Good afternoon everyone. We'll call to order the monthly meeting of the Village Community Development District 10. Today is October 17th, 2024. Before we begin, if anyone would, has a phone or iPad or whatever, if you'll please silence this unit, turn it off, whatever. So it does not disturb our recording of the meeting. We have Four supervisors present. Mr. Davis is out of town, so, but we do have a quorum, so we will continue. We will start with the Pledge of Allegiance, followed by a moment of silence for our first responders. To the flag of the United States of America to the republic which sustain one nation under God in indivisible with liberty and justice for all. Thank you Seat. Welcome Everyone. Before we get into the agenda, if anyone in the audience has any comments, anything they would like to bring up before the board that is not on the agenda today, if you would please go to the podium and state your name and address and no one. Okay, we will continue on. First item is our Law enforcement quarterly update, Sergeant, Well, good afternoon board. My name is Sergeant Adam Dodge with the Sumter County Sheriff's Office, and I'm here to provide you with your quarterly law enforcement update. Uh, typically during the quarterly law enforcement updates, I give you information about recent crashes, uh, motor vehicle citations issued within the villages over the last quarter. However, you're likely aware the Sheriff's office was involved with a ransomware attack, uh, in August, which has impacted our ability, uh, our, uh, network connection and, and communication within the agency. There hasn't been any significant impact to the services provided to the community. Uh, when you call 9 1 1, the deputy still shows up and a deputy will still invest, investigate a crime, all the same or make arrests. Uh, however, how we, uh, document transmit reports within our agency has been impacted. This ransomware attack has impacted our ability also to, uh, consolidate statistical information like crashes and citations issued over the last quarter. So unfortunately, I don't have those numbers to provide to you today. Uh, I'm told, or I've been led to believe that, uh, by the next quarterly update, we'll be back, uh, working as normal. Uh, so I'll be able to provide that information. Then. Uh, the, the impact really has been, uh, it's like policing in the 1990s. Uh, we've kind of gone back to the old school way of, of doing things and technology has made us, uh, more efficient, which has been, uh, an impact on us. But we've worked through and, and, uh, continue to get back on track with our network. So I do wanna make you aware Hurricane Milton brought to light some impacts, uh, within the county. Uh, many of you may or some of you may not be aware that the county operates what we call an EOC or an emergency operation center. Uh, Sumter County's EOC is a, a place where stakeholders from across the community are in one room to work together, uh, pre-storm during the storm, and then post-storm, the recovery phase. The Sheriff's Office participated in staffing multiple shelters across the county. We had several hundred hundred individuals, uh, seek refuge in those shelters. I will tell you that while the villages has, uh, site built homes, the newer homes and compliance with building regulations, um, other portions of the county have, uh, different housing options. We'll say that, uh, more people residing in mobile homes, campers, and the like. Uh, so those, uh, communities were more likely to seek, uh, uh, residents inside a shelter for the storm. We do currently have one shelter still operational. The, with Lache River in the forest, uh, south end of the county. The water level has continued to rise as those rain waters have consolidated into that river. And we are, uh, anticipating we've been, uh, working to evacuate people who we believe would be impacted by flooding. And now people are, their homes are being impacted by that flooding. So we're actively working to assist those, uh, those personnel. But that's kind of all the information I have for you today, and let you, do you have any questions of me? Any uptick in scams and things post hurricane that you know of? Uh, no, and not, not that I'm aware of. Uh, we always encourage people to be alert to the possibility of scams. Um, and if they are encountered by an individual who is, uh, uh, hoping to, um, sell them on a service or a product or to say you likely have damaged, uh, with the roof, uh, we would encourage them, uh, typically to contact a reputable company or, or reach out to, uh, seniors versus crime. If, uh, if you're not familiar with, with that organization and what they do, they're an excellent resource for the community to verify the validity of a business and ensure that that's a company that, uh, there's not any, uh, current issues with. Thank you. Absolutely. Any other questions, comments? Okay. Thank you very much. I appreciate your time. Your next quarter. Thank you. Your regular objection. Thank you. We'll move on to our consent agenda. We have three items, everyone is, unless you have any questions or whatever on any of those I items, I would entertain a motion for the consent agenda, which would include the, uh, approval of the minutes of the previous meeting, uh, award of request for proposal 24 p dash 0 3 8 for uncalled services, geological anomalies and storm water systems. And the last one is amendment two and renewal number six to agreement RFP 10 P dash oh 15 Investment advisory services with US Bank Corp Asset Management Inc. Any questions or comments on any of those items? No. No. Then we will entertain a motion. I move that we approve the consent agenda. We have a motion. I second that motion and we have a second. All in favor? Aye. Aye. Agenda is approved. Next we will move to our new business. First item will be resolution 2025 dash oh one travel expense reimbursement policy for a RC committee. Volunteers. Good afternoon. Shannon Boyd. Community Standards at the July 18th Village Community Development District number 10, meeting the board directed staff to implement a policy for the reimbursement of travel expenses for the district 10 a RC volunteer. After reviewing the IRS requirements for reimbursing volunteers, the Community Standards Department coordinated, coordinated with the finance department, budget department, district administration, and district legal counsel to establish a uniform process for reimbursing allowable travel expenses. The policy applies to volunteer members of the Architectural Review Committee for District 10. The reimbursable expenses will be, the mileage will be calculated by district staff for driving personal vehicles to attend official monthly