Prepared by: Sherry Gladin, Assistant Superintendent, Business Services Staff Analysis: At its September 27, 2022 regular meeting, the Board of Education ratified a Purchase and Sale Agreement with Kern County Board of Education, in the amount of $2,250,000, for property located at 222 34th Street in Bakersfield ("Property"). The Property consists of three contiguous parcels (APNs 120-290-10, 120-290-11, and 120-290-12) and totals approximately 4.05 acres. Located 1.3 miles from the District's main administrative building, the District intends to utilize the Property for specialized services for children, infants to preschool age, and administrative offices. Since the Purchase and Sale Agreement was ratified by the Board, District staff conducted inspections of the Property during the 90-day contingency period, which ended on November 28, 2022. The inspections revealed that repairs will be needed prior to the District occupying the Property. In particular, repairs to Building C and replacement of the sump pump and security fencing are needed. In addition, the District will be compensated by Kern County Board of Education for theft of some HVAC equipment and suspected vandalism occurring during the contingency period, which District staff is currently negotiating to occur outside of escrow. Despite the needed repairs, District staff believe that the Property is suitable for the District's intended purposes and recommend acceptance of the Property. Pursuant to the Purchase and Sale Agreement, the purchase is in the property's "as is" condition. Close of escrow is set for December 28, 2022. On or prior to the closing date, District staff authorized by the Board will need to execute a Certificate of Acceptance in accordance with Government Code 27281 and other documents necessary to complete the purchase of the Property.
