class sir, if I MAY say , every time I call this office and every time I see him in public he treats me greatly. His staff does amazingly so I rock with him >>chair: complement time for kionne. Okay. >>speaker: my name is scott paulette and I was at 21190 mainsail cir., 33180. As a member of the online coalition I opposed item 4e , the udp application. Hold the line fights for smart land use policies and sustainable development by upholding the urban development boundary which is one of miami's best remaining tools. Low acreage in this property alone is small but it would set a bad precedent for further development outside of the udb which we should be avoiding at all costs. This is a textbook example . Udb applications should only be considered if there is a need presented which there is not in this case. We should instead be focusing on making miami-dade more accessible and affordable, mainly building public transit and reducing the use of septic tanks countywide. I know the coalition is concerned this application would add another septic tank to the next. I want to express my support for item 11a5 on building speed regulations for residents in biscayne bay. Thank you. >>chair: public hearing is now closed. Met him attorney the agenda . >>translator: chair order of the day provides at 11:30 A.M. Those are your first reading items. >>chair: public hearing is open on all these items, I have 2 names listed. Mercedes cabrera , the item with which you speak on has been deferred and knoll cleveland. Please come forward and give me your name and address and you have 2 minutes, I believe you are taking on item 5e . >>county attorney: 5e is a quasijudicial matter so he would have to be sworn in. Let him swear you in. >> raise your right hand. >>speaker: who am I looking at? >>chair: it doesn't matter, just raise your right hand. >> use where the testimony you are about to give is the truth, whole truth and nothing but the truth so help you GOD? Hank you. >>chair: thank you, proceed. >>speaker: I live at 5990 sw. 50th st., miami, fl 331 >>speaker: I live at 5990 sw. 50th st., miami, fl 33155 here to speak about the boat show. I wanted to check mostly to see if this is being coordinated with the city of miami. Working out changes to accommodate 72 parking spaces for 40 foot trailers and a limited entry to enforce the dawn to dusk uses for the stadium parking lot. This needs to be something that's going to conflict with what the boat show plans are and just wanted to make sure city of miami and the county are working together fr that restriction. The environmental concerns have been discussed, I don't think they been addressed with this resolution but I'm sure you're going to try to take care of that, the idea is manatees will go inside the basin doesn't make any sense to me, it's water and are going to go to the safest place they can so I find that a little odd. It's a similar issue with the construction of the pedestrian walkways. With no mention of how sunset miller and choral way will be handled we have a proposal for $50 million to be coordinated with f dot but these other arterial roads need to be addressed as well and we have a safety issue with that linear part that doesn't address how pedestrians and cyclists will get across those roads so I want to make sure to get it on the record that these need to be invested in as well. >>chair: thank you very much. >>speaker: I know my item was deferred so do you want me to speak? >>chair: is no longer subject to a public hearing, mme. Attorney. >>county attorney: that's right. >>chair: but thank you for coming out. Have no more names on the list so public hearing is now closed, mme. Attorney. >>county attorney: we need a motion and a second. >>chair: moved by commissioner bastien, seconded by commissioner cohen higgins. We're going to take all of them at the same time I guess. >>county attorney: you can, some are ordinances. >>chair: we can do a roll call, mme. Clark call the role. >>clerk: [Roll call] Motion passes unanimously. >>county attorney: scond readings. Class vii a relates to the rules of procedure of the board of county commissioners amending two b one of the code requiring a statement of community benefits by the mayor or mayors designee for certain agenda items related to housing development projects providing separability, exclusion from the cold and effective date, 7b relates to zoning amending 33 b 11 requiring review of plans for development of financial residential properties with respect to storm water runoff providing that measures they were be required to prevent storm water runoff into abutting property under certain circumstances, making technical changes, providing exclusion from the code and an effective date. 70 creates section 1 b eight providing for publication of legally required advertisements and are publicly accessible website with the county as permitted by section 51.3110 florida statutes, amending section 2 b 150 of the code modified maximum duration of administratively approved transit service, making technical and conforming changes, poviding separability, inclusion in the code and an efective date. Those are your second reading items class commissioner bermudez your recognized . >>commissioner bermudez: I wanted t bifurcate 7d to create a notice procedure where staff provides the commission of 30 day notice prior to making a service adjustment. Doesn't change the approval process but just gives us notice. >>chair: show the item amended . >> MR. Chair and commissioner bastien and I tlked about this on item 7a. There were two friendly amendments and I'm going to oppose, one is I mentioned giving the mayor's office 60 days to delay a housing item while writing a memo seems too long so I would amend that section which is subsection c number two to be 15 days. Theoretically they prepared their big memo so they can write the community benefits down. They should already have read about them anyway and commissioner bastien, if you're open to this, I would add a third subsection of that which essentially rather than coming in as a separate memo because the separate memos always come late, we get them the night before and this matters to you. I would suggest that we also add and this is subsection 303, or if the item includes the county