or special a RC meetings for District 10. Mileage reimbursement will be calculated by staff based on the shortest route from the volunteer members, um, residents to the meeting location. The reimbursement rates and limits mileage reimbursement rate is 0.445 per mile as established by Florida statute. And the maximum annual reimbursement limit is $575. The budget impact, that's gonna be based on the miles from the voluntary primaries re from the voluntary members' primary residence to the meeting location for 52 weeks. So, staff's recommendation staff recommends the Village Community Development District number 10 Board of Supervisors approve the travel expenses for the District 10 Architectural Review Committee volunteer. And I'm here to answer any questions that you may have. Yes. This would be for the primary and the ultimate? Correct. Okay. Yeah. And Shannon, um, if we approve this, when would the, when would that start? Start November 1st. Oh, I would, okay. Any other questions? No comments. Entertain a motion. I move that we approve resolution 20 25 0 1 Travel Expenses Reimbursement policy for Architectural Review Committee volunteers. We have a motion. Do we have a second? A second. We have a motion and a second. All in favor? Aye. Aye. Motion is approved. Thank You. Board. Thank you, chair. Thanks. Okay. We'll now move to old business, old business Status update. Yes. Good afternoon. Board members. You have one old, uh, one item on old business, which was the review request to install no public access signage at Basin B 2 0 6 and provide an opinion if ponds can be designated as resident only. Um, so you did receive an email, um, from Mr. Brown that was on September 6th that addressed the, um, issue. And if there are instances where there are issues with alligators or individuals, um, harassing the alligators, essentially, um, that would be handled through the Florida Fish and Wildlife Commission. Um, and then as well, there were, um, the district fishing guidelines included in that, some of the plat language, um, specific to District 10. Um, and then we did pull some policies from other CBDs throughout the state of Florida. Um, and really it comes down to the same issue where, um, these are public areas. They put out guidelines. Um, the issue comes to district enforcement, um, and the capability to enforce those, um, guidelines. So really we would rely on law enforcement, which is the guidance that was provided last month as well, where if there is an individual that is on your personal property, um, staff's recommendation would be to contact law enforcement or if there was suspicious activity to contact law enforcement and have them address those issues. Um, and I'll turn it over to Mr. Brian if he has any additional information to provide. No, I don't have anything further. I mean, we've talked about this the last three meetings or so. Um, and that nothing's changed. The opinion remains the same. I know that you've been provided with additional information from, uh, district management. So really again, um, there's nothing further on our side to do. Uh, you have the information you need, you have, you know, um, legal advice on what you can and can't do. And it's a matter of what this board decides to do going forward. What I remember, chairman Miller, was we had two in favor of posting signs to oppose opposing signs. And you were the deciding and you tabled it. The situation we've got right now is that, um, With the, with the new information, I don't know whether you had a chance to review what Mr. Brown had sent us before. There were I think four other, um, c DDS throughout the state that had similar situations. Um, and they have basically the same problems that we have, and they have many different solutions, none of which seem that they're gonna work for our situation either. Uh, some of 'em limit access only to what they call patrons and guests, um, access via proper access points, which we already have that, um, catch and release only we recommend catch and release. So, and, and as you go down the line, we have the same rules and regulations already posted out there by Parks and Rec. Uh, but we've still got the problem. Um, if we try to limit access, who do we report it to and who has the authority to do anything about it? Uh, absolutely. If somebody is trespassing on private property, then the property owner has every right to call Sumter County Sheriff's Office and they will respond and either give them a citation, ask them to believe or give them a citation. If they are on district property, no one has the authority or wants to take the authority to ask for identification. Are they residents or are they not? Um, if we don't have that authority to prove whether they are truly trespassing or not, Sumter County's not gonna respond to it. Mm-hmm. Um, my opinion, and I'm just gonna throw something out here, uh, as a suggestion, we have some signage and we've said either take it down or be consistent. After the last meeting, I started thinking about putting up signage in these critical areas that we've got right now. Uh, not something that just says no access, no fishing, no whatever, but more of a, let's say a small bulletin board type sign or whatever, which we would be able to post parks and rec rules and regulations there for everyone to see. My complaint in the last meeting was the people that are trespassing are not villagers, or at least quite a few of them are not. Therefore, they're not going to the village website and looking and looking up to see what the rules and regulations are. They really don't care. Mm-hmm. They're just there to fish and enjoy themselves. And perhaps if we can provide more information, and this would be posted at the, at the access point. So if they're following the rules and not trespassing to get to the property, they should be able to see it. Uh, maybe it would slow things down. It would be a minimal cost to have a couple of these signs made up and perhaps put 'em in a sleeve and be able to move them from spot to spot to spot to hit the hot spots where, because what's gonna happen, we're gonna put 'em up at one of these fishing locations and maybe it'll slow down, but they're just gonna move to another one so we can move the signage with them to the next one. Um, I think it would be a small expenditure to try to eliminate the problem. Uh, and if it doesn't work, then we haven't thrown that money away completely by trying to put signage at every single location. Uh, Mr. Brown was adamant that signage doesn't work. And I, I don't necessarily disagree with that, but I don't like not doing anything at all and just being silent on the matter and leaving it up to the homeowners. I, I'd have a