Vice Mayor Cramer was excused. BUSINESS/ADVERTISING, PETITIONS, HEARINGS & COMMUNICATIONS: a) Planning & Community Development: Quasi-Judicial: Resolution 25-57 - PUBLIC HEARING - Presentation Upon Request A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRADENTON, FLORIDA, GRANTING SPECIAL USE PERMIT NO. PLN-SUP-24-0009 TO PERMIT A SIDEWALK CAFÉ WITH ALCOHOLIC BEVERAGE SALES FOR PROPERTY LOCATED AT 440 12TH STREET WEST, BRADENTON, FLORIDA (PARCEL ID NO 3318900002), IN THE T5 URBAN CENTER TRANSECT ZONING DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OR PRIOR RESOLUTIONS IN CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. Greg DeLong, Planning and Community Development Assistant Director, explained that Joseph Bennett with The Brown Bag restaurant submitted a Special Use application requesting permission to allow a sidewalk café with alcoholic beverage sales at 440 12th Street West. He stated that the property received approval on November 17, 2004, which permitted two tables on 12th Street West and six tables in the adjacent alleyway. Mr. DeLong explained that the owners were proposing two tables in the front and five tables in the alleyway, which is a reduction of what was approved before. Inside the establishment, he continued, there would be five tables and 20 chairs; however, no bussing or hostess station would be included. He concluded that the applicant requested to keep all of the outdoor furniture stored outside in the alleyway up against 440 12 th Street West. “STAFF COMMENTS: 1. City Council is encouraged to evaluate the request based on the provided criteria, as well as input from staff, the applicant, and the public. 2. It is in staff’s opinion that the request is found to be consistent with the intent of Section 3.3.2.5 of the Land Use Regulations and the Design Element of the Comprehensive Plan. The Planning Commission met on May 21, 2025, and recommended to City Council Approval (vote 5-0) of Resolution 25-57, Case PLN-SUP-24-0009 with the following stipulations: a. The sidewalk café is permitted no more than 7-tables and 28-chairs. b. The approved Resolution, including the approved site plan and conditions shall be on display and accessible on the Property during business hours. c. Within 30 days following the approval, the Property Owner shall execute an Indemnification Agreement in a form acceptable to the City. d. After the business is closed, all furniture (7-tables and 28-chairs) must be stored in the alleyway located to the south of the building. The tables shall be placed adjacent to the building unit and the alleyway gates shall be secured when the business is closed. e. Clear pedestrian access on the public sidewalk of no less than 5’ shall be maintained at all times in a way that neither seating nor tables affect the ingress/egress of travel, the safety or pedestrian and traffic circulation.

City Council Minutes – 06-11-2025 – M. Whalen Page 4 of 9 f. The property/business owner shall obtain all State licenses permitting the sale of alcohol as part of the sidewalk café. g. Any cleaning solution used to clean the sidewalk café area shall be approved by the Bradenton Public Works. h. Any future increase in seating for the sidewalk café area shall be approved by City Council.” Mr. Perry voiced concerns about furniture storage, Americans with Disabilities Act (ADA) requirements for clearance, security factors regarding closing the gates to the alleyway, access to the parking lot, and adequate lighting. Councilwoman Kocher raised concerns regarding the gate's placement on a right-of-way and its implications for safety. She emphasized the need for additional lighting and proposed establishing a policy for the gate. Additionally, she discussed the business's operating hours and the storage of furniture. Councilwoman Barnebey voiced concerns about the adjacent tenant and how that could impede pedestrian traffic. Chief Bevan also voiced concerns about the lack of camera coverage and lighting in the alleyway. Joseph Bennett, Agent, clarified that he would like to install the same seating that was approved in 2004. He said that the business does not have a liquor license and would only be selling beer and wine. He concluded that the hours of operation would be 7:00 a.m. to 3:00 p.m. Monday through Sunday and Friday and Saturday nights from 8:00 p.m. to 2:00 a.m. The public hearing was opened, and those who wished to speak were invited to the podium. No one came forward and the public hearing was closed. Captain Brian Thiers preferred to keep the alleyway open, as it feeds from a public street to a private lot. Mayor Brown said he didn't know how many people used the alleyway, but he suggested keeping the gates unlocked when the alleyway is not in use and putting more tables in front of the establishment. Scott Rudacille, City Attorney, suggested a continuation until the July 23, 2025, City Council meeting so the applicant could redesign the site plan in accordance with the comments, and the applicant agreed to the request.
