And you can see from our pictures that there's just a lot of stuff going on. I am police report. The violations were corrected with our inspection on August. 28. >> Find devices 16. 29. See that 60 47 with that city code were correct 8/28/2026 takes us to the issue. >> Of fines and costs and city have a recommendation on. >> We do. We have a final affidavit prepare that reflects potential civil fine of $17,400. Back on August. The 13th you imposed a $16,000 fine. So the total civil fine of $17,400 for inspections at 4.65. The city is not asking for any civil fine, but we are asking that recoup the costs of 4.65. So the taxpayer doesn't bear the burden for the process. reasonable to me thought vacate the prior. >> Orders and not imposed a fine, but it's Costa for 6, 5. >> And is off the record for All right. We'll go on record for city of Sarasota versus the tour they CA. And Holly is it's number 2025, 0, certainly identify your so again for the record, please or the funding. All right. That's probably the new reports. You know, the process. You're all start with Kennedy coming back this county. Whatever you're right. >> Thank you, Mr. Ellis, this is to continue case that we have for a violation of our Florida building code. One of 5.1 for shed renovation without a permit. The permit application was received back in May it looks like we are there some issues with a grand tree. So there is some arborist comments that were sent out. So we need some corrections or just Mr. Mr. Pauley to work with the arborist to make sure that he's he do what he's wanting to do. So because there's apparently a grand tree right by so just be looking Mr. Pauley to see what the timeline is to get those comments addressed. >> Okay. Polly, where this grant >> problem with the now. Make me change on footing. change that with my engineer because they cannot of the tree. Now they say and how I'm going to protect the tree off little bit confused what exactly they asking. That's where the wherever they suggest to me. I did it. And I fly it before this ago. And I have a ladder and they said, yeah, how you gonna protect the tree? I don't know exactly what they mean with that. I have to go to I do understand more from them. Why should protect the tree itself? I'm going to put some 2 by fours and make where thing. Thank you and the construction. the tree. that they want to do with >> Yeah, they want to see what your plan is and they want to check your tree protection. And since this is the grand tree, it's I think it's chain-link that's required. But I would talk to the arborists if you're here and you have some time go over and talk to them in and get some information because the code does require protection. >> Where is rivers? >> It's across across the street on the second floor. I will do that. Yes, and they can help you. >> I you know what >> I think they can explain that. They can explain it to you and show you a diagram Bill. Bishop William, some good direction there. So. You know, can't, you know, issue cropped up so long. We'll take that into account. So terms of when we schedule this. >> what's the suggestion of the city >> 30 45 days? >> And without 45 because of 3 issue, I guess means Im teen. That puts us into November. Time is and very, very tired. I wanted to make it down to that is for my mom and my dad. >> Right you want to get you want on. Well, you know, I think it's a simple as going over there getting the solution. Seems like it's probably there just tree protection issue be a big deal put a fence around the tree. So I don't think a big deal. But check it out, OK, I don't I can't turn it I worked at the city side that. >> Oh, my Everything with engine year and with. >> Everything. That's it's a hassle, right? I do not, Anderson. Really. What is the protection highway? Right today? What to do let you know that tell Yeah. >> What time of day is better for you. It's November. The 5th. >> Yeah, it's going to be morning like this. happened, >> ate 30's. Good for you, OK? 8.30, on November. 5th. >> They November 5th at 08:30AM, for the violation. 105, continuing. And yeah, I would stop over there if you sit your here. So. Thank Have a good day. Thank you. All right. We're going to go on record for city of Sarasota versus manageable Summers. It's case number 2026, 0, 0, 5, 0, 3, And for the record, are you Crystal summer? Yes, some are little think you've been here before. Know the process outside. We start with the city all start with Kennedy, the chill on the city's position on this. Then come back to get your response or Thank you, Kennedy. Whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of our Florida building code. One of 5.1% interior renovations that were done without a permit. We do have an application that was submitted back in April and the permit was issued on September. The 14th. So really that the city would be looking to see what the timeline is for those inspections and to get the permit closed out. And I do want to put on record that summer's this a new owner. So she bought into this and she's been working with previous owner. So we're trying to give her as much leeway as we can. So she's really pushing forward on this. bought into the prom All right. Yes, big surprise. >> For the record, you know, I went through a real estate agent and inspector title company. No lawyer, no one picked this up. So it was like a surprise to me. Obviously and once I got the notice, I contacted the previous owner and he said that his GC would handle it immediately. And Michael, not a problem. And so I just trusted that that was what was happening until I got the notice about this court case. So obviously have like kicked into high been on the phone with Whitney. A lot of doing everything I can to push things forward. And so the GC has been making progress. The previous owner paid the $3,000 in fines. So it looks like we're rounding the corner. I would just ask for more time because now that I'm on it, it's going to get fixed. I just trust that was being handled. wasn't after the fact, right? The work is complete. yeah, the work was done to sell the House. Okay. It was like a flip. And so I walked in thinking it was ready to roll. So it was a big surprise to me. Obviously. So I'm doing everything I