Several other agenda items, including a youth services agreement and presentations, were removed or canceled.

Why it matters

SCHOOL SUPPORT SERVICES, JONNY BISHOP - Planning and Growth Management, Chuck Dixon Subject SQF Right of Entry and Testing Agreement Meeting Jan 10, 2023 - REGULAR SCHOOL BOARD MEETING Category VII. SCHOOL SUPPORT SERVICES, JONNY BISHOP - Planning and Growth Management, Chuck Dixon Type Action Preferred Date Jan 10, 2023 Absolute Date Jan 10, 2023 Recommended Action Execute SQF Right of Entry and Testing Agreement The subject agreement authorizes SQF, LLC a telecommunications consulting company to enter specified District Facilities where the old Trillion monopoles are located on behalf of Tilson Infrastructure, LLC to inspect the monopoles to see if they are suitable for cell service single users. Tilson Infrastructure has approached the District about acting as a middle man to lease one or more of the monopoles specified in the agreement to a cell provider in exchange for compensation and removing the other monopoles that are no longer being used for communication services. The monopoles were placed at 26 sites in 2004-05 for the District Computer Network. They were owned by Trillion Digital Communications, LLC pursuant to a Master Lease Agreement that was executed by the School Board on January 27, 2004. Trillion Digital Communications, LLC went bankrupt and their assets were acquired by TX Communications, LLC d/b/a as Affiniti in 2013, and the assets have been subsequently transferred to Alternative Energy Solutions, INC d/b/a CLR (Communications, Land & Real Estate). The company owns the assets pursuant to the terms of the original Trillion lease agreement but the School Board owns the land and there are no easements or access entitlements that go with the assets based on a review of the records. In summary, Tilson Infrastructure, representing the owner of the assets, would like to explore the potential for using seven (7) of the monopoles for cell phone use. Staff believes it is in the best interest of the School Board for two primary reasons: 1. Cell phone service in these areas is poor and cell antennas in these locations would improve the service for staff, students, and visitors. 2. The other monopoles eventually need to be removed and this would cost approximately $16,000 per monopole since the monopoles are no longer being used for the District Computer System. and also, if the monopoles are suitable for cell service, they will generate income for the District over the lease period, and then be removed by Tilson, LLC at the end of the Lease period (subsequent to to the terms of a lease). If the SQF, LLC tests are successful, and Tilson, LLC proposes an agreement, it will be brought back to the School Board for consideration along with a recommendation from CCSB Staff.