concern that by putting the rules up there, or the guidelines, that the effect would be almost saying this is a place to go fishing and actually, you know, give people quote, permission to, to, to fish there. And I think the problem isn't, isn't so much about them following the guidelines as it is that they deviate once they get around the pond, and then they go up on people's property that whether they access the pond through the easement area or across property owner's land, that they end up sitting on their, you know, their landscape walls leaning up on their houses, things of that nature. So I, I, I like, I can see your point there. I like what Chairman Miller Miller is saying, because we know of one hotspot in Plank Road. Um, so we know of that. And you can't do anything about, you know, any enforcement at all. Um, unless you've warned people that what the rules are. So I would be in favor of posting it where we know it's a problem and you can't do anything unless you've warned people. That is the warning. Mm-hmm. We still don't have a, we still don't have an enforcement sentence. Mm-hmm. Right. But it, I mean, it's, it's better than nothing is. That's the point he was making. Well, I, I tend to agree with Jim. I think that's only going to encourage people to go in there. And I'm not sure it's gonna be, I don't think people are gonna, if they're gonna do that trespass, we gonna address that. Yeah. I think we're back to where we were. It is you two against posting and, um, Steve and I were for it, and you were the deciding vote. And we only have four to vote on it today. So it's, I think what we're gonna end up doing is just leaving it alone and, uh, hopefully next spring they'll forget about where they were fishing last year. And, uh, maybe it will slow down a little bit. Uh, we don't have any authority to do anything. I mean, they, the district is not going to give Sumter County Sheriff's Office the authority to do anything. I understand that, but I think Nothing without that, our hands are tied. I think it's better than nothing. And that's what Steve thought too. And Mr. Chairman, I would just, um, provide that. I, I know sometimes the residents are hesitant to contact law enforcement, but if it truly is an issue that law enforcement needs to be involved, you know, sometimes seeing out, seeing them out there at least once is a deterrent. So we would just encourage residents that even if it's the non-emergency line, if they feel like they're on their personal property to contact them and let them at least come out and have a presence there, that if it truly becomes an issue to that level, that, you know, if there are a few people out there fishing, they see law enforcement out there, they know that they're aware of whatever may be transpiring. I totally agree with that. And that that's something that we, we do have to leave up to the residents. We can't make those calls for 'em. It is their own private property. They are the only ones that can call. They are the only ones that could instruct Sun County Sheriff's Office that they need to do something because they're trespassing on their property. We cannot stop, make It clear that they are empowered to do that. You know, I think there was some concern about, you know, well, who do we contact? Well, who can do so? You know, we can't. So they need to understand that they're empowered to do that. They're empowered to call law enforcement if in fact someone is trespassing on their Property. I think that was pretty clear from the sergeant in that the last meeting, that, uh, yes, if they are on their property, private property, uh, now once they get out there and they're not on private property and they're on district property, the only thing they can do is say, we, we've had a complaint that you have been trespassing on private property and you need to understand that that is not allowed. Is there something we can do with regard to the website where we talk about the fishing regulations? Because the person who is more likely to go to look at the fishing regulations is going to be the homeowner who is saying, Hey, these people are out here. What can I do about it? What are the rules? Can we add something to that? The fishing regulations in our website that basically tells homeowners if someone is trespassing on your private property and is not in that right of way, um, that they may contact the County Sheriff's Department to enforce those rules. Yes, I can, I can certainly work internally with the team to include language. The last bullet on there is, you know, to not fish behind any residential or commercial property without the written consent of the property owner. But it doesn't explicitly address, you know, if that is occurring, what the next Step is. Right. Can we empower homeowners within that document though? 'cause they're likely to go out there and look at that if they're trying to figure out what the rules are, Whether it's something to be effective. Um, you know, if if you do trespass on private property, then you may be issued a citation or whatever on it. Yeah, that would be up to parks and rep to add to what they already have. We Could explore some verbiage that would somehow empower the home homeowners to understand that they're, they can contact law enforcement if they're in fact testing on their private property. Yes. I would still like an official vote of this board when all of the members are present, yes or no proposing what you were proposing. So would you like to table it until the next, until November's meeting? In the meantime? We, we can, I Think he Will be back, back now. December, we oftentimes cancel a year, not here in January. So Yeah, if Steve's gonna be back in November, um, yeah, put it on November's agenda. There, there's, there's a factor. If I can bring it up now. Uh, I've had a, I was reelected, uh, without, well, I ran unopposed for a second term since then. My wife and I have decided to relocate to Northwest Florida to be closer to the grandkids and, and our kids. But it's really about the grandkids. 