What louder it is time to start our meeting. So on roll call and those that all supervised are present. So please stand for a pledge of allegiance and a moment of silence. All I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for, And welcome meeting attendees. As you know, you can participate in any of our agenda items and, uh, you if you wish to participate, uh, uh, ahead of time. You can do audience comments now, but anytime you do so, you have to come to the podium. State your name and address where you live. Go ahead. Good morning, Joseph EO 1642, Mel Grove Drive, cottages at Summer. Chase a as you can see here, we've got a big turnout. It's most, it's a lot of the people here, residents from, uh, cottages at summer Chase have a lot of concerns, uh, violations. Um, being on the arc, first of all, being here 22 years as a resident, can't hear me. Being here 22 years, and also being an a member, a lot of people come to me and, you know, I, we, we talk about rock manual and what you can do, what you can't do. And I told a lot of the people, the residents come to the meeting. This is our government. You guys are our government. And, uh, if we got concerns, uh, you are the people that listen to us and hopefully get the concerns taken care of. I know the, for the, there's a long list of how, how it gets done. There's a way it's gotta be done. I understand that. Well, anyway, that's why you see a lot of people here probably from that, but I have a couple of common issues, uh, a couple of 'em, uh, being that we're changing the daylight saving time fees and standard, there's a light pole now you're gonna say called cco. There's a light pole on the entrance of cottages at Summer Chase that's been tagged for months. The streetlight, I mean, village Watch does that, that's who does, puts the ribbons on the poles for not working. I mean, how long does it take to get stuff done? There's a, there's a palm tree with a tag on it that's been there for months, not done. We have a lot of, uh, common landscaping issues in the cottages at Summer Chase. That's not being done. And I know it's village responsibility because I talked to one of the supervisors that handles landscape and basically one of them said to me, we kind of forgot you guys. That's what they said. And so we'd like to get the common issues. Landscaping may be taken care of. The, the, the stuff I mentioned, the issue of, uh, uh, people under 19 living in the villages in, in the, we have some in summer chase, at least one. I don't know where that is. It, it kind of like died. I haven't heard anything more about it. Uh, these are, these are some of the things the residents wanna know. I mean, some people like to speak, some people don't like to speak, but whoever wants to speak, they're welcome to speak as you know. But that's probably the issues here. A lot of violations that they see. I see. They see. So that's all I have to say right now. Thank you. Okay. Thank you for the information. Carrie. We do have a, a, a stipulation was there not with, with CCO that when we had an outage with a light pole, that they had so many hours in which they were supposed to respond, Um, part of their cost reduction and what the last several months that they did was that they were extending that time out. Um, if you, if if somebody has the number off of the poll, you can go on their website and check the status of it. Um, and we can make sure that it's been reported. But no, they, they no longer say that it will be done within 48 hours. And do you have any idea what that timeframe would be? Yeah, we received communication from CCO that indicated that they were moving that timeframe back from Carrie had negotiated down to the fact that it was gonna be ours. Yeah. And they simply announced, CCO simply announced they were moving it back to 30 days. So if they, if they miss a poll, if they pass a poll, it could be another 30 days. So, but this is from, this is from cco, and believe me, we have fought CCO because when we got word of the huge increases for the rental on the, the poles, there were individuals from this board who went along with all of the other boards to raise hell about it. And as a result, there were some cost reductions. And one of those cost reductions was the repair of the streetlights was gonna be moved back. Carrie had gotten it down to a matter of one day in several negotiations with cco, but they simply announced that in order order to save the money 30 days, and it was pointed out that if a light gets missed, it'll wind up being, it could be as much as 60 days. Could you all put your papers up to your ground? I just this so we can hear better. Please. You can hear this, can't you? Yeah. Okay. How about me? I'm next. Uh, my name is Donna Close. I live at the cottage of the summer. Chase and I have been here and here with a lot of our neighbors who have a lot of issues. Uh, I coincide with what Mr. De Mayo has said for a number of things regarding landscaping and elder. I have questions of who to go to when we have, we have a lot of cars parked on our streets in the beginning of coming in at the end of streets on houses that are on the end to make a turn, which would probably be impossible for an ambulance or a fire truck. And they're, I don't know whose responsibility it is to tell them that they cannot park on the streets at night. And if they can't, they, some of them have three cars, two in the driveway and one on the street. And I don't know if that's permissible or who you go to, to complain about that. Another thing is, um, we had an issue, uh, regarding pets last year. When you have an unruly tenant or owner about a dog being loose, who do you go to complain to? I was told that you had to go to the sheriff, is that correct? Yes. Do they control when pets are loose at night and they're not on a leash? There is a leash law here, and all the pets have to be on a leash law. And that is correct. That is through animal control. Through the county. I'm sorry? That is through animal control, through Sumter County. So we call them and they have to come out. Yes, ma'am. Okay. Okay. And I have another question. If there has been something approved in our neighborhood that a lot of us didn't know was happening, can you or who do you go to, to fight that approval? Can that approval be turned down? Uh, do you have to get a petition? Who do you go for that? Is that possible to be done? Well, all depends on the, the type of approval you're talking about. Well, some of it, some of it, you know, could potentially come here. Others could be the county and others. Well, one of the issues was regarding painting of, uh, of, of a house in our neighborhood. It happened a while ago. They weren't, they weren't supposed to be painting the front of their houses. Correct. The brick. Yeah. And, um, they called, uh, the person called arc, and they told that, well, I'm sorry, that shouldn't have happened. Well, we don't want that to happen again. We don't want that to be a precedent in our neighborhood. So who do you go to for that? Do you go to the arc, the ones that approved it or who I don't know. We would, we would have to. I'm, I'm not really understanding this situation, but Mr. Armstrong in the back is raising his hand. If you gave him the address of the property that you're talking about, he could go through and determine what happened and then provide guidance on the questions that you're asking. Okay. And I'm sorry, who