Mayor Black was recognized for his dedication and service to the City for over 35 years. Several of Mayor Black's family members were present including his wife, mother, and cousin. Former Florida League of Cities employees Lynn Tipton and Ken Small along with former City Commissioners Eunice Penix and Steven Van Gorden were also present. D. PUBLIC COMMENTS D.1. Kevin Taggerty at 13833 5th Street, Dade City, and from Dade City Life, spoke about the old Dade City oak tree that was in danger of being cut down by the County. There are thousands of people who are in support of the tree. Taggerty has met with the Facilities Manager of Pasco and asked him many questions including, why cut down the tree? Taggerty shared there is a palm tree plan to put 11 Sabal palm trees in the front. Taggerty didn't agree with them taking the oak tree down. The County Commission's response was because it was diseased, and it had a hole in it; the tree was a threat. Dade City sent out an Arborist to inspect the tree and they did not find that. The County is saying this will be a million dollars to replace. The County did not honor the Arborist report that was done. The County is going to send out their own Arborist in early August. Taggerty felt the County should have honored the report because they had a two-day in-depth discussion. The initial problem when the County went to cut the tree down was, they filed a report from an Arborist from 2015, which was 10 years ago. The permit did not say cut the tree down, it just said the tree's issues. Several trees were inspected when this tree was originally inspected. Taggerty said according to the Community, Sabal Palms are not a good match for the area. On July 30th, they are having a gathering to show support for old number 7. Carolyn Parrish at 14406 12th Street, Dade City, asked Taggerty if the Sabal Palm tree had any nested fruit that could be toxic for animals. Taggerty was unsure. Parrish believed that would be something they would want to look into. E. CONSENT AGENDA E.1. Surplus/Disposition of Parcel ID 27-24-21-0400-39900-0010 Acting City Manager vanErven introduced the item. Community and Economic Development Director Ralston shared a PowerPoint reviewing the item in depth. Commissioner Shive was not in favor of selling the property and wanted them to look at a reenvisioning plan for that area. Shive thought they should hold onto the property in case they wanted to realign the street. Mayor Black suggested the possibility of leasing the land and gave examples of other properties where they have leased land. Commissioner Cosentino agreed that the area is a problematic turn. She agreed with Commissioner Shive, someone also reached out to her to share the same concerns. Cosentino asked questions about the land being able to sell multiple times with the fencing on City land. The Commission had a brief conversation. Commissioner Cosentino also agreed the land should be leased. Commissioner Church asked if staff knew how long the fence had been there. Community and Economic Development Director Ralston said they found a record that the fence was installed in 1979. Commissioner Church said her concern is that this was more than 21 years ago and discussed legal actions that could possibly take place. Church thought executing a lease agreement would be a smart thing to do. She also had people contact her to ask what amenities they could put there to preserve the trail. Commissioner Shive asked Attorney Brackins about the property changing hands over the years. Attorney Brackins said it is called an encroachment. He does not know if that was pursuant to an agreement or not. Commissioner Church said if they got to a point where they were considering selling it, it worried her working directly with the property owner since there are other property owners who may want a seat at the table. The Commission gave consensus for the item to come back to them by Brackins and to approach the property owner about the use of the adjacent land. J.2. South of Morningside Drive and North of Clinton Avenue – HIGHLAND TRAILS PHASE II SUBDIVISION PRELIMINARY PLAN Acting City Manager vanErven introduced the item and it was presented by Community and Economic Director Ralston. The item is a Quasi-Judicial Hearing. Attorney Brackins swore in all who wished to testify, including Community and Economic Development Director Ralston, the applicant, and a resident who lives across from the project. Community and Economic Development Director Ralston reviewed a PowerPoint of the project that was also provided in the agenda packet. Staff shared the plan is consistent with the conditions of approval set forth in the ordinance and the City's LDR. The subdivision's preliminary plan establishes the general layout and design for the subdivision and has been followed for the review for Highlands Trail phase II and no deficiencies found. Please note that the subdivision preliminary plan is not binding nor is it an exact description of what may actually be built after fully engineered construction plans may be submitted. Commissioner Cosentino said the report Ralston put together was really complete and easy to follow along with the history of the project. Clarke Hobby with Hobby & Hobby, P.A., at 109 N Brush Street, Tampa, shared there was an extremely extensive staff report that was discussed in great lengths when they were at the Planning Board. There was testimony at the Planning Board from a couple of neighbors, and they have worked through their issues. Hobby thinks they have already met the legal sufficiency test with the staff report. They were happy to answer any questions. Hobby said the staff report was really detailed. Attorney Brackins explained lawyers were not placed under oath because they do not provide testimony. Affected parties: Josman