BULK ITEM: Yes DEPARTMENT: Project Management TIME APPROXIMATE: n/a STAFF CONTACT: Cary Vick COUNTY of MONROE The Florida Keys BOARD OF COUNTY COMMISSIONERS Mayor James K. Scholl, District 3 Mayor Pro Tem Michelle Lincoln, District 2 Craig Cates, District 1 David Rice, District 4 Holly Merrill Raschein, District 5 C1 Board of County Commissioners Meeting April 16, 2025 Agenda Item Number: C1 2023-3825 AGENDA ITEM WORDING: Ratification of an Amendment to the Special Category Grant Agreement 23.h.sc.100.04423 with the State of Florida, Department of State, Division of Historical Resources (DHR) for the Monroe County Courthouse Exterior Masonry Restoration project. This Amendment modified the original Scope of Work for the project and was originally approved by the BOCC at the November 19, 2024 meeting. After being approved by the BOCC an additional sentence was added to the modified Scope of Work before DHR executed the Amendment. ITEM BACKGROUND: The Historic Monroe County Courthouse exterior masonry has degraded, and has sustained damage over the years. To help fund the repairs to the masonry, the County was awarded a Special Category Grant from the Division of Historical Resources (DHR) for $482,825.00. This grant requires a 50% County match of $482,825.00. The original Scope of Work proposed by the County and approved by DHR included repair and replacement of damaged bricks and repointing of historic mortar joints. It was determined that the amount of work needed to make the building watertight once again would require more funding that was available with the grant and county match. The County proposed a change in the scope of work from brick repointing/replacing to application of a waterproofing sealant to DHR and they agreed to the change. The DHR issued a Grant Amendment to the County which modified the Scope of Work and also extended the grant expiration date from December 31, 2024 to June 30, 2025. The Amendment modified the original Scope of Work for the project and was originally approved by the BOCC at the November 19, 2024 meeting. After being approved by the BOCC, the Amendment was sent back to DHR for execution. DHR stated that they had recently made some changes to their legal language regarding sealants for all their newer projects and asked if the County would allow the following statement be added to our Amendment prior to execution: Water repellent coating specifications will be submitted to the Division of Historical Resources 21

for review and approval prior to application on the building. As the County is required to provide these specifications to the local Historic Architecture Review Commission (HARC) board also, Project Management did not see an issue with the requirement and stated that the sentence could be added to the Amendment. This Ratification is for the modified Amendment which added the above sentence to the modified Scope of Work after the BOCC approved the Amendment but before DHR executed the Amendment. PREVIOUS RELEVANT BOCC ACTION: 5/19/2021 – BOCC approved of a resolution providing support for the grant and affirming the County’s ability to provide the match. 5/19/2021 – BOCC approved for the Mayor to sign and staff to submit a letter of support for the grant application. 1/18/2023 - BOCC approved Special Category Grant Agreement 23.h.sc.100.04423 with the DHR in the amount of $482,825.00 with a county match of $482,825.00 3/22/2023 - BOCC approved a Task Order with Bender & Associates Architects for design and engineering services for the restoration of the brick exterior of the Historic Monroe County Courthouse in Key West. 7/17/24 - BOCC approved a grant amendment which extended the grant expiration date until 12/31/24. 11/19/24 - BOCC approved a grant amendment which modified the scope of work and extended the grant expiration date until 6/30/25 INSURANCE REQUIRED: No CONTRACT/AGREEMENT CHANGES: Ratification of the modified Amendment which added the following sentence to the modified Scope of Work after the BOCC approved the Amendment but before DHR executed the Amendment: Water repellent coating specifications will be submitted to the Division of Historical Resources for review and approval prior to application on the building. All other conditions and language of the Amendment are the same as approved by the BOCC on 11/19/24.
