2024 captions standing by everyone and welcome to the JUNE 18th, uh meeting of the davis city council. Uh, I will uh, let the record show. It is 649. We'll call the meeting to order. Uh, all of my colleagues are here and present so we have a quorum and I will turn to uh 1 of my colleagues and entertain a motion for the approval of our agenda for tonight's meeting. All right. We have a motion by council member nville and the second by uh, vice mayor va any further discussion on our agenda? All right, seeing none all in favor. Please. Say I 5 0 and we have an agenda for tonight. Uh before we start, um, we kick off the meeting tonight. Um, I'm just going to kind of have a a quick minute here to reset some of the expectations, uh for uh behavior and comments in council chambers. Um, I think it's helpful to remind everyone of the rules that we follow and our council meetings. Uh, and the last meeting we had some destructive behavior where we had to gavel and stop the meeting a number of times prevent moving forward. So first I'd like to address public comment. Agenda item number 3 on our uh on our agenda is open public comment time. Uh, this is time for public comment for items that are not on the agenda or items which are on the consent calendar, which is before you if you have the agenda we can see it online. That is your time for general public comment or items on the consent calendar. It is also time, uh public comment if you are not able to stay or an agenda item that is later on you can make your public comment during general public comment, but please kow that that is your time for public comment. We also provide time for public comment on each agenda item as I said, uh and here all comments, um when we get to an agenda item when it's a regular agenda item all public comment that is being uh committed or is being uh related to us is related to that agenda item. Be tied to that agenda item. So if the agenda item is on the wastewater treatment plant that public comment period is for wge water treatment plan, so, please keep your comments, uh to uh, all public comment should be directed to um us here at the des to the city council. You were here making public comment to us, uh, not to uh to the public here behind you or to our staff. Uh, finally we want this to be a safe space for people to share their views. We've we've reiterated this a number of times in council, even if other others in the room, with them. So we asked you refrain from a pause or any other audible expression of support or opposition while people are speaking please do not crowd the public speakers do not interrupt them and please stay seated or queued in line wen they are speaking often times. There is a line that goes down the middle. That is totally fine. Just please give the public speaker, u the space while they are speaking. If I as the person presiding over this meeting feel that someone's behavior is disrupting the meeting and preventing us from continuing on that will stop the meeting at nasa behavior to stop. You MAY have noticed and has been has happened in these city council meetings, uh, you are more than welcome to bring to bring signs in the council chambers. That is your right to express your views, but it should be freestanding and not attached to anything. We also ask that you stay seated in your seat, um in your queue or if you're queued up you MAY have your sign with you there in recent meetings certain members of the public have caused a distraction by trying to catch the camera with their signs, uh during public comment. We've had to stop the meeting a number of times due to that behavior, so please for helping us. Make this a safe space for everyone. To share their views on the governance of this city. So with that we're going to move to ceremonial uh item number 1 which is ceremonial presentations. We have 2, uh presentations here this evening. Thank you. Welcome back. Uh, we are now on to agenda number 2, uh, 2 a city manager brief announcements and we'll turn to our city manager. Mike webb. Yeah, thank you very much council a couple of announcements for you tonight. Um 1 is that uh tomorrow, uh, we celebrate and honor the juneteenth, uh holiday, uh as the city. Um, uh, and uh, this is uh, uh, the first year of the city is officially observing this as ah official city holiday, we have certainly celebrated, uh, JUNE 10th, uh for many years, but this is our first official year of it bing a city holiday, um that honors, uh, the date JUNE 19th 1865 when the last community of enslaved americans in galveston, texas, uh received word that they had been freed. Um, so uh, we uh, honor the recognition and uh history of this, uh monumental day with a result city offices will be closed as we observe that and of course the city emergency services will remain unaffected. And uh also coming up we have our uh city 4th of JULY celebration. Also coming up on the 4th of JULY and this is um, u kicks off is goes from te celebration and the official uh station goes from 4 to 10 P.M. At community park, um more information and what you have slide here is on our city, uh website wbsite city of davis.Org JULY 4th. Um, so the schedule includes even starting at 4 snacks treats are available for purchase from a variety of local nonprofit organizations. We'll move to agenda item, uh, 2 beats city council brief announcements and liaison reports from various 2 by 2 meetings and commission, uh or border in a jurisdictional assignment. S any of my colleagues have any reports for this evening? All right, seeing none. We're on to item 2c, uh city council indication with tent to pull items with consent calendar for discussion. And my colleagues have an item. They would like to pull for discussion. Now on to agenda item number 3, uh agenda item number 3 is general public comment, uh general public comment as I stated before for items that are not listed on the agenda for items that are on the consent calendar or if you are unable to stay for a regular agenda item, uh now would be your time. So, uh, we'll welcome our first public commenter welcome. Good evening. Uh, I'm kevin juan PRESIDENT Of davis downtown of davis downtown. Um, I'm here to comment on item 8 on tonight's agenda. I'm sorry. I can't stay late tonight. But um, just wanted to let you know the last week at our monthly meeting of our board of directors. We unanimously approved supporting the city's placing of a sales tax measure on the NOVEMBER ballot. Uh as an active partner