Gamez at 11948 Sanders Lane, Dade City, and owner of Gamez Farms and Microgreens, was present to let the Commission know that even though this building phase for around 1200 homes has not been approved yet, they as neighbors have been affected already by it. Since last year, they have been dealing with earth movers, dirt, and vibrations. Gamez also has videos of earth movers shaking in his house. Gamez informed the Commission that he is a nudist. He would like them to put a big fence up to be good neighbors. Hobby said this was not a construction plan that was in front of them tonight. They have a local representative that was present, they will meet with the neighbor afterwards to adjust the construction plan accordingly. Commissioner Cosentino asked how many phases there were. Hobby introduced their Planner, Ryan McCaffrey. Ryan McCaffrey, with Hamilton Engineering and Surveying, at 2409 West Lemon Street, Tampa, said the first phase came in as phase II. This is now phase 2, with sub phasing (A,B,C, D). The construction documents would include the entirety of the development that the client holds. He believed there is a piece of it that is under ownership of others in the northeast corner, which is not included in the application. Attorney Brackins asked for the preliminary plan purposes, if phase II was the last phase. However, in the actual development of construction plans in construction, they are going to do phase 2 in multiple sub-phases. McCaffrey confirmed that was correct. Commissioner Cosentino asked in layman's terms if the development had allotment for over 1000 houses and they are building out 700 houses. McCaffrey said that was correct. Cosentino asked if they were planning on building out the 1000 homes or are they feeling good about the 700 number. McCaffrey said at this time it is all systems forward with this plan. Commissioner Shive said he was not on board when the project was approved but he is happy the number of houses was reduced from 1134 to 684. The only concern that he had was at the last meeting, neighbors talked about an emergency exit that goes out to Elkins Road. Shive wants to make sure they double gate area so it will be truly an emergency exit. Mayor Black asked if there would be a Knox Box type system for emergency access. McCaffrey said yes and it is not plotted as right-of-way; it is designed for an only emergency exit. It is gated and not paved. Mayor Black shared after the last meeting he drove by the property. They wanted to make sure the gate would not be left open, and it is a permanent arrangement. Commissioner Church asked if the properties that they did not have ownership of were included in the plan. McCaffrey said the northeast parcel is in the PD, but it was not included in the application. Commissioner Cosentino asked if the staff report recommendation that they approve with the condition of the connecting bike trail was met, or if this still needed to be approved. Community and Economic Development Director Ralston said the conditions had been met. Moved by Commissioner Cosentino, seconded by Commissioner Shive to approve Highland Trails Phase II Subdivision preliminary plat with the condition of the bike trail making connection point to Clinton Avenue. FOR: Black, Church, Cosentino, and Shive AGAINST: None ABSENT: Woodard CARRIED. J.3. Setting Date for Tentative Millage Rate and Budget Hearings Acting City Manager vanErven shared staff has asked the Commission to set a meeting date between 9/8/2025 and 9/12/2025. As part of the TRIM (truth in millage) process, they have to adhere to a specific timetable. The Pasco County Property Appraiser certified the taxable value on June 28, 2025. Within 30 days of certification of the value, they must certify the maximum millage calculation and notify the Property Appraiser of the date, time, and meeting place of the tentative budget hearing. They have to hold the tentative hearing between September 3 and September 18. The hearing must take place Monday through Friday after 5 p.m. or anytime on a Saturday. The School Board and Pasco County have priority on setting dates for their public hearings, and the City could not hold a budget hearing on the same date. Acting City Manager vanErven reviewed possible dates with the Commission that did not interfere with the School Board or County. Staff recommended Monday, 9/8/2025. They will keep the regular date of 9/23/25 for the budget hearing. The Commission gave their consensus for the dates. J.4. Selection of City Manager Candidates to Interview Acting City Manager vanErven shared they received an additional five resumes and asked the Commission if they would like to add any applicants for interviews. Commissioner Shive said Ken Griffin's application stood out to him. He would like to include Griffin in the interviews. Commissioner Cosentino said when they talk about applying for a job at this level, she is extremely disappointed with the mistakes that were in the candidates resumes. Cosentino asked if the computer could be rearranging the resumes causing some mistakes. Acting City Manager vanErven explained that the resumes are submitted by the applicants, by email, to Sumter Consulting. Sumter Consulting then sends them to the City Human Resource Director Dison. Commissioner Cosentino confirmed with vanErven that the mistakes are under the applicant's control and not computer error. Cosentino thought applicant Lynne Ladner had good experience from her resume. Commissioner Church concurred on Ladner but shared she did not do a deep dive search on the additional applicants. Church said if her fellow Commissioners see applications that seem promising, she is happy to give them 30 minutes of her time. Mayor Black was in favor of hearing from Griffin. Commissioner Cosentino wanted to do more checking before