CONSENT CALENDAR - STUDENT LEARNING & ACHIEVEMENT Type Action (Consent) Preferred Date May 24, 2023 Absolute Date May 24, 2023 Fiscal Impact Yes Dollar Amount $24,472.00 Budgeted Yes Budget Source Non-Public Agencies / Non-Public Schools Recommended Action Authorize staff to approve additional funding for Non-Public Schools / Non-Public Agencies for 2022-2023 school year. Background At the August 24, 2022 Board Meeting Special Education requested authorization to enter into agreements with Non- Public Schools (NPS) and Non-Public Agencies (NPA). We also stated that we would return to the Board to request authorization for increases in prior contracts or for new contracts if the need for service support providers increases and/or additional Non-Public School placements are agreed upon through the IEP process. Current Status We currently have 2 students who will be placed in a Non-Public School setting. At this time, Special Education is requesting an authorization to enter into an agreement with the NPS listed on the attached report. Funding was previously approved at the June 29, 2022 Board Meeting. The cost of this new request is included in spring budget projections. Even with additional contracts coming to the Board, we do not anticipate that we will exceed 2022/23 NPS/NPA projected costs. As a point of reference and perspective, pending approval of tonight's agenda item, we will still be under the budget allocation for this year. The chart below shows the estimated totals. For NPA/NPSs this year, the following budgeting information is provided: Adopted Budget Encumbrances Expenditures Balance $15,184,190.00 $4,702,422.00 $9,193,119.00 $1,288,649.00 Policy Implications The proposed action is consistent with Board Policy 6170. CONSENT CALENDAR - FINANCE/FACILITIES Subject 11.1 Quarterly Investment Report Meeting May 24, 2023 - Regular Meeting of the Board of Education Category 11. CONSENT CALENDAR - FINANCE/FACILITIES Type Information Background In compliance with Government Code Section 53646, the Fremont Unified School District presents the investment report to the Board of Education on a quarterly basis. The Government Code 53646 (b)(1) cites: The treasurer or chief fiscal officer may render a quarterly report to the chief executive officer, the internal auditor, and the legislative body of the local agency. The quarterly report shall be so submitted within 30 days following the end of the quarter covered by the report. This report shall include the type of investment, issuer, date of maturity, par and dollar amount invested on all securities, investments and moneys held by the local agency, and shall additionally include a description of any of the local agency's funds, investments, or programs, that are under the management of contracted parties, including lending programs. With respect to all securities held by the local agency, and under management of any outside party that is not also a local agency or the State of California Local Agency Investment Fund, the report shall also include a current market value as of the date of the report, and shall include the source of this same valuation. Education Code Sections 41001 and 41002 generally provide that all money received by or apportioned to a school district shall be paid into the county treasury “to be placed to the credit of the proper fund of the district." School districts in Alameda County deposit all of their funds to the Alameda County Treasury. The County Treasurer makes investment decisions for the school districts, which is a common practice statewide. School district funds on deposit with the county treasury, along with funds deposited by other agencies, are placed in a County “investment pool”, called Pooled Money Investment Account (PMIA) and profits and losses realized from these invested funds are shared among the pool participants in proportion to the amount invested. Current Status The attached exhibits show the quarterly report of investments by PMIA. The table below shows Fremont Unified School District's share of these investment pools: Instrument FUSD Investment Market Value as of January 31, 2023 Average Maturity of the Portfolio (days) Annualized Rate of Return Pooled Money Investment Account (PMIA) - EXHIBIT A-1 $ 401,254,682.35 477 1.860% The 1.860% annualized rate of return represents the average earnings (annualized) of the Fremont Unified School District cash in the pool. The amount generated from the pool has been accounted for in the District's budget under local revenue (Interest Income) for each fund. Policy Implications As per Government Code Section 53646 Prepared by: James Arcala, Director of Budget, Audit, and Attendance File Attachments Exhibit 1 - January 2023.pdf (1,678 KB) Subject 11.2 Accept Gifts to Fremont Unified School District Meeting May 24, 2023 - Regular Meeting of the Board of Education Category 11. Background Education Code §35160 authorizes school district Governing Boards to initiate and carry on any program, activity or act otherwise in any manner that is consistent with or not preempted by any law and that is not in conflict with the purpose for which school districts are established. Acceptance of gifts to the school district is within the permissive authority granted to Boards of Education in the permissive code embodied in Education Code §35160. CONSENT CALENDAR - FINANCE/FACILITIES Type Action (Consent) Preferred Date May 24, 2023 Absolute Date May 24, 2023 Recommended Action Adopt amended Resolution #040-2223, authorizing staff to submit an application for the Carl Moyer Program School Bus Replacement Grant for Fiscal Year (FY) 2023. Background On May 10, 2023 , the Board approved staff to apply for grant funding to replace fourteen (14) diesel school buses with fourteen (14) new electric school buses and associated infrastructure through the Carl Moyer Program (CMP) offered by the Bay Area Air Quality Management District (BAAQMD). It has since been determined that additional vehicles would qualify for replacement through this grant opportunity. Current Status The District owns a total of thirty-five (35) diesel school buses that would qualify for grant opportunities under this program. The District will apply to replace the diesel buses with thirty-five (35) new electric school buses and related infrastructure. If approved, this grant opportunity will pay for one hundred percent (100%) of each vehicle, up to a maximum of four hundred thousand dollars ($400,000) per electric bus. The grant will also fund one hundred percent (100%) of any infrastructure cost for charging stations for electric buses. It is anticipated that there