'cause that's the fun part. Um, so anyway, the other day I sent to Kenny Blocker, uh, letter that at the end of that, on November 6th, I'll be resigning or just basically not taking, uh, my position for the second term. So, uh, that's something for the board to decide what, what the process is gonna be to, uh, to fill my position. But, but, uh, it's been great here. And we put the house up for sale and sold in two weeks. And, uh, so we're happy for you and I'm sure you'll enjoy it. It'll be a lot closer to Tallahassee. Where we got got, I don't remember getting to vote on it at all. My wife told the kids and the grandkids and my sister in Tallahassee that we were gonna move up to the Panama City Beach area. That's what you're gonna get. And after that, it was sort of like, I didn't have a vote. Right. So, well, I would like to keep one, keep it on me one correct answer. Yes, dear. Yeah. You know what they say. Happy wife, happy life. That's it. Well, congratulations. Well, thanks. We're gonna miss you. Well, thanks. It's been a pleasure, you know, being on the board for four years and, uh, but this is a new adventure and yeah, Thank you for notifying us. Um, that, uh, of that. So I would like to keep it on old business as an open item until we have a full five member board and vote on Any other comments, suggestions? No. I would say at the next time that we do, we are able to vote on it with the full board. We need to, hopefully we'll have information as far as verbiage that can be added onto the Parks and Rec website that would help the residents. And I guess we need to go ahead and make a final decision and have a final vote on what we do with the existing signage, whether we leave it up, take it down, or what we do with it. Right. And just go ahead and deal with all of it at one time. Right. Board vote. You wanna, you wanna vote everything all at one time? Or do you wanna vote about the signage leaving it up or leaving it down today? I'm, I'm unclear. Uh, well, we, Steve can't weigh in with the Official so you wanna wait? Yeah. Are you gonna be, are you gonna be be here for the November meeting at all? No, he won't. So we won't have a full November 6th. Appoint a new member. We may barely have a quorum for November. I'm not sure when Steve is gonna be back. He, I don't know if, I don't think he's gonna be back. In fact, somebody, 'cause some of the alternate on PA and he had asked me to sit in on the next meeting as well. But because of the timing, I won't be able to do that. Okay. 'cause we'll be, I'll be here, I'll be here in November. I'll be Here in November. So we'll have three Of quarter three, right? Yeah. Three. Yeah. Okay. We'll table it until November then. Well, no, we won't have his position still then. Jack, uh, Jim's Position, I think what she's requesting is that we table the decision until we have a board of five, Right? Mm-hmm. Yeah. So what we can do is we can leave it as an open item on old business and adjust the verbiage on there that when there's a full board seated, That's what I'd like To, it'll be an item for to reconsider. But I think we can also consider in November any verbiage since you might, you know. Yes, sure. Let us know what you can do about that. Yes. That makes sense In November. In the meantime, I don't think there's anything else we can do from the legal standpoint, right? We've done all the research we can do. Correct. We've got the information and it's still clear as mud Agreed. So, but a final vote of the board, I think we'll, you know, give closure to it. Maybe we'll start a new year with that on the agenda. Um, so, uh, I guess that Support leaving things along we'll keep We'll Just one by one, not be here. We'll have a perpetual for the next. So Brittany, what are we gonna do about this new news? Well, first and foremost, while we're on the subject, um, we would like to take the opportunity to thank Mr. Boyd for his years of service and thanks on behalf of district management and the residents and the board. Um, we do have a challenge coin that we'd like to present you. Um, So I, this means I can talk to Jim about board stuff on the Yes. Before I leave on November 7th. Thanks. Thank you. After November. After November, yeah. Yeah. So November 7th, we're We're gonna call him. Yeah. Yeah. Does that mean I can call a special meeting on November 1st? You have The authority, find out what day the movers are coming and schedule it for that day. He would Like that. Highly inconvenient. Alright, Mrs. Boy will trump all of us. Alright. So we are going to leave that on the all business agenda and hopefully resolve it down the road. Yes. And if I could just, um, to mention about the, the vacancy because, um, Mr. Boyd was running unopposed, so he would have automatically, he would've taken his oath of office, but he would've continued on in his existing seat. Um, with his resignation being effective November 6th. Um, we will need the board at the November meeting to declare the seat vacant. And then our recommendation would be, this is not a midterm vacancy because it's done within an election cycle. Um, the recommendation though would be to follow the same process and your, uh, policies and procedures, which would be to advertise, um, for the seat, and then take applications and do interviews, um, and then appoint from that process. That would be staff's recommendation, um, most likely in the January timeframe. That would give ample time through the holidays for individuals to submit their applications for consideration Comment. Sounds Fair. Mm-hmm. Sounds reasonable. I don't think we could get it done. Even, even if we did have that and any other business for a December meeting. Normally we don't have one in December. Won't, I don't think we'll have enough time to get the candidates and review everything by then. So. And We often don't have a board meeting in December. Right. And we have a lot of absences in December anyway. And we'll include that official action on your November meeting agenda, but I just wanted to put that out there as the, the process. Okay. Thinking about it. Start looking for candidates Hard, but we're gonna play above your neighbor. Right. Okay. Alright. Um, we're gonna move on now to informational items only. Uh, we have the DP monthly reports. Any comments, questions, anything there? No natural statements? No questions. And, uh, community development district 10 public hearing updates. I think we had one item still remaining there. Has there been any status updates on that? We had two items on there. One was resolved and the other one is still pending and it's still not in compliance. And the liens have been filed, to be honest. Is there any update on that at all? Uh, it looks like the lien was filed against it. Yes, there was a lien filed against it. We still have not received an a RC application from those homeowners. Um, so at this point they are just accruing daily fines for that one. And then the other one on Schoenfeld Street, uh, did come into compliance prior to, uh, any fines. Is this the one that we're not even sure there is a violation out there, it's just the fact that they made all these changes without getting approval? Correct. Could be, it could be something that would be approved by arc. We don't know. 