Board of County Commissioners

Tuesday, October 20, 2026 · County government meeting record

The 30-second read

Recorded outcome

County commissioners accepted an unwritten offer of dedication for a strip of land along SW 192 Avenue to officially bring it into the county road system and allow a developer to meet local platting and permitting requirements.

The Board of County Commissioners officially accepted an implied offer of dedication for a 43-foot-wide strip of land along SW 192 Avenue for public road right-of-way purposes. The county-maintained road inventory now includes this portion of land, incurring an estimated annual maintenance cost of $30 funded through the General Fund. The County Mayor or designee is authorized to record the acceptance in the public records within 30 days.

Why it matters

Property owners along the SW 192 Avenue corridor must comply with county development and platting requirements, which are facilitated by formalizing this right-of-way, while taxpayers absorb a minor ongoing road maintenance expense.

That registers as a 2/3 vote, thank you for the second. It met him clerk do we need to call role or is there a voice vote? >> voice vote. >> those in favor signify by saying aye. We give thanks to have the lord who allows us to be in this floor, this assembly where lord lives are impacted in a great and significant way. Lord would you bless the decisions made here, bless those who are part of this leadership. Lord if there be any ill will or if there be any selfish ambition lord and those who lead in this place would you root it out because miami-dade county lord is far too significant of a place lord for us to tolerate those or after their own gain rather than the good of our community so bless those who labor to serve this community and beyond. Would you bless this gathering these decisions. In jesus name everybody said amen. Class I pledge of allegiance to the flag of the united states of america and to the republic for which it stands one nation under GOD indivisible with liberty and justice for all. >>commissioner gilbert: going to go into opportunity to be heard to read reasonable opportunity to be heard, I'm going to call some names, are going to give everybody one minute, one minute, giambrone, bo drake, samantha barclay, brian adler, sylvia vaughn. [Reading names] You all line up at the podium, give me your name and address. If you're a student you can tell me you're a student in your address is withheld. don't give me your address if you're not. >>public speaker: samantha martin, 49th lane miami florida. I'd first like to thank commissioner regalado for addressing the future of the sea aquarium. We recognize this is a complicated project and an important opportunity. Virginia key is a special place in this proposed amendment would significantly change the public waterfront land that's why we are concerned about using the small-scale amendment process rather than the standard review process which includes additional state and agency review. Given the significance of these proposals and answers questions about this game were quality and seagrass habitat why wouldn't we take those additional steps? We appreciate the work being done but we are not sure it's being done appropriately. We ask that you defer until these questions have been adequately addressed. >>commissioner gilbert: thank you very much. >>public speaker: my address is 4700 southwest. 60th avenue 33155. Speaking on behalf of friends of biscayne bay regarding the sea aquarium development. We are concerned about the decision to pursue this as a small-scale amendment as this process requires one public hearing and agency review is particularly important in the context of manatee protections. For development of this critical environmental resource public submerged lands and a substantial marine infrastructure this reduced level of scrutiny is unacceptable. Community organizations have requested engagement with the developer for several months now and if no public advertised meetings have been held to address our concerns. The county should require charrettes with the developer and agencies present for advancing any approvals. These meetings must provide an opportunity for public input rather than simply presenting decisions that have already been made, thank you. >>commissioner gilbert: thank you. >>public speaker: sophia vaughn and my address is 32 three 5/69 avenue miami florida. I'm speaking today regarding item 4m and the seaquarium site of virginia key. There spends insufficient public outreach of information about the proposed amendment. Residents need clear accessible information to understand the proposal and its potential consequence. Meaningful public input must happen before the decision advances, not after key decisions have already been made. The public deserves adequate time to review the application supporting documents and relative study. Basque today is simple, defer the vote and schedule community briefings and additional opportunities for public input with pacific sufficient advanced notice. Our community deserves a voice in shaping the decisions that affect how we move. >>commissioner gilbert: thank you. >>public speaker: my name is julian and my address is exempt from ure and I'm here to speak in support of item 10 a2 concerning financing of the magnolia point development. I have seen how expensive housing has become especially for working families and younger residents hoping to remain in the communities where they grew up with 409 rental units planned for low moderate and middle income households magnolia point could provide much-needed housing opportunities for hundreds of miami-dade residents. Housing affordability remains a serious concern throughout miami-dade and the demand for reasonably priced homes continues to put pressure on families throughout the county. I believe the county should encourage developments like magnolia point while ensuring these projects remain affordable to the residence they have been intended to serve. I urge the board to vote in favor of item 10a2 and support affordable housing throughout miami-dade county. >> good morning chair and commissioners, my address is exempt from disclosure. I'm here to speak in favor of item 11 a2 which is the resolution to urge congress