Office ol tl'ie South Gate Ciity Clerk Item No. 1 SEP - 4 2025 FILED kl',lpg Ciffl of South Gate CITY COUNCIL AGENDA BJ[LL For the Regular Meeting of September 9, 2025 Originating Department: Administrative Servic I!,uiS I :rausto - - 4' ,f/l%b Houston f' SUBJECT: RESOLUTIII)N ADOPTING THE SCHEDULE OF FEES FOR SERVICES PURPOSE: The City Council will conduct a Public Hearing and consider adopting a Resolution approving and establishing a new schedule of fees effective for FY 2025-26 and rescinding Resolution No. 2021-51-CC. RECOMMENDED ACTION: Following the conclusion of the Public Hearing, the City Council will consider: 1. Adopting the Resolution establishing a new Schedule of Fees for City services effective for FY 2025-26; 2. Authorizing the Mayor to execute the Resolution in a form acceptable to the City Attorney; and 3. RescindingResolutionNo.2021-51-CC FISCAL IMPACT: Staff estimates the aggregate adjustments will generate approximately $500,000 in additional annual General Fund revenue, improving cost recovery for services affected by wage, benefit, and operating cost increases since 2021. The estimate reflects the net effect of the 7% baseline adjustment (where legally permissible), offset by exemptions and rounding, and does not presume full utilization of every fee line. Actual revenue will depend on service demand and compliance. BACKGROUND: The City's Master Fee and Charges Schedule consolidates fees for services authorized by the Municipal Code and other authorities. The last comprehensive update was adopted in FY 2021-22 (ResolutionNo. 2021-51-CC), which contemplated periodic inflationary adjustments subject to Council approval. Since that action, fees have not been updated, despite the City's costs increasing materially (as evidenced by cumulative CPI increases since 2021). Departments have reviewed their fee inventories and recommended changes to reflect current service delivery methods, staffing, and program structures. I 9

ANALYSIS: Under California Constitution Article XIII C, section 1(e) (Proposition 26), a fee may recover only the City's reasonable cost to provide the service and therefore is not a tax. The proposed schedule complies with this standard by: Applying a baseline 7% adjustment to most fees to partially restore cost recovery eroded since 2021. Exempting fees that are voter-approved, set by statute or regulation, or otherwise legally constrained. * Making targeted line-item updates to add new fees, retire obsolete entries, and correct titles, units, or administrative notes. Departments reviewed each fee and its cost drivers (labor, time standards, materials, and overhead). Where a fee's cost basis has materially changed, staff proposes a specific revision. Where costs remain broadly aligned but inflation has reduced recovery, a uniform 7% adjustment is proposed as an interim measure pending any future, detailed cost-of-service studies. The attached Master Fee and Charges Schedule is organized by department and service area and shows the current and proposed fee. Annotations identify fees excluded from the baseline adjustment and those subject to external limits. Technical edits (e.g., clari'Jying units of measure, adding account references, aligning titles to current practice) are included. Unless adopted as an urgent measure necessary to protect public health, safety, or welfare, fee changes take effect 60 days after Council adoption. If adopted on September 9, 2025, the effective date will be November 9, 2025. NOTICE REQUIREMENT: Notice of this Public Hearing was published in the Los Angeles WAVE on August 14, 2025, and August 21, 2025, and circulated via the City web page, Facebook, Instagram, and Twitter. TIMING REQUIREMENT: When local agencies want to increase their fees or charges, Section 66018 of the California Government Code requires a public hearing to be conducted, at which time oral or written presentations can be made, as part of a regularly scheduled meeting. At least 10 days prior to the meeting, the local agency shall make available to the public data indicating the amount of cost, or estimated cost, required to provide the service for which the fee or service charge is levied and the revenue sources anticipated to provide the service. The notice shall be for ten (10) days, and the notices shall be published at least twice with five (5) days separating the notices, not counting the dates of publications. The change in fees shall be effective sixty (60) days after the final adoption of the Council, unless passed as an urgent measure to protect the public's health, welfare, and safety. The schedule is as follows: First Day of Public Notice in Local Publication Date Fee Data is Provided to Public Second Day of Public Notice in Local Publication Public Hearing Date of Implementation of New Fees August 14, 2025 August 15, 2025 August 21, 2025 September 9, 2025 November 9, 2025 2 10

A notice was published on August 14, 2025, and August 21, 2025, in accordance with Government Code Section 6062(a). The proposed fee changes and documentation were made available for the ten-day public review period at the City Clerk's Office since August 31, 2025. If approved, the new fees will become effective sixty (60) days upon final adoption of the Resolution. ATT ACHMENT: A. Resolution B. Exhibit A - Master Fee & Charges Schedule (FY 2025-26) 3 11
