Board of County Commissioners Meeting Minutes June 23, 2026 wants the downstream effect of the projects noted in the plan. Commissioner Constantine pointed out the elephant in the room is the fact that they do not have the funding for this, so they have to bite the bullet and start looking at funding to pay for this. From the Board's comments, Chairman Herr summarized that older neighborhoods and older studies are somehow taken into consideration for those that have been waiting the longest, and they would like to add somewhere in the documentation whether city involvement is needed, appreciated, or required. Motion by Commissioner Dallari, seconded by Vice Chairman Lockhart, to approve and accept into service the Updated Stormwater Master Plan as recommended by staff's presentation today and addressing the comments made today by the Board . Board of County Commissioners Meeting Minutes June 23, 2026 Ordinance #2026-8 enacting a Rezone from R-1 (Single-Family Dwelling) and R-2 (One-and Two- Family Dwelling) to PLI (Public Lands and Institutions) for a Public Park and Community Center on approximately 12.96 acres, located on the north side of Merritt St, approximately 0.25 miles east of Ronald Reagan Blvd; Seminole County & DRMP, Inc., Applicants; as described in the proof of publication. Districts 1, 3, 4, and 5 voted AYE. Public Hearings - Legislative 22. 2026-0162Land Development Code Amendment -Consider an Ordinance amending Chapter 2- Definitions, Chapter 5- Administration, Chapter 20- Development Orders/Approvals and Denials of Application for Development Approvals, Chapter 30- Zoning Regulations, Chapter 35- Subdivision Regulations, Chapter 70- Dredge and Filling, and Chapter 90- Uniform Building Numbering System of the Seminole County Land Development Code; Countywide (Maya Athanas, Principal Planner) FIRST READING Ms. Athanas addressed the Board and presented the item as outlined in the agenda backup. Deputy County Attorney Neysa Borkert added staff is asking for a couple of additional amendments. The first is a revision to add language to 30.8.5.2(b) which is in HIP-Airport (HIP-AP). There was a list of allowed uses in this zoning category in the Comprehensive Plan which are now being moved to the Land Development Code. It also allows for mixed-use in this category. They added a provision that allows for multifamily units, such as condos, apartments, townhomes, and above-store flat housing units in mixed-use development only limited to 20% of the total net buildable area of any development and 49% of the maximum total floor area for the development. The second change is to the 5.2 use table to allow for vocational schools within the C-3 zoning category. Upon Vice Chairman Lockhart's inquiry regarding whether the HIP-AP change also applied to other HIP, Ms. Athanas explained HIP-TI already allows the same thing for mixed-use residential. It would be limited to 49% of the floor area for the project, which is what is being proposed for HIP-AP. The Vice Chairman stated she is looking for consistency within all the HIP zonings. Ms. Borkert clarified multifamily in HIP-AP is only allowed outside of the airport noise zones, so there are not many properties it will apply to. Ms. Athanas added target industry would be more encouraging of some residential components because of the target industry employment generating uses; whereas with the airport, they are really looking for airport supportive uses. She stated the Comp Plan was updated in 2024, and the old Comp Plan only allowed up to 10% of the entire future land use for HIP-AP to be residential uses. This change would be increasing that allowance up to the 20% for each site, so it is more lenient than it was in the past. That was the compromise they were trying to make, but it can always be discussed more. Dagmarie Segarra, Deputy Development Services Director, addressed the Board and explained the other consideration is the actual uses in HIP-TI and HIP-AP. HIP-TI allows for more offices and technology, which has a denser employment population. Page 7 of 14

Board of County Commissioners Meeting Minutes June 23, 2026 HIP-AP uses are more industrial and manufacturing, which typically do not need as many employees. That is why the percentages are slightly different. If the direction of the Board is to have them the same for consistency, that can be done. Commissioner Constantine commented he understands the necessity for residential at the airport, but he suggests limiting it because having more residential around the airport will cause a problem because of the noise, and he would like to avoid that. Chairman Herr opined they have fewer opportunities to create economic development . The airport is the largest one, and she would like to see housing elsewhere. Some housing to accommodate the workforce is fine, but she doesn't have an interest in increasing it beyond what has been recommended by staff. Commissioner Dallari commented there have been issues in the past about how density bonuses affect existing housing elements from the cost perspective and the neighborhoods. He inquired how that is addressed. What they are doing is one size fits all, and it should be in key areas and not blanket across the county. He would like information in relation to density bonuses on how much the rate is going to be, the fair market value, and how it's going to depreciate the neighborhood. With regard to accessory dwellings, Commissioner Constantine stated they still haven't figured out the question of ongoing ownership, and it's not in here. He doesn't know if it is judicious to start changing this without coming up with that answer first. Ms. Athanas noted currently the Code requires that the owner lives on the site in one of the two units. Ms. Borkert added this was discussed at a previous meeting, and direction from the Board was to maintain status quo, so staff didn't change that provision in the Code. Commissioner Constantine expressed his concern is what happens when the owner sells the house and how it is used, if it is sold to a landlord that intends to rent out both units or a vacation home. Ms. Borkert reminded they cannot prohibit vacation homes as it has been preempted by the State. Having the owner on the property and not rented out is an existing requirement in the Code. She explained, however, it is very difficult from an enforcement standpoint to make sure that continues to occur. Upon Commissioner Constantine's inquiry regarding separation requirements between alcoholic beverage establishments and churches, Ms. Borkert explained there have been instances where churches are moving into large spaces in strip malls where there are existing restaurants, so the setback doesn't exist. Mike Rhodes, Interim Development Services Director, addressed the Board and advised staff has been working with the County Manager's Office and County Attorney's Office with regards to how they are managing vacation rentals, and they hope to bring some amendments to the current ordinance and processes, to make it a little better and effective, later on this year. They have heard the concerns and intend on correcting them. With regard to public participation, Jim Hattaway spoke in support and recommended approval, and Alison Yurko spoke in support and distributed a packet related to the WRPA and her family's property located at SR 46 and Orange Boulevard (received and Page 8 of 14