to pass the red tape act. I believe that is in the interest of the board to properly represent the interests of small business owners in miami and nationwide. There is no need to ignore the plea to help alleviate the heavy bureaucracy and restrictions upon small business endeavors and we should always encourage and help our small business owners. I believe that it is unfortunate that this legislature is even needed but it is necessary and I urge the board to vote yes in favor of item 11a2, thank you for your time. >>commissioner gilbert: give me your name again. >>public speaker: although rosales. >>public speaker: my name is sophia and my address is exempt from disclosure. I'm here to speak in approval of item 11a2, the dump red tape act. A resolution would serve to address small business owners concerns desires and needs in a more convenient and efficient manner. A 2024 board conducted by the house committee on oversight determine small business owners were burdened with 300 million regulatory paperwork hours resulting in difficulty maintaining and growing their businesses. By implementing this hotline service small business entrepreneurs will be able to voice their concerns directly to congress instead of jumping through hurdles to resolve their issues. This act will ensure the government remains accountable and adaptive to its constituents. I'm asking the board to vote yes on item 11a2, thank you for your time. >>commissioner gilbert: MADAM Attorney and to the clerk's office who is ever taking the names downstairs you need to encourage the young people who are under age that they don't actually have to write their address. It becomes a matter of public record. You all want to make that announcement downstairs. >>public speaker: my address is exempt from disclosure and I'm here to speak in support of item 10a2 authorizing 61 million in funds to finance the acquisition reimplementation of these apartments and as housing costs continue to challenge families across miami-dade projects like this can make it possible for any residents to continue calling miami-dade. Investing in existing apartments we have the opportunity to improve living conditions preserve housing provide families with safer places to live. However I encourage the commission to ensure these improvements come with long-term affordability and protections, ultimately housing is more than just building, it's about giving families an opportunity to build their futures right here. Thank you for your time. >> good morning mayor and commissioner, rachel several steam water keeper of nonprofit miami water keeper and my address is exempt. Thank you for the opportunity to speak about the seaquarium project. I know this is first reading in the cgmp and there's another item associated. This is an iconic piece of property. It is important to so many miami ends and of course the environmental impact with considered marina on the bay. I want to thank commissioner regalado for her leadership. >>commissioner gilbert: did you sign up because I didn't call your name. Make sure we get a card for you. >>public speaker: commissioner regalado thank you for leaving on this and bringing the item. There's a lot of potential here and we do have environmental concerns we have been speaking about. Impacts to seagrass, potential corals water quality issues and we are concerned it is coming before the board without all the information available to the public so we are asking for clarity on what exactly is the plan for protecting our precious seagrass and other aspects of the proposal so we ask today that this project where this clock starts ticking on this be presented with complete information so we can understand what's being proposed here. >>commissioner gilbert: thank you. >>commissioner bermudez: MR. Chair can I ask you a quick question. I don't need the clarity today but I see the young men and women and now we had somebody who's not a young man or woman who says there exempt and we have an entity that has an address, we have a gentleman who comes from paul beach that says he lives in palm beach and gives his address so moving forward can we get clarity? Hoever chairs these things we follow the law. >>commissioner gilbert: I understand commissioner, for the young folks we know why but generally if your law enforcement or your husband is a judge or address is exempt we should state the exemption as there is a statute that goes with it but we will make note of that at some point. >>public speaker: 300 biscayne boulevard and I rise up for public comment on item chen moore. Two-minute numbers of the board I commend our the see idd and commissioner regalado for asking the right questions. The administration n has chosen a strong foundation. This is the right direction and a county united in systems is a county prepared for what comes next. And what comes next is the age of the automaton. In our community and technology there's anxiety over capabilities of ai and looking towards the future its effects not just on our systems but on our economy and we are prepared for contingencies before something happens. So I just offer my suggestions on this measure. Thank you. >>commissioner gilbert: thank you. >>public speaker: brian adler, 1450 brickell avenue suite 2300 there representing resilient llc, an affiliate of terra in connection with item 4m, the seaquarium. I'm going to respond because there were questions earlier. Today is not the public hearing, today's vote is only for as the commission knows is only for the item to proceed for the public hearing anticipated to be next month NOVEMBER 19 so a month away. Within that time there will be continued outreach. Here has been outreach to the community, there will be continued outreach and public sessions, there will be a community council hearing and then the hearing today. On DECEMBER 2, 2025 the commission adopted resolution are 1177 25 essentially authorizing a lease for the seaquarium to be awarded to tara. It directed the mayor's designee take all actions to effectuate the se. The application is solely to effectuate the term of the lease, thank you chair. >>commissioner gilbert: supervisor young. >>public speaker: good to see you there, chapel stanley young 500 northwest. Second avenue at 3645 northwest. 