Who's usually here. Think about it. Case number 2025, 0, 0, 8, 7, 2, So but for the record, the respondent is not present. So this can be with the sitch situation from the city's perspective. >> Well, this is is a continued case here. This is our 6th hearing. It's for violation of our Florida building code. One of 5.1 front and permitted accessory dwelling unit. And then Section 6 to be a varsity zoning code for permitted use for having to a dwelling units in a single family residence. They applied for the permit back in February. And we recently had a transmittal July, the 27th. So that is pending review. So they are moving right along and just given the fact that the weather's kind of that this morning they are moving. So that's good. Want continue push it out a little bit as good well. And I'm yes. All right. Let's see. We're looking at September. The 3rd. At 8.30. >> Cal continue out to 9/3/2026 at 08:30AM, Fund violations of 105, 0.1 of Florida building code 6 to be the zoning code are continuing. Just come from the last order and care. The things off the record on that case. I will go next to City of Sarasota versus SK Heigl Elysee formally 1, 7, 1, Whittier LLC case number 2026, 0, 0, 3, 2, 3, And for the record, no one's president on this one. But this is the one Robert Lincoln was here for The whereabouts unknown. I for the record no one's here on behalf of the respondents. So. see a winner. >> It's positive sign got kill to the rains. Got me This is a continue case we have today for violation of our standard housing code. 1.6 for a dock that was in disrepair. It's pilings that were left in the water. I am pleased to report the violation was corrected with our inspection on July, the 15th. So the property is currently compliance. >> All right. All went off and went to 1.6 instead housing code was corrected on 7/15/2026 going to the issue of fines and costs. City have a recommendation on that issue. We do. We for for some final affidavit prepare that reflects a potential civil fine. >> Of $17,300.5 inspections at $540. The city is not going to be asking for all of the $17,500 or 300 excuse me. Sorry. I can't see. So we're asking for a one-day $500 in the city to recoup its costs of 5.40. So the taxpayer doesn't bear the burden for the process some ago with that >> $100 civil fine and costs of 5.40, nothing to vacate on this when honor oak and metal wrapping up. Thank you. All right. We're going to go record for a city of Sarasota versus or LLC is case number 2000, 0, 0, 2, 2, 8, And it's I believe, a Jennifer Arroyo, correct? For them for the respondent. So it's a royal. I'll start with Miss Kennedy for the city. And I'll come right back to you. OK? Summit County, whenever you're ready. >> Thank you, Mr. Ellis, this is a continue case that we have for violation of our city Code. Section 16 Dash 47 for the accumulation of junk Russian trash. This is our 4th hearing on right of the first hearing. They were in compliance and we wanted to monitor it for. I think it was 45 days. And then we kept calling back out of compliance. And I understood from this Arroyo that her tenants kind of put them out. But there. For pickups all the time. So today they're in compliance. What is the correction date? I'm not sure that he put it in to be honest. 7.28. So the correction date is July. The 21 a lot of fun. 16. 47. >> That's correct. And I'm assuming you have no, you agree with this, the properties that was brought into compliance with their inspection on 7/28/2026, I do find that 16. 47 is corrected now. So fixes to the issue, fines and costs in this recommendation on behalf. >> The I guess we have a final affidavit prepare that reflects a potential civil fine of $21,300, 6 inspections at 615 to the length of time that it took. And I know surreal as is kind of struggling with the tenants here. asking for $500 fine and then the city to recoup its costs of $615. So the taxpayer doesn't bear the burden for the process. >> Just so you understand the recommendation here. The potential fine was $21,300. Recommendations for $500 fine to assess costs for this process of 6.15. Pursuant to the affidavit there. It sounds reasonable to me. So go with oppose of civil fine of $500 and 6.15, in costs and nothing to bacon on Okay. Well, wrap it up and thank you for coming and thanks for taking care of OK, Frank, thank you. I would receive that in the mail we can send in the mail or email it to You can pay today. However, you want to do it. Okay for a >> Thank you. >> I will go next to City of Sarasota versus Thomas ain't just the as trustee. The the steamy message revoke Ultra stated 12/15/2025 Jacqueline Darlene, as trustee of steamy Mesa, do vocal trust dated December 15, 2025 case number 2026, 0, 0, 5, 2, 4. And for the record, no one's here on behalf of the respondents. So city's position on this case. >> Well, this is a new case today for a violation of city code. Section 16 Dash 47 for the accumulation of junk rubbish and trash. According to the inspector, they removed the original debris. But now there's still some yard waste. You can see the yard waste on there. And there's still a little bit of debris. kind of scattered around. You can see. So I was hoping that someone would be here today so we could talk about a timeline to bring it into compliance. But unfortunately, that's not the case. So we do have an affidavit prepared that reflects an initial inspection of this February 27th of 2026. The notice was mailed on March. The 6 notice was served March 9th by certified mail compliance with set for March 14th. The property is not currently in compliance. The civil fine began running on March. The 15th 2026 through July 29th. That's 137 days at $100 per day for $13,700.3, inspections at $390. The city is asking that you enter this affidavit into evidence as exhibit number one. And then the notices of today's hearing as exhibits to and 3 and to impose the fines of caution. They're in. >> OK, admit 1, 2, 3, And based on the affidavit, all fun, there's a continued violation. 16. 