with the city of davis, uh, we look forward to further engaging the downtown community on this important issue. Uh at our AUGUST board meeting on having an agenda item to support the passage of the sales tax measure. And to ask our membership to actively support in this passage. We look forward to conveying to you the outcome of this discussion. In addition. We look forward to your participation in our events as we seek to provide educational forums and opportunities. Our membership. MAY be well informed on this important issue. Thank you. Thank you, kevin. Name is beth born. I'm here to speak to the flags ad the banners and the activities being promoted by this city council around the transgender child. When you tell a child they can change their gender. It's not just a lie. It's multiple insidious lies that will crowd their mental stability over time. The that humans can change sex tat words can change reality that the drugs and surgeries are not experiments healthy body needs to be fixed altered or hidden that body modification and cosmetic surgery will lead to that obsessing about how other sees you is healthy. That there is a you separate from your body. That who go along with your demands. Who do not go along with your demands? Do not love you or understand you but those that who say they want to hear. Are the are the ones who love you the most that you are only safe around people who agree with you. Can consent to being sterilized when you cannot imagine what this really means. That you can understand the implication of the laws of your sexual function despite not being sexually developed that your emerging sexuality is not linked to the confusion that yu're feeling that your difficult life experiences are unrelated to your gender distress. That puberty is dangerous for you and of a natural process of your healthy body and that your mental stability depends validation of every person you meet for the rest of your life. What cruel and terrible lies to tell to children? Particularly when claiming moral virtue while you lie to them. 1 of you council members to have the courage and to speak out, you know, there's no such thing as a transgender child every child is perfect just as they are. B. Is dora jensen. Um, so I want to talk about the um resolution you whatever your voting to put um on the ballot another, uh, p percentage point, um for your um, city sales tax, I guess right now. It's at the city the tax collected for every every city purchases 8.25% but you want to have another percentage point for it to be 9.25% and you're going to discuss that tonight. So, um, first of all, I don't like the the um, that it would be put on the ballot. It wouldn't have a sunset. It would just be only stopped when uh, when the citizens ad davis, uh, put it on the ballot to stop it. So that's sort of the new model that was used by the davis school board and that it it passed what they wanted, but for a new partial text, uh, that never ending only ended if the citizens put on the ballot, but it it passed very very um narrowly so they wasn't supported. And now you want to have that same model for your additional 1% of sales tax. So it seems kind of um unfair especially in this difficult climate for a citizens to ask for that and then not have a sunset on it. As I said also there regarding um, any tax that involves incentives and disincentives. Um, what the what the incentive for you guys are there more things you want to put out more taxes you want after you think you're going to win that and what's the distance and if for people um buying things in I won't buy in davis. I'll buy in woodland because they don't have as high a sales tax. So that's the disincentive you would be offering also the use of the money you guys gave I guess 5000 to the pride month. I don't want to raise our taxes for that when you don't give money for other um groups like patriotic causes or JULY 4th or something. I do like the way you fund the the firefighters. However, so that's my message. Uh, just know on the extra sales tax. Thank you. Thank you torso. Care if it's you or if it's a new back there the spec it is not your time. It's mine alan. Stop alan, please address the council. Thank you. You've got to stop. This is what I was talking about last time putting green screen up there. Don't allow people to do this. I have told you that repeatedly. had somebody camping at his house. Later later tat guy was caught for ammunition stolen goods. And oh and some something else. How come when he was at my friend's house? He didn't stop, huh? How about this? This guy had a record of arson. And talked to you a couple of weeks ago. Who punched someone in the face. And guess what a couple years earlier in davis some on someone in the face. Or how about the guy in sacramento who was dragged out and killed? Out of a bail bonds place. He had a record of assaulting people. The barbecue place burns down and some guy comes onto my back porch, and my he's lighting mail on fire and putting it next to my back porch on my wood house. With our system? Alan. Good evening. Good evening alan h the davis lorax. Thank you for keeping the peace and maintaining your community and the leadership challenge. Thank you very much for that. Um. Urge you to pass their some wonderful veggies. I'd like cool davis pointed out item 4 f the um, the scooter shelling program that's positive in terms of in climate the energy efficiency, uh on the mutual housing that program continuing that that's having 6, I believe and I'm 7 the long overdue the underpass underneath the amtrak trucks if you want to drive and so that's that's progress coming forward makes a lot of people accessible to downtown and do the train service. I'm also concerned though about that MAY has MAY and JUNE have been a setback on transit and climate change community to begin with at the MAY meeting of the yolo transportation district. The decision was made to not increase the frequency of the 42 bus. A crisis we're going to spend the half a billion dollars to widen the freeway, but we can't increase the bus service on every way now. And then we're told told that the 1 billion dollars on the widening freeway is balanced, but we can increase the bus service. I suggest that's not that's a dark day that we can't do that. I also point out to widen the is the widen I fruit. I think the ctc funding of that that's going to have 12,000 more cars to the road. Us to the wrong direction. That's really a setback