was his, what was his name? He, Mr. Armstrong. He's raising his hand in the back. You can speak with him after the meeting. Okay. Is this, is this with regard to painting of the house, Painting of the brick, specifically brick on the front of the house, putting Brick in or changing the painting Out? Painting, painting it. And it's not supposed to be painted. We What she's what she's referring to this, excuse me, cottages or Summer chase were built to mimic the Savannah Center. Mm-hmm. Uh, uh, if you, if you ride through cottages of summer Chase, you see some have brick front, some have design, some have a green roof, part of a green roof. It was all mimicking the Savannah Center. So someone years ago I wasn't on the A board. If, if I was on the A board and that came about, I would say no, they can't be done because of aesthetics. But they, they asked her to paint their bordeaux brick white who paints Brick white. And they, and it got approved because they said it's the modern look. It's not a modern look. We don't want the modern look, we want the old Savannah look. So that's, It was approved by the A RC. That's what she Yeah, that's what she's ver referring to. So it was approved, but it should not have been approved way back when. That's, And they said they made a mistake. So how do you Correct it? Why should not have been, We don't want that to happen to go forward with that. Part of the problem about this is the fact that the ARC approved it and trying to correct it is next to impossible at this point. Because there are obviously financial considerations. I can tell you that we've, I I've been on the board forever, and I can tell you that we've been through circumstances where somebody has had a house painted, it doesn't match the color palette that's been approved. And in fact, they've been ordered to have it repainted at their own cost because they didn't get approval in the first place. Right. From our, but this homeowner obviously got approval, and as a result, we may be between a rock and a hard place about this because the approval was granted. And for us to turn around and ex post facto deny this or turn it down means that there's going to be money involved and we'll wind up in a lawsuit over this because somebody's gonna wind up looking for the money. I, I, believe me, I commiserate with you because it shouldn't have happened. And as Mr. De Mayo said, it shouldn't have happened. Right. But it did. And So how do we prevent it from happening to other houses there? Do we go to the ARC and, and tell them that if there was this mistake and we don't want it to happen again? Absolutely. Yeah. That's the, that is the best. That's what you wanna do. That's exactly what you want. I that's absolutely what you wanna do. Okay. Because they, they either approve or disapprove it, and you wanna give them the infor the appropriate information, uh, for anything going forward. Okay. By all means make your protest known to arc Yeah. So that they understand that this doesn't fly in the community. Right. Right. And I I just have one other thing, um, regarding underage living in our neighborhood. There was a neighbor, uh, complained to the villages about this particular incident, and they told that they were told that it was an internal problem. What does that mean? And where do you go and what do you do? This, if I may, this issue has come up before us over and over again. And when they talk about the fact that it's an internal problem, part of the fact is I don't get to dictate to you what color the walls are inside of your house. No. I don't get to dictate to you what kind of carpet you get to put down. I don't get to dictate to you about whether grandma can live in your house or not. And as a result, because this is an in a man's home, is this castle. And because of the fact that we can deal with the outside the exterior lawn siding, all of that, because that does affect everybody else. The interior, I, I've done a whole lot of research about that. And we can't dictate what can happen on the interior of the house if somebody's living there. But it's in the deed restrictions, I understand it that they don't, no one under 30 can live there for more than a under 19, under 19 for 30 days. But that becomes a problem because of the way the deed restriction is written. That is enforceable by the developer, not this board. Correct. Un up to this point, the developer has chosen not to enforce it. And we, we, believe me, we've been all over the developer. We've sent letters. We have have made protest about this because we would like the developer to step up and resolve some of these issues the developer has chosen not to. What good is the deed restrictions if the developer doesn't adhere by what they put in? So there, there are three parties that can enforce deed restrictions. The first is the Declarance, which is the developer. The second is an affected property owner, which is you as a neighbor or somebody living in the, the neighborhood. And then the third is, as Supervisor Lazenby stated, the district has the ability to adopt rules that mirror certain deed restrictions. And then they can enforce their rules historically speaking. And, and Supervisor Lazenby is correct that they only have the ability to enforce external deed restrictions. However, chapter one 90 also allows them to do those through the use. Um, and establishing that this is a 55 and up community, which that does impact that. Right. And we presented to the board about two months ago, um, information should you want to adopt that under 19 into your matrix and be able to adopt that rule. However, there are so many other considerations that at that point the board decided that is not something that you wanted to get involved with. And it is later on the agenda. And Mr. Brianis will be presenting a little bit more information when it comes to enforcing those age restriction D restrictions. Correct. This is gonna sound as though it's, doesn't throw much weight. But yes, my suggest Sounds like being pushed off from one person to another. Nothing. But my suggestion is that you take, write a letter, prepare something, get a bunch of signatures and send it to the developer because it's the developer's responsibility to take care of the issue. Right? Yeah. If there's a lot of people that have signed that letter that shows that, that it's a significant enough issue to hopefully to take action. On that note, uh, Gail, we are, we're non-anonymous. Correct? In other words, we have to give our name to Report. Oh, you're going to have to, yes. Is there anything in the rules saying that we cannot, uh, arbitrate something as a group rather than one person? Because a lot of people don't wanna make the complaint because they're afraid of being targeted as one person. There's nothing. Is there anything saying that we can't make a complaint as a group? Well, what you're gonna have to do is, well, that's really for legal counsel to Answer. Say that That's really for legal counsel to answer all of the names. All of the names of the participants are going to have to be included. Yeah. But once again, I mean, in other words, if, if it's 20 people who are complaining, 20 people are going to have to put their name on that complaint. Yeah. That would resolve the possibility of somebody coming back to, to go after somebody. So To, to legal counsel, mark, is there a problem with a group signature for a complaint? The complainant, the