47 in the city code imposes civil fine today to $13,700 cost a day to 3.90. I also will be impose All-Star $10100 per day daily running fine until the violation was corrected. All indicated representative for the response required to attend the next What's available for us? >> September the 3rd. At 9.15. >> got to September the 3rd and 9.15. All right. We're going to go on record for our next case, which is styled a city of Sarasota versus Lauren. Well, Miller, it's case number 2026, 0, 0, 4, 8, 2, And so for the record, your name, please or Miller or Miller's president, Mr. Miller Procedurally I we start with the city of Sarasota, Kennedy's in for the city today. She will explain the city's position on this. Come right. Back to you. OK? Okay. Miss Kennedy. One of 5.1, 4 and interior renovation along with a carport enclosure that was done without a permit. The application was submitted back in January and it looks like we have correction letters that were sent out on the 22nd and 23rd of July. So we're looking for. To have have some responses to those comments sent out. So just be looking Mr. Miller, to see what the well, the time frame building departments asking for more information to crisis Building and zoning. was e-mail sent to Mister Miller >> From Kevin. I don't know who it was sent Do you have contractor on file? >> I have a lot. >> get your Is chemist Kennedy's indicating that that there was an application for building permit about probably in January this year. city just recently from building department asked somebody for some additional information. I didn't know if it went to you or what your contractor, but fill me in on what your position is on this. >> Okay. So I submitted plans to get drawn up. Okay. A fee that cost more than what the material was then submitted. The 24 elevation. hate that too. And then also had to get Coverage calculations. Help me out for was. And that's plans here. >> You can see there's these are also the different stages here. Doubled over the requirement. I I went there 3rd up. So I everything up here is far as in interrogations of some that. As of 7. 22. >> So I'm just wondering if the communication to us before after the things you submitted some, you seen this. recent memo here that to asking for additional information and that right now, that's what that's what working on that now. Okay. That answers. The question okay. That's I was looking for. There. All right. All right. Let's get was just maybe push your key this Give you a chance to work yourself through the process. You keep doing what you're doing to get the building permit how much work needs to be done. What your you get a building permit, don't you got to take a is the question. Overnight, more 6 months. Well, OK, so you got, but I mean, you're going continue his work. Once you get the permit, you're ready to back and forth with our company in Indiana. Okay. So when when when you're violation status and these things, you you know, I know you have 6 months under permit to do the work. Typically you need to just you did not get out quickly. Once you once you get your Okay. So all right. Let's just figure out when we got to bring this case back MS. Kennedy, have you have recommendation >> I do September 3rd, if that works for you, Mr. Miller, can always a Thursday. Not come back. Tilson your copy this. Alright, I'm going to okay. Thank you, Good day. >> More than candle. >> Yes. So this is Richard Ellis serving as magistrate at the City of Sarasota. So if if you identify your full name, if you don't mind. Kendall Ellis Ellis, okay, are off to a good start here. All And your what's your connection with Bek Air Team LLC. >> I am general contractor that appear before you last month. Okay. On the one to help things permitted Get process will get all the the issues corrected the remaining items, correct it. I got okay. Very good. Our will with us. Go on record here. We're going to go for City of Sarasota versus Bek Air team. >> Low seeds. Case number 2025, 0, 0, 0, 2, 6, Mr. Also start with the Miss Kennedy and chill on the city's position. And then I'll come right back to you. OK? All right, Kelly, whenever you're ready. >> Thank you, Mr. Ellis, this is a continued case that we have 4. I'll just kind of run through them. Multiple housing violations, which remain unchanged from. >> Last hearing 16 Dash 47 of the city code for the accumulation of junk rubbish and trash that was corrected with back way back and set July 14th of 2025. 16 Dash. 49 be for overgrowth, which is corrected back in October. And then we have one of 5.1 for some a structure and then some electrical work that was done without a permit. It looks like we don't have any permits yet. Applied for and according to the inspector, some of the interior repairs that are being done requires permits and he has been in contact with Nick. And so he's fully aware of what needs permit. So he's working on the permit right now. Can do. >> All right, Mr. Ellis, let me get your response. But could. >> I can't I agree everything you just stated. I'm I'm aware of because when I attended the hearing last month, this most brought to my attention with that. This regards to permit. I actually spoke with inspector make and then I spoke with the plans. Is that because Amber, about 3, 4, weeks ago because I wasn't for sure if we have to get these bears be that we're going to detached from the unit if we need to get them engineer or not, they They confirm that we need to get into the air. So I actually have my engineer I continued their contact information. They're working on it now and we sure have the engineer. There's here within the next week and a half 2 weeks and then I'll be submitting everything appropriately for outside exterior stairs and then also be going up from it after the fact for the interior bathroom, things that were done and I'll get my life is like Trish, an unlicensed plumber on file so they can go on and just make sure everything checked out. >> Okay. you're good plans. So this can any of the questions, Mr. Ellis, or think so? I think he answered the questions that I have. All right. I'll just a dog to adopt. The findings committee in terms of that status. The violations. And I guess we just need to talk about when we want to bring the spent. >> Yes, we're looking. We're looking at September. The 3rd at 10:00AM that works for you, Mr. Ellis. >> You actually be partly Definitely have it the permit everything up. The permitting Biden who knows may even have it back know how that they are there, but absolutely certain that their work search >> Matter of fact, on the train person actually will be at a time. Just look at my calendar out out of town. So actually to do with the last began in August. If you want to move it up for that very next in September that Monday. >> We can do September the 17th. That would be the following Thursday. Well, that worked OK, perfect. >> meant haven't I needed to take it September 17 teens at 9.15. >> Okay. 92 network. That was first against >> That's why all continue