What This Bill Would Do
The bill would require local governments to permit es in any zoning district where single-family residences are allowed, applying the same permitting procedures. It would prohibit local rules that prevent the construction of duplexes with at least 1,000 square feet of habitable floor space per unit, restrict parking requirements to a maximum of one space per residential unit, and ban more restrictive design or aesthetic rules than those applied to single-family homes.
Property owners would gain the legal right to build two-unit residential buildings in areas previously restricted to detached single-family homes, subject to uniform local standards taking effect 180 days after enactment.
Who It Would Affect
Groups the bill's text would affect if enacted, as described in the record. Being affected is not a position for or against it.
Property owners
Property owners gain the legal right to construct or maintain duplexes in districts previously zoned exclusively for single-family housing.
Local units of government
Local governments lose the authority to prohibit duplexes in single-family zones and must comply with federal caps on parking mandates and restrictive design rules.