mayors right memorandum approving the item and such memorandum includes a separate section setting forth the community benefits. So essentially getting these community benefits in the mayor's memo so we don't have three or four memos, we already get every memo late, that social equity site that says the same thing every time, I don't know why we do that. We get the financial impact usually wait and this would be a third thing we will get late though I think we want the mayor to include the memo. Those would be my friendly amendments in there is just let her put in the memo and if she is and then we go through your process, does that make sense? If it's in the memo fine and if not we go through the process. >> commissioner . >> thank you commissioner begins for your friendly amendments. In regards to the time, the 15 days, I think 15 days is you know, not enough time for the administration to go through the process. I would agree commissioner begins to I would agree to 30 days, but 60 days I think we need more time. I will meet you halfway and agreed to 30 days . >> would you consider having it be in the mayor's amendments? You have to understand there's a $15 million project minimum in areas with great density , that is every single thing I do. This adds a great opportunity of risk for further delays on use projects. There is not a single project in district 5 that involves housing under $15 million. Most of them are even under 150 million so they take forever, pursuant to county rules I review every rfp that goes out for county projects in district 5 and in all our projects the community benefits are based in to the rfp phase. They should be coming out in the mayor's memorandum so I just don't at least on a district 5, the other way is just exempt district 5 projects completely and I will write my own memo with every item certifying community benefits have been included I just, these things are already slow. They can take months to get out of the 29th floor. Anything that has given another month, it's for me on my big projects it's a real problem. >>. >>chair: commissioner bastien, before I go back I'm opposed to exempting any districts, that's the first thing but I don't mind it being in the memo, I don't mind at all and I don't need commissioner higgins to stay late again at the end of the sentence. Commissioner higgins, you want to speak on that. >>commissioner bastien: the fact is this process will not be late in any way. Will not delay in any way any project. The goal is to facilitate and make sure that the voices of the communities and residents are heard. This is not going to be a separate contract, is not a contract at all, it's already included in most of the projects. The only thing we're doing is making sure it is I have time. It is different than a social equity statement and I would ask gloria to explain it but it has nothing to do with it. This is something that would benefit , highlight the work and collaboration of the developers and residents. I think it's a good item and I would really respectfully ask for your support of the item as is, thank you. >>commissioner regalado: thank you. I go commissioner higgins concerns. This would slow down my district also. I will add that I share your concern about community input. And that is why the p that I have in the west grove right now as based in sunshine community meetings before, during and after because I want the community to be able to the false applying for this rfp early on. Part of my frustration in my district is by the time we get to community input everything is baked in so that's why we've been having these community meetings. It took a while to get it approved because obviously there is this misconception about the cone of silence but you are not breaching the cone of silence if you are having a publicly announced a meeting. At least in my district that's what I have found to make this into the rfp so the community can speak nice and early and no one can say they didn't hear from the community. I think that is the most impactful thing because my question about this item is where are we going to get this information from the community so early in the process? How do we know without even having meetings that this is in fact what the community wants and also in my district some of the requirements on in this item don't fit. I need more infrastructure that I need jobs. The johnson is hard for me. And you know, one of the things that we deal with is trying to create something that has the proper scope for our district and as higgins mentioned for those of us bearing the density, there are so few of us that are going to be most impacted by this and we're pushing these rfp's through and it's very painful and I do believe it's going to slow us down so I want to thank commissioner begins for her ideas. I think this is , this means well but I think this will have a lot of unintended consequences. My friendly amendment would be that we bake in public meetings that are sunshine. I think that's where we hear from the community early on and I have done that in my latest rfp. I think that would put to bed a lot of the issues because I don't see in this item commissioner bastien when we're going to hear from the community and how we're going to bake that and how do we know? What will happen is whoever gets the award we have to have those meetings and then were going to your other things. I feel like there's going to be multiple bites at the apple and we're not going to have clarity as to what the community benefit is and it just slows down. I agree we need a community benefit and it needs to be based in. I just think it would be better to do it with meetings and hear from the community sooner rather than later. >>chair: I just want to reiterate that the committee structure is meant for the amending of items. So for doing amendments that are truly substantive, that could have been done at committees, not deferred because we're doing it on the fly now. So commissioner bastien. >>commissioner bastien: thank you so much. I don't mind commissioner regalado to include the committee meetings. Whatever we can do to make sre the voices of the community is for I think would be beneficial for the process. I don't think the item will delay the process. As a matter