CITY OF NORTH LAUDERDALE COMMUNITY DEVELOPMENT DEPARTMENT TO: Planning and Zoning Board FROM: Tanya- Davis Hernandez, AICP - Community Development Director BY: Andrew Disbury - Assistant Community Development Director DATE: July 1, 2025 SUBJECT: Site Plan SPR 25-03 AutoNation Major site plan amendment to add a new auction house, car wash, and detailing bay in accordance with Chapter 98 of the City of North Lauderdale Code of Ordinance “Site Plans” within a General Business (B-3) zoning district LOCATION: 827 S State Road 7, North Lauderdale, FL 33068 APPLICANT: AutoNation Inc. Background AutoNation Inc. has leased the property at 827 S State Road 7, formerly operated by Off Lease Only. The site plan for this location was originally approved in 2018. Off Lease Only ceased operations in August 2023. The property is now owned by Spirit Realty. Location of Project

On behalf of AutoNation, the law firm of Lochrie & Chakas, P.A. has applied to amend the existing site plan. The proposed redevelopment includes the following: • Construction of a 7,267 sq. ft. auction house • Construction of a 7,858 sq. ft. detailing area (replacing the existing detailing area, which will be demolished) • Addition of a car wash and detailing bays • Landscaping upgrades • Expansion of the stormwater retention area • Resurfacing, paving, and striping of on-site parking areas Historically, the rear portion of the site functioned as auxiliary parking. No new pervious surfaces are being introduced as part of this proposal. Over time, various concepts for reconfiguring the area behind Building 2—including the addition of a car wash and improved drainage—have been explored. The applicant now proposes a site plan that enhances compatibility with surrounding development, incorporating elements such as additional parking spaces, upgraded landscaping, updated wall and directional signage, and architectural features and color schemes that complement the existing storefront design. Details of the proposed use are provided in Attachment A of this report. Assessment and Findings The Development Review Committee (DRC) met on April 8, May 8, and June 17, 2025, to review the project. After thorough evaluation, DRC comments regarding landscaping, drainage infrastructure, and signage were satisfactorily addressed by the applicant. Per Section 98-139 of the City Code, the proposed redevelopment is consistent with the property’s commercial land use and zoning, enhancing services for AutoNation customers. Access and Parking: • The site has three exit points and one entry point onto State Road 7. • Code requires 218 parking spaces; the site plan provides 1,445 spaces. • Color-coded site plans clearly designate the function of each parking area (public parking, employee parking, auction lot, overflow, etc.). • Security measures will include on-site personnel and additional guard rails. Zoning and Land Use Compatibility (Sec. 98-137) (a)(b) The project complies with the property’s commercial land use designation. The project supports Objective 2 of the City’s Comprehensive Plan by promoting infill development, revitalization, and optimal use of existing infrastructure and land. Final Plan Review (Sec. 98-142) The plan meets the requirements of Sec. 98-141 (a-e), subject to approval of requested variances for parking, landscaping, front setback, and unit size.

• The DRC reviewed the plan multiple times. • The applicant was notified in writing of DRC comments and attended the April 8, 2025, meeting. • The plan has been forwarded to the Planning and Zoning Board for consideration, with staff recommendations prepared. • Any additional costs for outside reviews will be billed to the applicant. • The site plan is provided in digital format and can be scaled as needed. Recommendation Based on the findings and the applicant’s responsiveness to staff and DRC input, staff considers the site plan to be complete and ready for Planning and Zoning Board review. If the Board recommends approval, staff recommends the following conditions: 1. Compliance with all applicable City Codes and Florida Building Codes. 2. All conditions imposed by the DRC, Planning and Zoning Board, City Commission, and staff must be met prior to building permit issuance. 3. The City reserves the right to impose further requirements as necessary during final approvals. 4. Copies of all regulatory permits must be submitted before permit issuance. 5. All City engineering requirements must be satisfied. 6. The applicant must address any operational nuisances (noise, traffic, parking) that may arise. 7. The applicant must comply with Chapter 102 “Vegetation” and submit detailed landscaping plans for a landscaping permit. 8. Proof of payment for Broward County impact fees must be provided before permits are issued. 9. All applicable City assessments and impact fees must be paid before the Certificate of Occupancy is issued. 10. Easements, if required, must be dedicated to the City. 11. CITY OF NORTH LAUDERDALE COMMUNITY DEVELOPMENT DEPARTMENT TO: Planning and Zoning Board FROM: Tanya Davis Hernandez, AICP, Community Development Director BY: Andrew Disbury, Community Development Assistant Director DATE: July 1, 2025 SUBJECT: Sign Waiver 25-03 AutoNation Inc. Signs SIGN WAIVER: SWAV 25-03 NAME OF APPLICANT: AutoNation, Inc PROJECT NAME: Main wall sign PROJECT LOCATION: 827 South State Road 7, North Lauderdale, FL 33068 PROJECT DESCRIPTION: Request to allow a wall sign with lettering ranging from 36 inch for lower letters to 37.5 inches for upper letters in height, where a maximum of 16 inches is permitted under Section 94- 16(C)(1)(C) of the City Code. Background AutoNation Inc. is requesting multiple sign waivers to facilitate new signage at its recently acquired site to support the operation of a new car dealership, new auction house, car wash, and detailing bay. The proposed signage will enhance visibility, wayfinding, and business branding along the State Road 7 / US 441 corridor. Per Section 94-43 of the City’s Sign Code, businesses located within or adjacent to a business or industrial district serving a regional market may request waivers from certain sign code standards. AutoNation qualifies for this process, which requires Planning and Zoning Board review and City Commission approval. The past occupant “Off Lease” did not have a wall sign waiver as the sign was a logo sign that met the overall size criteria due to the large building frontage.

