Background At the August 23, 2023 Board Meeting Special Education requested authorization to enter into agreements with Non-Public Schools (NPS) and Non-Public Agencies (NPA). REGULAR AGENDA ITEMS Type Information, Presentation Background On June 3, 2014, the voters of Fremont approved the $650 million Measure E general obligation bond initiative, under the requirements of Proposition 39 (2000), the School Facilities Local Vote Act. The scope of the bond work includes upgrading and repairing neighborhood schools by updating technology and aging classrooms; upgrading electrical wiring to current safety codes; fixing or replacing leaky roofs, aging plumbing and restrooms; removing asbestos; and repairing, constructing and acquiring equipment, classrooms, sites, and facilities. On September 23, 2014 , the Fremont Unified School District (FUSD) Citizens' Bond Oversight Committee (CBOC) was appointed by the Board of Education. California Education Code requires that following the passage of a "Proposition 39" bond election, a governing board establishes an independent citizens' oversight committee. Proposition 39 refers to the School Facilities Local Vote Act of 2000, which reduced the threshold required to pass local California school district bond issues from a two-thirds supermajority vote to a 55 percent simple majority vote. Current Status One of the requirements of Proposition 39 is for the CBOC to report to the Board of Education at least annually the status of the Measure E Implementation, including projects that have been completed. The CBOC will present to the Board of Trustees its annual report, which highlights the committee's activities and accomplishments to date . Policy Implications This report complies with the requirements of Proposition 39 an the intent of the Board of Trustees in establishing the Citizens' Bond Oversight Committee. REGULAR AGENDA ITEMS Type Discussion, Information Background On June 3, 2014, the voters of Fremont approved the $650 million Measure E general obligation bond initiative, under the requirements of Proposition 39 (2000), the School Facilities Local Vote Act. Proposition 39 refers to the School Facilities Local Vote Act of 2000, which reduced the threshold required to pass local California school district bond issues from a two-third supermajority vote to a 55 percent simple majority vote. Current Status Members of the CBOC have requested to review and discuss items for the Board to consider: Memorandum of Understanding (MOU) Between the District and the CBOC to memorialize the understandings between the District and the CBOC, including the members of the CBOC, access to records and personnel, etc. Make the current “Measure E” CBOC also responsible for all future bond ballot measures to mitigate current and future issues in finding and retaining members. Increase the number of CBOC members beyond the statutory minimum requirement of seven members such as including a designated seat for each high school attendance area to better achieve quorum and to perform other functions. Increase Term of CBOC Members beyond the statutory minimum term requirement for CBOC members to allow active and knowledgeable members to continue to serve. Change structure of alternative members to designate alternatives for all the seats that they qualify for as opposed to the current model of alternative members being restricted to fill a specific spot. (for example, a student-parent who is a member of PTA and AARP could fill in for three seats, not just one) The committee to be able to engage its own independent legal counsel (if required) in situations where FUSD and the CBOC may not be fully aligned. REGULAR AGENDA ITEMS Type Action/Vote Preferred Date May 22, 2024 Absolute Date May 22, 2024 Recommended Action Select Nuvera Homes’ proposal for the purchase of certain surplus property known as the Marshall Property, and authorize staff to continue negotiations for a purchase and sale agreement for future Board approval. Background At its April 21, 2021 meeting, upon a report and recommendation by its 7-11 Facilities Advisory Committee, the District’s Board of Education (“Board”) unanimously voted to declare the former Marshall Elementary School Site, a 2.62-acre parcel located at 5301 Curtis Drive in Fremont (“Marshall Property”), as surplus to the District’s education needs. On March 23, 2022, the Board authorized staff to proceed with the necessary steps for the disposition of the Marshall Property, including executing the preliminary statutory requirements and exploring all other options for disposition of the surplus property in the best interests of the District, including seeking a waiver from the State Board of Education (“SBE”) of certain surplus disposition statutes, if needed. On November 2, 2022, the SBE approved the District’s waiver request, which allowed District staff to issue a Request for Proposals, on February 17, 2023, for purchase of the Marshall Property. Proposals were received until April 28, 2023, which was then extended to June 2, 2023; however, no proposals received met the conditions and terms of the Board for the disposition. District continued to seek general proposals for purchase of the Marshall Property, and in February 2024, District’s broker initiated another wave of seeking proposals for purchase of the Marshall Property with further authorization of the Board. Current Status The Board was presented with three proposals at its open, regular meeting on April 17, 2024 : Nuvera Homes: $11,500,000, close of escrow approximately 15-21 months Warmington Residential; $9,750,000, close of escrow by final map, approximately 24 months ARK Group USA LLC: $6,350,000, close of escrow approximately 120 days The Board considered the proposals presented and authorized staff to commence negotiations with Nuvera Homes. The SBE waiver approval requires the Board to first receive proposals, then select the most desirable within 30-60 days of the public meeting where the proposals were received, and that the reasons for that determination be discussed in public session and included in the minutes of the meeting. No other proposals have been received by the District since the Board first received proposals at its April 17, 2024 meeting. Accordingly, staff respectfully requests the Board formally select the proposal from Nuvera Homes as the most desirable proposal based on the following reasons: The purchase price offer is the most favorable among the three proposals; The intended future use is for residential development, and not for use as a school site; Nuvera Homes has successfully developed several residential communities within Alameda County, with a new development partnership with the City of Fremont; and The proposal includes other favorable terms for the District, including a compressed due diligence and closing timeline. A final purchase and sale agreement with Nuvera Homes will be brought back to the Board for consideration and approval at a future meeting. Staff requests that the Board select Nuvera Homes’ proposal for the purchase of certain surplus property known as the Marshall Property, and authorize staff to continue negotiations for a purchase and sale agreement for future Board approval. Policy Implications Board Policy 3270- Sales and Rentals of Property Board Policy 7210- Method of Financing Prepared by: Daniel Hillman, Associate Superintendent File Attachments Motion & Voting Select Nuvera Homes’ proposal for the purchase of certain surplus property known as the Marshall Property, and authorize staff to continue negotiations for a purchase and sale agreement for future Board approval. IT will implement a hardware refresh to replace aging lab and staff computer devices at all sites. This upgrade will enhance functionality and safeguard against potential security threats. Current Status On March 27, 2024 , the Board approved the purchase of desktop devices for school site labs. These labs will need monitors with cameras to allow students to leverage new enhanced security features. In addition, on January 31, 2024 , the Board approved the purchase of 10,000 Chromebooks. There is a need to secure and charge some of these Chromebooks in classrooms with a smaller class size. Smaller charging bins will be purchased to accommodate this need. Based on an analysis performed by the Technology department the district will be able to reutilize some existing monitors and charging bins to save on these costs. The NASPO MHEC Master Contract will be used to purchase these devices. The cost breakdown is as follows: Item Quantity Total Dell 24 Video Conferencing Monitor 960 $158,400.00 Dell Precision Compact AIO Stand 960 $73,920.00 Environmental Fee and Tax $28,612.80 LocknCharge Carrier 15 Charging Station 100 $76,500.00 Tax $7,841.25 Total $345,274.05 Staff request Board's authorization to purchase Dell Monitors and Chromebook Storage Bins for cybersecurity purposes.
