What This Bill Proposed
Electric public utilities are prohibited from increasing rates for household customers or recovering any costs resulting from new electric demand created by data centers. The legislation requires the Public Service Commission to ensure that all expenses related to data center energy demands are allocated solely to the data centers through special contracts, tariffs, or separate rate classes.
Residential electric customers are protected from bearing any financial burden associated with the infrastructure, generation, transmission, or operational costs required to power large-scale data facilities.
Who It Would Have Affected
Groups the bill's text would have affected, as described in the record. Being affected is not a position for or against it.
household customer
Residential electric customers are legally protected from absorbing any price increases or cost recovery associated with new data center electric demand.
data center
Data centers with electric demands of 50 megawatts or more are required to bear 100% of their incremental infrastructure and energy costs through separate rate classes or long-term contracts of at least fifteen years.
Public Service Commission
The commission is required to promulgate new rules, enforce cost-causation principles, conduct independent prudence reviews, and deny rate adjustments that violate the cost-shifting prohibition.
