A - RES 19R-04-67 Development Agreement with LeParc at Lauderhill, LLC Ex. B -Le Parc At Lauderhill Bid Set Proposal REV01 Ex. C- Updated Le PArc Est revised Attachments: Commissioner Grant sought clarification on staff’s perspective. Deputy City Manager/Finance Director Kennie Hobbs stated there was a prior agreement approved by the City Commission related to an abatement for the development of the Le Parc rental property. The City offered tax abatements designated within its CRAs, as the City had a non-tax increment financing (TIF) CRA, unlike CRAs in other cities where they had the opportunity to provide cash incentives to spur development in their area. In lieu of the City’s CRA having that ability, one of the things they were considering in the CRA districts only was tax abatements. The subject issue before the Commission was an update to the previously approved agreement. Acting Planning & Zoning Director Zachery Davis-Walker highlighted the updates to the subject agreement as follows: • This addendum was due to quickly escalating construction costs • The subject memorandum of understanding (MOU) was approved in 2019 with a Page 4City of Lauderhill

July 11, 2022City Commission Meeting Meeting Minutes - Final specified abatement amount for a term of ten years • The addendum to the existing MOU provided for the same term, a slightly higher abatement amount; the primary difference was the provision for claw-backs that provided for certain conditions the developer had to meet prior to those incentives being reduced, along with an actual voiding for the incentives. Mr. Hobbs noted, previously, the approved abatement had a cap, and due to rising construction costs, the applicant asked the City to reconsider the new costs, and recalculate the abatement amount, which staff recommended take place. The new construction amount represented $72 million, and based on that new construction amount, staff was asking the Commission to consider a maximum abatement over a ten-year period of $9,103,503.00; this took into consideration ad valorem taxes, the debt millage. The applicant would continue to pay the fire fee, utility costs related to water and sewer, stormwater costs, and certificate of use (COU) fees; though there’s an abatement being requested, staff thought the overall impact to the community was positive, and they anticipated other property values within that area increasing, and by placing the cap, as property values increased, there was a hard cap as to an amount, though not necessarily for ten years. If property values rose quickly, the abatement period would be for fewer years, and if they rose more slowly, the abatement period would cap at ten years. Mr. Hobbs indicated the agreement called for construction to begin by the first quarter of 2023, and the applicant indicated they would be ready to move forward with construction at that time, and if construction was not concluded on time, the City had the ability to reduce the overall abatement. Commissioner L. Martin noted the fact that the subject development was located in the CRA area meant other developers coming to the City outside of the CRA would not be eligible to receive a similar tax abatement. City Attorney Hall affirmed staff would codify that tax abatements were only considered for sites located in the CRA areas. A motion was made by Commissioner L. Martin, seconded by Mayor K. Thurston, that this Resolution be approved. The motion carried by the following vote: Yes: Vice Mayor M. Dunn, Commissioner D. Grant, Commissioner L. Martin, Commissioner S. Martin, and Mayor K. Thurston 5 - Abstain: 0 Vivian Dimond commended the City Commission and staff for how well they conducted City business, stating she received numerous offers on the subject property, which she refused, as she was determined to build the subject development and be a part of Lauderhill. She mentioned it broke her heart when a previous speaker was unsuccessful in getting full city funding to take some youths to Tallahassee, so after her presentation, she went out to the lobby and offered to cover the remaining costs of the trip. She hoped to continue being a good community partner in the City of Lauderhill for years to come. She reminded the Commission she would be donating close to an acre of land to the City to facilitate street improvements. Additionally, the subject development would have a children’s daycare center, something she insisted on having on the property from the beginning of the process. She appreciated the Commission’s vote of approval, promising them she would not disappoint them. Page 5City of Lauderhill

RES-22R-07-140-City Sign Policy.pdf AR 22R-07-140 CITY SIGN POLICY EXHIBIT.pdf Attachments: City Attorney Hall spoke to some members of the City Commission on the subject issue, and he thought the word campaign was causing some concern, so another word would be chosen, as the words campaign and sign were in a different area by code, which was not the intent of the subject resolution. This was about City advertising various events and initiatives, such as City Commission events, etc. Director of Public Relations and Cultural Arts Leslie Johnson concurred, referring to the City attachment containing the policy with the language “City services or campaigns”, which she changed to “City services or events”. She agreed with removing the word campaign from the title. Page 8City of Lauderhill

July 11, 2022City Commission Meeting Meeting Minutes - Final Commissioner Grant asked when the change would take effect. City Attorney Hall commented the subject policy had a number of moving parts. For example, the City’s purchasing and installing electronic signs, which required a process that would span a number of budget years, as staff had to source the funding. He said some things might be more immediate, such as staff moving ahead with trying to design permanent signs, such as those going in City parks for Adopt-A-Park. Thus, the Commission’s present approval would put the policy into effect, but actual implementation would take longer, possibly six to eight months. Ms. Johnson indicated, in terms of the number of signs that would be activated, the CRA began to put up their Beer-B-Q signs, and they already elected to order only ten, so staff was working on those. A motion was made by Commissioner L. Martin, seconded by Vice Mayor M. Dunn, that this Resolution be approved. The motion carried by the following vote: Yes: Vice Mayor M. Dunn, Commissioner D. July 11, 2022City Commission Meeting Meeting Minutes - Final community leaders breakfast similar to that of the Lauderhill Coalition HOA presidents. Commissioner L. Martin said they pulled a small group together in response to receiving numerous complaints about the kind of information being provided to new residents moving to Lauderhill, then later discovered Ms. Johnson and her staff did an excellent job compiling information that was already posted on the City’s website. The information for new residents moving to Lauderhill included links for further information; his group would pursue printing five by seven palm cards, and business-type cards with a QR code people could zoom in on to find the same information. The intent was, over the next 30 to 60 days, to get information out to the City’s HOAs and other large groups the Commission and staff often met with. He said the information on the City’s website spanned all city services, including bulk pickup schedules, schools located in Lauderhill, voter registration information, hospitals, etc. He mentioned the paper shredding pilot program was very successful, and at three of the four park locations bins completely filled up in a week, with a possible dumping date of August 4, 2022, which might have to be rescheduled for an earlier date. In light of the pilot program’s success, staff would make adjustments going forward, monitoring which locations received the most usage. Vice Mayor Dunn wished staff to add to the hospital list Broward Community Family Health Center located in the Lauderhill Mall. Commissioner L. Martin mentioned July 10, 2022, was the 49th Anniversary of the Bahamas Independence. Mr. Hobbs reminded everyone about the upcoming Budget Workshop on July 12, 2022, at 9:30 a.m. at City Hall, at which the City Manager’s proposed fiscal year 2023 budget would be discussed. Mayor Thurston noted at the last Move with the Mayor event, they added indoor cycling or spinning and it would continue to take place every Wednesday at Veterans Park at 6:30 p.m.; there was good turnout with residents using nine of the ten bikes. He would be bringing back the grant writing seminar, and as there was a significant amount of information to disseminate, it would be a two-day event: part one on Saturday, August 6, 2022, and part two on Saturday, August 13, 2022. Soca Step Aerobics continued the coming Friday at 7:00 p.m. at the Lauderhill Sports Park; the number of attendees increased with each event, and the coming event included a challenge with the City of Tamarac.
