Code Enforcement Board

Thursday, May 7, 2026 · Government meeting record

The 30-second read

Record incomplete

The Code Enforcement Board reviewed multiple property violation cases, granting fine reductions for owners who demonstrated compliance efforts and setting new compliance deadlines for others. The board also appointed new leadership, electing a new chair and vice chair for the Code Enforcement and Nuisance Abatement boards.

Why it matters

Property owners facing code violations must comply with city standards or risk daily fines, though the board provides a formal process to request extensions and mitigate existing penalties.

[Music] [Applause] [Laughter] Yes. >> [Applause] Okay. Just let me make sure. Tap her just to make sure. MADAM Attorney ready? >> okay. Take your time. Go ahead. Starting just about two more minutes. We just have a few more residents that have some questions they have to. >> get answered, but we'll start in about two minutes. Okay. We're. >> going to stand for the pledge of allegiance. Please. >> continue to stand if you're here for your case to be sworn in. Please raise your right hand. Do you solemnly swear or affirm the testimony you are about to give today is the whole truth and nothing but the truth. Thank you. >> you MAY be seated. Do you solemnly swear or affirm you will. You would translate from spanish, from english to spanish. I'm sorry. Spanish to english and english to. >> spanish to the best of your ability. Thank you. Buenas tardes. Alguien necesita. Asistencia con el idioma ingle s espanol espanol ingle s por favor coloca se de p. En su mano derecha. Usted el testimonio q van a dar el dia de hoy la verdad y nada mas q la verdad. Do you solemnly swear or affirm that you would translate from english to creole and creole to. >> english to the. >> best of your ability? >> thank you. Bonsoir. Les anglais et. You? Okay? Merci. roll. Call, MR.. >> moshe. >> malca present MR. Ulises arias present. MR. Juan galan, MR. Arnulfo ramos. MR. Keon williams present. MR.. Javier. >> rodriguez present. We have a quorum. Thank you. >> good evening. Most of you are here this evening for the first time because you were just received the. Violation or others if you are here for. Mitigation which. >> is your mitigating the fine that was imposed on your property regardless if you hear from mitigation or to be heard when your case is called, please come to the podium and state your. >> name and. Address. >> if you're here for a to be heard you're going to plead guilty or not guilty. You're pleading guilty to whether the violation existed on the property at the time the violation was issued. Not that you're personally guilty of something it's about whether the violation existed or not. If you plead guilty, the city will put a summary of the violation. The board will determine how many days you need and will impose a fine if you're a residential property and this is your first time, it's up to. $250. If you're a non residential commercial property it's up to five. $1,000 per diem. If you're a repeat. Violator it's 500 for residential and 5000 for nonresidential. The board will give you a number of days and a fine. The fine does not run until the number of days to comply has expired. If you need an extension of time before your time to comply has expired so you don't get a penalty of imposed against you, you go to. Www.Gov.Com and search extension of time and you can ask for it online. There's a paper at the podium. Take it with you when you're done. If you're here for. Mitigation after you introduce yourself explain to the board what you're mitigating. How much you'd like to mitigate to the board is. Bound by a chart. Do I have my chart? Can I have a chart? If you haven't seen the chart come up and get it while we wait to call. Mitigations it'll tell you more or less what the board can and can't do for you. This is what they're bound to. There's some cases where they can go to zero. There are other cases that they cannot. So take a look at this. Look it over. >> while you wait if you're here for mitigation. All all orders of the board are appealable to the 11th judicial circuit court of florida within 30 days. And again make sure you take the paper to know how to ask for an extension of time because that's important that that avoids all the fines and penalties to being uh, imposed against the property. And make sure you take a look at the. Mitigation. >> uh, a couple of things. Housekeeping. >> yes. >> uh, MR. Gallon. And MR.. >> ramos have asked for an excused absence. Can I get a motion? >> can I get a. >> motion for that? >> I move for excused. >> absence. >> for both gentlemen. Second, I second. All those in favor? Aye. And then the other housekeeping is uh member cuneo was our chair and he stepped down. We need to. Nominate and vote on a new chair for code enforcement. Um, and just I know we're not here for