on that climate change. It has will cost some will say that's insanity. You think that's going to fix things but we did it anyway because we get free money. Money that could be spent on transit. It was reached programmed at congress level but you lobby congress. Just wiring into highways. I also note that the environmental justice the the additional lane on every well basically have high tolls. Which will basically favor the richest to use that land and they will buy out of congestion. So had some setbacks for the last month. But you for working there. Alan. Thank you, and thanks for all paying attention. So with regards to the the disruptions during these meetings the same guy in the the issue tonight has been calling me out during public comment. You can dislike or like what I say, but mayor chapman you need to put an end to that and let's talk about rules. I was here earlier tonight and your meeting said it started at 6:30. Not none of you sat down till 6:49. Your sister city representatives were here at 615. Excuse my french but you showed your ass tonight by getting here so late don't do it again, either move back the time or get here on time if there's an excuse it doesn't matter because you have people counting on you. So please be better meetings on time or push back the time now changing topics. I want to talk about um, kind of something that I was mentioned tonight being us being the bike capital of the us. We're not right now have any of you seen the uh, bike trail along highway 80. It looks worse than east oakland uganda. You name it? It couldn't be worse. There's graffiti all over the place stolen bicycles all over there was an effort last week to remove a lot of the people, which is great. But that needs to be a constant thing the bike trail along abysmal and davis and it really could be much better to use and 1 last thought there. Nobody knows how to get on there. Speaking to someone who knows most trails in the city. There should be some kind of signage on highway 80 that says like yo, this is the way to the bike trail. It would actually be used. Thank you. Do we have any more in-person, uh public comment for general public comment on agenda item number 3 seeing none. We'll close general public comment and we'll turn do we have any pre-recorded general public comment? We do. Thank you zoe. Is speaking on item 3 general public comments and seaking as an individual throughout the meeting. So a few things first consent calendar item e. I have been reminded recently with all of the leaf blowers that I've been hearing that I hope the city's landscaping and habitat maintenance and those types of services do the least amount of intervention possible while still maintaining spaces for the needs of the community different people who use those spaces but in the context of being as sustainable as possible including for instance leaving leave in places where it's feasible to do so, even if it's not as aesthetic as some people would prefer and then consent calendar item f on the shared scooter and bike program. So I still think we should be broadening the age and weight ranges allowed on these devices in order to increase access to them and then consent calendar item h on the thank you reading of the renewal of no trees police equipment. I still think most if not, all of this equipment should be rejected in order to facilitate true public safety in the community. And then finally since this is 1 of the main move out time for uc davis students. Wanted to mention that there's a lot of stuff around the city on curves and dumpsters in free piles in various places and a lot of it is still very useful and usable and also some of it is quite interesting and I think that people should be trying to reclaim as much of this as possible for use by themselves or others. Tat was our only pre-recorded, uh public comment. So we are going to close, uh general public comment um and move on to agenda item, uh number 4, which is our consent calendar and I'll turn uh back to my colleagues and entertain a motion to approve the consent calendar. Second. I have a motion by vice mayor fight last second by council member neville any other um comments on our consent calendar for my colleagues right? Seeing none all please say I I I opposed abstain motion carries 5 z. Thank you. Uh a regular calendar agenda item number 5, uh a public hearing for energy conservation agreement for battery energy storage system. The city's wastewater treatment plant. Um, it looks like we have adrian here, um from our staff team to present this item so welcome. Thank you very much council, uh mayor and council members. I understand nor john tonight, but I will do my best u to support this in their place. Before you tonight, we have another exciting project that we're working on at the wastewater treatment plant, uh to look at our energy usage of that plant and look at opportunities in ways to increase resiliency. Not just for the plant but find good projects that we can demonstrate there and potentially make u effective projects within the community as well. So back in MARCH of 22 the uh treatment plant staff underwent and it's it's very long the pg risk assessment process involvement rapids, um that was administered by a third party to take a look at the operations of the plant and determine how best can we um, target some interventions to make maybe bring this energy use that we have the power costs associated with this plant down and increase the amount of renewable energy that we're using to power this plant and its processes, um in that evaluation, we had 8 recommendations, uh 1 of which you have already seen back in MARCH of 2023 when we brought project to install, uh, not led lights in any area where we had we had incandescent lights remaining. Um then as now this public hearing is rquired for our funding source, and for this project to be able to move forward. So a little bit of background the wastewater treatment plant does spend a little over, uh, 700,000 a year in electricity. Um and 1 of the recommendations was to go ahead and work on the work on a battery energy storage system or what we've been calling a best, um to be able to shave off the energy that we would use during peak times and when we don't have those peak times be able to bring that energy in um, and really get our plant operating more efficiently so we plan on using this with other tools to address the long-term energy needs of our plant, um and reducing our