person that makes the complaint has to provide their information. Oh, so that could be numeral. Correct. You mean multiple 10 people? Correct. Okay. Thank you. And I just have one other question. Is there anything that, um, says in our restrictions or anything that people have to pressure wash their driveways? And if so, where is it? Sid and who do you go to? No, just Holmes. That falls under the knee and clean. And if there is a driveway that has a whole bunch of mold or mildew, then that would not be neat and clean. And if we received a complaint, then we would bring it to the board for a public hearing. Do we complain here or to who do we complain to? To community standards? Mr. Armstrong at the back of the room. Um, he can provide you with several opportunities of how you can file a complaint. Okay. Mr. Armstrong? Um, okay, Well I'll, um, bill, you want to say what you want? Say what? Do you want three minutes bill? Right. Oh, I, well, he's going to talk about something Else. Sorry guys. Sure. Well, we, we went ahead and exceeded the time limit because we wanted to hear what was had to be said. Good morning. I'm Bill Kam and I live in the cottages of Summer Chase. We have a somewhat unusual arrangement for the, uh, golf carts. It's easy to get in. And then there was a stretch of street that they have to traverse to get to the exit ramp. I have helped out numerous people given 'em the directions because they wind up going down summer chase in the wrong direction. One person even tried to get out the gate, but fortunately they turned around and I waited for 'em and gave 'em the directions. I'm wondering if there'd be a way to have an exit sign at the exit. People might be able to find it a little better. Thank you. I will. I I'm not familiar with it off the top of my head. Would you like district property management to look into that? Yeah. Okay. We'll add that to old business and provide an update next month. Okay. Thank you. He may also get his name so he could point out exactly where he's talking about and where would best benefit them. Because I agree with you. I mean, a a sign says a lot. Yeah. I used to say that to my students all the time. Some of the best signage in the world is Disney. I mean, you know exactly where to go. And the better you have signs, the the least likely you're gonna be encountering those people. So I, I appreciate your input on that. And if you'll talk to those people and show 'em where the sign should be, I can definitely take that under Advice. So, Mr. Harris, can you raise your hand, sir? If you'll, if you'll go to the gentleman raising his hand after the meeting and give him your information, that would be great. I got another one. I can add a little bit to it if you'd like. Um, we Live, we still got, you have to, you have to give, you have to give your name and where you live. Michael Braley live at the cottages of summer Chase. Our subdivision, or our village is directly across this way. Put the, pick the mic up and put it up one level. How about this? Is that better? Yeah. Okay. So if you picture El Camino, yeah. On the other side of the brick wall is the street that we're talking about. So there's the tunnel that goes from here under, and when you come out, you've got a run along an unnamed street till you come up to the entrance to the tunnel, which you go down and then you can cut in. Right? Well, the problem is, first of all, there was a white pole, And that's been knocked down so many times. It's frequently not there. So there's no indication that this is where it should go. It would be nice to have one way arrows painted on the cement and a sign saying, enter only, or this way to Savannah. Like some of 'em have nice directions of what you can get to. So something like that would help, but that's where it is. Okay. Now, taking that, my interest is the gazebo that's on that brick wall. We have all these nice, beautiful stately trees in the area I just talked about. And then you come past that, it opens up into a bigger grass area. And along the wall there's an opening for a gazebo surrounding that are large palm trees that provide no shade, provide nothing of any benefit. Um, I do drop their fronds frequently. And I just was informed that the district is no longer responsible for picking up the debris from these palm trees. So not only are they not any, uh, aesthetic value, they're now a detraction. So is it possible to petition to get those removed and put in some normal deciduous trees that would actually add some beauty to the gazebo? And who would I talk to? Or do I get a petition? What do I do to get this done? Where where is the area that you're referring to? Right directly across the street. Um, where, you know, where, um, Ashland Avenue is the last three houses. And so across from the middle house, there is a gazebo built into the brick wall. Did You say Ashley Avenue? Ash Land. Ash Avenue. Okay. So we, we will go and look at that. If it's district property, then we would be responsible for collecting any type of debris that fell onto district property. Um, let us go take a look. And again, we'll add it, add its old business. I don't, we don't generally plant additional trees in the area. Um, if the board directed us to, we certainly would. But that's not something that generally you expend the maintenance assessment funds are. Well, you, you'll go over, you'll, you'll do an assessment and see what makes appropriate, appropriate sense there. And We'll report back next month. Yes, sir. Thank you. Just the mail, um, back again. Uh, that was one i, I left out that, uh, developer built a gazebo on common grounds and we frequently, um, have a meeting, or not a meeting a get together every Wednesday night, six o'clock mm-hmm. Seven o'clock. We have to sit on the grass. There's a gazebo there that's been there for 22 years. Needs a roof, never been cleaned. The brickwork, the trees, that's what he's referring to. It's been neglected for 22 years. It's common. And we would like to use that. Right. It was there. We can't use it because it's been neglected, overgrown. And as far as the trees, the villages land, uh, supervisor of landscape told me personally, they do not remove, Not On them palm trees. They will not take any branches down. That was told to me by Ryan, supervisor of District three Landscaping. So that's different. That's correct. We do not trim palm trees. We do not take palm frons down in any area of the villages from palm trees. If they have fallen and they are debris on the ground, then if it's district property management, yes, we, we take care of that. But we do not go out and trim palm trees anywhere in the residential district. Well, you can go, when you go over and look, you can take a look at the safety issues of it and all those things. Yes sir. Okay. The area they're talking about is district. It's not, it's across the street on Ashland in the no homes there. Right. Okay. That being said, we'll move on to the next item, which is our law enforcement quarterly updates. Good morning. I'm Captain Semer with the Sumter County Sheriff's Office. First of all, I'd like to thank you guys for allowing me to come out here and share our information with you. And it's good to see a big group here as well today. So, um, first thing I always start with, when we do the quarterly law enforcement updates, we like to talk about the vehicle crashes and the, um, citations and things of that nature. So I'll