nuisance abatement, but it's tradition that generally the chair for both nuisance abatement. >> and code enforcement are the same person. So um if we have any. Nominations yeah I would move to. Nominate. >> MR.. >> williams for chair for both and I second okay. What was. >> the other part just to. >> make sure did you say anything else for both boards? Oh wait you have to do nuisance abatement and nuisance abatement. Correct. I'm just letting you know. But this is only for. >> code enforcement. Okay. Thank you. >> I second his motion. All those in. >> favor I thank you guys. Congratulations. Congrats. >> and now we have a vacancy for vice chair. Do we have a nomination for. >> vice chair? I make a motion to. >> appoint MR. Javier. Rodriguez. >> for vice chair. >> I second that motion. All those in favor. I. >> I. Congratulations, MR. Rodriguez and MR. Williams. Thank you. >> all right. Can we get started with the cases we're. >> going to. >> start with to be heard. >> and then go. >> to mitigations. Nobody checked him for the. >> extension of time. Okay cool. And I saw that we. >> had one add on is that uh we have a six add ons six add ons. Yeah. So I'll be able to pull them up but they're all their mitigations. Okay. And one um um uh, special appearance for a. >> partial release. Okay. That's not an issue either. >> so those those will be okay. >> you want to get that out of the way quickly? Do you want to just do the mitigations first? Yeah if you want to one one last thing when you come up for your mitigation when you're done wait for me over here because I need. >> to give you your order of mitigation. I'm sorry I missed that but yeah, let's do mitigations first. Okay. >> the first add on is um add on six which is a. Mitigation. So we don't have it's not on the actual calendar to. >> add on. All right. It's going to be yeah but you just need to go ahead and um okay the case number. 00082829 property address 11. Southwest seventh street. This is a commercial property. The lean ran to. $313,000 the minimum for the commercial it. >> is commercial. >> property is $15,000. Okay. Good evening MR.. Congratulations MR. CHAIRMAN. MR. Vice chair, good evening, members of the board nicky marrero here on behalf of the property owner tobacco road this is the tobacco road building where tobacco road used to be. The remaining commercial establishments? Yes. Um this the reason that this fine. Accumulated we've spoken to staff will be seeking the 15000. Uh my client is the owner. They had the tenant handling the violation. It was their work. It was their violation. They left and they left them with the bag. They failed to resolve it and by the time that my client took over, the fine was already running. They couldn't stop the fine but they went ahead and took it over and resolved the case on their own. But that whole time they were fixing it the fine was running and they did close it. Um but they weren't the original. >> violators so. >> we're asking for the 15,000 mitigation. Okay. >> thank you. I get a motion. I move. >> for reduction to 15,000. I second all those in favor I thank you. >> thank you have a good night. Thank you. Next case. Next case add on number two. Sorry. One second. Oh I thought it was going to. One second sir. Okay case number. 00121526. >> property. Address 1790. >> southwest. 15th street. Okay. >> are they here? Okay, okay. This the lien on this property ran to, uh, $56,250. Okay, I'm. >> about to hold on to tell you. Yes. Get to what type of property is this is a is. >> a. It's back to being a single family home. Yes. >> it was a single family house when the violation was placed. Okay, so it's a single family home. It does have homestead exemption. It ran to $56,250. Then the minimum is. $5,000. >> or by unanimous vote. >> it can go. >> as low as zero. Gotcha. You state your name and address for the record. Yes. Good afternoon. First of all my name is laura patino. I'm the authorized. Representative for the. Company that owns this property right now. So basically this violates. >> if it's owned by a corporation now. Yes and it's not. >> homestead exempt. Yes correct. That's why I mentioned was first there was a single family residence owned by a trust. Yes. The violation was placed back then when it was owned by the former owner. Uh we purchased the. Property in. JULY 2025. >> and the violation was issued on FEBRUARY 20th, 20, 2025. So it had another violation as well uh unsafe structure. Violation which we. Diligently address. We had a demolition permit. We demolished the property. We paid uh, the applicable fine for that particular violation and we inform the the code compliance department about it. So after that we were able to pull several permits related to the property to the project we're building there right now for which we understood there was no situation because usually you cannot pull a permit from the city if it