reliance on ghd emissions and also on the use of the on um, this does support, uh, the sue holes in our climate. Sorry climate action and adaptation plan. I'm going to say cap, um, both building energy and design and then carbon removal. Uh, the city council action tonight is the required for funding this project and we do anticipate coming back with more projects like this from that plan in the future. So what we're asking tonight is that we can conduct a public hearing then go through the authorisation process in our resolution to move forward with this project and lastly. We are looking to ceate a capital improvement project for this. Um, that is the last item o our recommendations, and I'm here for any questions. Thank you, adrian. Do any of my colleagues have any clarifying questions for adrian before we open the public hearing? All right, seeing none. We will go ahead and open the public hearing and welcome any uh, in-person public commenters on agenda item number 5. Is elaine roberts muser former commissioner of the now disbanded utilities commission the utilities commission urged the public works department to search out and secure ways to build resilience and increase environmentally sustainable practices in the city's utilities. A battery energy storage system at the wastewater treatment plant will achieve those goals. I know the former commissioners if they were here would enthusiastically applaud this effort and it was achieved by significantly steep costs with tax credits and a grant reducing the price from 3.4 million to approximately 500,000. Both stan. Grisco and adrien heinig were stellar staff leas on to our now defunct utilities commission ad the 2 were outstanding to work with they always listen to what the commission had to say and accommodated us whenever possible the public works department in this city is just amazing in what they accomplished. I am still astounded at to keep a pump from 1924 still working. I am also grateful the time I and other commissioners had to join city staff in their efforts to get all 4 utilities on a firm and sound financial footing it took a lot of hard work and dedication on city staff and the utilities commission's part, but we finally reached our objective in short the utilities commission was not dysfunctional. It is with great pleasure that good evening council. Um, the previous speaker was right as a former, uh commissioner of natural resources commission. I do strongly support this project. Um, this project will is read excuse me result result from a bruce carbon emissions and will save money. I will point out and I'll and I'll compliment the staff for chasing this down. Definitely. Point out though that the reason this is looking so good is that somebody else is paying the bill, right? This is the state and federal money if we were paying 3.4 million dollars, we wouldn't be doing this out of our own pockets. You might not think it but these are flush times. There is more federal and state money available for energy and climate issues, uh projects then there's ever been before and that money is fragile when the next administration comes in if it's not the administration that's there now, those budgets to change dramatically. So with that in mind, I I'm going to urge you to prioritize our efforts along these lines all across the board in city facilities. This bill the 1 across the way for example was pointed out in the 2010 cap as needing an upgrade and that still uh is waiting to happen, and I also want to encourage you in this rush. To grab the money to exercise due diligence and daylighting these projects commission's and the public s that to avoid group think or possible mistakes. You can talk to MR. Webb, maybe about the bright line project as an example. Thank you very much. Thank you. You have any other uh public comment for this agenda item in person? Seeing none zoe. Do we have any 3 recorded? Thank you. This is conor gorman speaking on item 5 about at the wastewater plant. So I agree with the utilities commission that I think the city should be doing as much as possible to build and maintain infrastructure that is as sustainable as possible and also as resilient as possible, especially as the climate continues to change and I do wonder how long ago the utilities commission made recommendation and what they would specifically say about this project and or what the finance and budget commission or the merged physical commission would say about this project. But as far as I can tell it seems to be a generally good idea. And moving toward that resiliency and sustainability. So it seems like something that should be approved and other things along these lines should continue to come forward to the city council as well. That was our last uh pre-recorded public comment. So with that we are going to close the public hearing and I will bring it back to uh the das uh for conversations questions or a motion for my colleagues. Thank you mayor chop, and and yes, thank you adrian to you and all the staff who worked on this. This is really exciting. I don't have a lot of questions. I just want to just a couple things quickly. Um, I when I first read this item I was so excited to see that we were taking advantage of the tax credits the inflation reduction act because that's such a really interesting and new approach where even entities like us who don't normally pay income taxes can get a tax credit even though we don't pay taxes and we're benefiting to to the tune of nearly a million dollars here. So that's wonderful. Um, can you just tell me though? I am not familiar with self-generation incentive pro that that program the sgip who's who's providing that program, is that of federal or state refers to the 1 point? It says the cost of will be offset by approximately 1.9 million of self-generation incentive program funds and I just wasn't sure where those come from. That is an excellent question that I will look into and get back to you. Great. Thank you. I appreciate this and very supportive of this item. So. Any other colleagues have clarify any questions or comments? No, I'm ready to make a motion. Uh, I move staff recommendation. So have a motion by council member arnold. A second. The second by council member ta any further, uh question or comments for on the side because yeah, thank you to the staff and commissions for all the work that we put into this. It's it's very exciting. We know the batteries is 1 of them to have thank you. All