'cause they've not submitted any application. So I mean, That's, that's, I remember looking at it and, and looking at the pictures and the everything else. Mm-hmm. And that I really couldn't see anything that was a problem. I just don't understand why they don't go through the process. Yeah, I don't, I mean, are they, are they the homeowners notified periodically that they continue to be fined? Oh yeah. They get an invoice every month. And have we actually, you, have you talked with those homeowners? Have they, have you been in contact or have they just been nonresponsive? Um, they have an attorney. Um, so, uh, we don't deal directly with have representative you have in contact with the representatives? We do not. I I have made, uh, contact with the attorney, uh, a couple times and, and we've not spoken. Um, we've emailed, um, but he's aware of it, so. Okay. All right. You help him. We are going to move down now to district manager reports. Yes. Good afternoon board members. The first item is the post storm review. Um, unfortunately we had put this item on the agenda for Hurricane Helene. Um, and then Hurricane Milton came shortly thereafter. Um, so we do hope, um, that you appreciated the, um, the type of communication and the, the volume of communication. We know that it was a lot that was coming to the boards, but we wanted to ensure that anything that we had you had as well. Um, and then an effort to keep, um, the residents up to date with any type of facility closures to office closures, things of that nature. Um, with Hurricane Helene, we were, uh, for fortunate that this area did not really, um, receive the impact that was anticipated. Um, our offices did, did close for that. Um, but fortunately we did not, um, identify any damage, unfortunately with Hurricane Milton. Um, we did receive, um, the, the high winds and the inclement weather that resulted in quite a few down trees and the larger bulkier debris items. Um, so following that event, district property management was out on the road the immediately the next morning performing their assessments. Um, we had put your debris hauler and debris monitor on notice prior to the storm. Um, we did activate them, uh, immediately following the storm. Um, those were competitively solicited contracts, um, by this board, um, that put us in compliance and eligibility for FEMA reimbursement. Um, so we have been actively meeting with them. Um, it is anticipated that that pickup will start October 20th. Um, we've been trying to get the word out. You'll see a lot of debris within the district right of ways, um, but then also homeowner right of ways and within their properties. Um, because we will be performing the collection for all residential properties as well as the district, the major thorough affairs that you see, um, as I mentioned, we will submit that, um, for reimbursement once this process is complete. Um, with that said, I know, uh, many of you were around for Hurricane Irma and when these events are widespread, especially to hurricanes, back to back, it really puts a strain on the amount of resources available, especially for cleanup. Um, so we are working as expeditiously as we can and we feel like we've, um, made a lot of progress in a very short period of time to have contractors on standby and ready to go. Um, but we understand it's not a necessarily as quickly as the residents would like, but there is a process that we have to follow and be in compliance, um, to be able to submit for the reimbursement. Um, one of the benefits, we did work with Jacobs, this go round, um, to ensure that they performed general yard debris cleanup as they normally would through the normal collection process. Um, during Hurricane Irma, that did not occur, and that was a major pain point with residents. Um, so Jacobs will be doing the lawn debris collection and the bulkier items will be through the debris hauler. Well, And this Is just an FYI from my colleagues on the board. I was at Middleton the other day, and you know, they always post all the listing of the new residents. I would say half to two thirds were Floridians new residents. I think a lot of coastal people are moving to the villages. Um, I do want to mention though, we do have a freeze right now on our website. So we were actively posting all of the storm updates, especially, um, with respect to facility openings. And as the golf courses come back online, because there is a lot of, um, lowering of basins and taking place right now. But our website is on an information freeze because we are in the process of transferring to our brand new website platform. Um, so just good time. It's not good timing. Oh, no. Um, so we would just ask that as we continue to email out updates to the board, if you have resident distribution lists, please, um, help us and forward that information out. Um, so that we can keep everyone up to date through as many outlets as possible. Are we using a different vendor for our website or what, what's going on with that? Um, no, it's still through, um, TSG is our service provider. Um, we've just been in the process of building a new platform. You're going to see a lot of enhancements, um, especially from the, um, user friendliness and the, the way information is organized. Um, we are looking forward to making that debut to each board. Um, there will be a brief presentation on that, but right now they had, we had the, the backend work scheduled prior to the storm, and unfortunately, this is when they, they need to capture all of that information that's currently on there without us making continual updates. Wow, okay. Speaking for myself, uh, I didn't get out the first couple of days. I spent most of it in the little, my little neighborhood cleaning my own yard up and helping neighbors clean theirs up. But when I finally did get out on about the second or third day, um, I was amazed and pleased at what had been done as far as storm cleanup already at that point. So that's a gotta give you credit for that. Let the crews know that, that they have done a fantastic job as far as I'm concerned. Thank you. We'll certainly pass that on through DPM. A lot of the landscape contractors were out helping do the first push to get, um, you know, all the, the debris into the right of way and cutting of trees and things of that nature. And now we'll just wait for the haulers to come through and do all the collection. Did any sections Of the villages lose power? Yes. Specifically on the east side of 4 41. Uh, in the, in the Lady Lake, lake County. Mm-hmm. I know for certain that there were some power outages there, I believe in the Leesburg section, district 14. Um, I'm not aware of any other areas. I lost it for a short time, but then it was three o'clock in the morning, so I'm not really sure how long. Uh, according to my wife, I slept through the whole