1 EXECUTIVE SUMMARY 2026 State and Federal Legislative Priorities Board Meeting Date: October 7, 2025 Recommended Action: Approve the proposed State and Federal Legislative Priorities for 2026. Is it Statutorily Required? No District-zone Impact: District-wide. Impact if the Board Voted Yes or No - If the Board votes “Yes”: Approval of these legislative platforms will provide the District with clear, Board-adopted guidance for advocacy at both the state and federal levels. A “yes” vote empowers the Superintendent, staff, and legislative partners to advance unified priorities that strengthen funding, workforce recruitment and retention, safety, and overall student success. - If the Board votes “No”: If the platforms are not approved, BCPS risks losing alignment and influence in Tallahassee and Washington, D.C. Without clear Board direction, the District’s advocacy efforts could become fragmented, weakening its ability to secure critical funding increases, protect local governance authority, and influence legislation that directly impacts students and schools. Background/History Each year, the School Board adopts state and federal legislative platforms to guide the District’s advocacy strategy. The 2026 priorities were developed through a deliberate process, drawing from the outcomes of the 2025 legislative session, consultation with BCPS departments, and feedback provided by the School Board during workshops and meetings throughout the past year. The final documents represent a comprehensive approach that aligns both state and federal advocacy around consistent categories—funding, workforce, academic excellence, safety, wellness, and technology. The legislative platforms provide a unified framework for advancing BCPS’s interests and ensuring that Broward students have access to the resources and For more information, please contact: Name: John J. 2 protections they need. They respond directly to issues that emerged in the most recent state session, including funding shortfalls, workforce shortages, safety mandates, and student support services, while also addressing federal opportunities in areas such as IDEA, Title I, school nutrition, technology, and cybersecurity. For this cycle, the School Board is being asked to approve two formats for each platform—state and federal. While both formats contain the same priorities and policy positions, they are structured and presented differently to better align with the needs of the intended audience. The comprehensive version provides full context and detail for policymakers, staff, and stakeholders requiring a deeper understanding of the District’s legislative agenda. The condensed version is designed for quick reference and ease of use during meetings, outreach events, and communication with legislators and community partners. Together, the dual formats ensure the District’s advocacy is both consistent in substance and flexible in presentation, maximizing the impact of our messaging at every level. Alignment to 2027 Goals and Guardrails All Goals, Guardrails, and Business Operations Measurable Outcome(s)/Return on Investment Approval delivers a high value return for minimal fiscal cost. A unified advocacy strategy has historically secured meaningful benefits for BCPS, including increases in the Base Student Allocation, Safe Schools funding, and federal support for technology and nutrition programs. By adopting these priorities, the Board enhances its ability to leverage state and federal resources, reduce reliance on reserves, and ensure taxpayer dollars are maximized for direct student benefit. Financial Impact, Funding Source & Budget Status There is no direct budgetary impact on the District for this agenda item. However, these legislative priorities could bring substantial fiscal relief to the District by increasing state and federal funding streams, reducing reliance on reserves to cover the current $722 million shortfall, and providing new resources. This item may strengthen the District’s financial stability while allowing more local dollars to be directed into classrooms and student services. 6

1 EXECUTIVE SUMMARY Out-of-Field (OOF) Teaching Assignment Approvals FTE Survey 2 2025-2026 School Year Board Meeting Date: October 7, 2025 Recommended Action: Approve the attached list of out-of-field teaching assignments. Is it Statutorily Required? Yes, Florida Statute 1012.42, State Board of Education Rule (SBER) 6A-1.0503 District-zone Impact: District-wide Impact if the Board Voted Yes or No If the Board votes “Yes”: Voting yes keeps the School Board in compliance with State Board reporting rules and avoids any potential financial penalty. If the Board votes “No”: The District will be out of compliance, and the Auditor General of the State of Florida may impose a financial penalty per student Full Time Equivalent (FTE) for failure to report and approve out-of-field teachers prior to the conclusion of FTE Survey 2. Background/History: State Board of Education Rule (SBER) 6A-1.0503, Definition of Qualified Instructional Personnel, requires that newly identified out-of-field teachers be approved by the School Board. The teachers listed in the attached document have been identified as out-of-field for the first time. The following outlines the reasons a teacher may be recommended for out-of-field certification: • Assignment to a course outside the teacher’s certified area (e.g., a teacher certified in Chemistry assigned to teach Math). • Assignment involving a student characteristic for which the teacher does not hold the appropriate certification (e.g., ESOL, ASD, gifted). Out-of-field teachers are required to complete annual training until they obtain the appropriate certification. For more information, please contact: Name: Dr. Ernie Lozano Title: Chief Human Resources Officer Phone: 754-321-1840 13

2 The Florida Course Code Directory determines certification requirements for courses and student populations. Using this guidance, the district identifies out-of-field teachers, except for gifted assignments, which are vetted separately through Innovative Learning. Out-of-field teachers must complete required coursework until properly certified, unless covered under the Collective Bargaining Agreement (Article 4d), which allows for a one-year involuntary assignment. The specific requirements and timelines are outlined in State Board of Education Rule 6A-1.0503 and the META Consent Decree. Teachers who fail to complete the required coursework in any given year may not continue teaching in the out-of-field area and are no longer eligible for future out-of-field assignments. HR Operations informs teachers of the options available to satisfy OOF requirements through multiple notices, webinars, consultations, and virtual meetings. The district provides free professional development in ESOL, Gifted, and Reading. Key reasons for out-of-field placements include: • State Board Rules require a teacher assigned ESE ACCESS courses to be certified in each content area (e. g., Elementary Ed, English, Science, Math, Social Studies). • Teachers certified in related subject areas but not for that specific grade/subject (e.g., English 5–9 vs. English 6–12). • Critical shortage subject areas. • ESOL endorsement requirements for teachers of English language learners. • Gifted endorsement requirements for teachers of gifted students. • There are not enough courses being offered to hire a full-time teacher; therefore, the periods are covered by a teacher on staff that does not hold the appropriate certification. • Fewer students are graduating from education programs, leading the district to hire more career changers who are often classified as out of field. A total of 1,037 teachers have been reported as out-of-field for FTE survey 2. A teacher’s name may appear more than once if they are identified as out-of-field in multiple certification areas. The figures for Broward are similar to those of other large districts. 14