can to stay in compliance and to work with the city and luckily the previous owners willing to take care of it. And so I just need a little bit more time because we're at the point now where we just need to get an inspector in to get, you know, make sure everything's to code. >> Has been issued. just to call afternoon calling the inspections. What's the recommendation? Terms of pushing it out, pushing it out. As you know, we revised process. So we're looking at get to give Ms Summers 60 days to get everything completed. I think that's probably 60 days. And then hopefully we can bring that back in and see what's going the trip. very much. Yes, that works for me. All right. So what are thinking? Meantime, it will. We'll set Okay. We're looking at November. The 19th. >> Which is a Thursday. Okay. What earlier is better because I have kids and staff to earliest aside. Good Okay. I will continue out to November 19th 08:30AM, find a violation. Continuing. >> 105, 0.1 and we'll see you then. Thank Thank you. Thank >> Thank you. Nelson Yoder. >> Good morning. Nelson morning, certain Nelson owner. Nelson, the Richard Ellis, who serving as magistrate the City of Sarasota this morning. How are you doing? I have put together grainy up here and we >> Having plenty of abundance of rain and everything. Nicely green up Very good. Very good Ohio. Is that where you're at? Yeah. Yeah. That for him at all, Well, listen, if you're ready, we'll go on record for the your case here. >> This is city of Sarasota versus Nelson, a Yoder and Betty m Younger case number 2026, 0, 0, 8, 7, 5, record. Nelson owners appearing by telephone mystery Odor procedurally We start with the city of Sarasota missed Kennedy's in for the city of Sarasota this morning. She'll explain the cities position on the case and not come back. You get your position. Okay. Okay. Yeah. spending whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for violation of the Florida building code. One of 5.1 for an above ground pool that was installed without a permit looking at our permit database. It looks like there were 2 permit applications which were both withdrawn. This case started back in April and it's become a safety issue. So I'd be looking Mr. Get are to see if he's either going to take the pool down before he get a permit to do it that way or how he's going to approach to get the property into compliance >> OK, it to What do you think? You know you with >> The FBI could I could not get I heard most of it. But yeah, breaking up a little >> That's who she indicated. There's a pool ground pool has been installed lot of permit. They've been to applications, but they were both withdrawn and there's a safety issue. There's that was when in because let me get your response to it. >> everybody want to know the story from from the front to the back. I can give you chart review. We bought this house back in 2018, but friends of ours that are no longer the owners. They are they we bought them out a couple years ago. But anyway, bottom what the bought the house one of our friends and my friend hired hired the poll company by the I got hear. >> The whole company name. What's that mean? All that? At the time was. Cool. hold EU. Are you at LL be from Brooksville Florida? And they installed the pool and they were supposed to, I guess we we did not know they were supposed to do everything and I don't know, debate. >> He would intentionally or if they didn't know about the permit. That's more than I can tell you what I know that we were found very end up in because we had no idea that we were supposed to have until this last year. When a friend of ours, we were thinking about air are doing something like that. And then that's when that that's when we found that out. And we were not I was not trying to do anything that illegal. And I was very surprised to see this come up because I did not know. So we have been trying all year. trying to get got guys from down there to get a permit for at hand. We're still trying, but we just haven't found anybody that's willing to get a permit for >> So can you tell there were permits that were withdrawn? It did jump to have contractors. >> When you're when you're speaking on the pollen, I cannot hear you near at playing havoc and the other guy out of millions that are you further away from your phone car? >> Right. On top of the phone, can you hear it? Me a little bit. I a hard time. I could really follow the other guy, but I couldn't I'm sorry. couldn't really follow you. >> So I guess my question is you have 2 applications that were withdrawn. So what happened there? >> Well, the guys were trying to get a permit. We could not get a permit because people were trying to deal with it. We're not helpful and they were actually kinda rude. I tried it myself to get a permit and the guy did not was not willing to help me. He Fairly rude and did not get that. That inspection. That's we just we just gave up. We gave up because people were not very friendly and helping at the new guy. When I reached out or when I got to know I reached out to you guys and you guys were we're more friendly than anybody else ever things thing. The city staff. What we're not helpful. Is that what you're saying? >> The others that the people we were trying to deal with all summer long and trying to get to help us and they were not helpful kill but phone number that I have when we got our notice in the mail a couple weeks ago, then I called that one number. And I remember talking to that lady. >> And I thank her from being that's She she was because she was trying to be helpful. >> Okay. So let's let's move. That one of my friends. The system is your what your intention here. We're going with this. It keeps. we're gonna take it What are you gonna do? >> I had a print. One of my friends about that list down there. And this last week after we had gotten your notice and I have the phone number that eye contact that one of the off people, then they gave me some information and then in the last week, my friend, Chris, my lot. Have been trying again to get people to get somebody to get a permit for me. But he happens happens. anybody down yet. But he was trying trying this last week. To get somebody this is a safety issues. So it either needs to come