Mallard, good morning. >>Male Speaker: good morning, CHAIRMAN Deas and the board. How much time do you need? >> MR. Chair, I have a brief powerpoint presentation. We've actually worked very closely with our neighbors after reach a point where they created a letter of no opposition, should be part of the record. If not, we will have additional copies coming in soon. I do know that there is at least one neighbor, MR. Ingram, within the audience, I don't know if you want to hear from them first, and then I can proceed with my presentation. It's up to you. >> go ahead and do your presentation. That way we can move faster. >> q the powerpoint. For five. Avenue to keep my eyes open for this one. I have to remove my mask to put my eyes on, otherwise it fogs up. >>Male Speaker: you will not get in trouble. >>Male Speaker: I will get in trouble with my wife. >> but you are going to blame it on me, I know. Let me quickly start: this is property 64 acres on the south side of 288 at western 1/67 avenue, east of 167 avenue, and 69th avenue. [Inaudible] I went too far. Sorry. This gives you a sense of the zoning classifications in the area, the -- there is really a rainbow of zoning classifications all from r you want to the east um, he wanted of course remnants of a you zoning and this property has historically been formed and it is, however, in the urban -- inside the urban. [Inaudible] And designated for state density development for up to two and a half units per acre. It's inside the utb and available to provide additional inventory for the rising population of the county. A sense of where we are, this property is really centrally located close proximity to the south a transit way and a portion of the property, southeast corner, the one-mile where you could see get this density, but we are not seeking additional density, we are seeking to developing accordance with the existing state density designation on the property. The property, again, is uniquely located in that it has access to the metro bus system and metrorail system virtue of access to the south a transit way, a map that actually shows you route 35 a which provides access and the rest of the infrastructure. The county has spent heavily and has set its priorities to spend the money on ifrastructure while in the short term and any long-term. This graphic shows you the central location of the property, almost equal distance to crime only on the west and his open highway on the east, as well as the turnpike further to the east. As I stated in the beginning, we worked very closely with our neighbors. We held a number of zoom meetings. I personally participated in three of the zoom meetings where concerns, issues were discussed. Just a summary of what we discussed at those meetings, I am happy to tell you that those conversations have resulted in a number of changes to the application. MR. [Inaudible] That there was appeal. The allegation that went before the council with a complete remove the kitchen for the application before you today, and that is thanks to the involvement of our neighbors and to the willingness to compromise and provide several concessions. Let me quickly summarize those for you: the first thing that we have done is we have added a restriction on the total number of homes. We are not restricting the homes to 148 homes. Maximum density that could be achieved on this property is 160. We are limiting that to 148. We have also agreed to provide for larger lots along the north side onto 88 as well as the west side of 1/72 avenue. To arrive and comply with the eom standards, complying with the eu standards which require much larger and much deeper lot. That's at the request of our neighbors. We have provided for a notice future residents of the proximity to the ingram preserve to the north, as well as the request of durham, we provided fr a buffer between the proposed homes and the preserve to the north. In addition to that, we have agreed that the property will be connected to the public water and sewer infrastructure, so the septic tanks will not be used for this 148 homes. Obviously as lenore brings additional construction to the area, additional properties can benefit from that, availability of water and sewer. We have also provided for a buffer along two 88 1/72 avenue again to provide a transition as you get to the west and as you go to the north, and that's actually a perimeter buffer that will be heavily landscaped, just to give you an idea. Calls for trees to be planted at a height of 10 feet and 35 feet on center. We are calling for trees at 14 to 16 feet. At 25 feet of the center. Are also calling for a lot in this declaration. Certain things take so long to own it, but we are providing for an effort to mitigate impacts on affected schools in the area, both elementary and senior, working with, promising to work with them to provide financial support to programs at those schools. Lastly, probably -- most important issues that we discussed before the committee counsel is we are agreeing to preserve, at least not to opose, the designation, the designation of the case residents, is that the history structure has been there for 100 years. It was actually moved here from 167 avenue to MAY 2 street. We are agreeing that we will not oppose the historic preservation office, attempts to designated which is to be happening, the first meeting will happen later this afternoon. We agree that if it is designated, we will apply for a permit to be located within the property where it can be preserved for generations to come in honor and memory of the chase family, MR. Case was an early firearm in the south dayton