Public Hearing on Admissions Preferences and Action on Request for Approval of Charter Petition for Academy of Creative Technologies, Antelope Valley and Adopt Resolution No. 2024-25-04 Meeting Jul 18, 2024 - Regular Board Meeting and PINCO Meeting Category 7. Educational Services - Action Items Type Action Recommended Action Having considered and reviewed the Charter Petition for the proposed Academy of Creative Technologies, Antelope Valley (“ACT AV”), the Antelope Valley Union High School District (“District”) administrative staff hereby recommends that the District Governing Board take action to approve the Charter and adopt the attached proposed Board Resolution No. 2024-25-04 approving the Charter and making written factual findings in support of the approval. Submitted by: Chris Grado, Ed.D. Assistant Superintendent, Educational Services Summary Statement: Pursuant to the Charter Schools Act of 1992 (Ed. Code § 47600 et seq .) a charter school petition proposing to operate a charter school that will operate within the geographic boundaries of the Antelope Valley Union High School District may be submitted to the District’s Governing Board after meeting specified signature requirements. The Governing Board is required to hold a public hearing and either grant or deny the charter petition within specified timelines from receipt of the Charter Petition. Pursuant to Education Code Section 47605(c), the Governing Board may not deny a charter school petition unless it is not satisfied that granting the charter is consistent with sound educational practice and with the interests of the community in which the charter school is proposing to locate, and the Governing Board shall consider the academic needs of the pupils the school proposes to serve. Further, the Governing Board shall not deny a charter petition unless it makes written factual findings specific to the particular charter to support one or more of the following findings: The charter school presents an unsound educational program for the pupils to be enrolled. The petitioners are demonstrably unlikely to successfully implement the program set forth in the charter. The petition does not contain the required number of signatures. The petition does not include affirmations of specified conditions. The petition does not contain reasonably comprehensive descriptions of all of the 15 required elements of a charter. The petition does not contain a declaration of whether the charter school will be deemed the exclusive public employer of employees of the charter school for purposes of the Educational Employment Relations Act. The charter school is demonstrably unlikely to serve the interests of the entire community in which the school is proposing to locate. Analysis of this finding shall include consideration of the fiscal impact of the proposed charter school. The school district is not positioned to absorb the fiscal impact of the proposed charter school. On or about May 15, 2024, the petitioners delivered to the District Office the Charter proposing the Academy of Creative Technologies - Antelope Valley charter school, along with a certification of completion, thereby commencing the timelines for District action thereon. Petitioners are requesting approval of a five-year charter term, beginning on July 1, 2024 and ending on June 30, 2029. As required by Education Code Section 47605(b), a public hearing on the provisions of the Charter was conducted on June 11, 2024, at which time the Governing Board considered the level of support for this Charter by teachers employed by the District, other employees of the District, and parents. The District Administration and legal counsel conducted a comprehensive analysis of the ACT-AV Charter Petition and assessed it against the standards and requirements set forth in the Charter Schools Act of 1992 in order to develop final recommendations. In accordance with the requirements of Education Code Section 47605(b), the District published its staff analysis and staff recommendations, including the recommended findings regarding the Charter Petition, by posting the report to the District’s website and providing this information to ACT-AV on July 3, 2024. Admissions Preferences : The Charter Schools Act requires the governing board of a school district to consider a charter school’s proposed admissions preferences during a public hearing to ensure such preferences are non-discriminatory and comport with the law. Education Code section 47605(e)(2)(B) provides that if the number of students who wish to attend the charter school exceeds the charter school’s capacity, attendance, except for existing pupils of the charter school, shall be determined by a public random drawing. Preferences shall be extended to pupils currently attending the charter school and to pupils who reside in the school district, except as provided for in Section 47614.5. As required by Education Code section 47605(e)(2)(B), the District has determined that the admissions preferences described in the Petition are acceptable. Procedures for Public Hearing : Consistent with the requirements under the Education Code, the District’s Board will hold a public hearing on the Petition during which it will consider the proposed admissions preferences, as well as consider and take action to either approve or deny the Petition. Petitioners will receive equivalent time and procedures as the District review team to present any evidence and/or testimony to respond to the Staff Report. The Board will then deliberate and take action on the Petition.