thing. I can tell you we did not lose power in Lake Sumter landing at the waterfront. At least there was no power outage there. Good. You Just watched the water ride. Yeah. But that boardwalk was under water. So is that, what's going on with That? That is correct. The boardwalk is still cordoned off. Um, and we did lose the gazebo that was out there. Um, it's now in Lake Sumpter. Um, we will be working on the process of working with our claims adjuster as well as our consultant. That helps with our, um, FEMA claims for permanent work. Um, so we'll be seeking any type of reimbursement available to us, whether through insurance or, or FEMA for those items. But we, we continue to do those damage assessments and work on all that documentation. So if we get any reimbursement from FEMA that would be contributing towards that, the remodeling of that whole area, which, Yes, that came up at the project wide advisory committee meeting. And that was a specific request that if there are any type of funds received associated with that, that it would be earmarked essentially for that. Mm-hmm. The rebuild. Okay. I will also mention that, uh, over the last few days I've been receiving copies of, uh, various news releases and so forth. You've probably seen the same thing I have. Mm-hmm. Um, and particularly the information as far as fema. Um, there, there's been a, a lot of talk online and so forth and pros and cons and why we even getting funds from payment and this, that and the other, or, you know, why are they taking so long or the information that is out there as far as those news releases or whatever I suggest to any of you, any of our residents or whatever, have any questions, make copies of this and give it to 'em. And it, it's very informative. Mm-hmm. It is. Okay. Uh, anything else as far as the storm cleanup? Anything else? I think the next item would be C code. Uh, right before that. I do have a save the date for government day. Um, so Saturday, November 2nd, please make sure to mark your calendars from 10:00 AM to noon at Eisenhower. Um, you do have a signup sheet that's floating around. Um, so this is a great opportunity for residents to attend. It is open to the public. Um, all of the local, state and federal agencies serving the villages will be in attendance. We take up, we take over the entire facility, um, for that time period. Um, but a representative from each district board will be in attendance as well for all of the district boards throughout the community to interact with the residents. Is that your moving day? I'm not sure We've got, Yeah. Okay. I'm gonna leave it up to Ms. Bell and Christine, uh, pick your spots or whatever. Jim, I understand you got a lot going on. If you cannot attend, uh, fill in where you can and I'll take the other empty spots for that day. Uh, just FYI that is also, um, like I'm in Sumter County Amnesty Day. Yes. Which is from eight till eight till noon or something. Eight till two. I think it's until two at like OI think it's, I think it's until two. Yeah, it starts at eight. Okay. Thank you. Thank you. And the next item is an update pertaining to cco. Um, so at your chair is correspondence that we received, um, right before the storm. And then Cico actually emailed each individual or mailed each individual supervisor an envelope as well, um, with the same information. So essentially, as you're aware, um, you did receive a substantial increase in your, your CCO rate, but only 50% of that increase is being funded, um, in your current year, fiscal fiscal year budget. The balance of that increase was slated to begin October 1st, 2025. Um, we have been advised that CCO has received a $100 million, um, grant that is essentially comprised of funding as well as low interest loans. Um, so what they intend on doing is a cost of service study in the first quarter of 2025, um, to determine how much of that funding can offset their LED upgrades, which was a contributing factor that they had stated, um, was resulting in from the increase. Um, so with that, um, they did not commit to any type of reduction, but they indicated the cost of service study, um, would take into consideration the funding, the grant funding. Um, and then they would determine if they could lower the, the other 50% of the, the, the contribution that would come due October 1st, 2025. Um, so at this point, um, you're continuing to pay your portion this fiscal year. Um, we do feel that it's prudent, um, to wait and see what CCO will do in the, the beginning of the quarter of next calendar year, um, to determine if there's any, if the board would like to proceed with any type of, um, other actions. Some boards have directed staff to review poll acquisition. Another board is seeking an RFP on alternative lighting source. Um, with that cco, um, the CCO board of trustees did adopt a resolution where they essentially consented that they will work with district management or the district boards. If the boards truly want to pursue taking over poll maintenance or poll ownership, um, that would entail cco, a valuation consultant would have to be engaged and CCO would have to be agreeable to the valuation consultant that was selected. Um, and then they would review the offer toter, determine if it was a fair offer to acquire the polls. Um, they did indicate that it is not just the pole itself, there's the underground conductor, the existing pole, the light fixtures, and then of course the, the metering system that would be in place to continue the electricity service. Um, so that is the information that we currently have to date. Um, I'm happy to answer any questions if you have them. Based on the information that we got at this time, it's my understanding that they will be no real decision on this until probably May. Is that correct? That is correct. We would anticipate the march April timeframe is when they would have the results of their cost of service study and then may would be a reasonable timeframe to expect the actual results. Are there any districts beyond seven that are looking at poll ownership? District two? District two is They, did, they provided direction to legal counsel to pursue that? How are those, how are They being metered? Are they able to Break that down by district like That? I mean, how are they being metered individually? So poll, They are, so there is a tariff sheet, um, that accounts for their, the electricity usage charge. So when you receive the bill for each district, depending on the, the type of fixture that's in place or the type of pole material, um, there is a charge for the actual pole maintenance itself or the pole lease. And then there is a separate electricity charge. So It's just, it's just really the total electricity divided