Chair Salem requested additional definition of the City Administrator position and a formalized process for Commission access to hiring materials for key Charter positions. Second Reading of Ordinance 26-964 Amending Section 90-5 “Appeals” of Chapter 90 AN ORDINANCE OF THE CITY OF ANNA MARIA, FLORIDA, AMENDING SECTION 90-5, “APPEALS,” OF CHAPTER 90 OF THE CITY OF ANNA MARIA CODE OF ORDINANCES; PROVIDING A PROCESS FOR VARIANCE REQUESTS FROM THE STRICT APPLICATION OF CHAPTER 90; PROVIDING THAT THE PLANNING AND ZONING BOARD MAY RECOMMEND APPROVAL OF SUCH VARIANCES TO THE CITY COMMISSION; INCORPORATING THE APPLICABLE PROCEDURES AND STANDARDS OF CHAPTER 114, ARTICLE II; PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE. City Planner Ashley Austin presented an amendment to Chapter 90 allowing applicants to request variances from traffic access, circulation, and parking requirements. Discussion addressed the distinction between interpretation appeals and variances, the Planning and Zoning Board review process, notice requirements, and hardship standards. On advice of the City Attorney, the Commission agreed to clarify that the Planning and Zoning Board may recommend approval or denial to the Commission. Administrative approval of minor variances was discussed as a possible future policy, not as part of this ordinance. Discussion with Possible Action – Commercial Rental of Beach Equipment Franchise Agreement RFP 26-004 Mayor Short presented three proposals for beach cabana rental franchises within the designated six-block area, limited to 36 total setups. Evaluation criteria included qualifications (20%), operational approach (30%), franchise fee (35%), and references/past performance (15%). Scores were My Beach Concierge 84.33, Cabana Up 83.92, and Beach Suites 75.10. Proposed fees for two franchisees were $20,000, $15,000, and $7,500. Proposed fees for three franchisees, $15,000, $10,000, and $5,000.

October 08, 2026 City of Anna Maria Page 3 of 4 Tiffany Adele, co-owner of Beach Suites, highlighted the company's experience, compliance history, and community involvement. She requested that the Commission consider qualifications and past performance in addition to franchise fees. Peery, representing My Beach Concierge, explained that the company's proposed franchise fee was based on historical revenue and represented approximately 15–20% of gross revenue. He also discussed the company's compliance efforts and community involvement. The Commission discussed two versus three franchisees, operating histories, projected revenues, enforcement costs, and the two-year trial period. Commission noted that the RFP prescribed the bid-fee structure and that changing it would require a new procurement process. Motion: Commissioner McMullen moved, Commissioner Lynch seconded, and the motion carried 4-0 to proceed with all three applicants under the three-franchisee scenario as outlined in RFP 26-004. d. Special Event - Beach Wedding Mayor Short explained that a wedding planned at a vacation rental could not take place at that location and requested approval for a beach wedding on Saturday, October 10, 2026. Staff had received the application, insurance, payment, and required agency signoffs. Motion: Commissioner McMullen moved, Commissioner Lynch seconded, and the motion carried 4-0 to approve the Special Event: Beach Wedding. 5.
