And I'm here in my role PRESIDENT Peddling for Safety, which is a non-profit arm of the North Florida Bicycle Club. North Florida Bicycle Club has over 1000 members who are very familiar with bicycle and pedestrian safety issues in Duval County. They all right. We all right. Thousands of miles of year. I don't come myself. And number on way, but way behind the rest of them. We're here in support of the general objectives of of the council bill. 5.70, regarding the regulation of electric bicycles. We understand there's been mix explosive increase in sales of electric bicycles, and not surprisingly bike injuries and deaths are rising, especially a young among young or inexperienced riders. >> Children whose parents by illegal overpowered bicycles. And other electric vehicles with throttles are likely to account for many of these additional serious injuries and deaths. Unpredictable movements cycling without helmets, distracted bicycling and ignorance are Disregard of traffic laws are also to blame. We strongly support any plan that would provide additional training for children use bicycles and electric bikes. Please note that Nassau County School Board has implemented a remedial traffic law course for repeat violator. You. There's our position that children who are too young to hold a driver's license under 15 should not be authorized to operate motorized bikes in motos or e-scooters in Duval County. We support setting speed limits on sidewalks, consistent with state statutes and comparable speed limits that are in effect in surrounding counties. Please note that the prevailing speed limit on trails and Nassau counties 10 miles an hour. Finally to better provide for the safe operation of electric bicycles and Duval County pedaling for safety and the North Florida Bicycle Club strongly support the planning and construction of separated bike lanes and other roadway features that better provide for conductivity. There are too many bicycle friendly features here. The tender stop seemingly in the middle of nowhere. Legal e-bikes operated by responsible adult should not be restricted or prohibited when the problems associated with their operation or due to other causes. Thank you. All right. Thank you. Actually, this was someone. >> Next will go to our we've got the supplemental. She the show's the order. That will be going the first time will take up be on Page 6. Item number 8, 2026, 0, 5, 1, 7, and motion on the bill. We have a motion a second on the bill is MISTER Hulu here. Come on down and present to us your desire to be on on construction trade board and you'll be given 3 minutes, sir. Well, good morning, everybody. My name is >> 37 years old. I'm here to talk about nomination qualify. More. You're to sorry your address, too. I just moved that. 36, 57. Trejo. Trail Cove, Cho covid that we as a 3, 2, 2, 7, 7, