NEW BUSINESS-CONSENT AGENDA-BUSINESS AND SUPPORT ITEMS Subject 8.10 Resolution to Release Petroleum and Mineral Rights for property previously owned by the Board of Public Instruction on CR 466A in Fruitland Park (Chad Farnsworth, Deputy Superintendent), Fiscal Impact: None Meeting Jul 14, 2025 - Lake County Schools - Regular School Board Meeting-Revised Type Action (Consent) BACKGROUND and RATIONALE: In the 1950s, the School Board (then the Board of Public Instruction) briefly owned a piece of property on CR 466A in Fruitland Park that they then swapped with O.K. Strickland for adjacent property that was incorporated into the Leesburg High Ag Farm. An attempt to clear the title for the Leesburg High Ag Farm through Quit Claim Deed in 2012 may have clouded the title on this property. The buyer of the property, Vista Serena LLC, has requested that the Board formally release the petroleum and mineral rights that may be vested in the Board by Florida statute. Due to the size of the property and the proximity to development, it is unlikely that the rights to mine any minerals that may exist would ever be granted, so there is little risk to the Board in granting this release. Sterling seeks to recover payment from the School Board in the negotiated amount of $304,518.67 on grounds that it is unable to recover from Citory, and Citory failed to obtain a payment and performance bond prior to commencement of the project, as required by Florida Statutes.