go ahead and begin with that. Uh, last quarter we had 411 car crashes. We had 253 car citations. We had 31 golf cart crashes and 29 golf cart citations. Um, since I got a big group of people here, I'd like to also tell you guys about our mobile app. If you guys are not familiar with it, uh, sun County Sheriff's Office does have a mobile app. We highly recommend that you guys, uh, download it. There's a lot of fantastic information in there. Uh, if you look it up, it's going to make sure you get to one in Florida 'cause there's actually a couple Sumter counties within the country. So, um, uh, a lot of great stuff. It talks about traffic, talks about crime. Uh, there's a button on there that you can pull up our county and see what's going on as far as what the deputies are doing. Uh, what kind of crime is involved. I will tell you this. If you look at the map, there's a big red spot over top of Bushnell. Bushnell is our county seat. It is not crime ridden, it's just where our jail is located. So where we bring everybody. Um, other than that, I do wanna give a shout out to community watch as well. On September 16th, they actually stopped the burglary, which was fantastic. It was late at night. They were driving around. They had to see some suspicious activity going around with Spanish Springs. Uh, they backed off just exactly what they were supposed to do and they called law enforcement. Uh, law enforcement showed up and people were actually stealing construction materials. Uh, anytime community watch gets involved in, uh, does something great, I always like to bring it to everybody's attention that it did happen. I will tell you that Suffolk County is a very safe community to live in. And villages included, uh, or violent crime rate is almost nothing. Uh, but we do have issues just like everybody else does. Our two biggest issues that we have are crimes of opportunity. Which means if you go to the one of the squares in your golf cart and you leave your cell phone in the cup holder or something of that nature and you come back and might be gone or your purse or something like that, uh, we ask you to do our nine o'clock routine. If you follow us on Facebook, uh, we talk about a nine o'clock routine, which they shut your garage doors at night. Make sure you lock your vehicles up and take the valuables out of it from time to time. We do have some people from outside of the villages. We'll come through and walk through our neighborhoods and check on car doors. If they find a car door that is unlocked, they will rummage through it. They'll take your sunglasses, your change. If you leave a firearm in it, they will take the firearm. And if you leave your keys in it, that's when they stop going in cars. 'cause they wanna go for a joy ride at this point in time. We'll have to find your car later on that afternoon or that morning. Uh, so those are kind of crimes of opportunities. The other thing, big problems that we do have, and this is a nationwide problem, not just a Sumter County problem is scams. I could tell you if you didn't play the Nigerian lottery, you didn't win the Nigerian lottery. If you ever get anything that you just don't, doesn't seem right to you, please contact us. We have a handful of detectives. We'd love to run it down the, uh, pike for you and find out what's going on and, uh, let you know if it's legitimate. Right now we're having a lot of people that are win winning millions and millions of dollars in different types of, uh, they had a loved one that passed away that lives somewhere else that they never knew about. And they left all this money. And please contact this lawyer's office. 'cause uh, we wanna, we wanna get you all this money. Uh, they want you to pay a fee up front so it'll tell you, Hey, you won, or you're gonna end up with millions of dollars, but you gotta pay a $5,000 fee. Uh, a lot of times they'll ask you for things like gift cards or something of that nature. That's definitely a scam. Please keep, uh, keep that in mind. Uh, they'll tell you, you have to pay the fee. You have to go buy gift cards at Home Depot or Lowe's or something of that nature. Uh, they ask you, then you're gonna go to the sheriff's office and turn those cards in. But they ask you, once you get 'em to give us a call, I want you to take pictures of both sides of those cards to make sure that you did get 'em to verify that you got 'em. And then go to the local andex or sheriff's department or wherever you may go and meet with law enforcement. Most people will say, well, I'm going to a law enforcement, uh, facility. I guess it's a good thing to do. The problem with that is when you take those pictures of those cards, you don't actually have to have them cards in your possession to take that money off of it. You just need the 17 digit number that's on the back of it. You can electronically take that, uh, money off of there. Uh, a lot of times they'll tell you to go to, uh, somewhere with cash and put it into a Bitcoin machine. That is definitely a big red flag for a scam. 'cause once you put your money in that thing, all you need is your pin number and your account number and the money will be gone. So kind of keep that kind of stuff in mind. Uh, beware of uh, phone calls, emails, things of that nature. But, and if you ever get anything that's unusual like that, please call us. We'd love to talk to you about it. We've probably already seen that scam before. And if you download our app inside of our app, we actually have a scam button, the scam. But you could touch that button and it'll pop up with all of the, the recent scams that we know about. And you guys, as the people, you guys can actually submit scams as well. So you'll submit something that you get, that you believe is a scam. One of our white collar crime detectives will actually run it through the rabbit hole and make sure it truly is a scam. If it is, they'll post it for all of you guys so you guys can read about it. We highly recommend that you sit down maybe a couple times a week and just kinda read through that stuff to see what the new scams are that way, uh, and share it with your neighbors as well in case they don't know about as well. Last thing we want is people to give away all their money. So, but that's all I really have. Unless somebody has any questions for me. I won't take up any more of your time. I've got, I've got one question for you, Bob. Yes. The golf cart citations, what's the, What is the number one reason for a citation? Uh, most of it is distracted driving, running stop signs, things like that. I kind of perused through 'em. I didn't, I, there's a lot of data there that I had to look through. But, uh, running stop signs is a big one. We've had a couple of 'em that were speeding golf carts as well. And keep that in mind as well. If I get enough time. Do I? Enough time. Go ahead. Go Ahead. Okay. Um, uh, speeding. Golf carts, a golf cart. Can't go. Not supposed to go over 20 miles an hour. If you're caught riding on the roadways in a golf cart, more, more than 20 miles an hour, it's actually a criminal citation. You will have to go in front of a judge to explain to him why you're going as fast as you were going in that golf cart. So please, those, those of you that, uh, speed up your golf cart to go a little faster. But please don't do that. You were hit the two things I was going to actually ask about. Okay. The one portion is gliding through stop signs. Happens all the