is additional potential positive fiscal impact for reduction in maintenance costs due to new vehicles being under warranty. This grant opportunity requires a Board resolution to apply. Resolution #040-2223 has been amended to reflect the revised number of vehicles. Staff recommends that the Board authorizes the submission of the Carl Moyer Program School Bus Replacement Grant and adopt amended Resolution #040-2223. Background The City of Fremont and the Fremont Unified School District have a long history of working collaboratively to provide safe and secure school facilities. Collaborative efforts focus on ensuring that schools are safe for students, staff, and the community. The School Resource Officer (SRO) program has been a cornerstone of the cooperative efforts between the City of Fremont and the Fremont Unified School District to provide safe and secure facilities. Recently the School Resource Officer Unit was nominated and received the National Association of School Resource Officers (NASRO) 2022 Model Agency Award. On June 28, 2017 , the Board of Education authorized the Superintendent to enter into a Memorandum of Understanding with the City of Fremont for School Resource Officer Services for seven years, 2017-2024, which also outlined the District's 50% annual share of the cost of the School Resource Officer program, and that such costs may be adjusted based on the outcome of the City of Fremont employee negotiations and that such adjustments would be reported to the Board in a future consent agenda item. The SRO program was terminated by the Board in November of 2020 and reinstated with a revised MOU and Handbook in July 2021 ; the MOU, effective 2021-2023, was further updated to reflect necessary legal language in November 2021 . In addition to on-site officers at high schools, the Fremont Police Department provides a variety of services to schools and staff, including supervision of sports and athletic activities, response to emergencies, and supervision of special events. Current Status The existing MOU expires at the end of June 2023, and staff is recommending renewal of the MOU for an additional three years of SRO services. In addition to the input received last year by the Fremont Police Department from the NAACP and Evident Change, FUSD staff sought input this year from the following groups: TK-12 site principals, the FUSD/ FUDTA Discipline Committee, and the FUSD Equity Team. The feedback generally fell into three categories, 1) Cost, 2) Clarification of MOU terms, and 3) Operational feedback for the program. The feedback provided by FUSD site principals and committees, along with anticipated feedback during the end-of-the-year presentation, inclusive of data trends, will be carefully reviewed and discussed by District Administration and the SRO Command Staff to ensure that our practices and continued program development best meet the needs of all FUSD students and staff. Both the SRO Unit and the FUSD Leadership Team have a shared commitment to continually improve the SRO program in service of our schools and community. This is a multi-year agreement between the Fremont Unified School District and the City of Fremont for SRO services that acknowledges the comprehensive set of laws and regulations that each agency must follow in their respective scope of work to support students, staff, and the community. The MOU outlines the District pays for half of the annual operational costs of providing the SROs’ salaries and benefits, with the City paying the other half of the SROs' salaries and benefits in addition to the full cost of the SRO Sergeant’s salary and benefits, as well as the costs to fund overtime, vehicles, and equipment. The MOU provides that either party may, without penalty, cancel the agreement with 30 days' notice. Attached for review and reference are the proposed MOU and the examples of feedback received. REGULAR AGENDA ITEMS Type Discussion, Information, Presentation Background The Fremont Unified School District’s current Long Range Facilities Plan (LRFP or Plan) was adopted by the Board of Education on January 29, 2014 . The Plan identified approximately $1.6 billion in facility projects at that time. On June 3, 2014, the voters of Fremont approved the $650 million Measure E general obligation bond initiative. On October 28, 2020 , the Board authorized staff to enter into an agreement with AE3 Partners (AE3) to assist the District with updating the 2014 Plan. This work includes a facilities assessment and condition report along with a prioritization of potential projects. AE3 was forced to suspend some of their work while schools engaged in distance learning during the pandemic, and this was further delayed when the focus of all staff was geared toward reopening schools for August of 2021. Along with the work being performed by AE3, District staff supported the Facilities Advisory Committee (FAC) in their effort to draft a set of goals and priorities for the final version of the Plan, which is still in development. Current Status Tonight, staff would like to present the Board and the Community with an update on the work accomplished thus far and the current focus areas for staff and the FAC on the Long Range Facilities Plan. As part of tonight's update, the Board will be provided with information on the following: Update on AE3 data collection and draft formatting of school site-level information. Between now and the end of July, District Staff from Facilities and Maintenance are visiting all of the school sites to verify that the work that is listed in the dataset from AE3 still needs to be performed as presented. Attached to this agenda item, AE3 has provided a draft school site summary so the Board can see what the LRFP will look like. FAC Chair Bryan Gebhardt will provide the Board with a summary of FAC’s advisory input on the goals and priorities the FAC believes should be considered in the final LRFP. The Board is asked to provide feedback to staff and the FAC on the following: Feedback on the goals and priorities important to the Board on the continued work of the Plan. Feedback for the FAC, if needed, on their advisory input regarding goals and priorities Feedback on suggested changes, if any, related to goals and priorities of the Plan. This feedback will guide the final phase of work for AE3, staff, and the remaining conversations with FAC as the Plan moves toward the completion of the full draft. As the final draft version of the Plan is completed, the Board will again be presented with information and an opportunity to provide further feedback and direction for AE3, staff, and, as needed, the FAC.