of fact the item is meant to bring more clarity and make sure the residents are engaged, that they don't have to come after the fact to present their opposition to our efforts. I think it will not dilute or delay the process for developers. I think it will reinforce whatever the process brings. I don't mind including the community meetings , I don't mind with that . >>chair: show the item amended to include community meetings, commissioner higgins . >>commissioner higgins: I tend to agree with you with this on the fly. I expressed my concerns with this activity with this item. I also expressed my concern at the number of items listed I actually now believe in state law are illegal. For example, as you know we've been preempted on apprenticeship programs. We've been preempted on wage benefits, it mentions job-training programs, all those things we are now forbidden to include. So this item was drafted in a well-intentioned manner before tallahassee took away all of these things. I actually am not sure if it's legally sufficient. Is well-intentioned but a memo at the end , I decided I go to financial closing there they've already been worked on for five years. So I just can't support something that slows it down when the community benefits need to be baked into the rfp process we each know our own community benefits that are needed. I don't need any septic conversions. Pardon , I defend housing all the time every day as you people probably are sick of. So often my community benefits would much rather than apprenticeship program I rather have in other 20 units of affordable housing, all other couple floors so I think our districts are different. I just think this is another administrative burden, the mayor was over here telling me writing this memo could take months which of course mystifies me I think it would take me half an hour. I've read all these contracts, their long that takes me two hours and I have a highlighter if anyone needs to borrow one area at the end of the two hours I know I could write the memo. So anyway respectfully I think I'm just going to have to vote against this item, thank you. Class thank you. Sure. >>commissioner regalado: can we send it back to committee, is that an option? >>chair: know. Just to the attorney, as is the standard procedure all our legislation has a separability of one part. So it's going to be legally sufficient even if we can't implement all of it. What's legally implementable will be legally implementable just to put people's mind at ease on whether it's legally sufficient . All right. Yes, are you going to move the item? Class as we know commissioner, the florida legislature preempted critical programs in our county however in this community benefit package does not mandate any additional community benefits. It simply requires the community benefits are agreed on our organized and decentralized in the fashion that promotes transparency and of responsibility contemplated for our residents so I'd like to move the item. >>chair: seconded by commissioner cohen higgins, rollcall class MR. Chair, MAY we confirm the other two amendments commissioner regalado had a statement regarding community meetings and the 30 days instead of 60. Thank you. >>chair: thank you, call the role. Class . [Rollcall? Senator garcia. Commissioner gonzales. [Rollcall] Motion passes 9 to 4. >>chair: let's move on. Class let me ask, was that 78 as amended, 7d as amended, is that a motion on all 4? >>chair: yes it was. We will do that one and I move the balance of the items. It's been seconded by the vice chair, any comments, call the role. Class. [Rollcall] [Rollcall] Motion passes unanimously. Class MR. Chair, I have a question . >>chair: you are recognized. >>commissioner hardemon: and I'm saying this one as a caution because we just voted on item 7c area and I have an amendment, I still do in reference to the work of 7c to allow the publication of to allow municipalities to publish as well as the county. So I wrote out the amendment. However I would advise , I was advised we should include in the language of the item 11a3 which is direction to the county mayor to provide for the legal advertisements. Though I just want to be stated on the record so that we are clear as to why it's preferable there. Rather than in item 7d. Class the item 11 a3 is the direct it to the administration to create the county website in compliance with chapter 50 of florida statutes. That is the website that these utilized so the amendment that you and I discussed would pertain to that particular item. Second reading item is amendment to our county code provides balances for the county to publish on the county website any required notices. >>chair: let's take up 11 a3 class I wanted to say something and be clear. Essentially the amendment that I wrote what I had wrote it now so now they have it. I don't have a physical copy in front of me, I'm trying to see if I can find it. But the amendments I wrote essentially it reads like this. Other government agencies that use a publicly accessible website t publish legally required advertisement notices are not prohibited from maintaining their own website. Those government agencies shall provide miami date county a link to their advertisements and public notices which shall be placed on the county's designated website so I think I'll do a definition section to explain what a government agency means. So in municipality, school board or any subdivision in the state. The reason I say this expressly is because many people would say the way this is written does not preclude municipalities from advertising. It just requires the county does let you know how lawyers are, one person doesn't preclude and one says it specifically states the county does it. So that's why I want to be clear, I don't know and I look to my friends also to say look, it's sufficient legally at 11 a3. It is sufficient legally in 11a3, that's fine but if an ordinance to be codified we should have the ability to do this and I wish we could do it in the ordinance as well because I don't want anyone saying it's not in the ordinance, it's only in a direction. And the direction is not something necessarily the municipalities have to adhere to, they need to adhere to the ordinance. So if it does not harm the