by the number of poles. Yes, the rates do vary based on the pole type for some of the larger poles like down more or Buena Vista, the, the large concrete poles, the rates varied slightly versus a pole that's in a villa unit. But is there a potential for the poles to operate differently or look differently in those two districts that are seeking ownership of poles? I think it would be premature right now to determine that because district two is looking at acquiring the poles as they are. Oh, district seven is looking at alternative lighting overall, which we we're not sure at this point what will become of that or the type of light fixture or how it would look. So how did district seven vote? I mean, did they, did the board in its entirety, all five members vote in favor of that, of checking or ownership of polls? They provided board direction and it was unanimous. Yes. Um, but at this time they all they have asked staff to do is, uh, prepare the request for proposal and that will be coming back to them in the December January timeframe. Okay. Um, for review. Um, they did indicate that they would, they would like, once we have that fine tuned, they would like to share that with other districts for review. Okay. Alright. Thanks for that information. But I think there is a, to answer your question, I think there's a potential if you start to have different districts buying their poles or you that they could choose to put up different light fixtures, you know, if they're going to LEDs, they could, they could vary. Well, and one of the reasons I asked Brittany for the, you know, was it a unanimous vote is 'cause certain of the board seven members are up for reelection. Well, they're just exploring at this point. Yeah. Right. Which is a cost. But How many of board seven members are up for reelection? Do you know? Across the, no. District, district, district seven board. How many of the board members are up for reelection That are opposed? One. Okay. Oh, okay. Yes. All right. Thank you. Bring answer. Which one of the, uh, boards two or seven are looking at Solar District seven. Okay. Now that, that could mean they take over the existing poles and put new fixtures up and that still would look different or whatever, but I, I would hope that before that starts taking place, I, I would hate to start seeing every district have different light poles and different Whatever. Yeah. And then, you know, does that become an arc issue? Yeah, exactly. Right. Um, Right. As far as our board, any comments, any suggestions? Um, I think there's another board who's looking at it and I'd be happy to look at what they find out, but That's Right. I don't, I don't see us doing anything District management aware of what you're, what you just said. What's that? Is district management aware of what you just alluded to that you are aware of another board besides two and seven? No, no. I'm saying if two and seven are doing it, another board is looking at it and once they get their results in their Oh, okay. I'd be happy to look and see what Oh, okay. What it is that they find out, but Okay. Understood. At this point, and I'm speaking for this board, so please tell me if this is incorrect, but we, we have no desire to, at this time, look at other options. We would prefer to wait and see what CCO is going to do and hopefully come back. I'm a little bit disappointed that it's going to be made before we hear anything at all. Um, and I, I really don't want to get my hopes up that it's going to be a, a huge savings to us. 'cause most of that is going toward the changeover from, uh, to the getting away from the old type fixtures to the new ones. Um, Yeah, As I understand that's not, that wasn't a significant amount of this cost increase to begin with. So I have noticed that along, along sison, um, towards DNE and Newell and all that, those lights are different and they're blue. So I mean, I, where did it, where did it start to where does it start to change? So that is a different provider. That area is under Duke. Oh, Okay. And what was communicated to us, and this is where I, there is an issue with some failure of LED lights when you start to see the blue purple color. Um, but that is a different provider and I, it is our understanding, they're not typically that color. Oh, interesting. Oh, wow. And I think it came up in one of the meetings we had with CCO that their understanding about that was that Duke was actually seeking to get those bulbs replaced under some warranty with the manufacturer. But I think they were concerned that there was the same, the same manufacturer, they're gonna have the same problem. So, Wow. Okay. Which is one of the reasons SECO waited this long to make the change that they wanted to make sure that they felt confident in the technology before they needed the change. So who provides the electricity for the southern districts? Is it Leesburg? It varies. Um, district 11, which is actually in Fruitland Park, is under Leesburg Electric District 14 that is in Leesburg is under Duke and the east side of 4 41 and some of the district one Spanish Springs area is Duke. And then sort of everything in between that is cco. Makes perfect sense, But yeah, Sure it does. Especially the fruit one from a legal Standpoint, Um, to be honest, what, uh, I know you do not represent district seven, um, but any type of agreement with CCO as far as either taking over the existing lights, I mean, there's more to it than just the poles themselves, and I understand that. I mean, but they have easement rights that go along with those poles. They have all the underground wiring, all of the, as they say, this sounds like an absolute legal nightmare to me to try to take over something like that. Yeah. Well, we'll find out after I deal with 'em for district two, that's what we are in the process of doing now. Mm-hmm. We will have well-informed counsel. Yeah. We, that's our comfort. We have well-informed counsel. You do a very good job And let you know What happened. Yeah. Okay. Any other questions, comments? Okay. No. Um, does I believe, does that conclude? No, we, next item we've got is the DE compliance and a RC annual review. R 2324. Yes. Good afternoon. Uh, Shannon Boyd, community standards. So today I have your deed compliance and architectural review. Fiscal year 2324 statistics. Um, so here you have three years worth of comparison, but for fiscal year 23, 24, um, the, you had 238 concerns reported out of those concerns, 22 of them ended up as written violation. And then out of those 22 written violations, four of those went to public hearings. And then as you see at the bottom where it says multiple concerns by one person in fiscal year 22, 23, you had two people that filed two