right, so we have a motion on the table by council member arnold the second by council barta, uh to move the staff recommendations, uh, 203. We've already conducted the public hearing. Uh, so 203. We've already conducted the public hearing. Uh, so with that being said all in favor, please say I I I opposed abstain motion carries 50. Thank you, adrian. Cuncil member neville, we will follow up with you on your question. We already kow you already know I shouldn't say bg is the source. That's what I I was curious. So like that's amazing. All right. Thank you. All right. Sure, we're going to take a uh quick recess and we'll adjourn back here. Uh next 10 minutes community development block grant often known as cdbg and home investment prtnership program, uh, its funding for the 2425, uh, recommendation and annual action plan and we are going to welcome or director of social services and housing. Uh, dana bailey welcome. Good evening council. thank you for having me. Um tonight. We'll be coming to you and requesting an approval of the resolution, um to allocate fiscal year 2425 cdbg home, um and home and cbg and home plans, and so I'd like to talk to you a little bit about the different programs and what uh, the recommendations are for this year. Um, every year congress allocates funds to the department through the department of um, housing and urban development or head and this is to administer the community development block grant often no missing g and the home investment partnership program cbg funds are meant to help communities offer transformative programs and services and moderate income community members and home funds are made available to communities to create affordable rental or for sale housing and to provide rental assistance to low-income households. The city of davis is a hud entitlement city, which means hud uses a formula grant to provide us an allocation to distribute based on population size. We're expected to set funding priorities and support programs specifically to benefit low to moderate income due this residents this year. Was told to expect approximately 1,621 in funding 720157 of that is city beach and 300420022 of that is home fun. It was a slightly less than last year. Um last year we received a total of 1.1 million dollars. So there's a slight difference o about 47,000 in the city of the g funds that we're being allocated ad 72,000 in common. So, you know, hud requires a city to undergo a planning process to assess their affordable housing development needs understand trending market conditions and make data driven plays based investment decisions related to serving vulnerable low-income populations this process results in the development of a consolidated plan. Consolidated plan is a document of the city submits to hud to explain what critical needs we plan to address and drives the annual actions that will do to make things happen. Our is 5 year 5 of our consolidated plan and we will submit an annual action plan which will which will describe to whom and how we will spend our hud funding to meet critical meetings. You'll see from the this chart. These are the critical needs that were identified at the beginning o our consolidated plan. Um, they fall into a number of different categories. All of them are things are that are meant to serve people that are vulnerable at risk and low income hearing data. We'll be developing immune consolidated plan new 5 year plan and at that time we'll be creating a new crisis that we'll be using over that by material. We've conducted an rfp process and staff has reviewed all of the applications that came in for that. Um, we've made sure that everyone that submitted for funding this year meet all of the ntional objectives and all of our requirements in order to be rcipient of these funding of this funding and that they I'll talk a little bit about cdbg and what the minimum requirements are for agencies that are upon for that funding. They must be a registered. Staff conducted a request for proposals or an rfp process for cdbg and home and we did that on MARCH 29th of this we had a workshop on APRIL 9th where we provided technical assistance to potential applicants to provide them with the requirements for cbg. Um, each of the applicants as I said met the criteria, um in order to move forward with the application we did the same for the home process not only is a little bit different. Um, the organizations that submit applications for home funds must be a community that housing development corporation or toto must have capacity to uh to move forward with the development project. We also have to have a project that targets extremely loaded loan from households. We can be a nonprofit developer and they must have uh, reasonable acquisition and construction costs and demonstrate readiness. This year we recommending the cdbg funding t the following organizations. Um using uh, 3 2 categories 1 is public we had 7 local organizations submit 9 project proposals in the public services category. The application total speed exceeded the fnds by 1333000 with that difficult, uh, the city maintains and administrative allowance of about 20% for each allocation in this case 144,000 for planning monitoring data assessment contract management and labor standards is held for the city's purposes for administration. Um this year the admin ca we use the admin cap to also fund a thousand dollars for fair housing, um of fair housing components. This is up from 35,000 from last year because we received more increase related to fair housing. And the amount allowable to expend for the public services category of that 72000 restricted to public services in this case, 180,000 and 23 dollars, and these are the organizations that were recommending for funding and the funding amounts that um, we're recommending for each and the total comes up to the 1082 dollars. Next is our public facilities category cdbg public facilities receives about 65% of the remaining hud allocation after the 20% for um, the 15% for public services in this case. It comes out to about 4688 dollars in previous years cdbg public facilities projects have supported um ada projects at the senior center and we've done some sidewalk improvements to make accessibility better throughout the city. This year the proposal to expand funds at this daytime respit center daytime respit center is located at a city-owned property here in davis. The site is co-located with the city's courtyard and you can