ordinance in 7 see what I would do is reconsider 7c to have it included because it makes me a little nervous when I see an ordinance passed and then I see a resolution that I direction and then is supposed to have the same result when the spirit is a little different for me. >>county attorney: commissioner, if you wish to reconsider the item to put it in the ordinance, that's an option because the title is broad enough to encompass that. Another option is we be happy to prepare an item for you. To codify what we believe is appropriate included included in 11a3 as part of the ordinance. The ordinance related more to the county's ability to use what the county is required to provide notice and it relates more to the county's ability to place that notice on electronically permitted system. If you wish to expand the ordinance to also include what is being provided in 11a3 to allow the municipalities to use the electronic sstem if that's okay, we be happy to prepare a separate item that's the main reason why the amendment is more to 11a3, is because it deals with the ability for the municipalities to use the systems whereas the ordinance itself just is what the county notices, that the county has required to place because of state law. >>commissioner hardemon: so you're confident then that the amendment to 11a3 is sufficient . >>county attorney: the amendment to 11a3 is sufficient. I understand there will be another amendment and the mayor is being direct it to prepare a policy and procedures to allow municipalities to avail themselves of the county created system. However it's up to the board if they wish to strengthen that , you're right it's in a resolution and it's a policy directive if they wish to strengthen it we could do that vis-c and we wuld be happy to prepare the item for you speed. >>commissioner hardemon: I'll ask the same questions and hopefully you can give me a yes, sir number is it necessary to amend the ordinance in order for us to affect the amendment that I provided for you? >>chair: >>county attorney: no commissioner. >>commissioner hardemon: we will take 11a3 with the amendment. >>chair: show it amended. >>county attorney: I believe senator garcia also has an amendment. >>chair: you are recognized. >>county attorney: senator garcia moves 11a3 to direct the county mayor or designee to direct a form use agreement by the county or another government in miami-dade county when such government wishes to use the county's website to publish legal advertisements and notices. Such agreement will include provisions to use the county's website shall be at no cost to the county and address and provide for indemnification and duty to defend the county, cost and payment for the county, and indefinite agreements are not to exceed four years with an possible agreement to review and the designee to enter into the agreements and require some reports on such items. >>chair: sen., on the amendment, the delegated authority is once we've approved the form the mayor has the ability to enter into it or is it on the creation of the four? >> this would delegate the ability to the mayor to create the agreement and thereafter to enter into it and report to the board on agreements entered into and the contents . >>chair: I believe the initial creation of the form because it's something that's going to bind the county in agreement with other governmental entities, we ought to be heard on creation of the form once we create the form she can enter into it. All right. So the item is amended. >>vice chair: to commissioner hardemon, can you backup here? What are we trying to accomplish with your amendment? We are allowing municipalities to advertise on their websites? As opposed to the county because I'm a little confused. My understanding was when this law passed its passing to help municipalities because of so forth so my understanding was by the law to please explain this to me, I thought it had to be done on county websites, not in municipal websites and I'm just confused about what the amendment actually just did . >>commissioner hardemon: you want me to explain first? >>county attorney: my understanding is to clarify that while you are correct the statute requires cities to publish their notices on the website that this makes clear there's nothing in the law that precludes the city from maintaining an additional website for additional notice and if they do so to provide a link on the county website for use of reference so this would be an additional method of notice. Just in the same manner the county in addition to publishing on their website it could do additional publications and community papers and things like that. 's before so it's an ad, not in or. >>county attorney: this would be additional means of notice. >> wouldn't that men have compiled anyway? I think it would have been allowed anyway, right? Class that's the question. Is not precluded. >> show the item amended. All those in favor signify by saying aye. Those opposed, moved by garcia, seconded by the chair. Speed >>county attorney: you are on your pull list, first item is 881 . >>chair: I got you on here but you pulled the entire agenda so let's release that. >> I move 881 . >>chair: seconded by the chair, all those in favor signify by saying aye area show it passing . Senator garcia. >> were talking about doing a program for human trafficking, what why did we get this organization to partner up with ? Commissioner , whose department? >> sergeant cruz is the officer in question. >>chair: you are recognized . >> the question was why the organization was chosen. We have a private funder and the private organization is focused on labor trafficking. They've researched the south dade community area and the most population of cultural area they've interviewed several organizations and departments in the south region. They chose miami-dade police department as the law enforcement department class MR. German if they went through a vetting process , if the one organization has stepped up we haven't picked one. >> they picked us at the law enforcement side to investigate law. >> they picked you as a non-for-profit organization involved. >> they also picked the private organization. The risk committee and miami-dade police department. >> I'm moving the item. >>chair: moved by commissioner garcia, all those in favor signify by saying aye. Show it adopted. 