The section will be moved to Supplemental Standards.  An explanation was provided by Planner Smith as to why certain sections of the existing code will be eliminated. Discussion and examples followed.  Sec. 3.5., H. Special review standards for R-3, R-4 and A-1 districts will be moved to correspond within each of the zoning districts.  Sec. 3.5., J. Recertification of major site and development plan approvals, to be removed. Director of Development Services Minor explained that having to recertify each Major Site Plan annually is a code enforcement issue and becomes very burdensome for staff.  Sec. 3.5., B., 2., a., - To be changed as follows: "The location and size of the site, including its legal description and a survey dated within 120 180 days and certified by a professional land surveyor. The Planning Commission all agreed on the change.  Planner Smith and Director of Development Services Minor will consult with Building Official Schwartz relating to Sec. 3.5., B., 2., l., and discuss the proposed times within which applications for building permits are intended to be filed. The Florida Legislation has a new deadline of 30 days to notifying applicants that their application is complete. More burden is being placed on local jurisdictions.  Sec. 3.5., B., 2., f. - To update the language to refer to "provisions according to accessibility in accordance with the Americans for Disabilities Act.  Sec. 3. 5., B., 2. d. - Discussion held relating to what "allocated to all parts of the site to be developed" relates to. Noting that "bulk" is the same as "dimensions", the Planning Commission agreed to change the language to "dimensions."  Sec. 3.5., B., 3., a. to be amended to read as follows: "a. Prior to the submission of any application for a major site development plan the application must attend a pre-application meeting with the Planning and Zoning Administrator at City Hall must be held."  All issues will be ironed out by staff prior to going to the City Commission for their consideration.  Sec. 3.5., B., 3., i. - Subsection i. - addresses the procedure in the event an applicant disagrees with the staff's review and feels all standards have been met.  Chair Tedhams asked if it was typical that the Planning Commission did not review Site Plans. Currently the Planning Commission only review Rezoning's. She felt the sentiment of the public was that the Major Site Plans should also be reviewed by the Planning Commission. After discussion, there was unanimous consensus to request that Major Site Plan reviews must also be reviewed by the Planning Commission. Planner Smith will bring back example languages from other municipalities. 3  There was unanimous agreement that Major Site Plan Resolutions continue to be recorded with the Manatee County Clerk's Office. The time frames as set forth in Sec. 3.5., B., 3., n. will remain the same.  Planner Smith and Director of Development Services Minor provided an explanation relating to the difference between a Minor versus Major Site Plan.  Planner Smith provided details relating to Sec. 3.5., B., D., Requirement Waiver. Planner Smith to bring back amended language as discussed. 5.b Continued Discussion - Commercial Uses Morris-Depew Planner Rodriquez explained the first review of the Commercial Uses was from the current code. The language has now been reorganized to include the revisions discussed and a new chart layout. Additional changes were as follows:  To remove Bait and tackle shop; Food stores; Hobby, toy and game shops; Parking lot: Accessory, Commercial; Pet services; Restaurants: and Refreshment stands. Planner Rodriquez referred to her memo relating to manatee habitats and reiterated the difficulty to enforce and implement. She pointed out that the City has no map or anything saying where manatee habitats are specifically designated. Planner Smith said if the language were changed from Manatee Habitat to Manatee Protection Zones it would create all existing marinas to immediately become non- conforming. If a marina wanted to redevelop, expand, etc. it would be problematic for those facilities to be rebuilt. A Manatee Protection Zone limits the speed zones within those areas. Planner Smith reminded that a person does not speed within the marinas. What needs to be considered is if a marina disturbs manatees and if there is a concern allowing for an increase of boating traffic where manatees would be. Discussion followed relating to the existing marinas and the City's boat ramp. After discussion it was agreed that the language remain in the Ordinance as written and would be addressed if something were to come up in the future. Planner Rodriguez will amend the language as discussed and have it ready to review at the next Planning Commission meeting. 6. New Business None. 7.