down. >> So or you need to, you know, kind of get moving on the permit because we need something because it's been since April. So we really need to get the safety issue addressed. >> We are planning we live in a guessing that we live in yet. So, you know, you may have some exposure there if somebody gets hurt. So, >> you know, here's the here's the here's the bottom line. Do you have a say, a pool contractor, the can. >> Navigate city's system here and get your permit. Are just going to take it down? Which would which way to go in on this? >> Well, of those 2 and I'm still trying to get it. But can you help me? Can you give me number of another guy that we have contacted alumni that happened happened committed to doing it yet. But the you know, somebody else I would like to permitted like that. But I'm not trying to be illegal. I bounding up in on and that's why I'm trying to to get it back 2 don't I don't think the city can give you that contractors. But I mean. >> So you have a couple contractors you're negotiating with now to help you. Is that what you're saying? >> Chris was privilege working with a couple of them and not of those had committed to it at the moment and I just looked exactly jury how moving forward with that. He is trying. have tried a lot to help me, Hank, have an e-mail. Anybody down. >> So so Mister Yoda, I would suggest that you really to focus on this that I think I'm going to guess Ms Kennedy at the next time we come back here is going to be asked me to start $100 a day. Fine on. It's going to be assessed on the property. So I think it's important to it to focus on this. OK, I'm gonna give you some advice on that. If you I would. I would get on the phone today and I hired a contractor cause. This kid is indicating there's a safety issue there and they they're obligated to really press forward on this. That, you know, it's so no one gets hurt. So. >> But there's nobody living at the house anyway. But that but there's nobody all summer long. The power an it's not it's not lot of the case it's not a house that's running out it are the case how and there's nobody even living there. we let this spring all summer long and that >> Here from the city Ms Kennedy with how what's the city's idea about when I bring this case back? Well, I mean, that. >> It's been going on since April and honestly, what we can bring it back in like. I I don't 30 days or so. Something like that. But as far as the time frame for correction, we had originally said we had discussed and said 5 days because they've been doing this since April. really needs to be. It really needs to come together either way to take it down or you need to get a permit. So willing to go to 20 days 20 >> we look Ohio. We're planning on coming down to Florida here in about 5 weeks from now. And I was planning by the time we get down there really take it down will have a permit. That's my So. >> Okay. So the go 30 days. >> did. Our will push the case out 30 days. >> And a 30 day, it's going to be at little sharp because we're and we're not leaving Ohio or Florida till about the 20th of the 21st. Do it's going to be can you you give me 45 date that I have time because we won't be coming down there till about the 21st or 22nd of October. So >> as and I are suggesting to me, though, I reading between the lines, you suggesting to me nothing's going to be done on this until you come down. That will not work for sir. Just so, you know, you know, you'll have you'll have hundreds of dollars of fines accrue. You need to get on the phone today and solve the problem. Okay. for you not going wait 45 days, it's often didn't fly down. You've got to have that, you know, phone, hire somebody. If you want to keep the pool and get in, get the problem solved or have somebody take the smell of pool, but you may need a permit for that as well. sure have check with the building department on that. So you need to know, don't wait. 45 days. All right. You know, on the phone today and try to somebody, OK? >> Yeah, we'll try. But how many days do I have to expand our do I have one week or 2 about what do I have time to think present case helped 30 days today. 30 to 40 day. Okay. All right. Thank you. need 30 day it. Should pull taken down or permit or permitted So I'm gonna I'm gonna we're gonna pick a date here. Bring this case back for you to appear again. So suggested date? >> We have October the 15th and we have 8.45. Our 10. 45 do either those work for you? >> October 15, 8.45, or 10. 45? But the matter to me. >> Let's go 8.45? could get up to October 15. Actually. You know what ate. 45? I have. I actually have a. The 8.45 45? >> I have some more data more times if you. >> I have have I have help. you have an appointment with my doctor at 9.30, that morning. So about one a. I we do want to in that they yeah. you want to do if you want to do one good that they do, we better you might as well do it. Now 10/15/2026 at one, PM, the violent act one, the violations continuing as we speak here today. >> But to your understand you got to try to resolve this immediately and we will talk in the 15th. This do home the order that respondent has 10 days to comply. The violations are continuing just 10 days to comply and correct the violations the fact. >> And our next hearing date, we're looking about 30 days out October, the 15th at 8.45. >> Out October 15th at 8.45? And so city's position on this. >> Well, this is a continue case that we There's been some changes. The miss. quits. I actually got the property from her husband after he passed. The inspector has stated that those violations are corrected, learn on September, the 14th. So the property is currently in compliance. >> All right. Mister Health. So we able to hear Ms Kennedy, she indicated there with the violations existed, but they were corrected with their inspection on September 14th. >> Yeah, that is my understanding well. All right. Well, I'll find that 7, 3, a 3 e 3 of the zoning code as well as >> 7, 3, 0, 6, c of his own. A co-worker act on 9/14/2026, which takes us to the issue, fines and costs Kennedy, that city have a recommendation on that issue. >> We do. They comply before the first hearing. So we're not asking for any fines or costs. Just ask that you find a violation and maybe