rutland area. That's a summary of the declaration. Based on the declaration, the south dade coalition issued a letter which was emailed to me last night indicating that they would -- did not have any objections to the approval of the application. They did ask for three additional things and I want to very quickly deal with them. Number one, they asked that prior to relocation of the structure, the home should post a bond to guarantee successful relocation in consultation with historic preservation office. They tell me that the county does not require a bond. And so, we will -- we are going to move it, if allowed, pursuant to conditions of the certificate of appropriateness from the historic preservation board. Do it pursuant to those terms and conditions. The home will be incorporated into the overall development. It is in our best interest to make sure that nothing happens to that structure and there was a building code which prohibits all structures. So we do not see any need for additional bond. I have told you how we are agreeing to comply with the eu standards in 1/72 avenue in 288 street. The coalition would like those properties to be rezoned to eu s instead of eu and. I don't have that specifically or conceptual objections to that. Legal to say okay, resilient found in eom, but. [Inaudible] I don't think it's necessary and that we are agreeing to comply with the eu standards monday, when an application, even when an application comes west of 16 and I avenue or north of 28 street, I'm sure the zoning director will, and say, yes, we have an eu about the lots are in the U.S. In size and lastly, the other request is for up to provide bigger lots o the north side of the property, but east of 1/69 avenue. Unfortunately, we have lower density to a point that we cannot lower any of the more. That's why we cannot agree to that request, we do have copies of that letter which we will introduce into the record. [Inaudible] Let me jst note for the record that. [Inaudible] Very quickly, this is -- this is the difference between eom and eu as. The very, very large phone, we are attracted to the young families in the area. Brought you a few renderings of what the homes will look like. The application will also be subject to the payment of impact fees, substantially improved infrastructure in the area. every department has looked up this application as listed, and since I hear commissioner martinez, left, I will close by saying that the county has a documented need for additional family inventory. We work for the approval in accordance with your professional staff recommendations and in accordance with the revised restrictions and will be available for any questions you MAY have. Thank you. >>MR. Chair: thank you. Way to move it. That's important. We will hear now from the people. So I have a MR. Nunez. MR. Nunez? I believe MR. Nunez is trying. Sorry if I mispronounced your last name. It is so hard to read here. >>Male Speaker:,good morning, members of the commission. [Inaudible] >>MR. Chair: hold on for a second. Can add forbes, geo dance JR., and arlene m butter? It does make the way down, please. Please state your name and address for the record and you have two minutes to speak. Please proceed, sir. >> good morning. Minimus MR. Nunez on behalf of those concerned citizens of south dade. We conditionally do not object to this application, subject to the conditions and amendments that were requesting to be incorporated into -- >>MR. Chair: sir, do you have an address? >> 16262, southwest 287 street homestead, florida. Wrestling, we would like to come in here and say we support, we object to the application subject to conditions that been incorporated in the letter. Our concern is with the movement of the historic search of that's over 100+ years old, we would like to incorporate language into a covenant that says idicates that the historic structure is moved, damaged, or destroyed, that the applicant would completely rebuild and restore the structure since it's being considered for designation currently by the historic preservation board of miami-dade county. I would also like this board to consider incorporating you as homes along the northern portion of the project site, which currently abuts the ingram preservation preserve and the other existing eu one homes built by the ingram family along to 88 street. That is pretty much it. Thank you very much. >>MR. Chair: thank you, sir. Sir? >>Male Speaker: good morning. I want. [Inaudible] Southwest 31 avenue, homestead, florida. I represent the long-range allegis city community advisory committee, also I am the chair of the naranjo lakes cra. This property lies outside of our boundaries. However, the project impact our development plans, and we are here to support the housing for this area, because we believe that it's a good fit. It was a part of what we had envisioned where we was ding all of our community urban centers, and this is the edge of before we go into the utb. Therefore, we feel like this is a good buffer for the area with these type of single-family homes, and we would appreciate it if this board will approve this project. Thank you. >>MR. Chair: thank you, sir. Sir, next person. >>Male Speaker: good morning. Jail temperatures, my address 001215 sw. 203rd street. I am the ex-PRESIDENT Of the school's community development corporation who worked the different. [Inaudible] Involved in this eu sees in this project fits what we envision of high density along the U.S. 1 itself, along the busway, with certain buffers as you go deeper into the western parlor community. And I think agreements that the attorney is hung