FEDERAL STATUTE: n/a FLORIDA STATUTE: F.S. 1006.28; F.S. 1006.283 SCHOOL BOARD POLICY: 2520 EXECUTIVE SUMMARY: The Board will hold a Special School Board Meeting to address the recent decisions made by the Florida Department of Education (“FLDOE”) on April 15, 2022, relative to the state adoption of mathematics instructional materials. In this regard, at the Special Board Meeting held on March 29, 2022, the Board adopted instructional materials in the areas of mathematics from the FLDOE’s published bid list for grades K-5 and 6-12. On April 15, 2022, the FLDOE released its adoption list relative to mathematics instructional materials publishers. The list did not include publisher McGraw Hill whose instructional materials for K-5 mathematics had been adopted by the Board on March 29, 2022. The FLDOE also did not approve for adoption high school level mathematics instructional materials by the publisher Savvas, for six courses identified in the attachment hereto, also adopted by the Board on March 29, 2022. The FLDOE has a process by which a publisher can appeal the FLDOE’s decision, which includes amending identified areas in need of revision. The District has been informed that both McGraw Hill and Savvas plan to file appeals with the FLDOE. Accordingly, as a consequence of the Special Meeting held on March 29, 2022, a 30-day instructional materials submission period was opened with a submission due date of April 28, 2022. It is recommended that given the above-referenced publishers’ intent to appeal the FLDOE’s decisions, the objections period for the K-5 mathematics instructional materials and the high school level instructional materials, noted on the attachment hereto, be deferred pending the outcome of the appeal process. This is especially appropriate since the noted instructional materials could be adopted by the FLDOE if FLDOE recommended revisions are made by the above-noted publishers. Subsequent to the conclusion of the appeal process, the Board will hold a Special Meeting to discuss such outcomes reached. This will include the review and consideration of any new publisher instructional materials that may be added to the FLDOE’s adoption list that could also lead to a resetting of the instructional materials 30-day objection submissions time period. LEGAL APPROVAL: The item was reviewed and approved by Jon Fishbane, District General Counsel.