they add Ladner. The Commission gave consensus to add Ken Griffin for an interview. J.5. Setting the Proposed Millage Rate for Fiscal Year 2025-2026 Acting City Manager vanErven presented the item. After presenting the item, vanErven clarified the proposed millage rate could not be increased but it could be decreased. Mayor Black said 6.93 was the millage rate last year and was the first time they dipped below 7. Public Comments: Saxon Evans at 15000 Citrus Country Drive, Dade City, with the Dade City Business Center, asked if the stormwater infrastructure was built into the millage rate. They had a lot of stormwater flooding last year and they want to make sure that it has been appropriated. They take on a lot of City stormwater on the private side. Evans wanted to make sure it was covered on the City's side in taxes because they got slammed last year. Mayor Black said the millage rate is different than the stormwater assessment. Commissioner Shive said he did not believe the business center was being impacted by the stormwater fee because they are handling a lot of the City's stormwater. He would like staff to check on that. This was also a prior issue. Evans explained the stormwater system they use at the business center. They had a deal/agreement when Billy Poe was City Manager where they would not get stormwater tax. However, they got taxed last year. Evans shared the issues with staff in the past, and staff is currently working on. DOT (Department of Transportation) is coming out on Thursday, and the County is coming out tomorrow. Finance Director Altman said the assessment was sent out and it became clear he saw an agreement where the Business Center would not be taxed. Altman will speak with the attorney about that. Altman apologized to Evans for him receiving the tax bill. Altman clarified that stormwater is not a taxing element of the millage. Commissioner Shive said this was a big issue when Poe was there. Evans shared it was a 2018 agreement. He would love to show the Commissioners the facility. They want to be able to help the City without drowning. His business is not a stormwater treatment facility. They are getting hit with so much trash off the roads that it is affecting their business. Moved by Commissioner Cosentino, seconded by Commissioner Church to adopt the proposed millage rate for Fiscal Year 2025-2026 in the amount of $6.93 (the current millage rate). FOR: Black, Church, Cosentino, and Shive AGAINST: None ABSENT: Woodard CARRIED. J.6. Approving Preliminary Non-Ad Valorem Stormwater Parcel Assessment Resolution 2025-14 A RESOLUTION BY THE CITY COMMISSION OF THE CITY OF DADE CITY, FLORIDA, ESTABLISHING A PRELIMINARY EQUILIVENT RESIDENTIAL UNITY UTILITY FEE RATE TO FUND THE CITY OF DADE CITY STORMWATER MANAGEMENT UTILITY SYSTEM FOR FISCAL YEAR 2025-2026; SETTING A PROPOSED PUBLIC HEARING DATE; AUTHORIZING THE CITY TO TRANSMIT TO PASCO COUNTY AND PROVIDING FOR AN EFFECTIVE DATE. City Clerk Guy read the resolution by title only. The item was introduced by Acting City Manager vanErven and presented by Finance Director Altman. Commissioner Church asked for clarification on the item. Church thought last year there was a concern that they could not do some things without an increase. Church asked Altman if he was saying that some of the grant money was going to cover that? Finance Officer Altman said they really don't know what the master plan is. They tried to bring it up on the consumer price index, saying to keep it the same as it used to be. If it's their pleasure, they can direct Altman to add $5, which would help them. Commissioner Church was not in favor of arbitrating numbers that are not based on their concrete needs. Commissioner Shive was not in favor of increasing the stormwater impact fees right now. Commissioner Cosentino asked if they waited, when would they know. Cosentino's other concern was if they need and increase and don't increase them this year, the next year's increase would be at a higher percentage. Finance Officer Altman said the grant takes one year to do. Commissioner Cosentino wanted to be clear that they will know exactly where they are next year. Finance Officer Altman said that would be a good goal and is achievable. Saxon Evans, an owner of the Dade City Business Center, shared a new law that was passed June 2024 and read changes that were going to happen. Evans said that most developments are not going to be able to fully treat their stormwater. Evans said this was from the State. City Clerk Guy highlighted a typo in the resolution for correction. Moved by Commissioner Shive, seconded by Commissioner Church FOR: Black, Church, Cosentino, and Shive AGAINST: None ABSENT: Woodard CARRIED. J.7. Approve Resolution No. 2025-15 Preliminary Street Lighting Assessment for Highland Bluff A RESOLUTION BY THE CITY COMMISSION OF THE CITY OF DADE CITY, FLORIDA, APPROVING THE PRELIMINARY ASSESSMENT RATE FOR THE HIGHLAND BLUFF SUBDIVISION ENHANCED STREET LIGHTING SERVICE AREA FOR FISCAL YEAR 2025-2026; SETTING A PUBLIC HEARING DATE; AUTHORIZING THE TRANSMISSION OF THE PROPOSED ASSESSMENT ROLL; AND PROVIDING AN EFFECTIVE DATE. City Clerk Guy read the resolution by title only. The item was presented by Acting City Manager vanErven. Staff recommended approval. The proposed rate for this fiscal year is $100 per parcel for the 29 parcels within the subdivision. Which is a $5 increase per parcel. No public comments were made. Carolyn Parrish at 14406 12th Street, Dade City, said Penix brought up an excellent point. At the intersection of 8th Street and Martin Luther King Blvd, it is on the east side, on the north side, it is empty. There are three big commercial semi-trucks. The south side where they are renovating the house, Parrish spoke with the owner and learned their goal is to turn that into a restaurant.