36th street in district 2 and three. I thank GOD for my commissioners but I rise up to talk about 10a1 about amending the debt on multi family homes in miami dade county. If we could give to those who are homesteaders, those who have seniors who need some relief who will be priced out of the home they have been in for the last 30 and 40 years and now are struggling to just pay just, it's insurance on the place and to keep the place up. So as a chaplain that walks the streets of miami-dade county and talked with those who don't even have a home to get a home and they need any kind of relief, any kind of effort they could have to really get that done. Thank you, GOD bless. >>commissioner gilbert: thank you chair. [Reading names] >>public speaker: good morning MR. Chair and commissioners, my name is lisa ochs neu and my address is exempt. I'm here to speak for item 11a5 for affordable housing while waving auditor review and public outreach rules. High living costs make affordable housing critical in miami-dade. Median rents over 2700 ours stretching working families to the limit and as a high school junior and recent resident of miami I know firsthand how quickly the environment changes. Frequently residents have to navigate new construction notices, delays in public transport and noise complaints read fast tracking developments impact residents beyond those relocating. Apply transparent public notices guarantee open communication and support for these communities. This will reinforce the counties interest in the betterment of miami as a whole. I'm asking the board to vote yes on 11a5 with an amendment of adding a public notice. Thank you for your time. >>commissioner gilbert: thank you. >>public speaker: good morning chair and commissioners, my address is exempt from disclosure and I'm speaking in support of item 11a5 which fast tracks a lease of 11.5 acres for affordable housing. T shows the county taking a step forward to reducing their accuracy and become more efficient. By waving the auditor review and public outreach requirements we will be able to move forward on initiatives such as affordable housing quickly. I and many others would like to see the county 's to remove unnecessary steps. For these reasons I asked for approval for item 11a5. >>commissioner gilbert: thank you. >>commissioner gilbert: >>public speaker: tom robertson, south biscayne boulevard suite 300 here to talk to you about 11a7 which is a settlement agreement and my purpose is to ask you to defer it. There are other parties in this lawsuit that are not included in the settlement agreement who are working with road space to try to settle and differing this item will allow those settlements to go forward. So allowing it to be deferred is not going to interfere with the counties ability to settle the matter but it will allow for the other parties in the case to reach a reasonable settlement in this matter so what I'm encouraging is you take item 11a7, the settlement agreement between miami-dade county red space and defer it till the next meeting, thank you very much. >>commissioner gilbert: thank you very much. Hold on. Is any procedural matter. >>commissioner regalado: it's a procedural matter in case there are other speakers. >>commissioner gilbert: we are not doing that, we're going to go to the amendment, MADAM Attorney. >>commissioner regalado: I am deferring it, I'm not commenting. >>commissioner gilbert: let's go to approval of the agenda. >> commissioner regalado you wish to defer 11a7? >>commissioner regalado: I was on the record stating they just now requested it. >> to the next meeting? Thank you. >>commissioner gilbert: let's go to the veto before that. >> I will read that with the setting of the agenda. MR. Chair, item two a1 is the mayor's veto message relating to our seven 9326 a resolution relating to foreclosure and demolition of the resources recovery facility. The item was adopted at the board's last meeting, mayor's veto message is properly before you. The mayor's veto of item will stand unless 2/3 of the commissioners present vote to override the veto. Your rules provide a motion to override the fate veto should be stated as follows, I move the resolution be adopted notwithstanding the mayor. >>commissioner regalado: I've passed out my respond to the mayor's veto. >>commissioner gilbert: thank you. Ust for today we're going to try this though. People are going to raise their hand and wait for me to call on them before they start speaking. We're going to do that. All right. But you can be recognized on this if you want. Hold on, let's let the mayor present first. >>mayor cava: through the chair, as mayor of this county the power of the veto is something I take seriously, I don't invoke it unless I think it's necessary and in fact I've only exercised it five times in my six years as mayor but today it is necessary and at the OCTOBER 6 bcc meeting the board adopted a motion that directed my administration to stop all spending on monies budgeted for the closure and demolition of the resources recovery facility in doral except for those necessary for public safety and security until negotiations with the city of doral contributions and funding to relocate the waste-to-energy facility has been resolved and I vetoed the board's action because it is too restrictive, it prevents the county from properly addressing conditions on the doral site and cost the county to unnecessarily incur additional costs to maintain a non-operational facility and first I want to address the incorrect assumption underlying the board's action that my administration has delayed delayed negotiating an agreement, the original directive was to bring back a negotiated agreement with the city of doral within 60 days of the board's adoption of a resolution selecting a site for a waste to energy facility outside of doral for the future and it has not occurred. Obviously this board has not taken action to identify such a state so that direction was recently modified at the board's second budget hearing to require an agreement by SEPTEMBER 26, 2026 and the agreement with doral has not yet come due and imposing this arbitrary deadline hasn't improved our negotiating position, nonetheless we've reached out to the city we are scheduling a meeting forth with with the mayor and city attorney