up, with the applicants with the declaration, it fits everything that the community, all the people that requested it. So I asked the you actually support this project as well. Thank you. >>MR. Chair: thank you. Ma'am? >>Female Speaker: good morning, commissioner! My name is pearly butler. My address is 26615 sw. 137 court, homestead 33032. I have been a member of the new range advisory board for many years and have monitored the development and projects in the council for quite a few years as well. Also, a realtor, and I have worked in the area for quite some time. There was a need for housing units in recent years. It's been nice to see nice projects come through the offering estate density homes. It's getting harder to find these homes. I'm sorry about this thing here. With the shortage of home, the county encourages high density and smaller homes to the field -- to fill the needs of the area. This project offers a different option for larger blocks ad homes, and I think that it needs dish fish to see the nice homes that's going to be coming up. I am in support of this particular project. And I would like for the commissioners who get to vote on the same thing. I think it would be a great deal to help the community and to help the people, because the need for housing is very great. Thank you for hearing me this morning. >>MR. Chair: thank you, ma'am. I have a david farrow? MR. Faurot, you know the routine? >>Male Speaker: yes. Good morning. Farrow, address is 16370 sw. 2/84 street. I am here on behalf of the concerned citizens of south dade. I'm here to express that we support this applicant. We don't object to any of the conditions that are outlined in the covenant. And so, that is all I have to say. Thank you. >>MR. Chair: thank you. Nice and sweet. That's what we like. With that, anyone else would like to speak on this item? Let the record show no -- oh, I have one? Almost have that one. Each one of you are going to speak, please take one podium a piece. Morning. >>MR. Chair: good morning, MADAM. Please state your address and name for the record. >>Female Speaker: busy young, 28104, southwest 130 cord court, homestead, florida. >>MR. Chair: thank you. Please proceed. >>Female Speaker: my husband and I have lived in this area for many years. We have been involved with the community concerned in this. [Inaudible] Because ive been here all my life, I am curious to see the development of new housing, especially single-family homes. I was pleased to hear that this development going to happen. More and more people moving here anyway. Applicant took our ieas and offer this project for our approval. I think it is a good one and I support it. >>MR. Chair: thank you, ma'am. Sir? >>Male Speaker: good morning. My name is deroe young, retired united states air force. my address is 28104 sw. 143rd court, homestead, 33033. I live a few blocks away from this project and don't have any objections to these plans. I have been attending my community meetings for years and seen a lot of different projects come through here. This one is a nice pick for the surrounding area. A nicer blend of homes makes it similar to what is already here. Also, like the fact that the applicant reached out to the community and offered concessions to be reasonable with the existing neighbors, we know this area is popular and growing and it's good to see nice options available. I highly support this application and hope you will also. And service to the community. >>MR. Chair: thank you, sir. Thank you for your service. With that, I think I have, if am not mistaken, MR. Rumi so? Is there MR. Rumi so here? How about MR. Ingram? I'm not going to ask one more time. Is anybody that I've not called their name, please come up so we can proceed. Anybody else, please come up now. Okay. With that, please. >>Male Speaker: good morning. I feel like the lone ranger appear. My name is william ingram, 16840 sw. 288 street. I cannot help but notice that I do believe most of the people that gave their addresses supporting this are on the east side of U.S. 1. I'm directly impacted. I'm 1/4 generation age in the redlands, grandfather on acres in 40th street 1902. I've lived on southwest 288 street for six years, moving her 1961. My wife and I built our home in 1978 when it was required to have five acres to build on. We awarded all the changes and realized nothing stays the same. However, we are in an area of state homes, most of one acre or more west of 1/67, north of 296 street. I do not think it's unreasonable for us to have the expectation for the zoning to require more than 1/3 acre, which is what I calculate, that is being asked for on most of the property. My family does have skin in the game, so it's not really benefiting me to ask for, you know, higher density wanted to have acreage in the area, right in the immediate area. We own 35 acres. We ask the plan and reserve front to keep it from being redeveloped. After much pressure from the county, sold a bit and we were sure it would be preserved. The high density bill in north was asking for would in my opinion and peril to preserve. Resume meeting, I asked MR. Mayo, attorney for lennar, if they would consider larger one acre lots on the south side of the preserve. They response with us as we would not, that it would be too great of an economic loss to lennar. i understand -- >>MR. Chair: thank you so much, for your testimony. Your time has run out. >>Male Speaker: two minutes? We went yes. >>Male Speaker: I see where this is going. Thank you. >>MR. Chair: all right. Go ahead, police. >>Male Speaker: good morning. Minimus justin michelle. I have been living in