City staff has evaluated the requests considering the site’s size, layout, traffic circulation needs, and compatibility with the surrounding area. The new signs are positioned well within the property and will not interfere with traffic sightlines or adjacent uses. Staff also recognizes that larger and updated signage is appropriate given the site’s large scale, new auto auction use, and the variety of activities occurring on site. Staff recommends that landscaping be installed at the base of the proposed freestanding circulation signs to enhance aesthetics and maintain the visual character of the corridor. Recommendation Staff recommends approval of the Sign Waivers to the Planning and Zoning Board upon the reviewing, hearing and testimony to allow for the increase in height for the name “AutoNation USA” with the following conditions: 1. All signs must comply with applicable provisions of the City’s Code of Ordinances related to sign construction, installation, and maintenance. 2. Meet all terms and conditions imposed by the DRC, Planning and Zoning Board, City Commission, and City Staff prior to permit issuance.

RESOLUTION NO. ___-05-25 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, APPROVING A SIGN WAIVER REQUEST (SWAV 25-03) SUBMITTED BY AUTONATION, INC., TO ALLOW LETTERING RANGING FROM 36 INCHES TO 37.5 INCHES IN HEIGHT FOR A MAIN WALL SIGN AT 827 SOUTH STATE ROAD 7, WHEREAS SECTION 94-16(C)(1)(C) OF THE CITY CODE OF ORDINANCES LIMITS LETTER HEIGHT TO A MAXIMUM OF 16 INCHES IN THE GENERAL BUSINESS (B-3) ZONING DISTRICT; PROVIDING FOR FINDINGS AND CONCLUSIONS WITH CONDITIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, AutoNation, Inc. (“Applicant”) has applied for a sign waiver in accordance with Section 94-43 of the City of North Lauderdale Code of Ordinances to allow increased letter height on a new main wall sign as part of the rebranding and redevelopment of the property located at 827 South State Road 7, North Lauderdale, Florida; and WHEREAS, the Applicant is requesting to install a wall sign with lettering ranging in height from 36 inches for lower-case letters to 37.5 inches for upper-case letters, which exceeds the maximum letter height of 16 inches permitted by Section 94-16(C)(1)(C) of the City’s Sign Code; and WHEREAS, the sign is intended to identify and promote the newly branded “AutoNation USA” dealership and auction center, and to provide enhanced visibility and business branding along the State Road 7 / U.S. 441 corridor; and WHEREAS, Section 94-43 of the Code allows businesses within or adjacent to a business or industrial district serving a regional market to request waivers from specific sign code requirements, subject to Planning and Zoning Board review and City Commission approval; and WHEREAS, City staff has reviewed the request and found that the increased letter height is justified based on the site’s large frontage, regional character, and operational scale, including new uses such as a car dealership, vehicle auction facility, car wash, and detailing bay; and WHEREAS, the signage is positioned well within the property boundaries and does not interfere with traffic sightlines or negatively impact adjacent properties; and WHEREAS, the Planning and Zoning Board has reviewed the waiver request, conducted a public hearing in accordance with applicable law, and recommends approval to the City Commission; and