has a violation or something on it. It came to our attention because we are under financing. Proceedings and during the lien search and so we found out that there was a lean it was super surprising to us because we're always in conversations with the city, uh, with the permits and so and it was super confusing as well, but I think it was more like a. Misunderstanding because back when the property was. >> demolished. >> we thought that everything was closed and settled. Okay, so that's why we kindly request your. Consideration to uh reduce this um this fine to the original amount that was. $225 because if it was a violation I think for. Failure to. >> maintain. Exterior of residential property. There I can tell you this. >> their application. >> intake was before the lien was recorded. So MADAM Attorney that's why it wouldn't have shown up. It would have been an open case. Their permits were complying the violation. So of course they're able to get the compartments. That's not a mistake. Just so she's clear then they applied for it after . >> they applied before um the lien was issued and I have a question MADAM Attorney. Uh. >> the property going to be treated as. >> a. Residential so it is uh it. >> is residential because the fine was presented when it was residential but now it's an empty lot so that changes it. The minimum is. $7,500 because they removed the structure's gone. So it cannot be. >> treated as a residential because it's an open lot now it's an empty lot but if it is an empty lot then there is a. Caveat that under the empty lot, if its last use was as a residence then you can treat it as a residence. However as and as a. Residence it was like patti arias keeps giving um and banana as a residence. She's the one who wrote this um not me uh as a residence it was a. Homestead exempt. But in bad shape so the minimum would be. $5,000 or two zero if you so choose. I don't know what she means by the minimum $225. They MAY have had a ticket at some point but that. >> has nothing to do with this case. So in terms of that so I make a. >> motion that we uh. Apply the minimum of $5,000. Yeah. >> I'll second that. All those in favor? Aye. >> thank you. Good morning. Welcome. >> thank you. Next case next case page I'm sorry add on for case number. Ce20180260213034 oak avenue add on for. Good evening. State your name and address for the record. Hi, my name is camila. I'm an. >> authorized. Representative for the property. 3034 oak avenue. Okay, it. >> is a 45 resident condominium in coconut grove. So this this lien ran to $901,500. Okay. And . >> the. >> minimum. >> is $15,000. Okay. >> okay. So a little. Backstory to this building we my we took it over my family's the owners and the developers of the building. We took it over about three years ago. The previous developer had said that he had taken care of all the liens taken care of multiple different things. That wasn't true. And then we my dad took. >> it over. He passed away nine months ago for ten months ago. So sorry to hear that. Thank you. So my mom and I ended up stepping in to finish the building and since it was. Self-financed. >> we didn't realize that this lien had been on our property until we got tco. So we tco the building MARCH 16th and then beginning our closings. That's when this came up so we handled it. My team was in the city for ten days. They handled it on MARCH 27th they satisfied all the. >> inspector and now. >> we're here kind of just to hopefully lower the fee. Okay right now it sits at about 901,000. Yes, yes. And. >> so the minimum that we can do is. 15,000 okay okay great. >> can I get a motion. Motion for. 15,000. >> I second. >> the motion. All those in favor? All right thank you so much. Welcome. Next case out on number one case number. 0008 sorry. 00081573. >> property address. 5851. >> northwest. >> 17th avenue. >> out on one. Good evening. Hi .I. >> am a I have a power of attorney for the property. You state. >> your name and address. >> bernard and so they state your name and address for the record. Moraima bernard. 7451 riviera boulevard. Thank you. This is a line that ran to $344,500. This is a school. What type. >> of school is this? It's a vocational tutoring school. It's a nonprofit nonprofit. So it's an machinery. Um because that's what I was thinking about. Yep. Uh, after I stopped talking to you. It's an elmo scenery, if I can even say that word. But I can spell it um, property and therefore it is allowed to be treated as a single family residence but its minimum would be ten. Well it's its minimums. $15,000 but it's commercial however you can I. >> believe if I look at the. >> documents go down to. >> zero if you so choose. Gotcha. State your case. Okay so. Basically they took it over from someone else in. 2024 there was a gate that was installed. They didn't know that it did not have a permit. They removed the gate. We've already paid all