explain the repeat violator provision. >> OK, Mr. Nelson, normally I would ask you for your response to the recommendation, but you can't really do any better than that. The recommendations for no find no cost. And I'm going to accept that and not impose a fine or cost just a cautionary note under the code. If you're the same respondents cited for the same thing within 5 years, the fines can run. You can use it as a repeat violator running the 5 to 500 dollars plus per day. But for today's purposes, no find no cost. Thank you taking care of the matter. Appreciate it. Thank you. Yeah, thank you. Appreciate today. Take care of. I thank >> All right. Nothing to know the procedure all start with Miss Kennedy and come right back to some skinny. Whenever you're ready. >> Thank you, Mr. Ellis, this is a continue case that we have today and I'll read through the violations. City Cause Section 16 Dash 47 for the accumulation of junk rubbish and trash 16 dash. 49 be for over growth. Both of those violations remain in compliance as of July. The 25th of 2025. One of 5.1 of the Florida building code for having to accessory dwelling units and a fence installed without a permit. Section 7.11. 0, one, a one for having the fence. That's greater than 6 and a half feet in height. Section 7, 1, 11. 0, 1, H for the Finnish find the finish line needs to face out and then 302, 0.9 of the state or housing code for no smoke detectors. 3 of 5.7 of housing code for Windows in disrepair and then section 7, 6, 0, 2, CC 2.1 c of our city. Zoning code for the occupation of either the accessory dwelling unit or the main structure. One of those who has to be occupied by the property owner. So let's say we have a fence application that was submitted on November 12th of last year. That needs corrections it also section 6 to a 2 before permitted use. Sorry about that. And then the ad ad you permit was issued on July the 22nd. So we just need the notice of commencement and the timeline for inspections. So just be looking to Ravelo to see what his timelines are. All right. So let me go to you. Unfortunately, we have been we've all the contractors had some setbacks with regard to the rain. >> Because we have to set some footers around the accessory dwelling unit. And so we have to set the footers around there. And we like Doug, the against like the term trenches out made the forms and stuff like that. We just have not had the proper because it it still with poured water in there and they can't pour concrete with with the water kind like port in there. So we're just kind of waiting around to see like a week that it doesn't rain to do the proper setting. And, you know, make sure things are correct. So that's the only thing we're kind of hanging around for right now is is really just that. It's getting any questions on how we doing on the fence application because it says that its need needs As far as I'm aware, owing the fences corrected. look back into the entity oh, yeah, about Your permit hasn't been issued. So it looks like is that the fence permit Aaron. Okay. Yeah. So it looks like there was some zoning comments that were sent out. That need to be addressed in order to get the permit issued. So you might want to. >> A look into that. But on a cardiac, pretty certain that they have been addressed, OK, pretty certain. But don't know. I look back. You have a contractor is yeah, yeah. So I would just follow up and say you need to get the offense permit because it's going to have to be. >> Issued an inspected as well. okay, okay. I I think the city's comfortable pushing it out 30 45 days give Mr. Are following some time to work through the permit process. >> And what's available let's go November. The 5th. Actually November, not yet November. The 5th. And mornings or afternoons better for you, Mr. mornings. Please warnings have 8, 38. 45 9.15. >> so 10, okay. >> All right. We're gonna go on record for city of Sarasota versus I can get close to this once of. Severely eyes. pellet plant, the ACA. Julie Uplift the when the last doable case number 2026, 0, 0, 6, 5, 4, for the record, the respondents are not present today. So the city's position on cases do his money coming in here. All right. Very good. All right. So I'll go to you that going to sit here. All right. >> This is a new case today for violation of our Florida building code one of 5.1 for an interior renovation without a permit. We do not have any permit applications that have been submitted to the city. I was hoping that somebody would be here today to kind of talk about a timeline. I think the city would be looking for to cure the violations of 45 day time line. We're the city would be asking for some fines and costs be imposed. >> That sounds reasonable to me. So I there's a continued violation. One of 5.1, all stab wish a 45 day. Did you 45 days? 45 days 5 day deadline to correct the violations. I just need a day to bring the case back. >> November the 19th at 8.30. >> the case back November 19th at 08:30AM. that'll take us off the record. All right. We'll go next to City of Sarasota versus JC Barn. Emma Lubar. It's case number 2026, 0, 0, 0, 3, 7, for the record. The respondent is not present today. So city's position on case. >> This is a new case to I'm sorry. This is to continue case today that we have for a violation of city code. Section 16 Dash 47 for the humiliation of junk rubbish and trash 16 Nash. 49 be for overgrowth. Both of those violations remain in compliance as of March. The 17th, then we have multiple housing violations the property wasn't secure. I think there was some back and forth to whether or not they were going to repair or demolish the structures. And I was hoping we've had a couple of no shows. So was hoping we'd have somebody here today to kind of talk about the plan for the property. But unfortunately, that's not the case. Back on July, the 30th you impose a civil fine of $24,400.6, inspections at 6 teen today since we've had multiple know shows we're asking you to increase the daily running fine to to 50 per day. And hopes that we get some movement on this. That's exactly what I'll do. All modify the prior order. Increase the daily running. Find it. >> 2.50, per day. violations. The exception 16. 47 16. 