COUNTY OF COLUSA, CA 2.3 Request For County Board of Supervisors Action Updated: 5/ 12/ 2025 11:01 AM A Page 1 MEETING DATE: May 20, 2025 DEPARTMENT: Public Works/ Road Department FROM: Scott Lanphier SUBJECT: Approve Agreement with Stony Creek Water District to Transfer Water to CSA # 1 for a period of Twenty ( 20) Years. Approve Agreement with Stony Creek Water District to Transfer Water to CSA # 1 for a period of Twenty ( 20) Years. Detailed Description/ Background of request The waters of Stony Creek have been adjudicated by the Federal Court in Sacramento and the document describing that adjudication is commo nly known as " The Angle Decree". The adjudication calls out specific uses of said Stony Creek Water. In order to avoid the problem of routinely using Angle Decree Water for other than the adjudicated purpose the County entered into a water transfer agreement with the Stony Creek Water District ( District) in August of 2005. That agreement expires in August of 2025. The Stony Creek Water District is supportive of renewing an agreement with Colusa County for the purposes of continuing the water transfer to CSA # 1. The attached agreement provides the language similar to the prior agreement and provides for up to 91.025 acre feet per year. Typically, the County has purchased anywhere from 10 acre feet up to 20 acre feet per year, with costs varying year to year. In 2024, the County paid $1,714.50 for 18 acre feet of water at a total cost of $95.25 per acre feet. That cost includes $55.25 for the water and $40.00 for an administrative fee. Staff is requesting a renewal of the water transfer agreement with the Stony Creek water district for a period of 20 years. Prior Board Action Authorization of C05-191 Water transfer Agreement August 9, 2005 Authorization of $8,000 for Environmental Services by BOR to Facilitate Agreement Fiscal Impact/Funding Source Approximately $2,000 per year (varies) from fund 182 which currently has a cash balance deficit of $-877,077.05 as of April 24, 2025. C0S- 191 AGREEMENT FOR THE TEMPORARY TRANSFER OF WATER BETWEEN STONYCREEKWATERDISTRJCT AND COLUSA COUNTY FOR SERVICE AREA # 1 ( CENTURY RANCH) This agreement, made this C/f!,--day of AlL(f '--"'-\;f' , 2005 between Stony Creek Water District ( herein referred to as " the Distrid ") and the County of Colusa, for the purpose of obtaining and providing a temporary supply of water for the Community Service Area # 1 ( Century Ranch) water system ( herein referred to as " CSA # 1 ") for a period of 20- years. Recitations: 1. The District has a contract with the Bureau of Reclamation ( Contract No. 2- 07- 20- W0261) whereby the District removes water from Stony Creek upstream from Black Butte Reservoir in exchange for water in Black Butte Reservoir. The times of removal of such water under that contract are between March 1 and November 30 of each calendar year. 2. Although the quantity of the water supplied to the District under the aforementioned contract are inadequate for the eventual needs of the District, there is a small amount of water available under the District' s contract with the Bureau of Reclamation which can be made available hereinunder to the diversion facility on a temporary basis. The District is not a public utility, and its ability to provide water is limited by many natural and political forces and it does not have the ability to physically deliver water under this agreement. The CSA # 1 will be restricted under this agreement only to water that is available from natural stream flow adjacent to the CSA # 1. 3. The CSA # 1 has three other sources of water and therefore is not, and will not be, wholly dependent on this agreement for a critical supply. The other sources of water supply for the CSA # 1 are: A . Three groundwater wells ( Well # 3, 6 and 7) which currently supply 100% of the water for the CSA # 1. 4. The CSA # 1 wells ( item A, above) are proving to be inadequate to provide M& I water during the eight months between April 1 and November 30 of each calendar year. 5 . In order to avoid the problem of routinely using Angle Decree Water for other than the adjudicated purpose the County of Colusa desires to purchase water from the District as provided herein, subject to all the natural and political conditions which may prevent performance on the part of the District, and the District is willing to sell and " transfer" water subject thereto. 2.3.b Packet Pg. 24 At t a c h m e n t P r i o r W a t e r T r a n s f e r A g r e e m e n t C 0 5 1 9 1 C o p y 1 0 5 0 1 C S A 1 W a t e r T r a n s f e r A g r e e m e n t t