the fees for all the. Permitting and everything and the sea use and that had not been paid previously. So I am. >> trying to see how. >> low we can mitigate this to get. >> this taken care of. A few questions for you. It was more than a gate. But this was um this was an empty lot. Okay so the empty lot is for. 5861 so they never pulled any permits for that. But since then there was a gate there and that gate has also been. Removed as well. And so there are no gates there and they're not going to put. >> any gates there. And all those permits have been. >> canceled to be complied with. But then there's no school there. Correct. The school is. >> only on 5851. The empty lot. >> is 5861. That's the school. Yes the. >> school is 5851. There's two lots they own both of them. Yeah it's part it's on part of it and we we since last week we've paid all the teachers and seniors that. >> were outstanding. >> which I think amounted to about $2,800. Okay. >> and so what's the current use? I mean it's a school but what's the school for? It's. >> still a. >> current use for the school and. >> the vacant lot is not being used at all. Well what kind of school is it? It is a vocational. >> tutoring. School okay and a k through 12. Um. >> it is no it is from five through 12. Five through. >> 12 yes. How long. >> has it. >> how long has the school been in existence since 2024. Okay. Got it. Um so obviously it's a nonprofit so can we get a motion here? Um we can we can do it's a minimum of 15,000 but we. >> can go as low as that. >> to. Zero if unanimous. Is that the minimum MADAM Attorney the minimum well the minimum is 15,000. However by unanimous vote you can go as low as zero because it's. >> it's. >> all tied. >> into um a school. >> which is elements in nature. Yeah. It's a nonprofit. Okay. That's blessed. >> that. >> nonprofit then and I'll make a. >> motion to take it. >> down to zero. Thank you. >> I second all those in favor. I thank you. All right. Next case. Yes. >> okay. Next case add on number five case number. Ce2021004514. >> property. Address 1404. North west. 60th street. This is add on five. All right. Anyone here for that property? Okay. Good evening sir. I don't have a I don't have a file for that so can we um but it ran to $46,500. It's owned by a corporation. What's on the property? Uh, boston partners. Llc the owner know what's on the. >> property right now. Oh, it's . >> a. Multifamily two units multifamily. All right. Okay. So it's. 46,500 which make the minimum. 15,000. >> however in again otherworldly math you can do. 20% of. 46,500. >> which is probably less than the. >> 15,000. But I don't have my. Calculator. >> and. >> that's. >> somebody else's job. >> so 465 46,593 9300. Is the minimum you. >> can go. Got it sir, you state your name and address for the record. Yes. My name is luciano perry. Um property address. 1404 northwest. >> 60th street. I'm uh represented legal representative for the company. Thank you. Um, the situation is that, um we didn't know about the the company didn't know about this violation. Um apparently it was served in the. >> property and to the wrong. >> um. Registered agent. >> the. >> registered agent you had. Yes. I'm sorry the registered agent you had on file we the the reality is that the companies the properties owned by a delaware corporation and it was served to the florida corporation so we never got notice of the violation it was placed on the property. Yes but it's a rental property so my client didn't get to to to get that. >> notice. >> from the tenant or prospective tenant. This goes back to 2021. Gotcha. So. >> basically uh they notified the florida. Corporation registered agent if that's the if that's the case and he wants to pass it when I have a chance tonight at some point I can try to get the file look at it if it if it went to it and it was a wrong notice then then we ourselves would get rid of it completely. That's what I was. So if you want to just pass if I'd known before we would. >> have done it earlier. Yeah but. >> if you just want to. >> pass it and come over here and then that's why I was. >> listening more because thank you for your time everybody. >> if you can find that so I can just yeah. >> let's we'll pass this one okay. Next case. Page 170. It's we're still in. Litigation case number. 00034378 property. Address 3609. Southwest. 24th. Street and you say the page one more time 170. >> thank you. Property address. 3609 southwest. 