49 be. Which were correct on March 17th and compliance remaining violations as cited are continuing. And we just need against al indicate the response required to attend the next hearing. And what surge suggested time and date for that one. >> We have October 15th 10. 45? >> All right. And that's well do into the case out October 15 to 10. 45 am. take us off the record. All right. We're going to go next to City of Sarasota versus James Reston as to why first aired Thomas. Preston is our remaining manatee. No rust and it's and it's case number 2025, 0, 1, 1, 4, 1, And I believe this year at nearest across, you know, I work start with Miss Kennedy and I'll come right back to some. can be whenever you're ready. >> Thank you, Mr. Ellis's to continue case that we have for violation of the Florida building code. One of 5.1 for some storm damage repairs that took place without a permit. The permit was apply for July of 2025. And then when it was issued on June, the 23rd of 2026, and it looks like we have 2 inspection schedule, which is fantastic. I I'm just looking the city would be looking today for what kind of timeline we need to finish up the permit so we can get the case closed out. >> All right. Let me go to you and get your response here. >> We are actually trying to get them. Plus out before came here today, we're coming close. actually called yesterday. thinking everything is good to go. So hopefully we have plumbing and electrical today. And if those pass building, I think for it. >> You're close us Yeah, we're very close. Advisory think goes up and we should be good go. >> As we push it out, 30 days to be on the safe I can pushed out 30 if you want to do 2 weeks. 30 days is going to be October. 15th. 2 weeks is October. 1st. >> Push it out 30. Okay. just because I'm okay. That's certainly fine. Oh, goodness. Okay. And I want show up and to be problem. So no, okay. So we've got October. The 15th, what time of day is better for you? This right? I got a 10. 45 said, OK? All right. >> All right, well, can do. appreciate can to the case out to October 15 to 2026 at 10:45AM. for the violation. 105, 0.1 continuing as of the state. We'll see you then. Thank you. We wrap it up and get Thank you. Thank you. Thank you. ? ? >> Lowe's Jennifer Hershey. >> Yes, she. >> miss her. She a ridge of this is a Richard Ellis Irving is magistrate the City of Sarasota. How are you doing? >> I'm thank you. How are you? very good. Thank you. If you're ready, we'll go ahead. Go to your K 2 cases. We have. >> I am right City of Sarasota versus Jennifer Hershey. It's a case numbers. 24 2024, 0, 0, 1, 6, 6 2024 0, 0, 1, 6, 8, and this her. She's by telephone. So as you know, Mister, shall we start with the Start with Miss Kennedy today. And I'll come right back. Miss Kennedy whenever you're ready. >> Thank you, Mr. Ellis, both of these cases are for violations of our standard unsafe building abatement code payment. Code 3. A 1.4 for a pair demolished structures on the property. The first one 2024. 0, 0, 1, 6, 6, The permit was issued on July. The 16th and it's pending notice of commencement and inspections. Second, one, 2024 zoos are 1, 6, 8, Permit was issued on September. The 15th. So we just need the inspections for those. This. I do want to just kind of put a record that this is our 17th hearing. So the city is looking for a list of something a little bit different today, but I'd like to hear from miss her. She on on how she stands with the inspections in the permit. All right. Mister where are you today? >> Yes, say that there still an issue with 96 street permit, but I just received an email from only in permitting to to go. And he stated that that permit and issued and then also for the 9, 7, 30 inch, a permanent home. Now they're requesting a notice of commencement. working So we're just trying to things patients. you can move forward. frustrated myself. How long everything ready to and get these out repairs? And I'm just trying to do everything that you get it currently image quickly as I control it a little bit hard because I have to go to the You know, these are things I can't really do. But I'm pushing as much as I can. Going. >> this is our 17 hearing, which probably close to a record here. What's the projected timetable of to do this work and get this? Thank Wrapped month. >> And contractors at it should only month. They said, you know, since all the permits are approved all the feeds, everything's ready to go. They said that the destruction will be repaired at the same time making sure that all the permits were approved because other You know, double or triple to have the crews go back. So you have to be in you know, and start working on the house on the trees and do everything at the same time and the time want. told me is 61. To get >> I care. You have questions or comments you want to make. >> I just have a couple comments. Maybe just stating the city's position. This is the 17th hearing. Every time we have a hearing, it costs money for Hershey and for the city. And so what we're suggesting today is to we have updated affidavits prepared is to enter the affidavits on both properties. And then when she's ready when the permit is closed out, we will bring them back and then hopefully you can revisit the fines and cost at that time to that. What? That's what we would be asking for today, rather than keep bringing this back. And I don't want to go out 6 months and it just doesn't make a lot of sense. >> All right. This I have a question. have some questions. Okay. >> You should affidavit prepared. And at that time that they've submitted. Were they plan or are you are these the same affidavit you're actually to submit today She's on that. >> These are updated affidavits. We did not enter the affidavits previously. These are updated through the current date. >> so I don't quite the end hot that hearing it's out for completed. And I come back in. >> As her, she let me it first of for your kind of breaking up a little Hear Ye. Are you location? Where are you on a cell phone someplace or? >> But where I am on a cell try to get in our teaching that you can hear me better. app. >> Now you're not. even worse. >> Is it better now? >> Maybe let's let's see how it goes here. So what? What? This can suggesting this you will is