so we will do all our good faith with the city of doral to bring an agreement for the board's consideration in this timeframe as directed by the board and the county continues to expend $60,000 per month to maintain and secure the site but the facility cannot continue to exist in its current state. The county is required to comply with orders to demolish the unsafe structures board and with oversight by the state department of environmental protection and furthermore to the process to demolish close and remediate a former solid waste facility is highly regulated. It requires permits, approvals and specific actions following timelines provided by the regulators and all these actions will require spending money which the department of solid waste management budgeted as part of the board's recently adopted budget and for those reasons I urge this board to sustain my veto, thank you. >>commissioner regalado: thank you. MADAME Mayor, I wish your staff would have spoken to me earlier and I wish that when we passed them we would have spoken more about the issues you had with it. This is not the time that we talked about this issue. In fact as I mentioned in my response to your message that I passed out, we've mentioned this twice in committee. E asked the commission pointblank and you still not reached out to doral. I brought an item at the first budget hearing and I again asked the question, you said the direction of your original item did not afford you the opportunity so I brought an item in the second budget meeting. You did not speak on those terms at that point and that past and when we talked about it yet again after the budget the administration had not even sent a letter to the city of doral advising them of this board's action so the item that we passed is in frustration. It is not in any way to take away your power. Everyone wants a resolution of this issue and it is mind blowing we have to talk about it six, seven, eight times before a letter is sent to the city of doral so I have a few comments in regards to your veto message. I'm happy to amend the item and work with you on the best outcome but once again even in your veto message your providing inaccurate information to the board that is in conflict with the report we all read at our last meeting so let's go through it one by one. You vetoed the board motion proclaiming the administration is not overdue bringing back an agreement with doral and the action restricts conditions of the site and action improved the counties negotiation. Each claim fails on the administration's own record. The action protects the only leverage the county has over the city of doral. That action exempts all spending needed for public safety and does not affect the administration's own demolition schedule as laid out in your memo. The administration has not negotiated with doral. I sent them a letter you're going to do something and you've informed them as to the report and the reality is the ratepayers are the ones who pay for this in action. This action was not driven by an incorrect assumption, it was driven by the administrations statements on the record. I delineated the times we talked about this and the dates in my response to your veto. this protects the counties negotiation position. What the city of doral most wants is for this facility to be gone, we've seeded this time and time again. Even commissioner bermudez has stated we need to resolve the issue and if the county spends public money to demolish the rf before doral contributes doral receives what it wants with no cost and has no reason to return to the table. A deadline is leveraged and cereal in action compounded board action that impacts them or what disadvantages every resident for miami-dade county that pays the rate for solid waste. This action does not restrict the ability to keep the site safe for regulatory requirements, it exempts every expenditure necessary for public safety or security with the site. The administration makes statements in conflict with its own report, agenda item to be 13 state demolition cannot begin until the state powerplant sitting active modification and rer issues a demolition permit and it says 2028 as the mmission target date. The deadline cited is FEBRUARY 18, 2029. The board's deadline for a doral agreement is DECEMBER 26, 2026. If a regulator requires an action not covered by the exemption the administration can bring it to this board. That said, the fact that in your eto you tated your failure to act is because we gave you a deadline of DECEMBER 26. We said we wanted an agreement by DECEMBER 26 would mean you'd be negotiating up till DECEMBER 26 so to tell us in the veto you haven't failed to act because your deadline is 2026 the city of doral's deadline to come up with an agreement is DECEMBER 2026 so I'm happy to amend the item to explain what negotiation looks like but it is shocking to me that we would do this. The last thing I want to mention is the administration uses board action as a sword and as a shield. When the administration does not want to act it says they are waiting on this board. When the board gives the direction it calls it micromanagement or it lacks specificity. But if we provide specificity it's micromanagement. Deciding how budgeted funds are spent is this board's responsibility. Negotiating is the administrations responsibility and if the administration needs the board's assistance it had several opportunities and you should have asked for our help in terms of changing the item we passed to give you more leverage. As the prior item made clear items in this particular department stop and the department does not consider the board. When this motion was heard the administration offered no amendments and no alternative and provided no status on negotiation until this point post veto and at the end of the day the ratepayers are the ones paying for this and I want to point out one more thing which I mentioned in my statement. The administration was not bothered to write a letter to doral, we spent $100,000 from the solid waste fee to send a notice for an item on the agenda so I move to consider this motion so we can amend it to provide more clarity to the mayor so we can resolve this once and for all. >>commissioner gilbert: motion. >>commissioner regalado: motion to reconsider. >>commissioner gilbert: hold on, I have the motion. I see commissioner seaquarium I'm recognizing him. >>commissioner hardemon: motion to reconsider because the motion passed >>commissioner regalado: to reconsider it before we veto it. >>commissioner gilbert: commissioner hardemon you have a question, is there a motion to reconsider with the motion passed and if it is a motion but I'm not sure that it is before us. We can reconsider before we do a veto. >>commissioner hardemon: I'll reconsider the motion. >>commissioner gilbert: any further discussion. >>commissioner regalado: yes, I'm happy to reconsider the motion and amend it. I think if the mayor needs assistance I think we could name a county commissioner to help with negotiation if jc wants to do it. It's his district. If we want to provide more clarity the mayor's veto men's and she needs a lot more clarity on what negotiation is and I'm glad she finally contacted the city of doral and they are talking but we're going to find ourselves in the same position because there appears to be hesitation to have this conversation with doral which is why you run an item, I amended that item, I run it again and I'm happy to amend this again so the mayor is happy with it but I feel there are things mentioned in the veto message that are just erroneous. In this case first of all the dates are wrong. That's why I gave the end of the year. There's a lot of things that have to happen that have not happened in order for us to shut down this facility. >>commissioner gilbert: regalado to your point, I'm okay with us voting new information but I got it, the dates were wrong. It's factually incorrect. Is there something else from this dais we can consider before we vote on the motion to consider. >>commissioner regalado: yes, and this is a policy decision. The mayor believes on doing this resolution takes away leverage. I believe this resolution provides leverage. It is a basic tenet of negotiation. Right now the mayor's position as the rf is not a place where we will put an incinerator and that we should consider moving everything there as quickly as possible. I believe our leverage is putting a pause in that process so that we can negotiate with doral. I don't see why we would give doral everything they want and ask them to negotiate because we have no leverage. >>chair: okay, got it. How many commissioners are here now? All right, so the county is going to be 2/3. >> yes. >>commissioner gilbert: okay, all those in favor of doing a roll call on this. >> this would be a motion to reconsider resolution seven 9326 adopted at the last meeting. >> MR. CHAIRMAN I need more clarification. We are doing this before we address the veto? >>commissioner gilbert: yes. This is a common procedural thing to try to find a middle ground before we determine whether we are going to override the veto so it's not uncommon but it's taking a 2/3 vote and unless there's any unreadiness, your good? Voice vote. All those in favor of the motion to reconsider signify by saying aye. Those opposed. No. I know it didn't get 2/3 but I can call the roll just to make sure. >>commissioner regalado: I appreciate it. >>commissioner bastien: yes. >>commissioner bermudez: no. >>commissioner cohen higgins: no. >>senator garcia: >>commissioner gilbert: no. >>commissioner hardemon: no. >>commissioner lopez: no. >>commissioner milian orbis: no. >commissioner regalado: yes. >>commissioner steinberg: >> motion fails 2 to 7. >>commissioner gilbert: that's confusing because when we did the voice vote it was so much more than two. Do we have a motion to override the veto? >>commissioner regalado: so moved, might as well. Again, I'm going to be consistent. It ratepayers are paying for this nonsense. >>commissioner gilbert: I'm going to take your arguments and apply them to this motion so is there a second on that, seeing none second. >>commissioner hardemon: I have a question MR. CHAIRMAN. You're being so nice. This item passed at our last meeting and I think it passed for a reason. So my question is really we received a veto message but the question I have is what have we learned? What have we learned that we can apply so those of us who vote in favor of this don't feel the same way we felt when we voted in favor of it. So an override of a veto is another step, another layer to what we can do. And it's not necessarily some things that people take very lightly. So anytime my mayor exercises his or her opportunity to veto, I take always the times applause because I think it's a message especially when they don't do it without going around and trying to corral votes for it, it's a message worthy of consideration so I want to know that we've learned something so that the message that was passed by this board is we know that it is heard by this administration. >>mayor cava: through the chair, commissioner, this item was based on a directive that happened without consultation with us to an item that came up that we were following from the budget hearing without consultation with us. I hope that what is learned is to consult the administration about our reasons and actions, thank you. >>chair: commissioner hardemon let me help out the administration. This is what was learned, that this board is dissatisfied at the pace with which this is happening and we want you to act more diligently when we give a deadline. We expect that deadline will have things as you work up to the deadline that should be taking place. That is the lesson I'm not going to override your veto and the mayoral veto process but you should take note that we are dissatisfied with the pace of this. We are dissatisfied because I think the original motion with regard to doral was my item. So we think you ought to be moving a little faster. That's the lesson, not consulting. We passed items in consultation and not those items are very direct and it doesn't in their movements on them so that's the lesson that was learned but I am not supporting overwriting the veto, thank you for the question. >>commissioner cohen higgins: thank you MR. CHAIRMAN, I have a question technically on what we did because the spirit of what the commissioner for district 7 was trying to accomplish was shared by the majority of the board because it was consistent with resolutions