out to September 17th at 09:15AM. And thank you, Mr. All 7 have a day to day and will take us off the record here. Okay. >> I appreciate to Carol, as guys have agreed as Thank Thank you. Our public. >> All right. What will go on record for our next case, which is city of Sarasota, Soda versus at EB Airport Holdings, LLC. It's case number 2026 0, 0, 6, 1, 3, And for the record. Your name, please. Charles, JoJo. Arnold is less than yesterday. Rmr Arnold up procedure that we start with the city. Ms Kennedy is in for the city allow on the city's position. I'll come right back to you guys OK, misskelley. Whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of our city Code. Section 16 Dash 47 for the accumulation of junk rubbish and trash and 16 dash. 49 see for overgrowth on an undeveloped lot. Both of those violations remain income or were corrected with our inspection on May. The 18th properties currently in compliance. >> All right, Mr. Do get your response? agree with that or? >> Yeah, I mean, I was over email that the issue was graffiti on that blue wall that just passed. And then there was the overgrowth in the lake at the dog track. We came to conclusion that that overgrowth in the lake is an ecosystem. And I in a meeting in that building across the street. And then obviously the trash dumping is a usually cleaned up. As soon as I'm notified, I don't go there every day. I have. Thirtysomething properties to deal with. But I do have it on now that it's summer of biweekly. What like landscaping and whatnot. And then you have some ideas on contract to maintain every 2 during rainy season. And then when it's not rainy season, once a month so you have any questions or comments? >> don't think I know we had some discussion about the pond in this, the things in the pond and we came to the conclusion that it was, you know, it's just part of the pond itself. So and that was fine. So I think we're ready to doesn't sound a recognition on the issue, fines and costs. We do. I would like you to take judicial notice of case number 2025, 0, 1, 1, 3, 5, 2, established a repeat violation. I'll do that. Yes. So we have a first and final affidavit prepare that reflects a potential civil fine of $31,500 since the finds it was 63 days at $500 a day. Then we have 3 inspections at $390. The city is not asking for all of a civil fine. We are asking for $1000 fine. And then we are asking that the city recoup its costs of 3.90. So the taxpayer doesn't bear the burden for the process. >> All want to get your response. could start the recommendation? Yeah, I mean, I think the dollar funds will have you know, like I said, we had a corrected soon as possible. It is on a monthly contract. I was, you know, every I'm pretty communicated with everybody in that building across the street when there is an issue and I understand obviously you guys position on having to go out there in the $390 for that every time some of these over there. But I do think that $1000 fine and OK? you know, the recommendations really 2 days of I guess they >> 62 days to bring the compliance, but it I will do since you seem like you, you're on top of an AL cut that in half to 500 assess the costs for the process of the taxpayer doesn't bear the burden for it. 3.90, and up. That'll take us off the record. good luck with Thank you. Thank you. Thank you. All right. We're going to go on record for city of Sarasota versus Ignacio borrow. And it's case number 2025, 0, 1, 3, 0, 3, And is ginia bars at the bars present with a summit of are you were here before us. You know the process. All start with Miss Kennedy for the city. Come right. Back to you. Okay. Kinney whenever you're ready. >> Thank you, Mr. Ellis, this is a continued case that we have for violation of the Florida building code. One of 5.1. For closure of a carport converted into a dwelling unit section 6 to be a varsity zoning code for permitted use for having multiple dwelling units and a single-family residence. And then section 7, 6, 0, 2, CC 2.1 C for the accessory dwelling unit or the main unit not being owner occupied. It looks like the application was received back October, but we really haven't had any movement. And the fine is currently running at to 50 per day. So I would just be looking to miss a party to see what the timeframe is to get the permit moving so we can get issued an and get closed out. >> All right. Now U.S. of our where are Where are you in the process here? >> So the last time we here, I went to the county. I talk with MS to Magnum. He asked for some pictures and I sent him some pictures I have in ghettos for back. So yesterday I went to the county and they say that wasn't supposed to send the pictures to I was supposed to send the beach or for the county and there was misunderstanding. But I I went with my husband home. His English 200% better than mine. In the we get in contact with them. And they said the last time we they have a contact with contractor was in April. And that being. Reaching my subcontractor in the year. That's what they say. >> All right. So your name for the record, please. If Ignacio Ybarra, Mr. Van of ours, that the rule of let the record reflect Mr. Barr's president now. All right. You think you want to add on this with your So, you all right. All right, as can you have questions or comments of No, I am glad that they appeared at the hearing today. Cause we were gonna just confirm it and bring it back up we weren't having any movement. So. >> I am very happy that they're here today. City would be comfortable pushing it out. Maybe 30 days to give them an opportunity to keep working through that permit process. So and we're looking at September the 3rd, if that works for you all and we have 10 o'clock. Yes, okay. One question. Why did they say the last quote, fact that they have with the subcontractor was in April? >> Which should me April. should be updating the. >> With I it looks like we had an affidavit that the last documents that received was back in April. It looks like. So. As far as I can tell with our system. So, yeah, there's been kind of a lull and maybe even talking to them, but nothing showing up in the system. So that's just how goes if it's not showing up there than we don't know what's going on. So okay. >> That's on their part, right? And they haven't done anything. >> Well, I mean, if you've submitted documents properly, then will be loaded up. And did you just recently do that? It was the definitive. Yes, okay. So it's probably not there yet. Yeah. So that's good that you're moving forward. Okay. >> All right. All of come from a prior order to this case up to September. 