81, bermudez and garcia. Release. >> thank you MR. German. >> I just have some questions of the ministration and I'll be supportive of the item but some of these applicants met the criteria and some did not. So my question is going to be basically , there's a lot that don't meet the criteria. For those that did not meet the criteria the item states we will fund them on the condition they meet the minimum threshold right. Within a timeframe determined by the administration . Can you tell us and elaborate on what that timeframe will be and how much time you anticipate you will need. >> bring up director to answer that. >> good morning commissioner, dir. There will be a timeline, it's six months. It's a loan program, we're forwarding the smaller development community the opportunity to come in for technical assistance, that wll get them through the threshold and if they cannot they will not be funded. >> that's important. One question is have you done this before but the ones that don't meet the criteria, are we doing this because they are smaller developers, you can just give me an idea. >> were doing affordable housing, we feel these are right at the cost of getting to the finish line and providing technical assistance they require. But if they can't then we will have to go back to the drawing board . >>vice chair: the last thing is something I harp on all the time. For those that did not meet the criteria for the ones that met the criteria and the ones that did not, are we tracking these awards, the timeline, how long they're taking and in particular both, the ones that meet them and the ones that don't but my concern is we should track other things. And that's really do we have a system where we track this? >> absolutely, we tracked this as we like to say, we can't measure, we can't manage. We provide a portfolio report that shows the surtax issued, development and timeline to produce. >>vice chair: said so if I go back to you six months, eight months from now you will be able to tell me this one that did meet the criteria wasn't able to meet it and the ones that did you can tell me what the status is on a particular project, correct? Thank you. I'm fine with it. Anyone else? MR. Chair. Commissioner gonzales, you are recognized . >>commissioner gonzalez: so the criteria are not changing. These are getting additional time to meet the same criteria, correct? >> correct. >>commissioner gonzalez: it says satisfaction of minimum threshold criteria by the date of financial closing in six months or whichever comes first . In order for them to get funded they have to meet the criteria. >> that is absolutely correct . >>commissioner gonzalez: I am good. >>vice chair: anyone else? Move the item. >>vice chair: all in favor signify by sying aye. Commission, the motion carries. 8l1 class we're seeing where coming into contract with fsu, why are we not doing it with any of our local universities or institutions here? We can do that with someone in miami-dade county. >>vice chair: do we have someone in the administration wishing to speak. >> kim brown, director of resilience planning. So the nature of this work is to create create a greenhouse gas plant with the grant we received through epa. Given it was a four count effort alone of our research was conducted through the regional climate change compact and what we found was fsu had the unique expertise housed under one umbrella of energy policy , economic development and the social issues around energy burden s that was the reason for choosing fsu. In addition they had a recent national science foundation grant. Sorry, I am winded. It's a long walk up here . >>chair: how long was the walk? >> on a national science foundation grant that looked at energy per any kind of enhancing ways for other represented communities to participate . >> is just to make a point that we have a lot of great institutions and it's important we look at the institutions and if it can be one that does it all maybe we can do it with two different ones and therefore looking at the four county region, miami-dade broward and monroe and there's something we should be able to get there but I'll go ahead and move the item . >> moved by senator garcia, seconded by commissioner bastian just to correct we do have something against fsu. >>vice chair: I didn't want to do that on the record. >>chair: all those in favor signify by saying aye. Show it adopted. Now we are on 8 l2 is released. >> I'll be brief. I'm going to support the item because I got information from staff but the only thing I'll point out is in these memos it would be great if we could just get a record of the company that didn't do their job. Just so we know for future reference and I hope that department is tracking that. That's my only comment, I'll be supportive and move the item. >> all those in favor signify by saying aye. Joey reported favorably. That's 8p1. Senator garcia . >> if I MAY, 8p1, two, four, seven. And 10, I have the same issue on all the. >> lets you them altogether. >> this is to the administration, we passed a resolution here about prequalified pools. They were supposed to get back to us i think in JANUARY for a report on how these pools are working and unit prices and so forth. Now we are on APRIL 2 , APRIL 2 and we've yet to receive any information. And I asked what is the status and was taking so long. >> through the chair, chief procurement officer will print that the report is done and we're waiting to review so we've reached out and would like to brief you before we issued it so we make sure we address your concerns area. >> good morning, namida chief procurement officer. The report is ready. Instead of doing the report when we pulled out the data it showed us 40,000 records and that was no way of giving you the report in a excel spreadsheet so my team is working with the it team to put together a dashboard that will give you the information real time and you don't have to ask and we're hoping to present the dashboard to you and your team and cc all the components are covered in the dashboard so we will be happy to do that this week if possible. And hopefully bring the report to the next aailable agenda. >> MR. CHAIRMAN, mme. Mayor. And