asking on behalf of the city for me to do today is to impose these fines and costs on on on the order and really shift burden over to you to get the thing resolve rather than rather than continue, you know, going to the 18th hearing because everytime generates more costs. You know, the the tough and she's about to show I'm looking at affidavit. large $98,500. But what what you suggesting is that, you know, put the ball in your court and, you know, again, I heard that I heard about a six-month timetable on doing the work here. And you know, that's you know, you typically when you're in violation status, that's too long. that's what that's the norm may be enough in normal. They do get every we get a building permit. You get 6 months You have to work on your inspections, cetera. This is sort of a different thing because, you know, this thing not only the violation, but this this case is I forget where the or we began this. But anyway, so what she's suggesting to me is I stab wish these fines and costs put the burden on you finish it up. You want guess if you want to take 6 months and the chances of getting the fines and costs reduce are going to be diminished. So but that's what she's asked me to do. To be clear here. So. >> right if we get fixed, he yeah, I got to tell got to find >> You got getting about every 3rd word here. Just to tell you but anyway, you may want to try get a location where I can hear you knew it would. >> Okay. I'm going to again. Is it any better now? >> It's now and I really I view just again, think you. Have this in in the in the next time we ever hear. You probably want to get your selfie on it. The landline or someplace loathsome location where your it can be understood. anyway, so yeah, well, that's again. She's what's to see. Affidavits want impose the fines and costs, put the burden on you to come back and ask for him to be reduced if and when. The thing is completed. But if that 6 months from now, your chances are you're not going to be so good. But back. >> One of the question about that because it needed things that I I don't understand. I You know, though, it was a long process to get the permits approved. And I got them approved and everything's ready to move forward. So does that mean that there's would not be a on the property? >> Yes. >> And if it >> if I'd come today, I guess I'm asking, what would she have been looking for? That would have been acceptable today because of these houses need to be fixed. And they said if it'll be completed, totally everything moving ready in 6 months, was there some milestones that she was looking for today that wouldn't stop that. happening? >> I can't speak for Miss Kennedy, but my guess this is what this was going to be her position, whether you are here or not here. >> essentially >> it's based on the, you know, this. Unusual length of time. It's taken that to get this case. Get these construction going and completed. And so again, I you know, again, if you're if you're able to step it up here and, you know, kind start that you'll get the permits issued and get the work done. It's going to enhance your ability to come back to me and reduce finds in cost. But the you know, but in terms of just keeping continuing to have the 18th hearing that the 19 hearing said, I think she's saying to me, that's it. That's Pointlessly. Let's just do. You know, that's what but the bird put it on you to get it done. And if you get it done, you come back and ask for a reduction of finds a cop. That's certainly going to be her position on this. >> Could I could I please request one more chance to have one more hearing before those huge fines are placed. has been gets very, very difficult. And I have been doing everything in my power to try to push You know, relentlessly been working and even discuss talking to other contractors because, you know, he's kind of taking a long time. >> And it even be willing to do that to get if I could just have. One more hearing to kind try to push as much as I can before. The huge fines are are put on the property. fine. >> Again, let me a lot of this is based on the fact that this case, initial inspections case with the 11/13/2023, you know, we do these these violent cases don't really hang around here that this long this isn't new really unusual. So. You know, again, I'm inclined me. I was going to tell you, man, gonna go ahead. Just in it. You know, I have the affidavits and admitted. >> And impose the fines the cost. But I I do keep the door open to you. If you just you know, if you decide you're going to step it up and get it done here in the next couple months, you know, come on back to me and all I'll take another look at the fines and costs, OK, and >> and how do I come back to you? Do I contact you go through this city? Joy? Scheduling charring? Yeah, you would. go through the city would just say I'm ready to. >> you know, I've completed the work out a violation after 3 years and I you know, I want to go ahead and set a hearing and bring it back to me and all revisit the fines and costs. All right. So the miss how all this could be. Go ahead and and proceed with the on the 2 cases here on the first case. This is the first one, Nick. >> The first time. >> So on 0, 0, 1, 6, 6, we some of civil fine that began running on. January. The 5th of 2024. Through September 15th of 2026. That's 985 days at $100 per day for $98,500. 