to five concerns. Um, and then you had nobody that filed at least six or more concerns. This is the view of it, just in a graph, just so for you to be able to see, um, the trends throughout the years. This is it monthly. So this is monthly, the number of concerns and then the verified concerns and the nu number of non verified concerns. So you're at a good rate. You have over 75% verified why there may be unverified, um, violations. It could be the wrong address was given, it could be the, um, trash. It was reported that trash was out too early by the time staff got there, that trash had already been picked up. Um, it could be a law and ornament that when staff went by, it was no longer there. Some reasons like that. Those are some examples of what could be a non verified, um, concern. Out of the types of concerns, as you can tell, the most, um, number one concern we get is the appearance of the home and or lot. So that would be your, um, overgrown grass, your weeds, mold on the home, something like that. That is the number one through all the districts. That is the number one, um, concern that we get. Um, with, um, then your second one would be your a RC. So a RC would be a complaint regarding where somebody maybe, um, made a modification and didn't have a RC approval. So that's what, um, those would be. And then for the a RC process, this shows monthly how many, um, a RC applications, um, were reviewed for District 10. And as you can see, a total of 830 applications were reviewed last year for District 10, um, by the A RC committee. And That is what I have for you today, and I'm here to answer any questions that you may have From my colleagues on the board. Um, the year to year comparison suggest to me that our residents are still availing themselves of the anonymous complaint system. And so, um, I see that, uh, they still enjoy having that. That's my take away from the year to year comparison. Any other comments, questions? No. Okay. Thank you. Okay. Thank you very much. All right. District council report. Just one report, just a reminder that the next supervisor in Sunshine Law Public Records and ethics is scheduled for next Tuesday, October 22nd at 9:00 AM It'll be held at Colony Cottage. If you need hours, you can sign up for the clerk's office. I will be there. I'll be there too. Safe Visor comments Is, is the other attorney Brio Bri's gonna be there also? Yes, ma'am. Okay, good. Jim, are you, uh, taking over for Steve on the uh, Yeah. Uh, just, uh, a couple of things. Uh, they had recommended that Pwac had recommended approval of a, of a blanket draw down purchase order for fertilizer chemicals, so forth. And, uh, I'm not sure what the expected total, uh, amount of that was going to be, but at the price, uh, for that, uh, per unit. But, uh, but with executive golf, golf management, they said believe it, all the executive courses are still closed and you know, most of 'em have water. Uh, once the water recedes now, then they'll have to put out more fertilizer and so forth because so many, you know, so much of that would've just been washed out with the, you know, with the effects of the hurricane. Uh, the, they're still, uh, experimenting with car readers. They've tried two different kinds, but they haven't been up to expectations. So I guess at this point they're, you know, they're exploring another, another option for the card readers for the gates. Uh, and I guess Pimlico and Pelican were, we're, we're scheduled to be, uh, opening back up in, uh, December, but I don't know if that's been adversely affected by the, by the effects of the hurricane now. But, uh, that, that was the gist of what, um, what was conveyed at the PYI don't know if you know about that, Brittany, of the, The contract amount, um, specific to the golf course is a hundred thousand per course for input. Oh, okay. Thanks. Is there any update, I know with the system down and not being able to give out notices or whatever, uh, the last notice as far as golf courses openings, that it could be possibly several weeks before all of 'em are open. Um, is there any update to that as far as, uh, what people might be able to expect to start seeing a few of them start to open back up? I'm checking my email just to see if anything's transpired. So I expect that there will be an update coming out very soon, hopefully today. Um, so when we get that update out and finalize that will in most likely include some openings? Yes. Okay. In the near future? Very. In the future. I, I would appreciate it because my honey do list at home, just about disappear. I play golf and I can tell you, looking at the golf course out in my backyard, I'm going, that looks like months week. Me? Yeah. I, I rode by a couple of them the other day and, uh, I think mangrove, 'cause I couldn't see all the holes, but it looked like most of the water had receded. Uh, at least the greens are no longer underwater. And the, and all the paths that I could see, there was not water from TD Green like it was before. So it, it's definitely going down. Mm-hmm. But, uh, I had one of my neighbors mention that, um, one of the golf courses, I think over at Sweet Gum, they were fussing about before the storm. They said it looks like they tried to totally drain that reservoir, you know, because it was almost totally empty. And then the day after the storm, he says, I apologize, it's full. They were actively trying to lower as quickly as possible And they did in quite few of rain. Like, whoa. They really went down on that. But, uh, alright. Any other questions or any at the, uh, at the PA meeting? Uh, Steve was not going to be back for that, so somebody probably needs to be designated to attend for, Is that the November meeting? Yes. What's the date on that? Uh, I don't have that with me. It Is actually Tuesday the 12th. Tuesday Veteran day holiday on the 11th. Okay. Okay. Anybody wanna volunteer for that? Let me see. Tuesday 12th. Yeah. Where is it, Jim, You said? Uh, it is at Sea Breeze And it's like eight o'clock or Something. Eight 30 I think. Yeah. Yes. Eight 30. I can do it now. Okay. Yeah, I'll do it. It's the same room and set up. Okay. Mm-hmm. Okay. Okay. So you're gonna cover that for us? Yes. Thank you. I'll do it. Okay. Anything else? Nope. Okay. Any other supervisor comments? Ms. Bell? None from me. Just been, it's been a pleasure working with everybody and we're gonna miss you again. Bill. It is great. Well, two, but happy wife. Happy wife. We all understand that. Yep. Lot closer. And the kids. No, nothing. Thank. Okay. No other comments? Motion to adjourn. Make motion we adjourn. I'll second the motion. All in favor? Aye. Aye. Aye. Meeting adjourned.

Yeah. Yeah. Does that mean I can call a special meeting on N