I to understand this report is not for renc for the county commission. This county commission voted on our item, we were given extra time and not until I pull the item did receive an email from the administration being we've got to talk to you now so that means either I'm not respecting district 13 is not respected for this commission is not respected this is where I get a little frustrated with the process. I sit here and I take everyone at their word. Things are being done. And then we have an item like this and it is complicated. But no information is coming back on the status. So what can we expect moving forward on issues like this. Because I get he's asking the questions, but I ask you the question because we had a great working relationship or I thought we did then to have this information only come to me the day I pull the items and I don't know what we're trying to accomplish here. >>speaker: to all commissioners, very often when there's an item you bring that is a report, direct is to do a report I have asked my directors to come to you with a report before publishing to make sure we've answered your questions so I apologize if this has led to some additional time and it was very complicated and did have to require an it solution to come up with a way to analyze all the data so it was directed, I don't remember when I was briefed on this report in the recent past I did suggest they go to your first area I apologize if that has added time but it was out of no disrespect, quite the opposite it was designed to make sure we could produce a report that would satisfy you. >>vice chair: thank you very much namida. >>chair: hold on, I've got to recognize bermudez on this. This is just senator I think your points are well taken. It's always good to brief a commissioner who sponsored an item before the item comes back but that briefing the street the timeline of getting it back because once the board takes the vote is now a board direct if that was sponsored by a commissioner and not just a commissioner director I appreciate the mayor and her team diligence but it's our expectation that we're either going to get backward to the extension, we're going to do something so I appreciate you working with them it is definitely to come back to the board, commissioner class I'm not talking about all four of the same time. My issue is simple but a little bit different. This is about procurement again. Regarding these prequalification pools if you look at those four items you'll see the requested allocation is often significantly larger than the reasonable contract award. I understand there's been inflation and everything is gonna but it's in some of these cases the allocations are quite significant. And they deviate from the initial reward. 8p2 is going to 3,002,000. 851,000, epa is going from my 19,753,000 to 54,632,000 to 851,000, epa is going from my 19,753,000 to 54,632,008. >>speaker: is going from 997,000 to 1,000,389 so while I understand it's not uncommon really mme. Mayor for the administration to extend approval, I think some of these things have to be reasonable and I know that it's got to be a reasonable thing in some instances and it's an expeditious theme thing to do but I think we need to take a closer look to see if it's in the best interest of the county going forward from a competitive standpoint. Those are substantial differences and nothing against some of the entities in those pools at this time but those are srious, serious differences and while there MAY be some valid reasons , I just think if that's the case and where having these jobs and I know smebody's going to tell me there's more employees here, more employees they are, that's great but these are substantial jobs. I think there has to be something done to make this more competitive . >>chair: items have all been moved by senator garcia, seconded by the chair. All those in favor signify by saying aye. Show them adopted. The next one is 8p12. I think I pulled it for an amendment first, mme. Attorney, 8p12. >> CHAIRMAN Gilbert moves to amend item 8p12 as per the printed supplement number 22 item 8p12 which has been distributed to members of the commission. >>chair: moved by the vice chair, seconded by the chair. sen., you are recognized . >>commissioner garcia: I see what we're doing here, we're trying to help a local business with the high cost of inflation . It's stagnating americans especially here in miami dade county but we're seeing a cost of living increase and I'd be happy to help with that but this contract took about two years to get a denial from this administration on an adjustment. And my question to the administration is why did this local vendor have to wait 2 years for a denial and then now come to the county commission for an authorization? >>chair: okay. Mme. Mayor , mme. Mayor . >>mayor: I'm looking for a representative from the department of transportation. >>chair: they are off to the right. Transit, you all stand up. Let me just remind you all we have to finish this meeting by 11:30. It is 11:05. >> I promise I'll be quiet. >> commissioner and through the chair, transportation director. Because of the changes to this particular contract I think it's relevant to form an evaluation review. Some time doing the calculation on the difference and minimum wage and cpi adjustment and during that time came up with the $207,000 that was reflected. Our additional conversations required more time for review so that's the reason. Some of these items would condense the time. They're coming before us anyway and there would still be an increase. I'm not a big fan of giving these increases but the contracts were signed already and I understand because of certain things happening around us where inflation is skyrocketing and gas prices are going up it makes it harder for these new businesses to work with us at the county and we have to give them some relief but at the end of the day we're going to do it for one, we have to do it for everyone and I wonder how many of these will come back before us. How many of these will come before us and what does it cost to the taxpayers of miami dade county because we keep on paying more, asking for more. I move the item that MR. Chair. >>chair: seconded by the chair. Let me add context