passed in 2023 but what I need clarity on is the resolution passed in 2023 does make clear doral is to pay upon the selection of a site which we have not yet done there was a subsequent resolution or direction given during budget that gave 60 or 90 day time period. I just need clarity from the administration we are traveling now under the new notion of 60 or 90 days, not the 2023 resolution first class we are commissioner and we also believe our negotiating position isn't compromised as we tear down unsafe structures and clean up the site because if this board gets dissatisfied with the negotiation with doral we can always say we built the site there, cleaning that up doesn't take the site off the table. >>commissioner cohen higgins: but previous resolutions did. >> they did today where functioning under the resolution that told us that site will not be made available for waste to energy. >>commissioner cohen higgins: just so we are clear as we address this topic what is the actual deadline of that more recent budget directive on either 30 or 60 days. >> it's a DECEMBER date and mayor levine cava has had conversations with mayor fonda alta around and rescheduling meetings to find out what that position is, we don't know what their exact position is but they've agreed to talk. >>commissioner cohen higgins: file JANUARY meeting we will have an update on the administrations position with doral on this issue pursuant to the updated resolution or directive we passed during budget, thank you. >>commissioner gilbert: pulled on. Yes, so your pulling up piece of paper so I know it's not going to be quick because you're holding a piece of paper, that single space is 17 pages so it will not be quick. Commissioner bermudez first because this is is district and you have 30 seconds to wrap this up. >>commissioner bermudez: I'm going to be consistent with the way I voted and I am going to support the veto because that's the way I voted. I do not think as the mayor or deputy mayor said that this precludes the mayor and deputy mayor from having those conversations. And I don't think, I think the mayor and deputy mayor are very clear on what they are doing. They've already reached out and they are, one thing, it doesn't, one thing doesn't keep the other from happening is what I'm trying to get back and that's the bottom line but we do, you all know where I stand. I think that I'm going to support the mayor's position because she's already acknowledged and so has roy that they are in the process of having those conversations anyways. >>commissioner regalado: thank you. I just wanted to point out the inconsistencies between the mayor's response to commissioner cohen higgins's questions. The veto message on page 2 specifically says the board recently modified its original directive related to the doral agreement in an early morning vote during the second budget meeting require administration to bring back an agreement with doral by DECEMBER 22 by imposing an arbitrary deadline rather than lining the negotiation of the agreement a selection of a site board disadvantaged the counties position with doral comedy action doubles down. The mayor continues to disagree with this board's position yet she's sitting here telling us now she's going to go into negotiations so I warn you all because even in her veto message not only is she vetoing the item we passed out of frustration for not acting on the first item she is doubling down in the message saying she is. So there is a disconnect here between what is being said amadeus and documents being provided to us and that is my frustration because she's going into a negotiation saying that she does not agree with this board's action so at a minimum we should name someone to negotiate this because clearly the administration does not want to or have clarity as to why in her veto message she's saying the item she did not veto which is the item we are currently traveling under now that you all decided to uphold her veto she still disagrees with it. And happy to withdraw my item I think we should be consistent. This is not consistent. As I understand the mayor is a strong mayor but this board passed an item that was a direction and time and time again what we are seeing is we vote on a direction and if the mayor doesn't agree with that direction she sits on it and she disagrees with it and nothing happens that's what's been happening time and again on this issue with solid waste and I'm happy to install. >>commissioner gilbert: the motion to reconsider failed, we are all the mayor's veto written there was a motion to override the mayor's veto. That motion was not seconded. That motion was not seconded, motion to override the mayor's veto fails for lack of a second. Let's get to approval of the agenda. >> second. >> I do have changes to your agenda. I have a request to bifurcate item 4c, senator garcia. I'll bring that back up while we are on this first reading. >>commissioner gilbert: point of order. Can someone bifurcate something and not be here? Because in the real world I know we can submit these early but if you're not here when it comes to the bifurcated item there's no one to the item. >> if he is not here when we get to 4c we will not have a bifurcation and I have more bifurcations, item 5d commissioner regalado wants to bifurcate that when we go to the public hearings. Commissioner orbis wishes to bifurcate item 5c, commissioner regalado wants to bifurcate item 5g and for item 8j1, they are adding this item to the pull list. 8n2, senator garcia CHAIRMAN Rodriguez and cohen higgins add this item to the pull list. 11a5, senator garcia adds this item to the pull list. 11a6, commissioner lopez adds this item to the pull list. Earlier during the course of the meeting commissioner regalado said she wished to request deferral of item 11a7, commissioner bermudez you pulled an item. >>commissioner bermudez: if it's deferred I will release it. >> with the setting of the agenda 11a7 will be deferred. 