AN ORDINANCE OF THE MAYOR AND COMMISSION OF NORTH BAY VILLAGE, FLORIDA, AMENDING SECTION 8.12 “BONUS HEIGHT” OF THE UNIFIED LAND DEVELOPMENT CODE TO PROVIDE FOR THE APPROVAL OF ADDITIONAL BONUS HEIGHT IN CONNECTION WITH PUBLIC WATERFRONT ACCESS AND OPEN SPACE FOR ENHANCED ACCESS TO THE ISLAND WALK AND IMPROVEMENTS TO EXISTING PUBLIC PARKS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR AN EFFECTIVE DATE - INTERIM VILLAGE MANAGER FRANK ROLLASON (VILLAGE PLANNER SILVIA E. VARGAS, FAICP). Village Clerk Alba Chang read the Ordinance title on the official record.

Regular Commission Meeting December 10, 2024 Page 3 Mayor Streitfeld asked Commissioner Acosta to reiterate her reasons for wanting the item deferred. Commissioner Acosta shared concerns over the holiday travel period, which caused many residents to miss this meeting and the opportunity to express their views. Secondly, a petition was passed around Harbor Island signed by residents who opposed a new construction project. Finally, she would like the Development Review Committee [DRC] meeting to occur before the Ordinance's first reading. Mayor Streitfeld explained that this Ordinance is not tied to a specific project or property but ratifies the Village’s Code on minimum acreage around a building. The DRC is a meeting between a property owner and Village staff. It is not a venue for open forum discussions. The DRC will consider aspects of the proposed site plan application and other technicalities. Commissioner Chervony echoed the Mayor’s comments by reiterating the Ordinance applies to potentially increasing building height requirements on Treasure Island and Harbor Island for current and future construction. The Ordinance restricts this height increase to projects with more than 3.5 acres and must have waterfront views. The new buildings will eventually and potentially lower taxes for current residents. Commissioner Chervony explained that the petition represents less than 6 percent of residents and was based on incorrect misinformation. He mentioned the processes and studies that are mandatory for every construction project in the Village. The TDR rate will remain the same, and the Village needs more recreational and shopping options for its residents. Vice Mayor Cuk expressed his desire to discuss the item tonight. He said all developers are encouraged to engage the public in a Town Hall at the appropriate time. Commissioner Rotondaro said the number of dwelling units on each project remains steady according to the TDR requirements and that building height has zero correlation with the number of people a particular building can accommodate. The passing of this Ordinance will improve views and add green space to the surrounding area. He wants to increase the required green/public open space from 7,000 square feet to 15,000/sq. ft. Village Planner Silvia Vargas emphasized that a site plan would not be reviewed during this meeting. The Ordinance will only apply to properties in specific areas: RM70 is located on Harbor Island, and CG is on the Kennedy Causeway south of Treasure Island. The site must have the appropriate acreage, earn the approval of TDR, and have already maximized existing height bonuses. The extension is 188 feet over the current height limit of 312 feet. Regarding the Village’s options for public amenities, we are currently underserving our residents. To meet this need, new construction endeavors will have mandatory requirements to provide public spaces for recreation and waterfront views, including maintaining these spaces in perpetuity. The language contains item B3, which incentivizes project owners to create public waterfront spaces in exchange for bonuses/offsetting costs otherwise dedicated to Village fees. Secondly, it secures funding for the Village's public recreation programs. During the October meeting, the Planning and Zoning Board unanimously approved this amendment. Mayor Streitfeld said she wants to maximize the benefits the Village can receive in exchange for a high-rise building and proposed increasing the green/public open space areas to 20,000 sq. ft. She also requested that language mentioning “mini park” or “pocket park” be reworded.