miami nine louis drive. We asked for a speed bump in this area. >>MR. Chair: sir, need your address, please. >>Male Speaker: I said already, 980 liberty drive, miami, florida. >>MR. Chair: thank you again. Thank you. >>Male Speaker: now, my problem was in this area because people drive so fast and we request to have a speedbump. I was living here for six years. No inspection never came in that time until we asked for this, we asked for that. Now we have to pay for it because I have some -- [Inaudible] It was put in the front because I did not know the drivers to mess up the grass. I want to make the area look nice. But since I did not know, I have to pay. Maybe 100 something dollars just for that. The inspectors came, I asked them to remove them. [Inaudible] But they drive me in anyway. i don't think this is fair. I wonder myself all those things when I came here for those things, if anything will happen for this problem I came here for? >>MR. Chair: sir, you can continue to speak if you like what I'm saying about, if I come here with this complaint, is anything going to happen or adjust, and say whatever I want to say and that is it? >>MR. Chair: think you. >>Male Speaker: MR. Chair? >>MR. Chair: who is calling me? MR. Monestime? >>Male Speaker: he was in my district. We will talk to him in a minute. You can ask him to regain his seat and I have someone that is going to talk to him. >>MR. Chair: MR. Monestime, speak a little louder, please. >>Male Speaker: yes. I will have someone speak with him in a minute from my district. I think he's addressing an issue of speed bump and a citation he received. So I will have someone talk to him. >>MR. Chair: I appreciate that. Thank you, sir. Is MS. Waters, supposedly was to speak? Please have her come up and fill out the paper when she finishes. Ladies and gentlemen, it's a two-minute time for everybody, to be fair. So everybody that comes and speaks, we allow for two minutes, especially when we have a day that we might lose quorum early. So that a standard thing that we do in the zoning meetings, just for anybody that has any questions. That's where we are at. Come on down, MS. Waters. >>Female Speaker: thank you for your indulgence. The bus was late, an hour, so I just as I got here. Fortunately people know me are no around me here enough to give me some time, lenience to be here. Thank you. I gotta catch my breath. The application on this -- >>MR. Chair: MS. Waters, your name and address. >>Female Speaker: sorry. Mary waters, addresses 13 600 sw. 220 ninth street, miami. >>MR. Chair: thank you. >>Female Speaker: I am a former member of community county 14 and the -- my last year I was the CHAIRMAN Of that, of the council. This particular property is in an area where three of the four sides is zoned either agricultural or with state. A you want, one acre per homesite. The only, the map that this just the applicant has provided to you is not really specific enough to exactly what the zoning and home sites are in the area. They are one acre two is much as five acre home sites. You have. Nerves that are around there, you've got a natural forest, the state of florida owns it. 10 acres right there. You have 60 acre south -- southgate high school has over 3200 students as of last year. The traffic situation is not going to be mitigated for any improvement to the neighbors. The characteristic of that neighborhood is the state husing. It's not a typical subdivision where neighborhood would allow for the um zning where originally it was intended to have 160 homes. The applicant has had -- has compromised in a situation where they will allow some the U.S. Zoning along the main street, 288 street, which does not help any of the neighbors whatsoever. I would please ask that you uphold community council 14 voted on where they voted to deny the application. Because it does not fit, it is not characteristic of that area. At the very least, you should have stayed one acre per homesite's, which is characteristic of that area. So I would please respectfully ask that you uphold community council 14's denial of the application. Thank you. >>MR. Chair: thank you, MS. Waters. >>Male Speaker: appreciated. >>MR. Chair: with that, anyone else I have not called? All right. Let the record show that no public testimony is closed. MR. Maglio, you have a couple minutes? >>Male Speaker: yes sir. One minute or even less. Let me close by saying the property is designated on your massive plan for state density which allows reasoning to um in the U.S. And he won't, of rezoning are present in the area. I am proud of the work that we've done with the community that have come into this place with the level of support. I am grateful for their time and input. We will much better proposal today before you then we did before. But I will ask you to approve the application in accordance with the recommendation of yur professional staff which includes your traffic division, looks at traffic impacts and durham water sewer. They make sure all of the impacts will be accommodated in mitigated. We urge your approval and will be available for any questions you MAY have. Thank you. >>MR. Chair: thank you. Commissioner cohen higgins, you have the floor. >>Female Speaker: thank you, MR. CHAIRMAN. Once again, I want to start by thanking the residents of district 8 and south dade for cming down and expressing your public comments on this application. I want to thank the applicant for working so hard with the community as it is made clear. I do have a few questions: can you specifically outline what has changed from the denial at community council to what's being presented to us