24th street. We got somebody coming. Yeah, this went to 40. >> what is it? Oh, $438,500. Yep. >> for this. Property and it was in a. Trust. >> yep. >> mhm. Good evening ma'am. Good evening. You state your name. >> and address for the record and it's a single family home, right? It's a single family home. Yes. >> do you live there now? No. It's registered like vacant. Okay. So no homestead on it. So it's a single family home. It looks like it was in with sort of a family joint. Tenants right of. >> survivorship and you're the new owner? No, no, I know the owner. >> I represented. The owner. They hired me on. SEPTEMBER to take care of all this mess that they have in the property. Okay. So yeah, it was a property that's been left vacant in bad shape. So the the minimum would be. $10,000 but you can go down to. >> zero with a. >> unanimous vote. Okay. Good evening ma'am. Good evening. My name is patricia carrasco. >> I represent. >> the property located in. 3609 southwest 24th street. The violation number is. bb23570074. >> building that's a different. Violation for the. That's building just what's here. Code enforcement the city of miami. 2357007. >> yeah we have that. Can you state state. >> your case for why we should reduce the the mitigation for this case yes they comply with all the. Violation. >> they maintain the lot safe. They register the property like vacant and the property is not abandoned. >> is. The. >> property owner is taking care. >> of the property. Gotcha. Uh is there any discussion? If. >> not I'll. >> entertain a motion. Yeah. >> I would move for 10,000. I get a second. All those in favor I okay so they reduced it. >> from 483,500. >> down to. 10,000 okay 10,000 .$10,000. >> okay. So discount of. 428,500 okay. Thank you very much ma'am. Thank you. Next case page. 166 case number. 00057888. >> property address 360 northeast 55 street. Good evening sir. Good evening everyone. State your name and address for the record. My name is stefan. >> and the. >> property address is. 360. >> north east 55th street, 166. I did bring here the. Contractor and. Engineer that helped me with the whole process. So we. >> have a. Clear understanding of give me one moment here, madam attorney. The lien on this case ran. >> to $15,750. The. >> property is a single family. >> home or duplex. It's a duplex. Okay. >> do you live there? I used to I. >> recently. >> moved okay. How recent? Six months ago. Okay, so the minimum is 10,000 but you can go as low as zero. Um and it was it was remodeled so now you got the. >> permits. >> to for the that you needed [Laughter]. >> for the remodeling that was done looks nice. Thank you. Okay. Um so the so the minimum would be. $10,000 however uh at. $15,750 you can also do the minimum as 20%. I can't do that math so somebody else would. >> have to do. >> it or as low as. >> zero it's 3000. 153,001 3150 20%. Make a motion for. >> the. 3000. I get a second. >> I second. >> that was. >> for. 3000 3100 150 150. And before. >> we take a. >> motion and I. >> do. Apologize. >> did you want to state anything for the. >> record my name? No. Did you want to say anything else for the record? Well, we took a vote going to explain that at first um there was we inherited the the plan. >> with the back. >> the parking being in the back so that's why it took so long to comply. Right. But you. >> guys probably already made your decision before we could make. >> a case. So. >> it's it is what. >> it is. I mean. >> I mean. >> we'll still listen good evening everyone good evening. So just to give a little bit of background as we were trying to sort the violation out and figuring out everything, there was a lot of back and forth with the city because the property was registered as a t five requiring for it to have parking in the back and which was nowhere to be found which was impossible. Um also all of the properties in the. Vicinities they're essentially the same way. Um they also had stricter requirements for green areas which we tried to comply. Uh initially we started reacting to all of the city comments as the way they were saying it until we realized that there was an issue and once we realized the issue, every permit we had to open in and figure out what the city we had to go through the inspector, through the supervisor everyone had to get acclimated to the fact that the the way it's registered in the city caused an issue. So all of the violations every time we had to do that every single department reviewer it was the same thing over and over again. So this is why it kind of extended the process. Um but at the end of the day we were able to find finally with public works the same thing we were able to to get to the bottom of it. So this is why it took a long time for us to address those those violations. Gotcha. And close out the comment before we take a vote. Are you good with anything? Any comments? No. >> okay. >> well we have a. >> motion it's been properly second all. >> those in favor I, I, I thank you. >> very much. >> okay okay. Just wait for. >> your. >> um form here. Next case is um add on number three it's a special. Appearance case number c. (202) 100-2049. >> property address 1460 southwest. Seventh street. And . >> what page. >> is that again? It's an add. >> on number three okay got it. We don't have that. >> so. >> yeah it's okay I can tell yo