time. Absolutely. But now I want to go to the other part. I see it with bicycles all the time. Absolutely. And if we see that we'll take appropriate actions. We're, we're very proactive out here with our law enforcement. I know this year with our budget, uh, we just got approved. Um, well it's already in effect now, but, uh, we are going to increase our traffic unit. Um, 'cause I think the biggest complaint that we get is speeders and traffic violations as well. So we are trying to beef up and make our traffic unit larger than what it has been in the years past. We have done a remarkable job. I mean, we've, we're just not too long ago. We, our traffic unit has actually doubled in size. So we're, we're definitely getting to where we, we should be. Just bear with us. We're doing the best we can See. This is one where I, I think that a couple of citations with the bicyclists, and I'm not picking on the bicycle clubs. They're wonderful. But a couple of citations for gliding through the stop signs and getting it publicized will do a lot to stop the problem. Absolutely. I got, I I almost hit one that scared the hell out of me when I'm, you know, right around the corner and, okay. So Yeah, you gotta be defensive here. Absolutely. I've driven all, I've driven in Europe. I've driven all over the US and there, there are two places I am the most defensive, uh, driver. One is Boston because of how it was structurally built. Yeah. Started small and then expanded and expanded in the streets and roads. Never, uh, were designed appropriately for the expansion. And the second one is here. Absolutely, absolutely. Be careful driving guys and slow down a little bit there. Yeah. Yes sir. Have you seen that, that, uh, the FedEx scam? The FedEx scam? Uh, we're having people come to pick up packages once in a while. Front doors that we talked about. Well, they Come actually, apparently it's been going on for quite a nu quite a while. But I just, I finally just got one, I got a text purportedly from FedEx and of course they don't have my telephone number. Absolutely. Uh, and said that I was not there for delivery of a package that needed my signature. And uh, if you look, they, they wanted you to click on a link Sure. Through a schedule. Of course you don't do it. Don't Actually, Don't click on the link. Actually, it actually, the a address was www.fedex.com but then there was a dash and some other things added to it so it wasn't real. Absolutely. And I actually just stopped at FedEx office up to, to talk to 'em about it because I knew it wasn't real. And they say it happens about every number of them. Absolutely. And I just got an email the other day saying that my package was unable to be delivered through FedEx as well and they needed to verify my address and stuff like that. Don't, don't click on that kind Stuff. Don't click on any of those links. Yep. I, I tell anybody you get anything like that. Best thing to do is if you want to confirm anything, get the actual telephone number Absolutely. Of The, the place and then call them or go visit them. But don't click on the links. Absolutely. I got a phone call not too long ago from my credit card company saying it was fraudulent activity on my credit card. I hung up on 'em and I pulled my credit card outta my pocket and I called that number 'cause I know that's a good verified number and sure enough, somebody bought $2,000 worth of hearing aids on my credit card up in North Carolina or something. Yeah. You get those said Wow. Yes sir. Since, uh, you're indicating that you're expanding the traffic division or whatever you called it. Uh, um, so will you be taking the responsibility for, uh, cost, the Costco, Wedgwood, Tonka, et cetera areas? Or is that still Bradley Arnold and I can't remember her name. Uh, the woman that works for him. Uh, anything traffic related, we take care of that. Uh, as far as law enforcement related, uh, traffic enforcement stuff that Suffolk County Sheriff's Office takes care of that. Yeah. And you remember they're also, they're gonna do another traffic study in February. Well, yeah, yeah. That kind of stuff. Now we're talking about studies and things like that. That would be the county not Talking about that. I just wanna know who we're, we should be going to now, should we go to your office? Oh, annex et is that Correct? Absolutely. If you guys have any traffic complaints at all, please feel free to call my office and uh, we'll I'll send somebody out there and we'll evaluate what's going on. If I have a, a digital sign that I'll more than happy to put it out there if we can find a spot for it. Uh, a lot of the residential roads, we're unable to do that because there's nothing but, uh, personal residence is all the way down the street, so it's kind of tough. So I have to do that with actual deputies, but if I can, we will, uh, definitely work on it. We do it all the time. Okay. Okay. Thank you. Alright. Thank you for your time. I wanna thank you guys for letting me come out here today and talk to you. I really appreciate it. Thank you. Thank You. You Paul, you have a question, fellow in the back? Yeah. Thank you Captain mean the case. We'll move on to our, pardon me. Next agenda item, which is, uh, a new business. First is the approval of the September 12th, 2025 minutes. So move second. All in favor? Aye. None opposed. And now I'll move on to public hearings. Yes, sir. Mr. Armstrong is making his way up and the first public hearing will be adoption of resolution 2026 dash zero one. Good morning, board matter, Armstrong Community Standards. Good morning. So before you today, we do have resolution 2026 dash zero one amending your rule. Two months ago, you, uh, you authorized for the advertisement of this rule amendment and last month we provided a draft sample of what the rule amendments would look like. The rule amendment would cover two areas. One is we are adding to the, uh, areas that we are capable of cleaning up. So, uh, if there's rogue v Grove, let's say there's a house that is, uh, bank owned and, and the homeowner's no longer around and there's Virginia Creeper growing up the side of the house, we would be able to be authorized to go on there if it ever came before you in a public hearing to maintain that space by spraying those types of rug bin growth, um, on the property. Another one would be, same exact example. Let's say there were pine palm trees and they were dropping palm fronts all over the grounds. We would be able underneath the order of enforcement to go on there and be able to clean up that debris from the property that's on the ground and be able to remove it to get back into a neat and clean manner. The second component was that we were looking to, We were looking to enforce the entire neat and clean rule at one time. So in this example it is, um, we have somebody that calls in a property and they say the grass is tall and there's weeds on the property. And we ask, is there anything else that's, that that's a concern as far as neat and clean goes. When we go over, is there pressure washing that's needed? Is the hedges overgrown? Is there the road buying growth? Is there anything on there that needs to be done? And they say, Nope, I just drive by it. I just see the neat and clean. I just see the tall grass and weeds. We go, okay, thank you very much. But when we get there, the hedges are over top of the eaves of the, of the roof. The, there's algae growth on the driveway. Um, there's