see it here in the illustration on the right. That's kind of what the site looks like. Um council authorized the use of a portion of the art for the rest of its in FEBRUARY of 2020 on average the site serves anywhere between 25 and 50 people a day and offers a variety of services to try and meet the basic needs of unsheltered individuals and connect them to services. Um the main office which is the office for the red arrow is pointing. Um, uh main office and client space that space is in a modular that is temperature control includes restrooms tv room, um a kitchenette for serving prepared foods, and aso that's where staff services are the client services are provided and we provide uh employment housing navigation referral to mental health mental image health programs and community administrative benefits. They're als showers on site. There's limited storage. seating area and there's covers and there's a covered wrestling space with cotton blankets. The site is very active and a fixture in the house community and there's no doubt it by appearances. It's able to attire. Uh, w know that the buildings are pre well previously used mostly for um, our public works, uh staffing um, and it was used for storage and utility work and it's probably done at the end of the juice for life. Fortunately have the availability this year to use, um, cdbg funds. We're going to we recommend using those funds to adjust to priority areas. Uh, 1 is ada access to the primary office space which is where the red arrow is, um, where the srvices are located. It'll make it much easier it will make it much easier for people with a mobility devices to be able to access the the site. There's a current ramp there the deteriorated and we're looking at the potential of adding hvac to what we're calling the rest the resting room that's located in the building where the blue arrow is. Um, particular building wasn't initially intended as a rest room. Uh, but what we found that I'm working with the previous provider is that it MAY it was a good space for people to be set up for people just kind of rest, but it it is an area that could potentially be improved. Addressing home funds. Funds are uh, and that are designed and enhanced to city's efforts to create and retain quality affordable housing. The funds can be used to develop a qualifying projects to rehabilitate existing projects and expand the capacity of nonprofit developers or tribal governments to leverage resources for development. Total home allocation for this year's 34222222 1% of that allocation will be set aside for city administrative purposes. It's and the balance. Um will be the recommending goes to mutual housing which has worked with the city o a number of other uh projects in the past and then they're able to do a rehabilitation of the new harmony site, um to add uh upgrade the lot of heater system and a water softener system to meet energy efficient efficiency purposes. Oh, this is kind of my apologies. But this is the aspect of uh, what the uh, social services commission and staff are recommending is funding and it all ties back to the recommendations that I previously showed you, um, the grant totals amounts of 720,000 and 157 from the cdbg and 342 for her own will be fully allocated if we um, this council decides to use the recommendations of social services puts forward and the staff. Um, we've already done a staff review of the submitted applications. Um, the social services commission has also reviewed on the applications. Um, they've used a new process this year. They reviewed all of the applications. They did a rating and ranking process to determine how they would like to make the for each for each organization. Um all organizations that apply for funding were awarded funding issue on that petition not petition not exactly in the amounts, they requested but after deliberation, um, the social services commission, uh moved forward to make recommendations based on the best use of the resources that they saw, um, they uh have moved all of these funding recommendations to cancel and after council makes its determination. Um, and if they would that be in resolution at that point, we will move forward to submit an action plan to hud so that they had notes on how the city intends to move forward. Um, with with fiscal year thank you, dana. Do any of my colleagues have any clarifying questions for our staff team before? We open the public hearing? Berta. So, uh, you mentioned that some of the funds would be used for that restroom, uh building. Uh, can you give me more detail on what sorts of improvements? Yeah. Thank you and with the uh made that so at this point what we're is potentially add in, you know, heating and cooling system to that building, uh, what we'd like to do is to do an rfp process to uh, solicit the contract you could tell us what it would take to add heating and cooling to that building. We're asking for them to come to us with a terminated which means if there are any additional costs that would take to add from eating. Uh, like if this insulation is required if this framing room needs to happen if there's electricity that needs to be updated load anything that they think that they would need to provide to deliver a term key product. We're asking them to include that. Um, the priority as I said is to completely able to improvements first. Um, the access is the is what the current provider has asked us for with the clients are asking us for its required to take care of that, but we we do our gas did alternate that would include te request for that cost to complete all of that updated. So once we have that cost we know if we have budget. Are you currently able uh, they do have access to to just come into that private into the main building that is calling to get out of the elements, uh, because that 1 is fully uh conditioned correct. That's the primary building primary access for clients is in that module where all of the srvices take place. Again. That modular control. It's got uh restrooms there. It's got tv facilities. Tat's where food is served. Most people go into the main building really the restroom is the the resting room is kind of a an extra space. Um some functions it, uh, but it's not the primary location that they go. Um, many folks tend to really congregate outside, uh out in the courtyard. Um, the curtyard is actually you can see it's a very large space in the middle. Areas out there that um places that have shade where the trees