for this item. This item provides bus service for residents who primarily work in south dade to get to monroe county. This adjustment was on for the other transit services and I'm not sure why it took so long. I apologize for the change but the numbers changed for the administration so we changed it back but I appreciate the administration the work they've done on this, mayor and jimmy, thank you all for this and I like to add that this actually helps our residents get to work so I appreciate it, it's been moved and seconded, all in favor say aye. Show the item adopted now we are on 11a1, senator garcia. >>commissioner garcia: MR. CHAIRMAN, I make a motion. This is MR. Bermudez's item. We were having an issue in my district with robert , we'd like to see if they can add that to your resolution to look at the specific staff that was removed . >>commissioner bermudez: I know we're all having issues with different stops, I'm fine with that if that's the case. The intent of this is to have a report so we can evaluate what we did last fall actually had an impact on our transportation. We agreed to waive all these fees, fairs and I want to see if it actually worked . >>commissioner garcia: for the record it's robert fulcrum towers. >>commissioner bermudez: is the item moved? I will second. >> MR. CHAIRMAN that was as amended as well . >>vice chair: that was 11a1, we are on 11a4 mme. Attorney. 11a4, district 5 commissioner you are recognized as one of the appalling commissioners. >>commissioner higgins: this is one of those rare cases where an easement suddenly, I can't remember where we had red letters written about that. I did go back and watch the committee and it doesn't seem ... There's so many sides to this story I don't know which side is up and which one is down but it seems there is new information that's been made apparent sense to me. We have one item which basically gives us property over to an individual who I guess will divide it up among her neighbors even though one of the houses is up for sale, I checked it out yesterday and on the other side we have this idea of turning it into a public space in our part at a time when we know green space is certainly at a premium. I don't know. It seems this needs to go back to committee and the public hearing needs to be reopened so we get all sides of the story before we have to make a decision. >>vice chair: commissioner from the seventh district you are recognized . >>commissioner regalado: I concur with commissioner higgins. I think after the meeting we were bombarded with different information which wasn't discussed at cmmittee. I think it's for the benefit of everyone involved if we really notice this and send it back to committee. The alternative is if we vote on it it's just going to end up in litigation and it's going to be delayed for everyone. Without making a decision as to the merits it's better for us to send it back, notice it and deal with it at committee where we had the opportunity to hear from everyone and get a little clarity on this process because the way it was permitted to us, we had questions as to what would happen contractually. i'm happy to second that motion, commissioner higgins and take it up in committee . >>vice chair: I don't know if there was an official motion on the table. >>commissioner higgins: I will transform it into a motion. >>vice chair: we haven't even heard from the sponsoring commissioner from the district . I have comments on it too. I guess my concern, I was on the committee before us not to long ago and I remember all the public hearing. I am more concerned about making this a habit. We went through the process, went through the legal process. People wre hurt. There was not much opposition if any at all if I recall. All the neighbors were here and came up and spoke. New information came up or just information from people that didn't come the first time? Which one is it? I want to get into the habit of backing this up every time someone comes and stirs the pot but listen, I'll hear from them. >>chair: commissioner cohen higgins. >>commissioner cohen higgins: thank you to commissioner regalado and commissioner higgins for your concerns that have been addressed. I don't agree with sending this back to committee. This was noticed at committee. People came and spoke. Those presenting last-minute oppositions and last-minute money dropped on our desks yesterday evening if not night received notice of the committee and chose not to appear and quite frankly this feels a lot like dc because I've been here before. And it was thrown into litigation. The litigation delayed nothing and the complainant lost that litigation but aside from that and this being dc being asked to do what we've been asked to do in the past there are no new facts as it pertains to this parcel of land . This is a simple situation where a group of neighbors under florida statute got together and petitioned miami dade county to buy our parcel of land that they by florida statutes are able to buy. We sit on this day us and hear from residents complain about parcels of land in their neighborhood being developed and they either disagree or they agree. Here the residents of palmetto bay one one step further. They didn't voice opposition to the city of palmetto bay, they went one step further and submitted an application under florida statute to acquire the parcel, spend the money on the parcel so they could control the future of this parcel that is surplus land no department in miami dade county needs and it's not just one resident. We have petitions signed by 23 residents and all the abiding residents to this parcel who say we want to acquire this parcel. We do not want it turned into a park. Again, this is an fbl property that has high-voltage power lines on it and when we asked our body are tasked with choosing between a group of residents making their voices heard following a fully legal process and by the way I wish I didn't have to get into this the residents when they came to gain emotional in front of the committee body because of a daunting task it had been dealing with miami-dade county. Their application went unanswered for over a year and months later when the village of palmetto bay and after the fact submitted an application for the exact same