Safe and Supportive Environment 4. Efficient and Fiscally Sound Operations BACKGROUND: The Consultants Competitive Negotiation Act (CCNA) Committee met on July 29, 2025, to select an architectural and engineering firm for the Pinewood Elementary School Renovation Comprehensive Project. The Committee utilized policies in accordance with Section 287.055, Florida Statutes for the selection of architectural and engineering firms. The CCNA Committee met initially on July 15, 2025, to review proposals submitted by the following firms: Baker Barrios Architects Spiezle Architectural Group, Inc. Larson Design Group, Inc. Zyscovich, LLC *MWBE, **LDB, ***MWBE/LDB, ****VBE All proposals were evaluated using the evaluation form contained in the Request for Qualifications package provided to all interested firms. The evaluations were based on each firm’s related experience, proposed project staff and functions, and location of the firm, workload, equitable distribution, financial capabilities, and cost control measures, minority and local developing business history, local preference policy score, and completeness of the firm’s response to the District’s Request for Qualifications. Scores were totaled for each firm, and a shortlist ranking was established. Zyscovich, LLC Spiezle Architectural Group, Inc. Baker Barrios Architects Larson Design Group, Inc. On July 29, 2025, the Committee interviewed the shortlisted firms. The interview results were based on the Request for Qualifications evaluation form criteria. Criteria included the firm’s references, overall approach and methodology, project team, cost control, project scheduling, MWBE, LDB, and VBE implementation plan. After interviews, the Committee members scored each firm’s performance using the established form. The resulting scores were then totaled , and the firms were ranked as follows: Zyscovich, LLC Larson Design Group, Inc. Spiezle Architectural Group, Inc. Safe and Supportive Environment 4. Efficient and Fiscally Sound Operations BACKGROUND: On December 14, 2021, Thornton Construction Company, Inc. was selected for the Four Site SY 2024-25 Middle School Functional Equity Classroom Additions Project. Subsequently, on May 21, 2024, Thornton Construction Company, Inc. was issued Guaranteed Maximum Price (GMP) Amendment No. 2 for the construction portion of the project. At the time of the construction notice-to-proceed (NTP), the design drawings for the temporary phasing portables were included in the approved Phase III construction documents. Subsequently, separate construction documents and permits were required for the phasing portables. The time required to prepare the documents and obtain the applicable permits delayed the installation of the phasing portables, requiring an extension of the project’s substantial completion date. Change Order No. 2 authorizes a time extension of one hundred and twenty-one (121) calendar days, extending the project substantial completion date from December 24, 2025 to April 24, 2026, additional general conditions in the amount of $295,866.46 ($234,730.75 for College Park Middle School, plus $61,135.71 for Hunter's Creek Middle School), and additional general requirements in the amount of $222,393.35 ($136,699.41 for College Park Middle School, plus $85,693.94 for Hunter's Creek Middle School). Based upon exceeding the applicable limits (greater than 120 days and $200,000.00), School Board approval is required for Change Order No. 2. The total project budget for the Four Site SY 2024-25 Middle School Functional Equity Classroom Additions Project is $46,567,000.00 (in accordance with the FY25 Budget). FISCAL IMPACT STATEMENT: This change order will increase Guaranteed Maximum Price Amendment No. 2 in the amount of $518,259.81 for the Four Site SY 2024-25 Middle School Functional Equity Classroom Additions Project. The District will seek recovery from the design professional of any additional costs incurred as a result of the design errors or omissions pursuant to the terms of the design agreement. Consent - Approve Legal/Audit Items Subject 15.01 Request Approval of Final Order of Dismissal for Bid Protest in RFP 24182, Dental, Vision, Life and Disability Insurance Meeting Aug 12, 2025 - School Board Meeting, 5:00 PM Type Action (Consent) Recommended Action Approval of Final Order of Dismissal for Bid Protest in RFP 24182, Dental, Vision, Life and Disability Insurance Goals 4. Efficient and Fiscally Sound Operations BACKGROUND: The District issued Request For Proposal RFP24182 for Dental, Vision, Life, and Disability Insurance on or about January 13, 2025. On March 26, 2025, the District issued its Notice of Intended Decision to award the dental insurance contract to Cigna. The third-place proposer, Delta Dental Insurance Company, filed its Notice of Intent to Protest on April 3, 2025. Delta Dental Insurance Company filed its Formal Written Petition (Protest) on April 14, 2025. The matter was sent to the Division of Administrative Hearings for resolution of the bid protest. On July 17, 2025, Administrative Law Judge Andrew Manko issued a Recommended Order recommending dismissal of the Formal Written Petition (Protest). Pursuant to §120.57(3)(e), Fla. Stat., any exceptions to the recommended order in a bid protest action had to be filed within 10 days of the issuance of the decision: “Each party shall be allowed 10 days in which to submit written exceptions to the recommended order. A final order shall be entered by the agency within 30 days of the entry of a recommended order.” Delta Dental Insurance Company did not file exceptions to the Recommended Order within 10 days of July 17, 2025. As such, all exceptions are waived. See Sonny’s Italian Restaurant and Pizzaria, Inc. v. State Department of Business Regulation , 414 So.2d 1156, 1157 (Fla. 3d DCA 1982): “The final agency order under review revoking appellant's liquor license is affirmed upon a holding that:…(4) any error resulting from entry of the final order on July 2, 1981, prior to receipt of appellant's exceptions to the recommended order, is not material in light of the fact that the exceptions, dated July 6, 1981, were not filed within the requisite ten day period of section 120.57(1)(b) 8, Fla.Stat. (1981) , when measured from either the date the recommended order was entered (June 19), or the date submitted to the agency and parties (June 23). Sec. 120.68(8), Fla.Stat. (1981).” (Emphasis added) See also Envtl. Coal. of Florida, Inc. v. Broward Cnty. , 586 So. 2d 1212, 1213 (Fla. 1st DCA 1991): “Environmental Coalition did not file any written exceptions to the recommended order entered in this case. The final order adopted the findings of fact contained in the recommended order in toto. Having filed no exceptions to the findings of fact contained in the recommended order, Environmental Coalition has thereby expressed its agreement with, or at least waived any objection to, those findings of fact.” Because no timely exceptions have been filed, there is no basis for Delta Dental Insurance Company to challenge the factual findings, legal conclusions, or recommendation issued by the Administrative Law Judge. As such, a Final Order of Dismissal adopting the Recommended Order in toto is warranted. The attached Final Order dismissing the bid protest should be entered by the School Board. The School Board also sought attorney’s fees and costs under §§57.105(5), 120.595, and 120.57(3)(f), Fla. Stat., because the protest was without factual or legal basis when filed. The Recommended Order ruled that jurisdiction is reserved to the Division of Administrative Hearings on the School Board’s Motion for Attorney’s Fees and Costs pursuant to those statutes. Such an action can be filed separately with the Division of Administrative Hearings after issuance of the Final Order. Under School Board Policy BDG, School Attorney Legal Services, the undersigned General Counsel may file a motion for attorney’s fees in his discretion: “Motions seeking reimbursement for attorneys’ fees and costs or sanctions for frivolous actions or pleadings may only be filed on behalf of the Board by the General Counsel, or designee, or by outside counsel on behalf of the Board upon express written consent from the General Counsel, or designee.” The General Counsel may submit the motion for attorney’s fees and costs under the above-identified statutes based upon the fact that the protest was without factual or legal basis when filed, as permitted by School Board Policy BDG.