Regular Commission Meeting December 10, 2024 Page 4 Village Attorney Anthony Recio said the increase in square footage impacts the offset amounts. Village Planner Vargas said the square footage has no bearing on the Island Walk space required by all waterfront sites. Village Attorney Haydee Sera noted revising the second reading to state that the Parks Enhancement Contribution Fee will not be credited against Park Impact Fees. ACTION: Commissioner Chervony made a motion to approve the proposed ordinance on first reading with the following amendment: 1. Research the impacts of increasing green/public open space areas to 15,000/sq. ft. vs. 20,000 sq. ft. 2. Remove language that references “mini/pocket park” . 3. Add language to clarify that Park Impact Fees are ineligible to be offset or waived. Vice Mayor Cuk seconded the motion with the condition that the Village maximizes its return when it comes to offsetting fees to the project owners between the first and second reading. Upon a roll-call vote, the motion passed 4-1, with Commissioner Chervony, Vice Mayor Cuk, Commissioner Rotondaro, and Mayor Streitfeld voting for. Commissioner Acosta voted against. 6. Advisory Board Minutes / Written Report: NONE 7. Village Commission’s Report • Commissioner Andy Daro: Commissioner Daro praised all involved in the seal coating on Harbor Island and said he is very happy with the outcome. He said the sidewalk improvement endeavor would begin in early 2025. • Commissioner Richard Chervony: Dr. Chervony said the Florida Department of Transportation (FDOT) will complete all enhancements/upgrades to the bridges leading into North Bay Village by the end of December. These repairs should last another 20 years before maintenance is required again. The flat bridges will undergo maintenance and upgrades in 2029 and are in the second design phase. The Treasure Island Elementary School (TIES) Community Center is scheduled to break ground in the second quarter of 2025. The new Village Hall and Safety Complex will break ground in early 2025 and is estimated to be completed in one year. Stormwater filtration and pump systems will be installed on all three islands. Art in Public Places efforts continue. Memorandums of Understanding are being drafted to partner with the City of Miami and Miami Beach to increase Causeway safety. The Village Police Department continues to work towards minimizing crime and improving public safety.

Regular Commission Meeting December 10, 2024 Page 5 He said some of the comments on social media are incorrect and/or misleading and encourages all residents to contact the Village at any time to voice opinions or concerns. The Palm Tree Club and accompanying hotel have been redesigned to be a more modern place for residents and visitors. They have also addressed the noise complaints some residents expressed. He also mentioned that nothing was granted to the Palm Tree Club for free, and they paid for all necessary expenses/fees required to open/operate. Finally, he thanked all staff for repairing the Hispaniola Avenue pump and urged the residents to join an advisory board and participate actively in their community. • Commissioner Doris Acosta: Commissioner Acosta expressed her support for all Village members and wants to participate actively in the ongoing initiative to make North Bay Village the best place to live. She praised the work in repairing/restoring the sidewalks on Treasure Island. In the short term, she is interested in organizing an art exhibit to promote awareness of social and environmental causes. Finally, she urged the community to actively attend meetings to alleviate the spread of misinformation and learn more about what the Village is working towards. • Vice Mayor Goran Cuk: Vice Mayor Cuk congratulated Mayor Streitfeld and Commissioner Acosta on their recent election victories and thanked various community members and staff for their efforts and participation. Palm Tree Club: He agreed that the noise level was excessive and reassured everyone that measures are being taken to muffle music and noise at future events. • Mayor Rachel Streitfeld: Mayor Streitfeld added to the Vice Mayor’s comments that the Commission does not have authority to grant permits within the Village but can set parameters within permits for staff to follow. She mentioned how the Village has a new hotel available for visitors. She expressed pride and appreciation for the success of recent public events hosted by the Village. She announced that the Village would offer free theater and art classes to 60 North Bay Village children, thanks in part to the Children’s Trust. She requested updates from the Village Manager on the following matters: ∗ 1666 Kennedy Causeway Garage: A structural engineer is creating a plan to repair the deemed unsafe structure. The ETA for some ground floor repairs is expected to be February/March 2025. The second level will be restored in sections. ∗ Treasure Island Roadway Paving: The plans have been completed and will be presented to the Commission in January 2025 to approve the piggyback contract before the bidding process launches. Mayor Streitfeld said to make this project a priority. ∗ Treasure Island Cove Lighting: The Village is attempting to get FPL to install a light on the public side of the street. 8.