also the grass and the weeds, and we can only address the tall grass and weeds. We can't address the other concerns, but it's the same exact rule. So the next month we, we get a call for that, for that driveway. So now we have to reopen another case underneath the same exact rule for a violation for the driveway. And then it may be two months later somebody decides to call in the bushes. So then two months later we're going after the bushes in the same exact rule for the same exact thing. It's neat and clean. So what we're doing is we're trying to consolidate it to where if we get a call for a neat and clean violation, we will address the, at entire rule at once so that we're not compounding these public hearings over months and we're also not incurring additional costs to do this. We can do it all at once in one fell swoop. So that is the request today for this amendment to your rule. And I'm here to answer any questions, but it is staff's recommendation for approval. We have any questions? Well, I like the idea of being able to do it all at once. That makes a great deal of sense when we get into talking about specifics, you mentioned things like the palm front. My only problem is if I use this as a, in generality for an individual who goes north, uh, for the summer, the individual who goes north for the summer, and sure they have a lawn service, but I've seen a whole bunch of lawn services who they'll pick up the palm front and as soon as the mower's gone by, they drop it right back on the lawn and they stay there and the homeowner doesn't have any idea. I mean, I'm not, I you're going to are you will be making phone calls I assume. Absolutely. We still phone De because the homeowner's gonna have to make some kind of arrangement. I mean it doesn't happen every day, but every time we have some kind of a big storm. Mm-hmm. I mean I go up and down Buena Vista up and down El Camino real. I go through up and down Talley Ridge and I see it every day after we've had some kind of a storm incident. And certainly the district is not picking it up as fast as we would like. And I don't expect the homeowner may be either. No. And, and again, a complaint would have to be logged by someone from the community within, within, within the community. So we would still have to receive that first. And yes, we call the homeowner wherever they're at or if it's a bank, we'll call the bank. We'll still go through our process to try to get compliance. And if it's a seasonal resident where we've called before, for example, weeds in the landscaping bed, they go, oh, I'll get, I'm gonna call my neighbor, see if they can come help me and, and take care of this for me or I'll get my landscaper on it. I thought they took care of it. So what's great is if you still look historically, which we will provide these statistics for you, we're still around 98% compliance before any public hearing has had. So these concerns that are called in, even though neat clean's the greatest one are being taken care of. So, which, which is great. Okay. Do we have to open a public hearing on this? Yes. Okay. Are you done? So we'll open, go ahead and open the public hearing. So if you have any audience wants Everybody, I just Had a question. You have name and address again? Name and address again? Got close cottages of summer. Chase, I have a question for this gentleman here. Oh, you okay. When he was the neat and clean, my question is, he will come out and do the driveways in the weeds and the neat, it's like, do you address mold problems and overgrown weeds in the back of the house? Yes we do. Yes You do. Okay. If we can see them then yes. Right. You can see them. Yeah. I'm sorry. If they can be seen without trespassing on the property, then yes. Yeah. And if they can't be seen from like the front of the house, perhaps there's a house behind them, they can get approval from that person Right. To come to the back of their lawn and look like over a fence or whatever. But they can't go on the well Picture Duke and you take a picture. Yes. You would just need to provide that to community Standards. I'll take a picture to show that the mold is there and, and, and as always, just note anything that you submit to community standards is in public record and would be used during that public hearing process. Right. Anything else on this? And we'll go ahead and close the public hearing. And do we have a motion for the adoption of the resolution Adopt? I'd like to adopt resolution 2026 dash one amending the rule to bring about deed compliance. And do you want me to do the second day? No, that's it. That's it. That's all we need. Okay. Do we we have to have a second. Second. All in favor? Aye. Aye. None opposed. Thank you. Board. Thank you. And Supervisor Ballis, if you don't mind, can you just pull your microphone a little bit closer? Thank you, Sir. How's that? Is that fine? They indicated they couldn't hear you, so just try to speak closer. Thank you, sir. Well, that's why I said is this fine Now? Can't hear. No, they still can't hear. Where are we now? Yeah, I guess that's the only way to get around it. How's that? Okay, next is, uh, let's see, adoption of resolution 20 26 0 2 amendment and restatement of chapter three rule, which is Village Community Development District number three, towing rule. Yes. Good morning board. Caitlin Bisoni, executive coordinator with administration presented today for a consideration is a public hearing regarding the adoption of resolution 2026 dash oh two, which amends and restates your towing rule. The chapter three of the district's towing rule to incorporate enforcement measures for repeat offenders. Chapter three was originally approved by this board on November 8th, 2024. Following that approval, staff identified the need for enhanced enforcement provisions, which were publicly noticed at the August 8th, 2025 board meeting. Working in collaboration with legal counsel, we have developed the proposed amendments now before you the amendment established Section five, repeat offenders designating any vehicle or vessel owner with multiple violations within a 12 month period As a repeat offender, the enforcement framework is, is structured as follows. First violation would result in the standard procedures including the four day hour notice requirement prior to towing authorization outlined in section three. At the second violation, the district may authorize immediate towing without notice written notification of repeat offender status will be provided to the owner and a $50 administration fee will be assessed. Third and subsequent violations will result in immediate towing authorization without notice. With a hundred dollars administration fee assessed, the district manager or their designee shall maintain comprehensive records including photographs, documentation of all violations. Individuals may appeal repeat offender designations within 30 days of the notice. First time designations are appealed to the district manager or their designee. Second time designations are appealed to the District three Board of supervisors who decisions shall be final. All administration fees are due within 30 days and may be pursued through any legal remedies available to the district. And of course, if you have any questions regarding this, I can answer them. You have no questions. We will open the public hearing. You close it. Pardon me? You closed it. I didn't hear what you said. I saw open the