3rd at 10:00AM by the violations of 105, 0.1 of the Florida building code. 6 to be the zoning code 6 students. >> 7, 6, 0, 2, CC 2.1 C or can all continuing violations. This point. So I guess just stay with the contractor and get the thing moving. Okay. good Thank you. Thank Good luck. the today. >> I will go next to City of Sarasota vs. >> I I Why? to case number 2026, 0, 0, 6, 1, 2 2026, 0, 1, 1, 6, 7, >> And for the record, no one's here. But I think maybe there's stipulation on this one. the skinny was a situation here. >> Thank you. These are new cases. And yes, we did receive. We did receive a call from Modi's. She's usually here to take to kind of represent Mr. Finger off of his properties. But she's the rain has kept her in today. So we'd be comfortable just pushing this You know, since she's not here, just agreeing to a continuance, OK? So we're looking at September. The 3rd. At 10 o'clock. >> Alright, continue both cases to September. The 3rd at 10:00AM just and in terms of findings of the violations determine if it and determined animal to determined. All right. That'll take us off the record on those 2 cases. I will go on record for city of Sarasota versus Levi Nell Hershberger as trustee. The the vial hershberger vocal trusted October 27 2000 5 rate. Rachel, the hearse burgers us to do that. Hershberger Revoke Ultra stated 10/27/2005. And it's case number 2026, 0, 0, 5, 0, 1, 0, which identify yourself for the records. Ruben Fisher when Fisher is here. And Mr. Fisher, you've been here enough. You know the Start with Miss Kennedy and I'll come right back. Summit County, whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for violation of our City Zoning Code section 7, 3, 16 for a 62 inch live oak. That was trend the excess. We have some excessive canopy removal and or in proper pruning pruning. That violation was corrected with our inspection on April, the first of 2026. And then we also have section 7, 3, 25 of the zoning code, sets 4th the penalty for the removal and that amount is if you don't mind bringing up the affidavit. and this is going to bring up the affidavit here to reflect so its $225 per Dbh Inc. And there was 86 inches. There was actually 2 trees. It looks like. So the total find for the removal is $19,350. And the city is looking for payment. So in order to correct the violations. So I just be looking to Mr. Fisher to see see what that timeframe looks like. If he has any other information that he's able to provide. >> OK, Mr. Fisher, let me get your response to this far as understand everything was inspected and it's all. Is that correct? Looks like you're looking for $19,000. So that's is that what? That's what's going That's the penalty. Section 7, 3, 25 talks about a penalty. It's $225 per Dbh Inc removed. >> And you had how many inches. 82. I apologize. 86 inches at $225 an inch which comes $19,350. perhaps you need to maybe pass that along to your client and have them either pay or reach out with something. >> So there's no. There's no chance for deduction or. >> I mean, I think that would be up to Mister Ellis. But the city is looking for 19,000. So that would his discretion. >> What want to do want to continue this out for 30 days or so? What you give to give you a chance to talk to your client and what happened here, OK, cause that he's somebody, somebody obviously been a pretty big step here. So right. >> In the meantime, >> the >> this was happening right when there is transition from. >> Hershberger >> the new owner, the property was being sort of network with a look. He was out and we. We corrected everything, you know, right away. But who cut the tree? who is? Well, that was it >> The owners out of town. >> And he. Get somebody in there that. Didn't know what he was doing and didn't know that, you know, you know, there are many a trim that and I met with her win. It was kind of like a couple different. >> I pushes out 30 days give you a chance get all the details on. This this is 19,000 bucks. I think maybe just don't want to you know, you get your full Mr. Herstory Hearst Burgers explanation as to what happened here. Exactly. So well. >> Actually, Mister Hershberger is. Out of the picture because there's a new owner and this was happening right in that. >> When it one of the >> at the closing process. So there's there's I think, a state statute that says you have a code enforcement case pending, you have a duty to give notice to the buyer of the pending coded for. Was that done to they got letters. We were back and forth. That contacted me and I was taught working with her. She was out and we just. >> We corrected everything. You know, fast. But yeah, in the middle of it. The honor being out of state. Just didn't know. >> So is the new body was the buyer that did hit somebody do it or the seller out? It was the new owner. The new owner. And he was he had. That letter. He was aware of that. And I said, you know, I was gone well. This is the first hearing, I think, correct. It is. You so we he was aware of this. This and I said, go to the hearing I'll get everything correct. ID go to the hearing and see where we're at with what what we can do. So. Well. You know that I >> as want to give you a chance, somebody gonna come in and give a good explanation why this happened. You might want to bring this guy with you the next hearing site. You know, it's $19,000 of the weather inclined to just to enter the water. So it's your. You know, we want give you a chance to bring him to get some more information, maybe ask him to come to the hearing. >> Okay. What about a phone call? be fine. Up completely can call in. >> Yeah, we can call him if needs to contact our week. Is the procedure that some forms to be filled out you not to do it? You know, and so, if you can help him with that, he could appear by phone. We I just want I want to go with what happened here. So okay. I guess tried to explain that. Yeah, think what you you know what you says the buyer didn't. You don't know exactly why. And you know, but he but, you know, I mean, I can just dinner the night, the fine today and deal with it that way. I can. I can have him at the next hearing. Colin, I think it might be a good idea to have to do that just of if there's a reasonable explanation might have some mitigating, you know that, you know, effect on the order. So but when we have, >> we have September the 3rd. And 10 15. Does that work for you, Mr. Fisher. Sure. Okay. >> That's well to continue out to September. The 3rd at 10:15AM, by the. 73 to 5 is continuing the tree removal part of its 7, 3.60, was corrected back on April. First 2000. 