today? Can you just make that clear? >>Male Speaker: meanthe three main changes. about three. Number 1:the road salt reduction in density. [Inaudible] 160 homes, agree to 148. We get there by the second change which provides that onto 88 and 167 avenue, we will not build um loss, but rather the U.S. Lots. A sense of comparison, um requires area of 15,000 square feet, the other provides 25,000 square feet. And have. [Inaudible] In the third change is that when the application went before the community council, the future with the fate of the case was rest much in doubt. The structure was not designated historic. Lenore in the. [Inaudible] We oppose the designation and we will knock it down. The structure will remain on the property. To let you know, it will be relocated to its original place on it 1/67 avenue near to 92nd street. That's three major changes. >>Speaker: thank you for aligning that. That leads, next question regarding the case buffalo. There is a meeting at 2:00 today here before the historic preservation board. Explain to us what the outcomes will be. Let's say this property is not determined historic by the board. What happens in that instance. >>Male Speaker: the meeting today is to. [Inaudible] Which was to the board and says we would like to bring you an application or a proposal for designated structure historic. Report. Encumbrance of and I have no doubt that the board will authorize the initiation of the proceeding. It will then come back for the board so that the structure is designated historic, one that structure is designated historic and I will have to do two things: number one, they would need to get a certificate of appropriateness to repair, to alter the structure. Two, they would need certificate of appropriateness to relocated within the property. So if the board was to say that the structure is not historic, then I would be free to demolish the structure. Now, there is precedent to what we are doing and I worked on the project. It was 1/77 avenue and 308 where the from residents was preserved and incorporated to the overall subdivision. That's exactly the PRESIDENT We are following. We are confident the board will find it historic and structure will remain within the property. >>Female Speaker: explained to me with a 100-year-old bungalow, being located within, you know, if you feet of brand-new residential properties, how exactly is that going to work? >>Male Speaker: it's neat, if I say so myself. The structure want to be placed on a larger lot. as you probably know, um allows guest quarters. So what leonhard plans to do is relocated to a larger lot. There will be a home built on the larger lot and the structure will become either a guest quarters or an office will be incorporated into the overall demolish. It will be preserved as part of the project. With the historic preservation board, no matter who owns the property, they will be required to preserve and will be required to obtain approval before we make any changes to the structure. >>Female Speaker: thanks for clarifying that. Of this home gets deemed historic, then there are a ton of laws that apply to a to preserve it and make sure that the bungalow is protected, correct? Ma'am. And is actually a very small structure. Is 800 square feet or so. So you can easily see how you have a main residence and then have element in the back and will be forever protected. Hopefully preserve permitting any durations. >>Female Speaker: thank you so much. I like the fact that the traffic currency on this aplication is consistent, that is connecting to sewer. But you made a number of concessions including one that is worthy, because you glossed over in your presentation group regarding the financial contributions to our schools in south dade, particularly avocado elementary and south gate high school. You are making a $10,000 contribution to each of those schools, which I think is tremendous. In light of the answers that you provided to my questions and all the recommendations provided by staff and the fact that there is zero protest and waivers in the fact that the concerned citizens of south dade is in favor of this project, I moved to -- >>Female Speaker: second. >>Female Speaker: and move this consistent with staff recommendations. Thanks so much. >>MR. Chair: I have a motion, I have a second. Commissioner sosa. >>Female Speaker: thank you, MR. Chair. The concessions are incredible and the wy they have worked with the community, going from septic to sewer is important. To your attention, if possible. As part of the declaration of restrictions agreement, it says that the owner shall plant live oak trees or such other similar shape species. I want to bring to your attention that we should start making sure that we do not allowed to plant anything close to any structure that are invasive trees. Durham now has learned a lot. Oak trees are beautiful, but we have learned that when big trees, the roots, the roots that are beautiful become trunks and they destroy the sidewalks. People fall, they destroy houses and infrastructure. so I want to give you that idea and I'm going to instruct the attorneys to prepare an item for me that prohibits completely in a tree that can be basically -- you know what happens to plants? They become beautiful plant they start becoming invasive and then you have to knock them down, and that hurts, because that hurts the environment and that hurts the pocket of the neighbors that are there. So, commissioner cohen higgins, if you can work something out in that sense, that no invasive trees were trees that can become invasive. We have beautiful natives that can help our