parcel after the residents submitted their application and were completely ignored, the village of palmetto bay decided to get involved. I don't agree with that. If residents follow along to a t and are ignored for over a year by the county and again this is before my office gets involved I'm going to side with the residents they did everything they needed to do by statute what is before us is within the discretion of this board to convey a parcel of non-developable land, again non-developable land though the residents and the 20 neighbors all of which who have signed on and are in agreement can control that parcel of land work under $14,000 . I don't agree to sending it back to committee. I don't agree to last-minute drops and threats quite frankly, what was received yesterday were threats or the office of inspector general to get involved. When nobody showed up the prosser proper process to voice your concerns last-minute shots being fired except shots have been fired before. They were blanks then, their blanks now. This parcel belongs to the people who follow the law and I fully support them. I hope the board will support the people of palmetto bay as well. I have letters signed by all the abiding neighbors who we completely disagree with the resolution to acquire the proposed land and turn it into a pocket park. They had applications sitting for over a year. I can read these resolutions into the record but I believe the timeline is rather concerning from the perspective of the residents voices being heard and I strongly support the residents and their ability to follow florida statutes and have the discretion of this board, sided with them and allow them to acquire this non-developable parcel in their backyards, thank you MR. Chair. >>vice chair: commissioner from the third district. >>commissioner hardemon: I sat on the committee where this was being hurt and I must admit, I thought it was strange. It was a strange item to me. And I held my tongue and I held my tongue because I wanted to be supportive of the district commissioner. But when you read the item and it talks about hundred 10,000 ft.B2 of souls on the amount of land that this parcel is, that's looks like a little elbow, it's a long and when you see the picture of the space, I haven't visited it personally. But it is, it appears like a vast space. And we talk about the power lines it doesn't look any different than any power lines I see in any other residential neighborhood in the places I live. So to me, it was interesting one that first the property appraisal value this at $14,000 which is a reduction of what it was before which is strange area I've never seen items almost get half-and-half value cut in half from our property appraiser when all the prices have been going up. And you know, anytime people say I don't want to park in my neighborhood, always rubs me the wrong way. It's something about I don't want to park means I don't want visitors means I don't want people, means no basketball hoops, those things raise the hairs on my skin. But I still held my tone. Against this item. But I do think more clarity in it is appropriate. Because if this was a group for instance in your district if you have a group that said we don't want to park, what we want to do is xyz because we think this will have these benefits, clearly identifiable, this is what we want to do and you said I like that idea and I think that would be good for the area. In order for me to do this it's best that we convey the property to them. I can get with that. That's something I understand. That you want to move it to other people's hands in order to address the item so I don't have a problem conveying property even at this amount of square feet. There are times in which we convey property at no cost. So whenever it's appropriate, sometimes it's appropriate for a zero cost, sometimes it's appropriate to change market rate, I don't know if market rate is 14,000. It's what was taken to the property appraiser's website. So I say all this to say I don't mind having further discussion because now other people have questions about it, questions I did not want to raise at the time. And at the end of it we MAY all have a resolution that makes sense. We MAY agree with it. It's just that it's strange, I think that's the best way to put it. I haven't read that last-minute document that was sent described as shots being fired because by the time it's too late it's time to focus on the order today. I haven't had a chance to look at. I would look at it if needed. But I don't even understand what they want you to do with the property. So just to take it from the county to do what? To fence it? So that all of them just have green space behind them, a private golf course? I don't know. is it a space for them to walk their dogs, just to lead the members of the club, it doesn't take too many pople to get together to come up with $14,000 minimally. So it's just strange. It doesn't really come off as purely something that can easily be explained in ways that we can see. MR. CHAIRMAN, I was quiet about it in committee. If we wish the committee to have a discussion, that's fine. If we want to continue this hope we can get further clarification that's also fine. I don't want the item to die because it's declared. Class seeing no one else to be recognized and seeing no one, it's 11:22. >>commissioner garcia: very brief but I agree with the concerns of commissioner hardemon and I remember commissioner higgins I agree with you on the other item that took place at palmetto bay. I was not aware of the item but I received this though I have shared some of the concerns that commissioner garcia stated. >>chair: you said it like this . >>commissioner regalado: we want to support you oneness which is why I'm saying send it back to committee. I understand you have signatures but I'm concerned about the notice given to adjacent property owners and I'm concerned about the precedent this MAY have for other easements through the county area I think it would be in everyone's best interest to ensure their proper notice. We don't want to get into whatever issue there is that palmetto bay, we just want to make sure we do it right whatever the outcome is. Class ist, this was the CHAIRMAN's committee. The item I th