26. So we'll see you then, OK, it. >> more win. We're trusting used to talking about a form that has to be is a form to if you want to peer by telephone all that they that provide for the for the next hearing for him. That was excessively. >> Pruned or improperly pruned. There was some excess of canopy removal. >> And then we also have section 7, 3, 25 establishes the penalty for the removal without the permit. The actual 7, 3.16, was corrected with pulling of the permit. That was on March. The 6th. However, we are still not complied with the fine that was established by Section 7, 3, 25 and that amount because it's $225 per into TV age and at $16,200. So that remains out of compliance at this time. just be looking to the respondents to see what kind of timeframe are looking up. All right, gentlemen, get your response here. You have one house are. >> I for what? >> Well, the the >> ordinance established the $225 per one inch dbh on trees that are cut without the proper permit. So the city's I think asking me now for I think what they're saying is that come into compliance them 16,000 with the number $16,200, $16,200. >> Well, I didn't know that was established at this point. Do we go for the magistrate right here decide what if there is a fine would be right. So, you know, I don't know if you are seeing the photos that are up there, but been building to this area was trail for over 18 years. We have worked to see our Bruce through all the homes over 85 those we bill just in this area. And we've never really had a issue at all. We worked through the entire process. Permitting the home, course, the tree. With the city. We move the house all the way to the West property line. customize the home. We customize the pool deck. All with the idea of saving this tree. We went out and proved the tree. I guess that person the trick of the day was overzealous. There's that great line. How much can you cut off which 23 5%? >> Anyhow. >> We even the trenches, the airspace. Uncover the roots to save the tree make sure we didn't cut routes. Bigger than 3 inches. We went through a hole that good faith. Try to mitigate the street keep this tree. We understand that the trees are very important not only to the city that really to even it helps sell homes. It's a beautiful thing and that's why people. By west of the trail is because it's a beautiful place. All our intentions are good. The the issue came out that when the tree survey was completed, it was 10 feet off. So we are on their falls. Information about the location, exact location of jury. When it came that the home was good true is going to be a 8 feet from the hole, 8, 9, feet, 10 feet from the hole itself. You can have a tree like that. So that's where we hired. I think Kelly agrees. The arborist. She came up with the proving I guess it's structural damage. You would have it. Our intention. You had an arborist that made the call on cutting. >> Not on the cutting on the aftermath of the ICU. So we thought it was simple. Trim the tree >> And got a good thing for the tree is work with us for many years. It is. We have never had an issue. So there was nothing intentionally done here. We worked to city in good faith. Throughout the entire process, even towards the end. Unfortunately, the tree had to be taken down. so. You know, the 16 to find is. >> inexpensive, fine. For some it really was an accident. It seems like that makes me maybe more sense to me. I mean, I push this out 3 or 4 weeks and we have 16,000 bucks, a lot of money. So seems like it might be said, I think it might be worth. We're having him come in and testify. What his mind set was in terms of doing this. >> in the aftermath of the pictures can show what he did it. The tree looks. looks to me matter, arborist, but it looks balance that looks like trim that well. >> I think that might be a mitigating circumstance. So, you know, So, you know, I think that might be worth doing having a full hearing, having, you know, you also have an arborist. I think you said you're hired after the fact, right? Arbors might want to come in and and talk to me a little bit about. But the you know what to do, what he should he or she thinks is extent of damage to this tree is so, you know, it's not I think worth. think it's worth probably me. Gathering that information before I make some call. And just the item, rather just impose $16,000 fine weather here, something some mitigating circumstances for some. Why? Why we do it that way, might need 30 minutes on this one from 30 minute block here. >> You see what I can find. >> The city may want to present evidence on that one as well. So does this. And that. >> This that we have September the 17th let's see. We have 11, 30 does that work? Block it off to 12 to noon? >> Michael, you will be Yeah. >> He's getting married regulations isolation. What may be our person has a different opinion about what level of damage was done to the trees time m be different. Hear them. >> Well, I think. Kelly Greens, the think she. Her opinion after back to the tree was structurally damage. should come down. She come down the street. You come to be removed, yet >> Maybe that maybe the >> more important information is how it how it happened. okay. maybe you're the man cut the tree might be good. >> Either good or bad witness for us. we might have. >> If so what you guys think about it. Sounds good. Thank you, gentlemen. Take care to them. Thank Thank you. Care. I will go next to City of Sarasota versus JC Bar and Lubar. It's case number 2026, 0, 0, 0, 3, 7, >> And for the record, no one's here on behalf of the respondent. So with the city's position on this case? >> Well, this is to continue case that we have for violation of city Code. Section 16 Dash 47 for the community shun of junk rubbish and trash. 16 dash. 49 be for overgrowth. Both of those violations remain in compliance. As of our inspection on March, 17th. We also have multiple housing violations which remain out of compliance and to 1.3 of the sand or unsafe building abatement for the property not being properly secure. That remains out of compliance as well. we've only had the respondent. Well, I think it's the heirs of the state they attended back in March, but we haven't had any further contact with him. And I was hoping that they'll be here today to kind of give us an update. So with that, we do have an updated affidavit prepared. That reflects an initial inspection of October 13th of 2025 notice was mailed October 16th. The notice was served November 17th by posting compliance set for November. 