Board of County Commissioners Meeting Minutes June 23, 2026 filed). Dave Axel spoke in opposition and requested a change in the alternative design standards. He explained he has a client who owns 66 gross acres at the northwest corner of Celery and Cameron that is currently under contract for a proposed development. When they attended pre-application in December 2025, they were made aware there were alternative design standards. Their understanding of the reason was under current lot criteria, it is not possible to achieve or get close to the allowable land use density. The pattern of development along that road has been gated subdivisions typically with 50-foot lots, and that is what they are proposing with a mix of 60 around the perimeter, which would achieve a density of approximately three units an acre. The property is bounded by wetlands on the north, by roads it would be connected to on the south and east, and by a gated subdivision on the west, with a gated subdivision across Celery. He is requesting that Section 35.73.1(c)(1), projects using these standards shall not be gated, be stricken. In this section there is still a requirement for connectivity, so if connectivity is possible, it will happen. In his particular case, it is not possible, and he does not want to be forced to go through a PUD process to achieve the same density that would otherwise be possible with this alternative standard. No one else spoke, and public input was closed. Public Speaker Forms were received and filed. Upon the Chairman's request, Ms. Borkert addressed Mr. Axel's comment and advised currently that section of the Code prohibits gating of projects using alternative standards. Mr. Axel previously sent an email suggesting to maybe prohibit gates unless connectivity can be established per a further subsection down which says if you can't connect because there is some type of obstacle, then you are not required to connect to the neighborhood; but you are required to connect if you can . She stated it's up to the Board as to what they want to do with the suggestion. Because the requested changed is not substantive, if they still required gates and that is what is noticed in the ordinance and is proper, she doesn't think it needs to go back to the Planning and Zoning Commission. The Board has an option as to what they want to do. They can strike the prohibition and say the communities are allowed to be gated, they can say they have to gate unless they can't connect, or they can leave it the same . Ms. Athanas added there was direction at prior work sessions to decrease gated projects where it makes sense. When staff was drafting the language for the alternative design standards, which are voluntary and not a requirement, they drafted it to prohibit gating. However, if the will of the Board is to allow some leniency on that, there is already the clause that allows the Development Services Director to waive the connectivity and gating requirement. There were comments by the Board and consensus to give the Development Services Director authority to waive connectivity and gating requirements. Chairman Herr stated she thinks they are ready to pass this as it stands today knowing there is further input given from the dais. She inquired at what point those would come back. Mr. Rhodes advised the second reading is scheduled for July 14th. Assuming the changes as proposed are not too problematic with regard to advertising Page 9 of 14

