with us to? So that were not kind to, you know, add fuel to the fire and say, hey, you know, good people are going to be punished here. All right. I appreciate that. >> I I'm just looking at the violation. I I suspect a lot of the VI find had a lot to do >> I I'm just looking at the violation. I I suspect a lot of the VI find had a lot to do with a no show because I typically presented with an affidavit and there's nobody here to read. But that's what's But let me hear from the city have a chance to review this. Yes, we have. >> I do want to just say a couple things in response to Mr. If you thank you for thank you. There is no targeting on the part of the city. Maybe there's something going on with the neighbors. That's not under our control. The other part is if you want to know who made the complaint, all you have to do is call us and we'll either you can put in a public records request or will give that to you it. It is all open to everybody. So that was and again, if you go back and you look at the screen here, Mister Ellis. Whether it was the truck or something else. It's been something with this property for a very long time. So and while the $8400 is because of the no show we would be open to a reduction. I think the city is looking for maybe $100 fine and then the city to recoup its costs of 3.90. So the taxpayer doesn't bear the burden for this process. Use a 10800 Google plus the cost. All right. So get your response to that. I think that's more than fair. Given the number of complaints know the rest. I do by myself and I cannot. and I do submit any document in that. In moment that and then in down. Moments ago, I have I had the gun. Got the name fall bet. But something in center Sorry. I don't remember name. Okay. Right. >> So think the city would be comfortable pushing it out about 30 days just to make sure that process continues to move forward. Let's send it may be for an afternoon appointment since Israeli early there. How about August? The 27th at one 30 in the afternoon. Our time. >> Do 8.45. 45? Okay. All right. That's exactly what I'll do. I'll continue the >> Do 8.45. 45? Okay. All right. That's exactly what I'll do. I'll continue the case out. 8/27/2026 at 08:45AM. fund violation 105, 0.1 continuing at this point. We'll see you then hoping wrapping up today. Yes, if thank you. Good luck thank you. Thank you.