27th. The property is not currently in compliance. The civil fines begin running on November. 28 through July, the 29th of 2026, that's 244 days at $100 per day for $24,400. And then 6 inspections $615. The city asking that you enter this evidence and enter this affidavit into evidence as exhibit number one and to impose the fines and costs their end. >> OK, I'll admit the exhibits. Number city exhibit one. And based on that all adopt the findings of this entity. and pose a civil fine today to $24,400 and cost today of 6.15, will be imposed. Start off $100 per day daily running fine indicate that. Respondents are required to attend next hearing. What's are available for us. >> We've got September 17th at 10 to 15. >> I'll come to September 17th at 10:15AM, now take us off the record. OK? What will go on record for city of Sarasota versus one. 19 McKinley, LLC and Magnolia Cottages LLC. It's a case number 2026, 0, 1, 1, 0, 7, the council for the record. Your name again, please. >> Yes, my name is Ray near out here and I'm from the Najimy Thompson law firm. >> Okay. Miss you out You've been here before. So, you know, I procedural start with Miss Kennedy come right back to Summit County. Whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of our City Code Section. 34.5 Dash 15 D for the designated responsible party changing on a vacation rental without notification to the city. Section 2, 3, of 4 be one of our city zoning code which defines household living periods of Tennessee greater than one week, Section 6 to be for permitted. Use. >> Tennessee, >> less than one week is considered transient nature and not permissible in the single-family zoning district. 34.5 dash 18 be of the city code for not displaying the certificate registration number in the advertisements and then section 34 point 5 dash 18 see for the seven-night seven-day minimum. I have a couple corrections dates. The seven-day 7 night minimum, which would be the 2, 3, of 4 be one 6 to a to B and the 34.5 dash 18. See all of those were corrected with our inspection on July. The 7th, the other violations remain out of compliance. So we have to the designated responsible party and the certificate registration number being on their advertisement. Thank you. >> Mr. Out here. I want to get your Could yes, thank Yes, this property was changed to a new management company was previously, I believe Lido Key vacations. Magnolia Cottages is taking over we do agree the designate a responsible party forms need to be. I handled my understanding. Is that first round application has been submitted, but there's still some corrections that need to be made. Thank I spoke with Daniel about that. We some items to clean that up and get that resolved. So we're aware of that. And then I think the only other issue at this point was on the VRBO listing. I was not showing the current license number and the owner is aware that she needs to fix at. So that's just an pending item that needs to be are soft. how much time you think you need to resolve these issues? I think these can be done rather quickly. I would say 2 weeks. All right. So misskelley with what we have, but maybe 3 weeks out to be safe. >> I think probably going to go or okay Maybe actually 5 because we're so full the first available date that we have a September. The 3rd. And our mornings or afternoons better for Mr. Out here. Mornings are good. Okay. Have a 10, 15. Yes, it works. OK, that's what I'll do. I'll continue the case out to 9/3/2020 6, 10, 15 >> on the violations as outlined by MS Kennedy. There. we'll see you then. Thank you. Appreciate Thank you. Thank you. Thank you. Today. All right. We're gonna go on record for next case, which is a city of Sarasota versus Thomas. >> Edward Mitchell is case number 2026, 0, 0, 5, 9, 5, And for the record, sir, your name, please. Michel a Mishawaka. All right, Mr. Mitchell, a procedure that we start with the city of Mister Kennedy's in for the city today. explain the cities position on the case and come right back to So misskelley, whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of city code. Section 16 Dash 47 for the Cumulus Jean of junk rubbish and That violation was corrected with our inspection on July. The 29th, then 3, a 7 point for the standard housing code for care premises, instruction, materials being stored outside and then as well as section 7 to 14 D for a prohibited commercial trailer. Both of those violations were corrected with our inspection on July, the 25th. So the property is currently in compliance. >> Mr. Shaw, get your response to Accurate to you. >> Person causing all the problems living. There's been case. Your tenant, you test a victim. Okay. >> Why will fight for the record? The that Section 16 47 was corrected 7/29/2026 307, 0.4 of the Standard Housing Co corrected July 25th. And 7 to 14 D of his own could crawl correct. July 25th 2000. >> 26 takes us to the issue of fines and costs city. Have a recommendation on We do. I do want to before we get into that. >> grass is getting overgrown. It's not part of this, but we just wanted to mention it to you that the grass is getting ever grown. So just bring it to attention. So we have a first and final affidavit prepare that reflects a potential civil fine of $12,600, 3 inspections at $390. The city's not going to be asking for all of that civil fine. We're just asking for one day fine of $100 and the city to recoup its costs of 3.90. So the taxpayer doesn't bear the burden for the process. >> All right. So you understand can recommendations to me. How much money do what the rest of the potential fine was $12,600. The recommendation section $400 for one one day fine and costs of 3.90. That's her recommendation $390. >> That's the that's so the city doesn't bear that. I mean, how much to out completely for 90 total if that was the accept that recommendation? >> $490. That that's the recommendations are just want to get your Make a statement. Sure, sure. The trailer. That was in the yard and other things. >> There's the same thing in the yard next door. And then it's been there the whole time and nothing is ever done about that. I've singled out. I've corrected this problem. I had a problem with the person living there that lived there for 15 years. And I've got out at an expense to may. And I don't understand why we can complete and show that I have gone above board to do what