public hearing. Oh, you're opening one coming up. Okay. Then we'll go ahead and close the public hearing. So do we have a motion, motion To adopt adoption of resolution 2026 dash oh two Amendment and restatement. You can't, I still can't hear you talking. Okay. Adoption of resolution 2026 dash oh two Amendment and restatement of chapter three, rule Village Community District number three, towing rule. Do we have a second? Second. All in favor? Aye. Aye. Any opposed? None opposed. Okay. Thank you. Thank you. And first the next item is, uh, case number D three dash zero one dash 26, which is VCDE number three versus Joanne g Bryant at 32 90 Richmond Drive. Yes, Sir. Good Morning. Board before the public hearing. Uh, as usual, just a quick overview of the public hearing process and public hearings. The board acts as both the judge and jury in that capacity. The board will consider evidence, make findings of fact, and draw conclusions of law. During the hearing, the board may only receive testimony and evidence from the property owner, district staff and those that will be substantially and directly affected by the outcome of the Board's decision. And those are usually neighbors, uh, surrounding the property at issue. The board's required to limit testimony to relevant evidence as it relates to the matter before it at the conclusion of the public hearing. The board will need to determine whether staff presented competent, substantial evidence to support a finding of the alleged violation. And if so, the board must enter an order of Enforcement against the property owner. If there's anyone here to testify as to case number D three dash zero one dash 26, please stand and raise your right hand. Do you swear or affirm this evidence testimony you're about to provide truth, nothing but truth. Thank You. Yes. We can now open the public hearing. Yep. Public hearing is now open. Hello. Board Met Armstrong Community Standards. So before you today, there is case number D 3 0 1 2 6 Village Community Development District number three verse Joann g Bryant 32 90 Richmond Drive, unit 41 Lot 1 8 3. Violation of the district's rule to bring about decompliance, specifically the rule that states no building or structure shall be constructed, erected, or placed or altered on any home site to the construction plans and specifications. And a plan showing the location of the building or structure have been approved after the home has been constructed, nor reconstruction, additions, alterations, or modifications to the home or in the locations. And utility connections of the home will be permitted except with the written consent of the developer or architectural review committee appointed by the developer as found in the village Community Development District number three, external deed restriction standards. The district is responsible for approving alterations, changes, or modifications to home sites and the exterior appearance of the structure of the home. No aftermarket change should be made to any homes, home site, or home without first obtaining district approval. This includes but not limited to Arbor's, Chelsea, Perus Pools, patios, screen cages, decks, awning expenses, walls, enclosures, landscaping, driveway additions, repaintings, and room additions to the home. On August 1st, we did receive a concern regarding a structure in the, on the west side of a property without architectural approval. Staff did look, um, to see if ARC approval was submitted and received and there was architectural approval, uh, received for a landscape modification. But upon inspection of the property, it wasn't a landscape modification that was occurred. It was a paper patio addition that occurred within that space. So we did reach out to the homeowner and, um, communication has been had with the staff and community standards regarding this, this concern. Um, a plan was shown that this is what was presented and approved, but this is what the, the Landscaping company actually put in. Um, the concern is, is that it's built in the road right away, which cannot happen. You cannot add things into the road right away. It needs to be behind the property lines. You're allowed to have a paver patio on your property. It just can't. You can have a paver patio, you just can't have it where it's located. So that is, you can't have it. Uh, it has to be a certain distance away from street it to be correct distance from the street, from your road right away from behind your property line. This is too close to the street. And this is, this is over that line. This is in the road right away. So this was discussed with the homeowner and a new plan was submitted, um, but it was withdrawn by the homeowner before it was seen by the Architectural Review Committee. So that is why we are here today. It is staff's recommendation to find the owner of violation of the district's Decompliance rule as cited by the DECOMPLIANCE staff. The owner has 45 days to submit and receive and approve architectural review application for the landscape modification and bring that property into compliance with the approved Architectural Review application, or restore the property back to its originally constructed design. If an approved architectural review application is received and the property is brought in into accordance with the approved Architectural Review application, or if the property is restored back to its originally constructed design, within 45 days of the Order of Enforcement, case number D 3 0 12 6 shall be closed. If an approved architectural review application in accordance with District Three's Architectural Review manual is not received, an approved architectural review application in accordance with District three Architectural Manual is received, but the property is not brought into accordance with the approved a RC application. Or if the property is not restored back to its originally constructed design and the property is not brought into compliance within 45 days of the Order of enforcement, impose a $150 fine to be paid within 10 days of the invoice and impose a $50 daily fine until the fine, until the property's brought into compliance. If the property is not brought into compliance as required here and staff shall record the Order of Enforcement claim of lien, the public records of Sum County Florida. It is the property owner's responsibility to contact Community Standards Department to request a decompliance officer revisit the property to confirm compliance. The fines reached $1,500, the case shall be turned over to district counsel to seek all available remedies, which may include initiating a lawsuit and seeking an injunction against the property owner. The property owner is responsible for reimbursing the district for attorney's fees, costs, and expenses associated with or related to this order enforcement claim. With lien, the property is brought into compliance and all fines are paid. That German authorizes staff to execute and record a satisfaction release claim with lien Jeremy to execute the order of enforcement. And I'll step aside for The homeowner. Yes. Hello. I'm Joanne Bryant, 32 90 Richmond Drive in the village of Bel Air. Um, I had contacted a homeowner, a home landscape company to do the work and insert the patio for a sharing library. I've been providing a sharing library since COVID and it's just grown and increased over time. Um, but it, it was my understanding that an arc was submitted and was