20 inspections that $1665. So the city would be asking you to enter the affidavit into posed to find some cost shown as exhibit number 2 on this case. >> it, the affidavit in the I based on the affidavit on pose the fine on the affidavit, which is $98,500. I'll start of the running $500 per day until the violations are corrected. >> Now. >> Opposed ask a question about that. I'm getting violation. But again, now even know I had approved permits and a contractor like the fines are starting again. >> The violations the violations occurred in the rye violations have been running for you. I normally say days but I'm gonna say years now. if the and told the violations are corrected, the fine will run it at $100 per day. Again, I can revisit all fines and costs, but a lot of it depends on how how, how actually expedite of the work is at this point. I will. I will certainly revisit that. But yes, there are fines running it because there are violations. It still exist. And they've been you know, the original again, point out to case originated back in November, 13th of 2023. So that's our issue here today. But I'm gonna go ahead post the fines and costs. Start the $100 fine. And then we'll go to the second case. >> The second case, the civil fine began running on January, the 5th of 2024. through September 15th of 2026. Again, that's 985 days at $100 per day for $98,500.20, inspections $1665. The city would ask that you enter this affidavit into evidence of exhibit number 2 and to impose the fines and costs. >> All right. I will do that out affidavit and based on the affidavit impose the fines and cost 98,500 knowledge and civil fine Costa, 16 65 $100 per day. Gailey running fine. I will not reset here in the hearings in these 2 cases will be reset at the request of the respondent. And the city of 0 and or the city of Sarasota. again, just search duralls, concise. Yeah, it's in your power. Just reset the hearing. As soon as you complete the working and the the violations are corrected with the inspections in the work being done and then come back to me and I'll revisit finds in cost on these things. And again, I will just tell you my bench park will be how quickly expedite the work. Okay. All right. Have a good day. Take care. Thank you. bye. >> We're going to go on record for city of Sarasota verse Angel Delgado Junior and just he's a it's a case. Number 2026, 0. May have misspelling the the last time again. >> Just little tiny. that the you know, that's >> you are. You. >> HC ACA. >> Okay. he's that, I wasn't sure was on. All right. This county, whenever you're ready. >> Thank you, Mr. Ellis, this is a continued case today violation of Florida building code one of 5.1 for an interior renovation without a permit. The application was received by the city back in December. The permit was issued on April, the 14th. And it looks like just need some inspections and the timeline for inspections right? let you tell you want change you ask me if it's possible. If he can start getting his inspections one-on-one because he knows that was. >> permit was for one. But he wanted to know if they can start coming to do all the inspections are still about 6 months away from the completed. But there's a lot of stuff that already been completed that can get inspected. And he wanted to know if they can get that started one at a time. >> That might be something you need to call the inspections line for. The okay. OK, we do have a okay. We have one inspection that was passed back in June, but I think that's probably a question for the inspections line or the building division. I can't answer because I don't schedule inspections and I don't coordinate with the building inspectors. He said a lot of the work has already been but they're still about 6 months away from the final. >> You know everything but a lot of the stuff that originally like the original deck that's already done, right? That started the whole thing that finished the defense is done. >> So things like that. So the than that, he says everything's moving along. Just won't start getting stuff inspected. >> Yeah, I would call permitting and they can probably work you through. Give you 2 inspections and give you some more information. I just don't have that information get I think the city would be comfortable pushing this out 60 day since the permits active and they seem to be pushing forward and moving along. Let's up in front of a November. Looking at the next hearing to be scheduled on November. The 19th. And what time of day is good for you all mornings afternoons like like to like billion 10, 30 and I have a 10, 30 on November. 19th. >> No, away. >> All Looking to get out the case that the November 19th at 10:30AM, for the violation continuing continuing of 105, 0.1. Thank you, gentlemen, for coming you. >> Thank Thank you. >> go next. The city of Sarasota versus William Joseph case number 2020 0, 0, 6, 6, 3, And for the record, no Half of the respondent. He's not here. So cities position on on this. >> Well, this is a continue case. If you recall this gentleman is a firefighter and he asked for a continuance. He was working at the first hearing. So we did a stipulated continuance. So I was hoping was going to be here today. Anyway, the violation is for Florida building code. One of 5.1 for an interior renovation without a permit. The application was received on April. The 23rd permit was issued on May. The 29th. So at this point, we just need the notice of commencement and all the inspections called to close out the permit. So I think the city would be looking to have the violation cured within. 45 days. >> all due order, often a violation of one of 5.1 is continuing. Indicate the respondent show here in fully remedy the violations within 45 days. And we just the kid he's required attend the next hearing. And what her son available time we have November. The 5th. >> And I have an 8.30. continue the case out to 11/5/2026 of the 08:30AM. >> The male takes off the record. So, you know, I always start with. >> The city would Miss Kennedy today and I'll come right back to you. So this can be whenever you're ready. >> Thank you, Mr. Ellis, this continue case that we have for violation of city code sections. 16 dash. 49 be growth. 