WHEREAS, the City Commission finds that the proposed signage is compatible with the surrounding area, enhances site identification, and supports wayfinding and business function without compromising public safety or aesthetic standards. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT: Section 1: Findings and Intent The foregoing "WHEREAS" clauses are hereby ratified and incorporated as the legislative findings of the City Commission. Section 2: Approval of Sign Waiver The City Commission hereby approves Sign Waiver Request SWAV 25-03 submitted by AutoNation, Inc., permitting the installation of a wall sign with letter heights ranging from 36 inches (lower-case) to 37.5 inches (upper-case), at the property located at 827 South State Road 7, North Lauderdale, Florida, notwithstanding the restrictions of Section 94-16(C)(1)(C) of the City Code of Ordinances. Section 3: Conditions of Approval Approval of this sign waiver is subject to the following conditions: 1. All signage shall comply with all applicable provisions of the City’s Code of Ordinances, including those relating to construction, structural safety, installation, and ongoing maintenance. 2. The Applicant shall satisfy all conditions imposed by the Development Review Committee (DRC), Planning and Zoning Board, City Commission, and City Staff prior to the issuance of any permits. 3. The signage must be installed in substantial compliance with the site plans and specifications submitted as part of the application. 4. Landscaping shall be maintained or added, as applicable, to support aesthetic integration of signage with the overall site design, especially for any freestanding signs associated with the property. Section 4: Conflicts All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: Severability If any section, subsection, sentence, clause, or provision of this resolution is held to be invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions hereof.

Section 6: Effective Date This Resolution shall take effect immediately upon its adoption. CITY OF NORTH LAUDERDALE COMMUNITY DEVELOPMENT DEPARTMENT TO: Planning and Zoning Board FROM: Tanya Davis Hernandez, AICP, Community Development Director BY: Andrew Disbury, Community Development Assistant Director DATE: July 1, 2025 SUBJECT: SWAV 25-04 NAME OF APPLICANT: AutoNation, Inc PROJECT NAME: Circulation signs PROJECT LOCATION: 827 South State Road 7, North Lauderdale, FL PROJECT DESCRIPTION: To allow three (3) circulation signs measuring 7.31 square feet in area and four (4) feet in height, whereas, the code allows six (6) square feet in area and three (3) feet in height according to City code of Ordinance Section 94-14 (5) within a General Business (B- 3) zoning district. Background AutoNation, Inc. is requesting a sign waiver to install three (3) freestanding circulation signs as part of the redevelopment of the site located at 827 South State Road 7. The site is being redeveloped to include a new vehicle auction facility, car detailing services, and a change in ownership. Circulation signage is one of fifteen (15) proposed sign types for the site and is intended to assist in directing customer and transport vehicle traffic throughout the property. The specific request includes the installation of three (3) circulation signs—identified as Signs S05, S13, and S14 in the applicant’s submittal—each measuring 7.31 square feet in area and standing 4 feet tall. This exceeds the maximum size and height allowed by Section 94-14(5) of the City Code, which limits such signs to 6 square feet in area and 3 feet in height. The applicant has indicated that the increase in size and height is necessary to accommodate the operational needs of the site, particularly the safe and effective movement of large transport trucks. The additional height and area will improve visibility from elevated cab positions and promote more efficient circulation throughout the site. The signs are designed to be uniform and compatible with the overall signage program for the property.

Recommendation Based on a review of the application, staff finds that the request meets the intent of the City’s Sign Code and supports safe vehicular circulation on a large-scale commercial site. The application is considered complete and is now transmitted to the Planning and Zoning Board for review and recommendation. Staff recommends approval of Sign Waiver SWAV 25-04 with the following conditions: 1. All signs must comply with applicable provisions of the City’s Code of Ordinances regarding construction, installation, and maintenance. 2. The applicant shall meet all conditions imposed by the Development Review Committee (DRC), Planning and Zoning Board, City Commission, and City Staff prior to permit issuance. 3. Signs must be installed in substantial compliance with the plans and specifications submitted as part of this application.