11a8 I did supplement, commissioner regalado adds this to the pull list. 15b1, commissioner garcia adds his name to the pull list. I have additional requests for cosponsorship, 4k substitute commissioner bermudez, 5h, cosponsor, 10a1, commissioner bastien is assuming sponsorship, 10a5 and 11a2 commissioner cohen higgins, those will be listed in the final printed agenda with withdrawals and scriveners errors noted in the memorandum and items I just mentioned, commission will approve these items by single vote setting the agenda except ordinances for first reading, public hearings, item 61 discussion item on the county stormwater plan, regarding safety review playground slides and dade county parks. And the following pull list items. 8j1, 8 and two, and 11 a five, 1186, 11 a 800 supplement, 1481, 1482, 14 a4, 1485, that's a first reading item, I'll read it with the other items grip 1487, d&b one and 15 before, motion to set the agenda is in order. >>commissioner gilbert: I'm going to take the motion from commissioner lopez, second by commissioner bastien, anything else you all want to pull? All those in favor signify by saying aye. Did we pass all the 14s? >> none of the 14 have been pulled, if you wish to take a motion on those it's 1481, two, three, four, five and seven. >>chair: all those in favor signify by saying aye. I appreciate it, good morning CHAIRMAN Rodriguez. The commissioners, vice CHAIRMAN, not on mayor. This will not be as long as our esteemed county attorneys I can assure you of that. 'm basically bringing up the clerk wanted me to address item 5 I. This is the item asking for the clerk of the board to implement a centralized automated online protest portal. There are three main points the clerk wanted me to bring to your attention regarding this item. The requires the clerk to procure a bid protest system. That would require funding. The cost of the system is unknown at this time. It is not known a quantity whether the clerk procure that system or asked the counties it staff to create a system. Hat's something that is a?. Additionally funding for that proposal included in last year's budget the budget that was for the cob received cuts as you all know. Procuring and implementing and maintaining a new bid protest system will require a significant amount of staff. An hours to launch. He bid protest filing fee has been unchanged and we bring that to your attention because it's been unchanged since 2001. It's addressed in the I/o. That has caused significant problems for just hiring hearing officers by the clerk of the board, this has been going on 10 years rent through the county attorney when we present a list of hearing officers you are not getting as many hearing officers as you can because the wages and rates for hearing officers have been stopped since 2001 as has the filing fees. Having filing fees that have been stagnant since 2001 also caused less money coming into the cob to fund the project so what he wanted to your attention was we have a project year which the clerk will always move mountains to try to implement for the board because that's what he's here for funding is not there. Wages for the hearing examiners are not there and the fees are not there and they haven't been changed in 25 years, thank you. >chair: MR. Romano. >> my address is 8770 southwest. 97th terrace here to speak in favor of item 5 a. Here at the miami herald coach of the year award he later served as director for the middle school. At our first two seasons together we earned a combined three wins and 17 losses. But you learn far more about people in victory, you learn what they're made of and coach stewart is made of iron after that inglorious start and many years of success with people going onto division I football those are the least of his accomplishments. Coach stewart understood what was estate was more than wins and losses. Today his former players include cfos of major public companies, leaders and above all good fathers and sons. Coach stewart was influential and built in us a core of what we are today so thank you for considering this item. >>chair: we have a minute to speak, the first speaker was an elected official and that's why they've got a little extra time but wanted to say that. This impacts the county reducing the acreage from 30 to 52 acres in the existing threshold but the county has not provided an inventory of properties or explain why 30 acres was selected as a new threshold. The development illustrates why this matters, it's approximately 36 acre upland property requires a variance on the minimum, this would eliminate that requirement while the county is considering additional lands and sequential marina facilities, the commission should identify which properties become eligible and evaluate environmentally sensitive areas, public lands and precious natural resources and we urge you to support item 5f to examine the lease and the relationship to this amendment before moving forward. Our transparency and fairness and protection of our lands, thank you. >>public speaker: my name is nick, 244 23rd street miami beach 515 year representing my company chariot living. We have a mou

MEMORANDUM Agenda Item No. 14(A)(5) TO: Honorable Chairman Anthony Rodriguez DATE: October 20, 2026 and Members, Board of County Commissioners FROM: Geri Bonzon-Keenan SUBJECT: Resolution accepting an implied offer of County Attorney dedication for a portion of SW 192 Avenue from approximately 502 feet south of the centerline of SW 336 Street south for approximately 167 feet, in Section 23, Township 57 South, Range 38 East, Miami-Dade County, Florida; authorizing the County Mayor to take all actions necessary to effectuate same The accompanying resolution was prepared by the Transportation and Public Works Department and placed on the agenda at the request of Vice Chairman Kionne L. McGhee. GBK/ksMDC001 Resolution No. R-901-26OFFICIAL FILE COPY CLERK OF THE BOARD OF COUNTY COMMISSIONERS MIAMI-DADE COUNTY, FLORIDA

