Approval of Request for Subordination of Pass-Through Payments Meeting Jul 29, 2025 - Regular Board Meeting of the Hemet Unified School District Category F. ACTION ITEMS Type Action Recommended Action Approval of Request for Subordination of Pass-Through Payments RATIONALE In 2011, the State of California enacted legislation to dissolve all local Redevelopment Agencies (RDAs) as part of a broader effort to address the state's budget crisis. RDAs had been responsible for using tax increment financing to eliminate blight and support community development. However, concerns over the diversion of property tax revenues from core services prompted the state to restructure redevelopment financing. In June 2011, Governor Jerry Brown signed ABX1 26 and ABX1 27 into law. ABX1 26 dissolved RDAs; ABX1 27 offered an alternative that allowed agencies to stay operational if they made payments to the state. In December 2011, the California Supreme Court upheld ABX1 26 in California Redevelopment Assn. v. Matosantos, and struck down ABX1 27. On February 1, 2012, all RDAs were officially dissolved. Following dissolution, successor agencies were established to manage the winding down of former RDA activities. Typically, the city or county that formed the RDA assumed this role. Successor agencies are responsible for, among other things, continuing to make payments on enforceable obligations including bonds and payments to schools. In cases where successor agencies desire to refund their existing debt, the market typically requires other taxing entities (e.g., school districts, counties, special districts) to subordinate their tax increment revenue to ensure sufficient funds are available to pay debt service. The Successor Agency to the Redevelopment Agency for the County of Riverside (“Successor Agency") is looking to refund the debt from two project areas (Mid-County Redevelopment Project Area and Desert Communities Redevelopment Project Area). Staff has reviewed the Exhibits provided by the Successor Agency, created by their tax consultant. For the District, it is critical to make sure there is enough money after paying debt service and other senior obligations to fund our annual redevelopment payments. For the Mid-County Redevelopment Project Area, the coverage is +/- 4 times the amount needed. This should be adequate to ensure the District receives its redevelopment payments. For the Desert Communities Redevelopment Project Area, the coverage jumps to +/- 7.6 times the amount needed. This should be more than adequate to ensure the District receives its redevelopment payments. Per Health and Safety Code 34177.5, the Board has three (3) options: 1. Approve the request. 2. Disapprove the request – The District can only disapprove the request if it finds, based upon substantial evidence, that the Successor Agency will not be able to pay the debt payments on the proposed refunding and the statutory pass-through payments required to be paid to the District. 3. Do nothing – If the Board fails to approve or disapprove the request in 45 days after receipt of the request, the request shall be deemed approved and shall be final and conclusive. The 45th day for this request is August 9, 2025. Staff recommends the Board approve the subordination request and direct the Deputy Superintendent, Business Services to execute the subordination request and submit it to the Successor Agency. Fiscal Impact: Although there is no fiscal impact anticipated, all county project areas accounted for about 10-15% of the redevelopment revenue HSUD received in 2024-2025. Total revenue received was $6,531,565. The payments from the county will terminate as follows: Desert Communities Redevelopment Project Area • Payments terminate in 2028-29 Mid-County Redevelopment Project Area • Payments terminate in 2035-36 Submitted by: Darrin Watters Deputy Superintendent, Business Services File Attachments B3a Hemet Unified School District_subordination request.pdf (211 KB) Motion & Voting Approval of Request for Subordination of Pass-Through Payments Motion by Stacey Bailey, second by Ross Valenzuela. ACTION ITEMS Type Action Recommended Action Approval of Elementary School Attendance Boundary Change Effective July 1, 2026 RATIONALE Business Services requests approval of the boundary change for Cawston Elementary School, Harmony Elementary School, Winchester Elementary School, Rancho Viejo Middle School, Diamond Valley Middle School, West Valley High School, and Tahquitz High School, effective July 1, 2026. With the projected opening of Pleasant Valley Elementary School for the 2026-27 school year, school attendance boundaries need to be adjusted. It is also proposed to realign the high school and middle school boundaries so that students will remain together as they progress through the schools. There is currently one student residing in the affected area who will be graduated by the time the proposed change takes place. Two proposed boundary options were provided for public review and comment. On May 14, 2025 and May 21, 2025, a community open house was held to inform parents and guardians of the proposal and solicit feedback through June 4, 2025 regarding the changes. Due to a low response, more outreach occurred and the public comment response window was extended until July 18, 2025. All information, including a public comment link, have been made available on the District’s webpage. Staff recommends approval of Option 2.