approved prior to the work being done. It wasn't until I received notification the first time that I went before the other board and was given a copy of the submission that was made and was informed that the um, drawing had been modified from what the, what I agreed to at the time that I hired the landscaper. Um, I don't really know what I can do about that. My neighbors love it. I did receive a petition this week. I have over 60 signatures of my neighbors in support of it. I did try to talk to the gentleman that filed the complaint. His response was that it offended him. I did not understand what about a sharing library could offend anybody. But, um, he said that we didn't deserve, it wasn't appropriate for a neighbor, a neighborhood like ours. I don't know what that means. I think we have a wonderful neighborhood. I'm a strong proponent of reading and was thrilled to be able to do this for my neighbors. Uh, I never dreamed it would come to this. Nothing was done out of disrespect for anybody. It was done because of my love for reading and because I am thrilled to be a member of this community. Um, people from outside of Bel Air come and use it. Um, and it's worked great. Our street that it's on is Venice, which has no houses on it, and it is, I think it was a hundred, within a hundred feet or something. It's less than a hundred feet long, so it's just a pass. Hundred yards. Sorry. It's just a pass through street and it's been there. It looks wonderful. I tried to do it aesthetically so that it would tie in to the rest of my house, and I'm hoping that some kind of exception can be made. Originally it was 10 feet from the road. Um, but then I did not feel that the first step it and wasn't there. And I felt that it needed to be added for safety reasons. And that did put it to less than 10 feet. But, um, that's it. I hope you all will consider it, that you'll make an exception, um, and approve it for our neighborhood. Everyone loves it. And I'll be back another time to try to change it. So that one person else, my neighbors. Ma'am, I just have one question for you. Sorry. Yes. The, the structure that's there is, do you agree that that was built where it's built is not consistent with what was approved in the ARC application? I was not aware that it was different than what was in the ARC application. I submitted when I heard, I was understanding that when I, I went and submitted a separate one from the landscaper people. I identified the pavers and did what was originally, um, agreed to between the landscapers and myself. And it wasn't until that point that the woman in community standards made me a copy of what they submitted and they had erased the word pavers. Okay. So This is, and had it down. I did not know. I was just told it was approved and I was adamant about this with the land, with the landscapers. I said, this is different from anything else in the villages. I want it to be nice. I want it to be approved. You have to get approval before I invest this money. Um, but my, um, that was the one that was submitted by them. They had me sign it at the time that I signed the contract with them. Um, I ended up paying a total of $8,500 for the building of that and the additional yard work I had done. Um, so when I, they just had you sign it, they go, don't worry about it. We'll fill it out for you. We'll submit it. That's part of your fee. So I trusted them to do that. And this, apparently, it wasn't mentioned that there was gonna be pavers. I was not aware of that until, right. Like I said, I went before the first board. Okay. Understand. But I, you know, my neighbor, The problem, the problem is what was submitted is different and approved is different than what was actually built. And that was their landscaper. And I understand you didn't understand all Any of that. Well, it had, yeah. It had the original, that was all an original area there. Yeah, I understand. And it was originally just a bunch of weeds Sure. Between the two crepe myrtles. And so even up to that point, that is all within the 10 feet, which I've been told actually is what it needs to be instead of 16 because it is a non-active road and there are no houses on it. Um, and that beginning of that was 10 feet. So I think, um, it was adding the additional step that put it less than that. And that was less than 10 Feet. Right. That was at a decision that I made for safety reasons. Sure, I understand. Um, 'cause I thought it was too high of a step and I didn't want anyone to fall. So I was trying to be responsible. I understand. Um, but I'm an avid reader and obviously our neighbors are, and, um, they love it. And everybody was completely shocked when this was brought before the board. And, um, I figure I have 60 some for it against the one guy against it, and I'd like those to be taken into consideration. And, uh, if there's any of 'em that wish to support it and say anything vocally, I'd love to have it. Jack, If you want, you can, you can turn the petition in. Okay. Give the petition to, uh, Gary. So it's, it's not that the, the library cannot be approved. It, there is no restriction for this in the deed restrictions or your a RC manual. It is where it is placed. So she can turn in an a RC application with this exact design, but far enough off of the property line and it can be approved and she can keep the library. Unfortunately, it doesn't appear that it's just that step that is too close. So unfortunately, she's going to have to move the entire structure further back off of the property line to be in compliance with the deed restrictions and error. And how far are you saying it needs to be? Oh, it has to be 10 feet. Correct. The 10 feet, it would be that straight step. It is just that 10 feet or approximately that without the step. We have to look at her, um, her site plan to see how big the road right of way is in that area. Unfortunately, a lot of residents think that their property line is the curb or the street that's not your property line. Right. Your property line is several feet off of the curb and then it starts, and then it has to be a certain footage off of that Up. So I'm guessing it's what about eight, eight feet? It's about eight and a half feet. Eight and a half feet. Mm-hmm. So we, we can certainly, again, the staff does an interactive process with residents if they'd like to sit down and they can help her design how this can be far enough off the property line before she turns it into the a RC for approval. The the struggle is going to be that she's going to have to pay to have this moved. See, I, I'm, do we have others who wanna before we speak? I mean, Yeah, you may wanna finish up with the resident and then close the public. Yeah. Do any residents comments? Do you wanna Make a comment Asking, Uh, J Jack Callahan 3, 3, 2, 1. Richmond Drive the village of Bel Air. Um, I would first like to thank this committee for their time and contributions to the residents of District three. You have made a concerted effort to improve the lifestyle of its citizens. In the same vein, I would like to thank Joanne Bryan, who with her own money and concern for the betterment of her neighborhood, created a first class book exchange that is utilized, enjoyed, and appreciated by many. The 60 people that went out of their way to sign is probably much less than the people that get to use, utilize and enjoy t

Uh, they backed off just exactly what they were supposed to do and they called law e