are, um, the tables out there and folks who go there. The primarily the okay, and in that um name area like when it gets really hot to you if we use for students know that's something that we are looking at. Um, we've actually had a few proposals from some local nonprofits and some folks from the basic community to come out and do some additional projects at the um, 1 is to add shade structures, um, which we're hoping that we'll be able to undertake and the administers. Um, so we've got a number of other projects planned for that site. Um, but tonight would just help. Thank you. Vice mayor. Yeah just to piggy back on that. So if de if you put out the rfp and turns out that the the uh bids are way higher than the available funds. What's the approach? Given for the rest of the room really or if the vids come in much higher than the 4680 that we've already got what the goal is to kind of face it first phase is to be a um, the 88 improvements. We'll see how much time is left over after that and then based on what the other improvements are. We can face it to do some city bgs for funds for 2425 and potentially use some for the following year 2526, you another part of the to do another part of the it depends on what comes back. So how are you uh asking for council approval for the use of those funds potentially if it is lower, uh, but then, you know, I guess I'm curious about where you come back to council if it turns out you need to face it somehow and ask for additional funds or what is kind of the approach. We and let you know what the actual costs are. We could tell you what the delta is council can determine if they'd like to alocate additional runs to this project or if there are opportunities for us to raise additional funds for the project and to close the delta. We'll try that approach first. And I'll note procedurally that this item would need to come back to council on any event for a bit award for construction award as part of that process. So that'll be a natural check-in opportunity and if need be of course like first adjustment of the bids come in than great. So maybe I'll just tag on the comment, but it's really great for that. So I I would say just for you to create if you were to buy to council and it does turn up the money is not adequate but come with us with some ideas for a plan about where we do forefronts fun to potentially make those make those improvements for the restaurant. Thank you. Thank you for says we're having a few questions. So, um, thank you for this work dana. And I think you probably know too that I'm I am really supportive of us being able to those healing and cooling improvements. That would really enhance the quality of life of so many people. Who are we use that location and realize now people are often in the um smaller room, that is heated and cool that it's smaller lying on the floor resting and so that the larger restaurant, you know, I think would be really wonderful if you could provide the cooling. Um, and I appreciate the idea that we'll kind of come back to us. And so let we're at. Um, is this that has to be let based on the lowest bid or is it 1 of those ones where there's sort of a combination of low bd and quality health? How does the contract work for it? It'll be a combination of bid low low bid and if the qualifications of the contractor um, so their experience in providing this, uh particular type of project and you need pass projects that they've completed. That's what will help to inform. Are you thinking going to do a a sort of primary contract and then an alternative fit are you thinking that those who are likely to bid on this might be distinguished vendors and convenience on likely to find someone who's equipped to do the ada work and the hvac. Usually what we find is when we put out the rfp and we ask for the primary and ask for the ultimate, um, maybe the contract that we will provide both where they will say, we're not going to do a bit ultimate, so we're not going to bid on this particular project. So is but we want to make any contract that bids aware of what is available to be um with the funding that we have and then that's why we've set it up as a little so that we can try to be more controversial. Thank you. Yeah, and there's also an option for the contractor to bring in subcontractors to do. Usually what we will find is that it will find your general contractor. Um that has the ability to uh managed to get traed our clients. So the project will be able to station project. Um, so it'll be a contract with scott the experience doing tat. I'm doing that type of paperwork and they usually generally usually have access to a number of subs. I can do that. And it's prevailing wage and its treated like a public works project. Thank you. Any other can I clarifying questions for dana before we open the public hearing? All right, not seeing any other uh questions from my we go ahead and open the public hearing and we will welcome any um, in-person public commenters. Good evening city council. We want a very uh, abusively thank the staff for um, including upgrades to the rest rest centers resting in this part of the cdbg bid process as as you all of the um, the organization that I'm representing tonight has been advocating for improvements to be made to the rest of the room for some time ever since we went on a tour of the rest of the center last summer and realized how unbearably hot it is in a room that is supposed to be for sleeping and relaxing. Um, obviously it's not usable for its intended purpose at this time and and it hasn't been since the davis is the only city in the country that provides a sauna for their homeless population. Based most of your comments. Um I'm sure that you agree tat the respit center is a public facility should provide the same level of comfort and safety to our homeless neighbors would expect any other city facility to provide to the general public. So we very much support utilize the uh public facility in cdbg funds any that are remaining after the ada recruitment state place, um to add insulation hvac, um, potentially fire sprinklers and um do whatever repairs are necessary to minimize, um energy from the building. If not enough funds, u, which I very much hope there will be. I would hope that we could all work together to ty to identify some resources, um to make this happen. Thank you. thing um, so this is I I know this is a hard ask but um, we urge you to expedite the process of um performing those