16 Dash 47 for the accumulation of just rubbish and trash. The inspector says that these 2 violations are in and out of compliance quite a bit. And then we have one of 5.1 of the Florida building code for Kitchen and Bath renovation without a permit. And then 3 of 3005.1 of the standard housing code for a roof in disrepair. This this is our 8th hearing. So. I'd like to see what the status is of the permits and things it looks like it's pending plan review, but we need some movement. I think the city is looking for some movement. So it's pending plane corrections. All right, sir. >> Just that for me, for the rest of. I haven't got it because took some numbers. see you back the one that because a recent survey did that so they think they can that being by when that restaurants are rated does. So I don't know what to do. What doing. The >> I mean, you got we get people get after the fact permits all the time. Yeah. But right. So the work started. So somebody needs do to put a Napa permit application. Reflecting the work that's already been done in Coleman spectrum. So the contractor doesn't want want to certified somebody else's work icing. it's common. But there's there are people that do specific these things. Yeah, you're going to have to find a plumber who does the after the fact trying to think what would his method be? Didn't do that? I wonder, I I mean, just make sure they're licensed. You know? Yeah, make sure their license. Look at the dbpr something Google and then follow up with dbpr and stuff. Yeah. I think there's some I think there are some contractors, at least that average highs for doing after the fact permitting work. So I think I would Google that, you know, and ask for, you know, try find somebody who does after the fact permitting. >> Thanks. Sure. ready. When a star the Army for >> So they paid you for the roof and you're ready. You're ready to go on the review. Okay. All right. So you have a roof you hired a roofer at this point. >> Okay. >> Okay. We're going to go on record for code compliance. Special magistrate hearings. Today's date is September. 72,026 the first case on the docket, city of Sarasota vs Srq Motor Sport Club LLC doing this. as you will steak and sushi lounge. It's case number 2026, 0, 0, 4, 7, 9, for the record. No one is here. And the half of the respondents. So. was the city's position on this one. >> This morning, this is to continue case. We have violation of city code section 16 dash. 29 C for which talks about FOX preparation. They were having some issues with. Their boxes or someone's box is not being broken down stored properly into the recycle bin. And then 16 Dash 47 for the accumulation of junk rubbish and trash. Okay. Yeah, I will try and we will have on company will be changed before we didn't make the next phone. it a cure. So have a good day. Take care back >> all right. We'll go next to City of Sarasota versus coming home. Its case number 2026, 0, 0, 7, for one. And for the record, no one's here on behalf of the. city's position on this case. >> Well, this is a new case today for a violation of city code. Section 16 dash. 49 see for overgrowth. 16 Dash 47 for the accumulation of junk rubbish and trash. And then section 7, 2, 0, 7, of our city zoning code for vehicles and in a recreational vehicle being stored on a vacant zoning lot we were hoping that this home would be here today so we could get a timeline for corrections. But unfortunately, that's not the case. after speaking with the inspector, the city requesting that you give us home in 10 days to comply and then or we be requesting finds and costs at the next hearing. >> All right. This do home the order that respondent has 10 days to comply. The violations are continuing just 10 days to comply and correct the violations the fact. >> And our next hearing date, we're looking about 30 days out October, the 15th at 8.45. >> Out October 15th at 8.45? I will go on record for city of Sarasota versus Arnold. J U.S. could stressed. The of the Arnold G Gas revoke will trust you ad 8/1/2022 Ryan Moore Morris ask with his trusty them. I am what Smokable Trust you ad 8/1/2022 case. Number 2025 0, 0, 4, 4, 0, for the record. No one's present behalf of the respondent. And so city's position on this. >> Well, this is a continue case that we There's been some changes. The miss. quits. I actually got the property from her husband after he passed. She has since passed. So we're not sure what's going on with the property. It's a continued case. It's provided a violation of Florida building code. One of 5.1 for an interior renovation. We do have a demolition permit that's active as of March, the 17th, but we're just not sure. What they're planning to do. And I'm not real sure anybody knows at this point, but it's been going on. This is our 8th hearing. So I've asked the inspector to update the affidavit so we could get that on record. Well, that's not the updated affidavit. Is it that ask you to think never mind? I didn't ask him to update the affidavit. I must made that up well, anyway, so were the with the city's willing to push it out 30 45 days to give them some time to work through the. We've got October, the 15th. And we've got 10, 30. To October. The 15th at 10, 30. >> The violation continuing confirm the last quarter. And that'll takes off the record. All right. We're going to go on record for Neck Annex case, which is styled a city of Sarasota vs. >> Stephanie Marie White, case number 2026, 0, 0, 5, 1, 6, And for the record, are you Marie White, in this white? I don't know if you've been here before procedurally. I we start with the city of Sarasota. This Kennedy is this morning. And she'll explain the city's position on this. And then I'll come right back to you. OK, OK? All right, county, whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for violation of our Florida building code. One of 5.1 for a wet bar and some cabinetry that were installed without a permit. We did have a permit application that was submitted, but it was proved it needed to be the entire scope of work. According to the notes. So I just be looking to miss White to see what her timeline is for getting that permit in the city is looking for some movement. Now. All right. This way. Have a preliminary permit drawing here. So we're going install basically general contractor is >> going to be working on the case and just waiting for him to get together. Subcontractors, OK, onto been put, install this. This talked about maybe some electrical. Hopefully he's going submit for the permit. He's got the those are the plans and everything Mary plans. Yeah. Okay. Okay. All right. Let's go. The city of is wanting 30 days for this case for MS this white to be on the road, getting this thing done. So that's what the city's requesting 30 days today. All right. So >> so you're on it to like to we'll bring this case back in over 30 or more. And just to give you a 30 day kind of deadline to get rolling on the think it done so. All right. Let's do it that way. And we've got. just a moment. October the 22nd. And what time of day is better for you. This why morning mornings have 8, 38 45 9? >> A nice. Good. Good. Okay.