environment. But I totally support and second your motion. >>MR. Chair: I have commissioner heyman, followed by commissioner regalado. >>Female Speaker: thank you. Ad thank you. A couple years ago, you and your firm were very supportive of initiatives for our comprehensive historic preservation legislation. The question, and for whatever you said that said if it is deemed historic, it's a great plan. Employee is excited about that. But if it's not, I would like is instead of it being knocked out, just do something else the property, give someone who has the mindset to want it preserved, whether it is a dish this is ohms, so whether it is our duty historic reservation board. They are a great group, or somebody else, and opportunity to pick it up and relocate it for possibilities later on, but not destroyed it or anything else, if that could be a consideration in a timely fashion. >>MR. Chair: commissioner heyman, thank you for that. The date heritage dish fish they've gathered support for the designation. The staff is strongly in support of the designation. >>Female Speaker: but if it does not happen, besides historic preservation, he properly set the dade heritage group, they are entities that have been the past stepped up. They saw the value of it and literally relocated it or preserved it. I like that to be in consideration. >>Male Speaker: we can certainly offer it to either parks and rec. >>Female Speaker: thank you. I am in support of those. >>MR. Chair: commissioner regalado? >>Female Speaker: thank you. Sally but my mind. That was one of my concerns. I think having a plan b if it's not declared historic, is important. If it comes with funding to restore it, I'm sure that our parks department will be happy to take it. But I don't want to speak for maria nardi are the other organizations that are involved in this. I think it is interesting that, if it is declared historic, you are going to make it part of a private residence. For those of us that follow historic preservation, we know we have issues currently with fort dallas, we have all these historic landmarks but unfortunately is at the local government is not a good steward, then gun, you know, they fall into jeopardy. Think it is a novel idea. It does resolve the maintenance issue, which always becomes an issue. So by attaching it to that title and having that covenant enforce the owner to maintain it, I think it might be a solution long-term that we should all consider for a few other properties, because we have -- commissioner higgins knows, it's not exactly the property we are talking about that we are concerned about. I think that's great. Also, very excited that you are connecting to why is the end there is a reduction in the amount of homes. But the other thing that commissioner sosa mentioned, you know, thank you for including our eu program in that track. In that portion of the declaration in page 2, you actually speak specifically to what commissioner sosa is talking about. You just limit it to this area. You know, they have a list of native species that can only be planted there. That is to her point. So I would just, you should just mimic the same language that you ae going to get some direction from eu nested plans you will put in other parts of the development. It does not speak here to biodiversity. I recommend biodiversity too. That's another issue that we have. You know, we want them to be native and we want biodiversity. Learn to love the buttonwood. It's pretty much the theme here. No palm trees, no palm trees. Thank you. >>MR. Chair: thank you. Finisher comment and I will move on. >>Male Speaker: general answer regarding trees: the covenant is actually. [Inaudible] Species MAY be approved by staff. So staff wants to change the species, we can do that. >>MR. Chair: okay. Sounds good. We will deal with that and I think after this discussion, we will have a little change coming on the tree lines. [Laughter] Yes, I know. The roots our problem. So with that, we have a motion, a second. >>MADAM Attorney: commissioner cohen higgins. >>Female Speaker: for. >>MADAM Attorney: commissioner -- >>MR. Chair: hold on. I have the attorneys liking me down. >>Male Speaker: out online saying it here. >>Female Speaker: under the commissioner monestime and commissioner mark hardiman came in a few minutes late, if they could both announce for the record that they were listening to the tape before tey came in. >>MR. Chair: gentlemen? >>Male Speaker: I was. >>Male Speaker: yes I was. >>MR. Chair: both of them stated. Continue on, MADAM Clark. >>MADAM Attorney: commissioner hardiman. >>Male Speaker: for. >>Male Speaker: commissioner heyman? >>Male Speaker: 's -- commissioner heyman. >>Female Speaker: yes. >> commissioner martinez aye. >>Female Speaker: commissioner monestime. >> yes. >> yes. >> commissioner soto. >> yes, yes. >> CHAIRMAN Diaz. >> yes! All right. It passes! Thank you. Please leave quietly. Let's tke up 3a. Nathan? >>MR. Attorney: MR. Chair, do you want me to go back to the first item? >>MR. Chair: no, iiia. >> item 3a, country palms holding the z 2019 new protesters, 24 waivers. >>MR. Chair: okay. Three a is yours again. Anybody representing 3a? Going to be busy this morning it looks like. >>Male Speaker: busy yesterday, a long day. Commissioner address 7111 new, on behalf of the applicant holding, the subject property is the home of the somerset academy high school charter. I am joined by carrie and o'sullivan, [Inaudible] Who was the principal of the high school as well as by a number of our students, a number of our parents and supporters who are here in support of this application. I am