Board of County Commissioners Meeting Minutes June 23, 2026 requirements, then it is possible they can get those prepared and presented on the 14th. It sounds like they are all within the framework and should be able to keep it on track. Ms. Borkert stated there were two amendments requested by staff, and she believes she heard consensus from the Board as far as what Mr. Axel brought up in not requiring gates and allowing the Development Services Director to waive that requirement. Those three changes can happen before the second reading on July 14th to show the Board what they specifically are. Ms. Borkert advised the accessory dwelling ownership and residency requirement enforcement will not be ready by July 14th, but they can bring it back with more information. With regard to density bonuses in existing neighborhoods, the program that has been proposed was initially provided by Kimley-Horn who did a study, and staff put together the framework based on that study. If there are any changes to that section, she's not sure how to prevent that from impacting existing affordable housing units other than applying it now going forward so they can get more affordable housing units, which she thought was the goal. Commissioner Constantine commented the concern was Missing Middle called directly for affordable housing and not just increased density. Staff said they would bring it back but it's not included in these amendments. Ms. Borkert responded staff is looking at Missing Middle and working on preparing some thresholds. She cautioned they are still operating under SB180, and they need to be careful with changes to Missing Middle. Motion by Vice Chairman Lockhart, seconded by Commissioner Constantine, to adopt an Ordinance amending Chapter 2- Definitions, Chapter 5- Administration, Chapter 20- Development Orders/Approvals and Denials of Application for Development Approvals, Chapter 30- Zoning Regulations, Chapter 35- Subdivision Regulations, Chapter 70- Dredge and Filling, and Chapter 90- Uniform Building Numbering System of the Seminole County Land Development Code as presented by staff with the caveats of the three items that were identified to be brought back with modifications at the July 14, 2026, meeting at 1:30 p.m. or soon thereafter; as described in the proof of publication. Districts 1, 3, 4, and 5 voted AYE. IIX. COUNTY ATTORNEY'S REPORT County Attorney Kate Latorre reported on the following: 1. With regard to the County's litigation with Benchmark Construction Company and Liberty Mutual related to the Country Club Heights sewer and water main replacement project, they recently received a settlement proposal from Liberty Mutual for $1.4 million. This is a statutory procedure which starts the clock ticking, and they have so many days to either accept or reject the offer. Because of the abbreviated timeframe, she wanted to have a discussion at this meeting instead of scheduling a closed session. It's staff's opinion the offer falls far short of the County's current damages. It would only resolve the litigation with Liberty Mutual, and litigation would continue with the other parties. Staff, the County Attorney's Office, and outside counsel all recommend the Board reject the offer. Motion by Commissioner Constantine, seconded by Vice Chairman Lockhart, to accept the recommendation of staff and the County Attorney. Page 10 of 14

Board of County Commissioners Meeting Minutes June 23, 2026 Districts 1, 3, 4, and 5 voted AYE. 2. Ms. Latorre explained the County submitted a request for reimbursement to FEMA for work that was performed on De Leon Street following Hurricane Ian in 2022 where the road completely washed out. FEMA denied in its totality the County's request for reimbursement. The Office of Management and Budget recommends appealing the denial. It is a federal administrative appeal procedure, and because of the formality of the process, she would like the Board's consent before filing. It is a two-tier appeal process, and this would be the first appeal. Motion by Commissioner Dallari, seconded by Vice Chairman Lockhart, to accept the recommendation of the two-tier process and allow staff to appeal the decision of FEMA and move forward and keep the Board updated. Ms. Latorre clarified with Commissioner Dallari the motion also included the second appeal, if needed. Districts 1, 3, 4, and 5 voted AYE. 3. Ms. Latorre stated this is a follow-up to the discussion after the last Board meeting regarding a public comment requesting a moratorium on data centers. The County Attorney's Office researched the issue, and there is legislation that was adopted this year that goes into effect on July 1st that gives local governments authority to regulate, under their land use regulation authority and comprehensive planning authority, large-load customers, which includes data centers. SB180 does not prohibit a moratorium. However, they would have to do the groundwork to support the need for it. If that is something the County wanted to pursue, she recommends there be a significant amount of staff research. If that's what the Board wants, she thinks it would be appropriate to direct the County Manager to have staff start the process. Discussion ensued. Ms. Borkert commented it's a two-tiered process where they identify first if they need this, and then move forward with a deeper analysis. No objections were voiced, and Chairman Herr confirmed Ms. Johnson and Ms. Latorre had direction. IX. COUNTY MANAGER'S REPORT AND STAFF PRESENTATIONS No report. X. BOARD APPOINTMENTS 23. 2026-0477Approval of the District 5 appointment of Robert Young to the Parks and Preservation Advisory Committee Motion by Commissioner Constantine, seconded by Commissioner Dallari, to appoint Robert Young to the Parks and Preservation Advisory Committee from 1/1/2026 to 12/31/2027. Districts 1, 3, 4, and 5 voted AYE. Page 11 of 14

They expressed their concerns including the project falling behind schedule, the County not attending project meetings, the appearance to the residents that the County has let go of this project, and the contractor not providing safe walking zones . They requested the County exercise more control over the construction company who is responsible for the project. A list of additional concerns from both speakers were received and filed. Ms. Olore explained there is a TECO gas line that has delayed in the removal but hasn't stopped the work. There are three to four crews out there today. She has talked to TECO about getting the gas line removed. Sometimes during design, utilities are missed, and there are a lot of utilities out there. TECO is working with their contractor to move quicker. Prior to school letting out, they had to limit the amount of time the construction crews could be out there to make sure the kids could get to and from school. During the school summer break, the contractors have been given an additional 4.5 hours to work on the job. She checked with the construction manager, and the contractor schedule is to provide these services by the end of the year. As of right now, they are still on track. She requested a copy of the public speakers' itemized lists so those items can be addressed. She added there is a County representative at every project meeting and advised she will work with the citizens on their concerns. Vice Chairman Lockhart commented as soon as her office was notified of these concerns, she took a tour and saw what was referenced. Her office immediately reached out to Public Works staff. She has seen firsthand how horrible the conditions are. They will do anything they need to do to make sure the contractor is in compliance. Public Speaker Forms were received and filed.