WHEREAS, AutoNation, Inc. Background AutoNation Inc. is requesting multiple sign code waivers to install new signage at its recently acquired site in North Lauderdale, Florida. The signage is intended to support the operation of a new car dealership, auction house, car wash, and detailing bay. The proposed signs will improve visibility, facilitate wayfinding, and strengthen business branding along the State Road 7 / US 441 corridor. In accordance with Section 94-43 of the City’s Sign Code, businesses located within or adjacent to a business or industrial district serving a regional market are eligible to request waivers from certain signage standards. LOCATION: 978 SW 81ST AVE APPLICANT: Jodian McGhie - Thorpe The Special Exception Use (SEU) Permit request SEU 25-01, scheduled for consideration by the Mayor and Commission this evening, seeks approval for the expansion of an existing preschool located at 974–976 SW 81st Avenue into the adjacent bay 978 within the Bilu Plaza. This request is submitted in accordance with Article IV, Special Exception Uses, Section 106-156 of the City’s Code of Ordinances. This section permits uses not otherwise intended for a zoning district to be allowed as special exception uses, provided they are appropriately limited in number, area, location, operational characteristics, or relationship to surrounding permitted uses. Furthermore, such uses must not adversely impact public health, safety, comfort, appearance, morals, or general welfare. Location of Project

Background The proposed expansion into Bay 978, which is currently vacant and comprises 1,000 square feet, will bring the total business area for Bays 974 to 978 to 2,700 square feet. The applicant states that the business will meet a need for extended weekday care during the hours when the existing preschool is already in operation. The expanded space will accommodate two additional classrooms, serving 14 new preschoolers. The proposed hours of operation are Monday through Friday, from 6:30 A.M. to 7:00 P.M. The preschool facility will remain closed on Saturdays and Sundays. Upon approval of the Special Exception Use (SEU), the applicant must comply with Section 106-156 of the City Code of Ordinances regarding special exception uses. Analysis Based on information provided by the applicant, the existing and proposed preschool will create up to 9 jobs including ancillary positions. The proposed preschool use of 1,000 square feet of additional space requires an additional 3 parking spaces according to the Section 106-223 (a) (18) of the City’s Code. There are 95 parking spaces in the plaza supporting 10 businesses. These are existing conditions. The Development Review Committee (DRC) consists of Planning and Zoning, Broward Sherriff’s Office (BSO), North Lauderdale Fire/Rescue, Public Works and Landscaping met on May 8, 2025 and discussed the review criteria in City Code section 106-159, that cameras would be suggested, no drop off adjacent to the building would be allowed, park and walk required since the lane with width is only 18 feet and with one-way access and marked fire lane. The DRC team also required signed and sealed floor plan for the new area showing its connectivity to the existing area with the life safety plan. Standards of Review: Sec. 106-159. Standard guidelines and review criteria. (a) General standards. The standards and guidelines to be applied by the administration, the planning and zoning board and by the governing body in considering applications for a special exception use are as follows: (1) The effect of such use on surrounding properties. An otherwise lawful activity may, because of its location, interfere with the property rights of adjacent landowners by creating an unreasonable disruption to the area by way of increased noise, storage and use of dangerous materials, undesired increase or intensity of development and other reasons. It is the intent of this section that each application for approval of a special exception use be evaluated in light of the unique characteristics of the neighborhood in which it is to be located and the positive and negative effects that it will have on that neighborhood and the community in general. Special consideration is to be given to the effect that the proposed special exception use will have on the safety and welfare of the minor residents of the area. Applicant Response: None

Staff Response: The preschool is existing and seeking to expand. The preschool abuts an existing residential community which it serves paying special attention to the minor residents. Any disruptions or nuisances caused by the increase business will need to be corrected. (2) Access, traffic generation and road capacities. Consideration will be given to the design capacity of the adjacent roadways, the current and projected volume/capacity ratio of the roadways, the particular traffic generation characteristics of the proposed special exception use including the type of vehicular traffic associated with such use, and traffic generation characteristics of other uses permitted in the particular zoning districts. Applicant Response: None Staff Response: The 14 additional students and 2 additional classrooms proposed represent a minimal impact to traffic and parking requiring an additional 3 parking spaces. (3) Availability of and impacts upon the capacity of utilities, public facilities and services, such as police and fire protection, water and sewer service, and drainage systems. Applicant Response: None Staff Response: The DRC review revealed no increase impacts or capacity on the City’s public facilities BSO recommended cameras and fire required that no pickup and drop off was allowed in the fire lane. (4) Conformity to and compliance with the stated goals, objectives, policies and land uses, including land use intensity, established by the city comprehensive development plan. Applicant Response: None Staff Response: The request is consistent with respect to permitted uses in commercial districts listed within the City’s Comprehensive Plan. Based on the review by the DRC members and the information provided by the applicant the special exception use request to expand the preschool by an additional 1000 square feet is in alignment with the city’s goals and objective to further business development safely and to provide a safe and secure environment for our young minds to develop and grow.

Recommendation Staff recommends approval of the Special exception Use to the Planning and Zoning Board upon the reviewing, hearing and testimony to all the expansion of a preschool with the following conditions: 1.