prepared to make a presentation unless, wish of the board. However, I'm happy to say that I urge you to approve it in accordance with the recommendation for staff. >>MR. Chair: I just want to make sure if it's -- I have no people opposing from what I understand I'm going to ask the audience if there's anybody opposing this program will this application. Okay. That is for you, commissioner cohen higgins points up to you when you want to do. You want to listen to it or whatever, just tell me. >>Female Speaker: excuse me, MR. Chair? >>MR. Chair: I know we have to listen to the people, but I wanted to see if the presentation was being listened to right now. Go ahead. >>Female Speaker: thank you, MR. Chair. In light of the paperwork we have before us, I feel sufficiently informed regarding this application and in the interest of time and courtroom today, and happy to forgo MR. Mile's presentation. >>MR. Chair: okay. Anyone that would like to speak or asks to speak on the item, it's time to do so. Quite a bit of you, but it seems very positive. if you are in favor, you can stand or you can waive -- MADAM Attorney, you tell me if I'm off, they could waive their support. >>Male Speaker: [Inaudible] >>MR. Chair: does anybody your support that we go like this? Okay. Tank you so much. Does not suffice the speaking of everybody? >>Female Speaker: if individuals are choosing not to speak in waiving support, that is fine. >>MR. Chair: thanks so much. We did the intellisense you today. [Laughter] Anybody can see application? Please stand up. Let the record show nobody stood. Commissioner cohen higgins? >>Female Speaker: thank you, MR. Chair. I could be wrong. I don't have my glasses on. It appears there are some students from the school that came to chambers. I would love to hear from at least one of the students, if time would permit. >>MR. Chair: absolutely. >>Female Speaker: looks like there's a lot of them and it would be good experience for them to come to the podium and say if you -- >>MR. Chair: I like the the family brought to me. I think it would be a good edition to a lot of kids that I now. >>MR. Chair: thank you. >>Male Speaker: MR. Chair,? >>MR. Chair: yes, MR. Mnestime. >>Male Speaker: these two. [Inaudible] >>MR. Chair: MAY lose his job after this one. [Laughter] Commissioner cohen higgins, we good? >>Female Speaker: thank you, MR. Chair, and thank you to those young men for coming forward and speaking. You did a wonderful job. With that, MR. Chair, I would like to move to approve this application. >Female Speaker: second. >>Female Speaker: for staff recommendations. >>MR. Chair: I have them motion and a second. Anybody else would like to speak on this matter or are we good? Okay. Looks like we are. MADAM Clark? >>MADAM Attorney: commissioner garcia? Commissioner heideman? >>Male Speaker: for. >>MADAM Attorney: commissioner heyman, commissioner higgins. >>Female Speaker: yes. >>MADAM Attorney: commissioner martinez? >>Male Speaker: and batting a thousand today. >>MR. Chair: so far. >>Male Speaker: does not happen often. >>MADAM Attorney: been away for so long. >>MADAM Attorney: commissioner monestime. >>MADAM Attorney: must be the hair. >>MADAM Attorney: commissioner by collado, commissioner so so, commissioner soto, commissioner cohen higgins. >> for. >> CHAIRMAN Deas. >> yes. >>MADAM Attorney: motion passes. >>MR. Chair: thank you, everybody. Lisa cuatt quietly. Let's go back to 1a. >>MR. Attorney: item 1a, c 2019, no practice, no waivers. >>MR. Chair: commissioner heideman? What is your pleasure on this? >>MADAM Attorney: is there anyone else that is here to speak on this from the public? >>MR. Chair: I don't have anybody. Take it back. They came in. Yes, was right in front of us and I have lower oil youth and I'm sorry I mispronounced it. When is bessie young. That is the three that I have. >>Male Speaker: if we could just have the public comment first? >>MR. Chair: yes, sir. Go ahead. >>Male Speaker: >>MR. Chair: are you the applicant? I apologize. It does not say here. I thought you were just speaking. Anyone who would like to speak on this item, come up now at this time. Anybody? >>Male Speaker: MR. CHAIRMAN, seeing that there are no people who want to speak on public item, I am fully apprised of the item is over the application. I have no further concern regarding it. it's not necessary for me to hear that the presentation from te applicant. With that being said, I would weight that presentation, if he is agreeable to it, and move to test test. >>Female Speaker: second. >>Male Speaker: second. >>MR. Chair: I have a motion, I have a second. Does anybody have to speak on this or want to speak? If you are in favor, just wave and we are good. Thank you. And the other two people that I have that I mentioned before, are they here? Okay. With that, MADAM Attorney and MR. Attorney, is that okay? Okay. Just want to make sure. I have a motion in the second. MADAM Clark? >> commissioner heideman. >> for. >> commissioner heyman. >> yes. >> commissioner higgins. >> yes. >> commissioner martinez. >> aye. >> commissioner monestime, commissioner by collado. >> yes. >> commissioner sosa. >> yes. >> commissioner soto. >> yes. >> commissioner cohen higgins, commissioner garcia, CHAIRMAN Diaz? >>MR. Chair: yes. >>Male Speaker: thank you, commissioner. >>MR. Chair: okay. Is item 3b. Commissioner monestime? >>Male Speaker: it's family foundation z 2021, no protest, no waivers. Sergeant in arms, do we have anybody? Nobody? All right., in addition monestime, what is your -- >>Male Speaker: I have a question for the representatives. And very familiar with the property. I understand this