I needed to do to get this situation corrected. And, you know, I'm trying to figure out while $390 when gone above board the correct all this and spent a lot of money. Correcting it. a huge expense to me. And I'm still not through covering all property he had a fire pit back in the back. That cost me $400 to remove all the blocks and everything left over garbage and different things. I've corrected all of this. At my expense trying to comply with the city. >> it was a hearing and I don't think you know, to talk about what's going on all this and not being fined when, you know, it was just a hearing and I've corrected all the problem. So why might be in fine? >> Well, I think the theory on the Costas Acosta ordinance and somebody got expert came and try to quantify what it costs to have. Somebody cited for these violations and to have hearing officers come in and code enforcement Specter's go out Cedric Center. So that's where the Costa ordinances design based upon the number of inspections. That's where that comes from. The idea is that it's that, you know, the person responsible for the violation should bear the cost of not the taxpayer. That think that's where that number comes from the recommendation, the typical the potential record, the fine was 12,000, $100 or $200 the recommendations for one day fight on I was I was find $12,000. I haven't had a hearing about was being fined. So that's not out that op-ed hearing, right? So you cannot find out why was being fined or even didn't even know. I was being fined at that point. >> This is a hearing to let me know that was a problem. Well, before the hearing off corrected all the prom. >> You haven't. But you haven't fined until we have a hearing in today's the hearing. Okay hearing about my problems and now there are no problems about corrected them. All right. So it seems like. >> To that donor no problem. So why my fine for a problem that no longer exist. In addition just to hearing I wasn't given a warning. On the front it get this done. I had no hearing to warn me that I was getting ready to charged $390. OK? Now the citation, I under the words you receive a citation. >> And I think there is a correction deadline that's actually give there yet. And so we have I think if you probably got a 5 day correction deadlines, my guess I don't have the citation of a motion anything in the mail. I wasn't given anything. You would have do it. You would have been K should not that got in the mail showed me that I needed to be here today. >> And that's all I've got in a separate of the hearing. Notice the original citation has to be served by state statute by the city at the location you've designated at the property Appraiser's office so they would have sent the citation that I don't know if you received personally. You know, when your mail received anything, that's my problem. Well, it would it would have been sent there. Okay. It's winter. >> open that back up. So the the notice of violation. >> So it was sent to 2 to 3 to Riviera Drive here in Sarasota. And then it was delivered on March. The 23rd at 04:15PM. Someone accepted the letter. >> There's your answer, sir. Some so I am going to go with that. I think you don't realize it. But it was a very generous recommendations. Some of the go with $100 fine cost of 3.90, I will also give you a little bit of a warning on this. If you're cited for the same thing within 5 years, the fines can run in excess of $500 a day. So be careful. Going to let me say this. All my rent was I'm selling so I won't have any rentals to get any more problems from. But first, difficult maintaining rentals. I understand that. So I get I mean, you know, it's fun to have a hearing to find out that there's a problem. >> And before I was given any opportunity to correct before there was a five-nation from a repeat. What I just said to the citation gave you a cheese are actually 9 any information. Well, it was that the letter for this hearing today. Well, unfortunately, evidence kind indicates otherwise somebody you're at your I guess it was your residents resort is set to Cornelius or was it sent to my Rivera Riviera Drive? River, your drive that where you is that where he was this letter? It was the notice of violation that laid out the violations and then the correction time those exact with the violations are tells you what to do avoid the hearing. And I did there. Well, also tells you have to call in with that within that time period, Colin, the inspector to come back out into a reinspection. Did you do that? I don't even know who my inspector is. Not kind of phone call, I guess this lady here is my inspector. The first time I ever heard anything from her was this week telling me that I think everything's going to be fine. Your case is going to be. >> Probably dismissed with no, you know, problems because everything's been clean up. All you need to do is get that trailer around the front yard, which I did it my expense. It cost me about $500 to into compliance and which done and wholeheartedly happily and I understand And the guy's been evicted. So I may not have gone above board. To you. The Cape, this court happy. >> I understand why I'm going. I'm going in circles now. So I want to repeat the same. >> Things go Ow. How much? $490 or okay. Thank you so much. Have a good day, sir. Take care. >> All right. We'll go next to city of Sarasota versus you. Your Donna Orlando Hernandez Senate's case number 2025, 0, 0, 4, Mr. Hernandez is present here along with his counsel. You can see Leo Sileo. As you know, I always start with the city win this Kennedy. >> Come right back to some is Kennedy. Whenever ready. >> Thank you, Mr. Ellis, this is a continued case for violation of the Florida building code. One of 5.1 for a shed offense, carport posts and kitchen renovation. We did have a permit that was issued back in May. And I'm pleased to report that the final inspection took place on July. The TWENTY-SEVENTH properties currently in compliance. >> Now to an agreement without an agreement we finally got a. >> I will fight for the record. That 105, 0.1 of the Florida building code was corrected on July 27th. >> A 2026 which takes us to the issue, fines and costs this Kennedy is a recommendation from we do. We do have a final affidavit prepared and back in January, you had imposed so far find $26,600 6 inspections. I think at 6.15, this is our 10th hearing. And then you did stop the daily running fine on February. The 5th. So all in all the potential civil fine was $29,400.12, inspections. That 1065 just due to the length of time compliance was was do way back in January. Probably long before that we are asking for $500 fine and then the city to recoup its costs 1065. So the taxpayer doesn't bear the burden for the process. 