The purpose of this section is to ensure transparency,26 accountability, consistency, and fiscal responsibility in the27 administration of the Village fee waiver program and to provide the28 Village Council with sufficient information to evaluate the actual29 cost and public benefit of fee waivers.30 31 (b) Standardized Cost-Accounting Framework.32 (1) Within three (3) months of the effective date of this section, the33 Village Manager shall develop and implement a standardized34 cost-accounting methodology applicable to all fee waivers35 granted by the Village (“Cost Methodology”).36 37 (2) The Cost Methodology may include, to the extent reasonably38 ascertainable:39 7

Beginning with the first full fiscal year following18 implementation of the Cost Methodology, the Village Manager shall19 submit an annual report (“Annual Fee Waiver Report”) to the Village20 Council. The report shall include:21 22 (1) The total number and value of fee waivers granted during the23 fiscal year;24 25 (2) The total estimated staff costs associated with fee waivers;26 27 (3) The total estimated maintenance, utility, insurance, custodial,28 security, and facility costs associated with fee waivers;29 30 (4) The cumulative amount of annual Village funding provided to31 each organization receiving fee waivers;32 33 (5) A summary of fee waivers granted to organizations located34 within the Village and organizations located outside the Village;35 36 (6) Any trends or significant changes from prior fiscal years; and37 38 (7) Recommendations for modification of the program, if any.39 8

Page 6 of 8 Additions shown by underlining and deletions shown by overstriking. (f) Statement of Policy and Intent. It is the policy of the Village Council1 that fee waivers should be evaluated based upon their actual cost to2 taxpayers and their public benefit to Village residents.3 4 The Village Council finds that transparency regarding the recipients,5 cumulative value, and actual costs of fee waivers is essential to6 determining whether public resources are being allocated in a7 manner that maximizes benefits to Village residents and protects8 taxpayer-funded assets.9 10 The Village Council further finds that requiring reimbursement of11 direct Village costs would not eliminate the fee waiver program but12 could instead allow the Village to continue to waive rental charges13 while recovering taxpayer-funded cash expenditures associated with14 providing Village facilities and services.15 16 The Village Council finds that the information collected pursuant to17 this section is necessary to evaluate the effectiveness and fiscal18 impact of the fee waiver program before determining whether19 modifications to the program are warranted.20 21 Section 3. Severability. The provisions of this Ordinance are22 declared to be severable, and if any sentence, section, clause, or phrase23 of this Ordinance shall, for any reason, be held to be invalid or24 unconstitutional, such decision shall not affect the validity of the25 remaining sentences, sections, clauses, or phrases of the Ordinance, but26 they shall remain in full force and effect it being the legislative intent that27 this Ordinance shall stand notwithstanding the invalidity of any part.28 29 Section 4. Codification. It is the intention of the Village Council30 that the provisions of this Ordinance shall become and be made a part of31 the Code of Ordinances of the Village of Palmetto Bay, Florida, that32 sections of this Ordinance may be renumbered or re-lettered to33 accomplish such intentions, and that the word “Ordinance” shall be34 changed to “Section” or other appropriate word.35 36 Section 5.