is on 1/2 an acre, but the owner actually owns, you know, the other parcels I would say south of that. That would provide greater, is there a plan to, is that a plan to assemble all of these for larger development? Because I think that you probably are looking, trying to maximize the development over there by bringing that in. Is that the case, >>,co morning, commissioner. The adis foundation is a nonprofit institution in our community that focuses on providing services and help to the jewish community, has purchased four acres along 95th street. They are building a school campus, and what we have done is we are acquiring some of the parcels on the back to have more open space. It will not be a high-rise development. It's going to be a series of two story buildings for a jewish school. We are currently working with some of the owners to see if we can get additional properties on the north side to expand our proposed recreational facilities. On this particular track of land, it's going to the asp our process because it's an urban center. We are proposing two-story middle school there. That is really with the intent is. >>Male Speaker: in the application for the school's, MS. Cohen higgins, would come back for the sport, right? >>Male Speaker: under the mc zoning district, that is a use permitted by rights so they are going to the administrative site plan approval process. >>Male Speaker: okay. >>Male Speaker: it's interesting, because currently today, under the existing zonings of both properties, you could have a school. The one thing is that we want to make it all the same zoning, majority of problem. He is four acres and already an urban center. We have one acre parcel in there from a design perspective because it's more flexibility active and having to operate with two different zoning districts. >>Male Speaker: thank you. >>Male Speaker: I move the item, MR. Chair. >>Female Speaker: it was properly moved and second. I have only one question, if you allow me. Are we talking about eight stories closed to residential is going to be? >>Male Speaker: no. That a great question, commissioner sosa. We have submitted a covenant living limiting the height of this parcel to be three stories. How are site plan shows two stories, but we submitted to make the same height which is currently allowed but the zoning. >>Female Speaker: thank you, commissioner monestime, because we are getting a lot of concerns from the community that allowing the big stories closely residential areas are bringing three stories is perfect. Much. Anyone else who have an oath to share, it was moved by commissioner monestime and seconded by commissioner heyman. Any additional discussions? None? >>MADAM Attorney: commissioner heyman, >> yes. >> commissioner heyman. >> yes. >> commissioner martinez aye. >> commissioner monestime, commissioner rigoletto. >> yes. Axios. >> commissioner soto. >> yes. >> commissioner cohen higgins. >> for. >> commissioner garcia. >> amen. >> commissioner heideman. >> for. >> CHAIRMAN Diaz. >>MR. Chair: yes. >> motion passes. >>Male Speaker: thank you very much. >>MR. Chair: thank you. Last one I believe is 3c. >> item 3c, princeton heights llc z 20 11060, no practice, no waivers. >> I have two people in support. And who is representing, is there anybody? You're ging to represent. Okay. All right. I got. [Inaudible] I mispronounced the hell out of that. You've got both of them. All right. You filled out two guards. >> my son, robert chisholm, is my attorney. >>MR. Chair: chisholm. Okay. Is he here? All right. This is commissioner cohen higgins. Do you want to hear from them and the presentation, or what do you prefer to do? >>Female Speaker: how long the representation do you anticipate? >>Male Speaker: we just have the basic, what we call it, standard presentation you would do with sony. We work closely with pnc staff. Since we are only requesting a map change and we saw that everyone was in agreement with no objections, w did not want to take up anybody's time. If we ever want to do a project there, we would come back of course and coordinate totally with you and with staff accordingly as we have always done. We have been involved in that area for about 30 years, commissioner, and we have impeccable track record. We won national state and local awards in all projects. the architect as well and the owner. Actually, my wife is the owner. >>Female Speaker: smart comment. With that, you know, I don't -- >>MR. Chair: at least he saying the right things. >>Male Speaker: my name is robert chisholm and 7082 nw. Avenue. >>MR. Chair: thank you. >>Female Speaker: MR. Chair, I have sufficient information before me. Not necessary in my opinion for the to be -- >>Female Speaker: second. >>MR. Chair: I have a motion and a second. Anybody else would like to speak on this matter? Is there anybody out there that needs to speak on this matter or would like to speak on this matter and not give a card? Okay. And the two pople are obviously in support that I have the two. We are good, MADAM Attorney, MR. Attorney, with that, MADAM Clark? >>MADAM Attorney: commissioner higgins. >> yes. >> commissioner mrtinez. >> aye. >> commissioner monestime. >> commissioner regalado. >> yes. >> commissioner sosa. >> yes. >> commissioner soto. >> yes. commissioner cohen higgins. >> for. >> commissioner garcia. >> aye. >> commissioner heideman. >> commissioner heyman, CHAIRMAN. >> yes. >> motion pashas. >> all right. I think that's a record-setting zoning meeting. So with that, thank you all for coming. Adjourn. >> second. >> by commissioner cohen higgins. Second by commissioner sosa. All in favor, say aye.