repairs on the resting it would be great if the rusit center gets to have at least part of this summer in a climate controlled and safe safe and comfortable space. So thank you for the time. And ill just just oh, just give me 1 second for that alan miller ad I get 2 minutes and seconds too. Excuse me for the record. I'm gonna announce that she stood up and sid was representing hard days, which is recognized group that so she had up to 5 minutes. So we were always historically done. So with that I'll welcome our next public commenter my apologies. Uh, alan miller, um, back when the respirator center location was chosen we were told it was going to be down on second street the night of the meeting. And the back of the room with filled with a bunch of people who lived right by it of davis manor did not have the ability, uh to fight at that night because they didn't know it was coming to them as the alternative location. But guess what all those people were a particular race. It was not white. And most of the people who came from davis manner were from a particular part of davis manner. Also, most of them were not white when they came the next week and complained. That who had come the week before their houses were worth hundred thousand dollars more. Money speaks and right after that was put in and I went to the opening and I supported the general concept, uh we were told by members of the council that there would be a nitro facility and it would not be in district 3. But I kind of naively that you know councils should respect. Promised to people from previous councils, just uh because im stupid, I guess um, and so, uh, what happens I drive down l street at night and there's ghosts walking between this place and the 7-eleven and I've almost hit them a few times and then there were 2 crimes uh, and they were both a block away in the paper the same day and then of course my friend who lives on fifth street, you know, he got the um, 2 different women, uh doing the catalonian christmas thing. My name is john castel franco and I share the task force. For um on housing and homelessness, so the davis united methodist church and thank you for the opportunity to comment this evening. In 2019 council made the good decision of opening a respiratory center on the corner, um near the corner of fifth panel. I'm here this evening to support the proposed improvements to the respit centers resting room. Especially heating air conditioning insulation and fire sprinklers. David needs to provide its unharmed residents with different types of assistance to respond to individual to diverse needs. Is at the top of the list. Now for some a safe and comfortable place to rest during the day will be very important. Te book of proverbs tells us that a generous person will prosper those who fresh others will be refreshed ad a number of people from my um church or attending to support the proposed improvements that they could stand our way. John. Of the veos. Uh, I've been a community volunteer with the restroom center. Basically central development. Take a pause during co so 1 of the things I've done more frequently now is bringing excess meals from meals on wheels. I actually assumed from the old county office of education. Breakfast is for dinner 1 time as for about 2 years. So the shopping deal with 2 things. Uh, certainly, um agreed with the speakers on upgrading the restroom those need attention to the credit of downtown street team. They put 3 sofas inside the the main building so that helps um 1 of the things that is new. Um at the facility is having a employment specialist, and I've been finish when I see part-time jobs around town and parents have been very enthusiastic about receiving that information. Uh, it's it's uh certainly time to upgrade it and thank you for considering supporting operating facility. Thank you. Thank you steve. clutter and I'm co-chair of interfaith housing justice status. So I'm speaking in favor of using the community development block grant funds for making the rest area the rest that center more usable and more comfortable. I wish there were sufficient funds to build around permanent housing permanent shelter, but I guess that's not possible now. So this a welcome addition, but I hope before long we can. G more for what that homeless folks have told us in the um, report that would have been made to the social services committee this week, uh about homeless and tey say that having at us that permanent view around shelter is a high priority. So I hope we can get there. Barbara. Have any more in-person, uh public comment on agenda item number 6 is daniel. I'm a retired scientist and currently still working is a tai chi instructor all over the greater sacramento area. And you know, I hve retirement social security and all that stuff, but it doesn't it just doesn't meet the needs of housing. I'd like to bring your thinking to the most basic item and that is that um often as I go around various places tat are um, uh assisting the the homeless be on house. Um, I'm often given order and especially over the summer that becomes plentiful. However, I'd like to know that I'm rarely i'd like to point out to you that here in davis. There's a dirt. Of restrooms that are publicly available in particular. For example, there's um, community park uh where there really isn't a public, uh restaurant and I have you know, I traveled around I teach uh in various places and in wholesome and west sacramento, there are some very nice restaurants. That um, the unhoused actually keep very clean, um because tey're very nice restaurants and um in falson, for example, they're they're locked electronically, so nobody has to lock them. But uh the ones in west sacramento are used by by city people.

Uh, and then from 4 to 8, there's a free game zone, uh, that's being put on uh at 6:30 P.M. We have live music, uh, that's being coordinated by the davis live music collective, uh foka do uh at 6:30 and dust bowl revival at 8 pm and then that is followed at 9:35. Not 9:30. But 9:35 by 15 minute, uh fireworks show, uh that we have lined up. Uh, so we encourage folks to ride ride their bikes or walk, uh, if possible vehicle parking of course is very limited around there, uh the off leash dog area in community park will be closed that day. Um, but we encourage come out have a great time. Uh, and uh, looking forward to to celebrating our nation's birthday. Ihave tonight. Thank you. Thank you, mike. All right. We do. Thank you
