Minutes of the Regular Meeting of the Winters City Council held on May 2, 2023 ________________________________________________________________________ City of Winters ______________________________________ Kathleen Salguero Trepa, City Clerk 10

Statement by Jack Young, Winters resident Dear City Council members, Thank you for your service to our community. I’m writing to you because I’m concerned about the council's ability to provide effective leadership given the recent events with Richard Casavecchia. Richard Casavecchia, a Winters city council member, is now facing felony assault weapon charges. In this situation, resignation is Casavecchia’s best service to the City of Winters and our residents. If he is not willing to resign, he should be removed by the Council. Mayor Bill Biasi’s statement that the charge is "a law enforcement matter" and "does not involve the City Council" is beside the point. The purpose of the City of Winters Council Code of Conduct (2022) is “to promote and maintain the highest standards of personal and profession conduct.” According to the Code, city council members are expected to represent their constituents in a legal and responsible manner, serving as “a model of civility and leadership, demonstrating honesty and integrity in every action and statement.” Many other California cities’ codes are similar. The Los Angeles code, for instance, states that “All elected officials of the City are expected to conform to the highest standards of personal and professional conduct. The Council shall have the power to adopt, by a two-thirds vote, a resolution of censure with respect to any member of the Council whose actions constitute a gross failure to meet such high standards …” Having unregistered assault rifles and handguns is illegal, irresponsible, and certainly not conforming to the highest standards of personal and professional conduct. Although the Winters’ code does not include any repercussions for an elected official who fails to uphold these standards of civility, honesty and integrity, the Council could – and should – effect a forced resignation or removal of Casavecchia from the Council. You know the situation. On April 2, 2023, Winters police located three AR-15-style rifles at Casavecchia's home. Two of those rifles were not registered to Casavecchia, according to the documents. During a traffic stop several hours earlier, Casavecchia told officers he had firearms in the truck. Of the three handguns in the truck, one did not contain a serial number or any identifying information. Court documents report that "Based on the officer's training and experience, he opined the handgun was manufactured with several aftermarket parts, none of which contained a serial number." Casavecchia has acted illegally, irresponsibly, and inappropriately. The City should not –cannot – allow someone with such blatant disregard for gun laws to represent the city and its values. How can we trust or depend upon him “to do the right thing in even the most difficult situations,” as the Winters Code of Conduct demands of council members, when he has already failed to do so. Respectfully, Jack Young Quotes from https://www.kcra.com/article/winters-councilman-arrested-gun- charges/43669854 11

As a resident of our beautiful town of Winters, I am extremely dismayed at the recent situation surrounding one of our city council members, Richard Casavecchia. Recently, Mr. Casavecchia was not only found in possession of a firearm with no serial number, but was also initially charged with corporal injury and false imprisonment of his spouse. Since the initial charges, there are now felony weapons charges I understand that we are all innocent until proven guilty, but I feel Mr. Casavecchia should step down from his position until this proceeds through the judicial process, and an interim council member appointed. These are VERY serious charges and news of this has spread to local TV stations, Twitter etc. In today's environment where guns, violence and domestic abuse are threatening our safety, we need to show our residents and visitors to our town that we take these kinds of charges seriously. Removing him from his position does not in any way say he is guilty, but it is a message that he needs to not be involved with our city decision making processes or act as a representative of our town until this is dealt with in the legal process. This kind of protocol is done all the time within police forces, school districts and most professions. Why not extend that same protocol to Mr. Casavecchia and his position within our city government. If there isn't some action taken by the Winters City Council, we are establishing a dangerous precedent. What if, in the future, a council person is charged with felonies ie. drug smuggling, child abuse, felony hit and run, just to name a few, then the person will remain in their position as there is no precedent set to remove them or have the step down until the case is resolved.. This is a very dangerous situation and a HUGE RED FLAG to the safety of our community. IF there is any way the council can put him on leave etc. , I think it needs to be done ASAP. Perhaps Mr. Casavecchia will step down temporarily until this is resolved. I know many with whom I have communicated think a recall would take too long and doesn't send a message for immediate action. This situation is being watched by many outside of our community and I hope action of some kind will occur to make the statement that our community is better than this!!! Sincerely, Nancy Northrup 707-365-4459 942 Potter St. Winters, Ca. 95694 12