Executive Summary The purpose of this item is for the Board of County Commissioners (Board) to accept an implied offer of dedication for roadway right-of-way purposes for the subject portion of land. This will cause the land to officially become incorporated into the County-maintained public road right-of-way for SW 192 Avenue. Annual maintenance costs associated with the acceptance of the subject portion of land for road right-of-way are estimated to be $30. Recommendation It is recommended that the Board approve the attached resolution accepting an implied offer of dedication for a portion of SW 192 Avenue from approximately 502 feet south of the centerline of SW 336 Street south for approximately 167 feet, as illustrated in Exhibit 1 and more particularly described in Exhibit B, attached hereto and made a part hereof. The Department of Transportation and Public Works (DTPW) needs this portion of right-of-way for road purposes and recommends that the Board accept this implied offer of dedication. Scope The subject portion of land is located within District 9, which is represented by Vice Chairman Kionne L. McGhee. Fiscal Impact/Funding Source The total fiscal impact of accepting this implied offer of dedication is estimated to be $30 annually for maintenance costs associated with the subject portion of right-of-way being included in the DTPW inventory. These costs will be funded through DTPW’s General Fund allocation. Date: To: From: Daniella Levine Cava Mayor Subject: Resolution Accepting an Implied Offer of Dedication for a Portion SW 192 Avenue South of its intersection with SW 336 Street Section 23, Township 57 South, Range 38 East October 20, 2026 Honorable Chairman Anthony Rodriguez and Members, Board of County CommissionersMDC002

Honorable Chairman Anthony Rodriguez and Members, Board of County Commissioners Page No. 2 Track Record/Monitor DTPW is the entity overseeing this item and the person responsible for monitoring it is Javier Bustamante, Assistant Director, Project Management & Support Division, DTPW. Delegated Authority The resolution delegates authority to the County Mayor or County Mayor’s designee to take all actions necessary to effectuate the acceptance of the implied offer of dedication. Furthermore, the County Mayor or County Mayor’s designee shall record the acceptance of this implied offer of dedication in the Public Records of Miami-Dade County. Background This section provides the historical and legal basis for the County’s acceptance of an implied common law dedication of a 43-foot-wide strip of land along SW 192 Avenue (being a portion of the property currently bearing Folio Number 30- 7823-002-0025 (“Parent Parcel”)). As evidenced by the Warranty Deed recorded in Official Records Book 23240, at Page 3015, of the Public Records of Miami-Dade County, Florida, a copy of which is attached hereto as Exhibit C, on March 28, 2005, Joyce Morrison, a widowed woman and owner of a 2.6-acre tract of land abutting SW 192 Avenue, granted the property to Thirteen Aqua Cats, LLC, a Florida Limited Liability Company, explicitly excluding “the East 43 feet for right-of-way” from the legal description. The exclusion of the east 43 feet for right-of-way expressed the owner’s intent to dedicate that portion to the County for right-of- way purposes. A search of the public records did not find any documents indicating that a formal dedication of the subject 43-foot strip was ever made to the County, nor was any record found of the formal creation of an easement for right-of-way purposes over it. However, common law dedication of property for public use may be made by the express declaration of a party or by its acts. The intent to offer the subject land for roadway purposes was reviewed and confirmed by an examination of title. Subsequent conveyances of the Parent Parcel have continued to acknowledge the original dedication intent, with various deeds in the chain of title containing the same language excluding the subject 43-foot strip from the legal description of the property. The latest conveyance on record is the Special Warranty Deed recorded at Official Records Book 35287, at PageMDC003

Honorable Chairman Anthony Rodriguez and Members, Board of County Commissioners Page No. 3 1019, of the Public Records of Miami-Dade County, Florida, a copy of which is attached hereto as Exhibit D, which reaffirms the implied offer of dedication through the same exclusionary language. In order for the owner to comply with development requirements for the abutting land, the County requires the subject 43-foot strip to be formally dedicated for public right-of-way along SW 192 Avenue. Accordingly, the owner of the Parent Parcel is seeking the County’s formal acceptance of this implied offer of dedication. No information was found in the public records that would withdraw, revoke, or impair this implied offer. Agenda Item No. 5(I) Page 3 WHEREAS, pursuant to Resolution No. R-441-25, the Board of County Commissioners (the “Board”) established the Special Task Force to Reduce Inefficiencies in Procurement (“Task Force”) to review existing laws, codes, procedures, and administrative practices governing Miami- Dade County’s (the “County”) procurement process and to recommend changes that would improve efficiency, transparency, accountability, and fairness; and WHEREAS, in carrying out its mandate, the Task Force examined each phase of the County’s procurement lifecycle, from pre-procurement planning through contract performance, to identify opportunities to streamline procurement processes while ensuring that each discussion addressed the subject matters identified in Resolution No. R-441-25, including procurements for goods and services, architectural and engineering professional services, construction contracting, public-private partnerships, leases and development agreements, and concession agreements; and WHEREAS, throughout its review, the Task Force worked closely with the Strategic Procurement Department (“SPD”), procurement professionals, and subject matter experts, and also conducted a workshop to obtain feedback from members of the County’s small business community regarding opportunities to improve the procurement process; and WHEREAS, the Task Force has transmitted its Final Report to this Board, thereby fulfilling its mandate established by Resolution No. R-441-25; and WHEREAS, on September 1, 2026, the Board adopted many of the recommendations of the Task Force’s Final Report in Ordinance Nos. 26-61, 26-62, 26-63, and 26-64; and WHEREAS, in Ordinance No. 26-63, the Board directed the County Attorney’s Office to coordinate with the office of the Chairman of the Board of County Commissioners to prepare and present to the Board a simplified procurement framework under the Code of Miami-Dade County (the “Code”), with reference to a single implementing order (“IO”) that consolidates all procurement-related IOs; andMDC006