500 often as recommendation. Correct? The 65 in cars counseling to get your response to that. >> Sure. So the hearing at which the fine started to occur room Mr. Hernandez was leaked to. He has tried to be present for every single hearing. You know, that's when he got me involved. He is bent over backwards to everything the city needed. There was one inspection after the other after that and he's paid quite a bit in fees and permitting fees. So we are asking to get the lowest possible here today. >> Well, and I don't know if ready recognitions you know, fairly generous. Well, the Sun said this, but so it would all do. You have a little bit of a break on the final goal to cut. You have to to 50 cost? You know, the cost of the thing. I you know, I just I was go 7.50, on that around that thing off for So that'll completed and I do need to bake it. In this case. Did it. I'll break out the good of a Kate. The previous order that established the 26th. Plus fun. So anyone that's gonna wrap it up and thank you for coming. What was that total? Number to 55 costs. 7. It's 1001 1000 total. Yeah. >> Okay. Thank you. Have a great day. Take you think you take care now. It's kind of a shocker. Isn't We do get we get that from man who? champ publicly In fact, What are we on the wreck? We are a record the record for a city of Sarasota versus the Welch family. Trust. >> You ad 4/7/2015 is case number 2026 0, 0, 4, 3, 1, and your name again for the record. Yes, my name is Barbara Welsh Wbe Lch. Trustee of Welsh. Family are good. Thank you. All right. procedure that we start with the City of Sarasota, Ms Kennedy's in for the city and show outlined the city's position on the case. And I'll come right back to you and get your position. Okay. Okay. As Kennedy whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of city code. Section 16 Dash 47 for the accumulation of junk rubbish and trash. And as you can see, there was a trailer that was full of materials from the house that had been removed. That violation remains in compliance as of our inspection on July. The 13th, then we have one of 5.1 of the Florida building Code front, interior renovation without a permit. And as you can see, a counter tops and things and I just be looking to Miss Welch to see what her time line is. I don't see that any permits have been applied for. So just what the timing is of the permit things like that. I Let me begin by when I got the stop work order, we stop work. But I didn't realize that. I was in violation by not applying for permit. I just stop work because I thought you know, reach out to a contractor. This isn't a extremely low rent property you can talents on a street that's famous for rock cocaine and prostitution. And I think 10 years ago somebody was shot in the head. It's not really a. So it doesn't generate a lot of money and so contacting a contractor has been a challenge. But I did reach out to Kevin Magnussen. And asked him what. is essentially all we're doing is replacing the cabinets and with cabinets that destroying new cap. That's from closer. Home Depot. And in the exact same footprint. Asked him and I have since gone on and realize there's an application in a proposed in the. But Kevin said, send me pictures and I'll tell you if something needs to be done, there might need to second says a national electrical standard. I need to be an extra output in. So took a picture of all the outlets and he wrote back and said this has to comply with any S. So when I I've talked with a couple of contractors and they're like, absolutely not. You're not putting up walls. You're not installing new appliances. The you know? >> Mr. Magnussen indicate that we need to be even put a new outlet in the bathroom or not even touching the bathroom. So so when I tell contractors we needed electrical contractor, I think I don't know. All we're trying to do is he's kept up. They'll look at me like I'm a crazy person. So we we haven't really nailed down exactly what what needs to happen. But we do have a couple of calls out to a couple of other contractors might. Be able to just walk us through the process. And I know I have to apply for a permit and do that. previous and opposed. And you know, obviously should have been done. Back in February. Before I started. But but how hiring, you know, a contractor to do that? I could. You know, it's certainly do that. But finding dire electrical contractor that's going be a little bit more money. And again, this is. This is a this is a property my parents 74 for $17,000 we live to one side. Rented of the other, allowed us to get a house. And so the legacy started just to keep it that low rent charge. Like $700 for each side. The problem is that doesn't leave us with a lot of funds actually. So that's where I'm at with that what I can do ease. on on the Web site and and seeing the application for a permit. If I could file an application for permit with the proposed in out. the previous. And then I I suppose get something back from the permitting office telling me one way or another. Whether I have to put another couple of outlets and there is that. All right. Well, I think. >> Probably you probably need to check with permitting ahead of time because it's in a trust. So, yeah, Mr. Some of to Magnussen said that he doesn't think that I can apart from your my idea is and Mr. Ellis, your l

>> All right. We're going to go on record for code compliance. Special magistrate hearings. Today's date is 7/30/2026 first case on the docket, a city of Sarasota versus James Ian. Whenever you're ready. >> Thank you, Mr. Ellis, this is a new case today for a violation of the Florida building code. You come back to come back here and talk about where you're at in the process. September 3rd, mornings or afternoons better for you, Mr. Miller. Mornings 9.30. On the 3rd us with all due out into the case up to September 3rd and 09:30AM. >> Wind the violation of 105, 0.1 of the Florida building code is continuing at this point. Mr. Villages to keep it up and we'll see you then. OK, thank you. >> Do we send an e-mail with that? >> They will send you an email with the disorder. It will bill, you mail it to you and make you want to they want make sure mistakes. back edge the mail address address. I mean, you're analysts let her in the back your email address. So that wo