6. The waters of Stony Creek have been adj udicated by the Federal Court in Sacramento and the document describing that adjudication is commonly known as The Angle Decree". The court bas appointed a Water Master for Stony Creek and Tributaries ( currently Mr. George Wilson, who maintains an office in Orland in the Building, occupied by the Orland Unit Water Users Association). Thus, as a Marshal of the Federal Court, it is the job of the Water Master to enforce " The Angle Decree" in a fair and just manner. The Water Master has been involved in the negotiations lead ing to this agreement, and has authored portions hereof, and ofcourse, will be involved in monitoring its implementation. 7. All parties involved are aware that in the event of a severe drought a water shortage may occur which could require a reduction in diversions to the Facility. All diversions on Stony Creek are.subject to prior water rights. The Water Master will determine if diversions need to be curtailed in order to avoid infringing on downstream Angle Decree water rights. 8. It is the parties' understanding that Sec. 3405(a)( l)(M) of the CVP Improvement Act (Title 34 ofP .L 102-575) authorizes the transfer of water from the 2920 acre- foot supply ofStony Creek Water District. Now therefore it is agreed as follows: 1. All the above statements, including the title, are incorporated by reference. 2. The District will transfer to the CSA #1 not more than 91.025 acre- feet of water between March 1 and November 30 of each calendar year. Said water is to be removed from Little Stony Creek at a maximum rate of 75 gallons per minute so as not to disrupt downstream flows in any significant way. This rate is equival ent to 0.168 cfs and over a 24 hour period yields 0.331 acre- feet or I 08,000 gallons. 3. Since the District must order and pay for water at least two months in advance. An order and appropriate check must be received from the County of Colusa by the D istrict (currently Mrs. Jessie Westcamp, Secretary, 940 County Road 303, Elk Creek, CA 95939, phone number 963-3085) sixty (60) days prior to delivery. The County of Colusa agrees to discuss this schedule with her and agrees to purchase a minimum of two ( 2) acre- feet per month between March 1 and November 30 of each calendar year. 4. Fees for review of this transfer agreement by the Bureau of Reclamation have been estimated not to exceed $ 500.00 and a check for that an1ount is due to the District upon signing of this agreement. This amount will be deposited with Bureau of Reclamation; any excess will be refunded to the County of Colusa, and any such additional costs shall be the ob ligation ofthe County of Colusa. 5. Costs of Municipal and Industrial ( M&I) water are greater than for irrigation water. It will be assumed that all water transferred under this agreement is for 2 2.3.b Packet Pg. 25 At t a c h m e n t P r i o r W a t e r T r a n s f e r A g r e e m e n t C 0 5 1 9 1 C o p y 1 0 5 0 1 C S A 1 W a t e r T r a n s f e r A g r e e m e n t t

domestic use ( M& I) unless otherwise stated in the order, paid for, and measured accordingly. Costs charged by the Bureau of Reclamation are available from the Bureau of Reclamation in Willows. The County of Colusa agrees to pay these rates as charged to the District by the Bureau of Reclamation plus an administrative fee for the District of $40.00 per acre foot of water ordered ( or used if ordered amount is exceeded). Costs will be adjusted on an annual basis, but the administrative fee shall remain constant. 6. All water diverted under this agreement shall be metered and diversion records will be kept and made available to the Water Master. 7. Since the Officers and Directors of the District are volunteers working without compensation, and since the District has little or nothing to gain except the goodwill of the Community, its Directors, Officers and the District itself will be unable to defend either themselves or the District against any legal challenge to this specific agreement or behavior associated with it. Should any such challenge arise, the District would expect the costs to establish or retain this agreement as valid to be borne by the County of Colusa and the County of Colusa agrees to consider any such costs should they arise. These costs could include those necessary to establish compliance with NEPA, ESA, FWCA, CEQA, CESA or similar environmental laws, or costs associated with an attempt to pacify downstream holders ofprior water rights. 8. No transfer of water under this agreement shall confer any appropriative, public trust or other right on any person on entity. 9. It is agreed and acknowledged by the parties that this agreement has been arrived at through negotiation, and that each party has had a full and fair opportunity to revise the terms ofthe agreement. Consequently, the normal rule ofinterpretation that any ambiguities are to be resolved against the drafting party shall not apply in construing or interpreting this agreement. 10. The County of Colusa agrees to hold the District its Officers and Directors harmless with regard to unintenti9nal oversight in the execution ofthis agreement. 11. If any provision herein is found to be contrary to any federal State or Local law, the remaining provisions shall remain in force. 12. This transfer requires the approval ofthe Bureau ofReclamation and will become valid only upon such approval. 13. This agreement may from time to time be in conflict with prior downstream rights, including those defined in the Angle Decree, Equity No. 30. The County of Colusa shall allow access to its diversion facilities by the Water Master appointed by the United States District Court for the Eastern District of California 3 2.3.b Packet Pg. 26 At t a c h m e n t P r i o r W a t e r T r a n s f e r A g r e e m e n t C 0 5 1 9 1 C o p y 1 0 5 0 1 C S A 1 W a t e r T r a n s f e r A g r e e m e n t t

to determine compliance with the tenns of this agreement. In diverting water, the diverter shall comply with orders ofthe Water Master. 14. Both parties hereto agree that this temporary transfer is in the best interest ofboth parties and their users until such time as the Bureau of Reclamation can write an exchange contract directly with the County of Colusa for the CSA #1. At the end of this 20-year period both parties agree that ifthe County of Colusa has not been able to contract directly with Bureau of Reclamation that they may re-negotiate for continuation ofthis transfer subject to water needs and availability.
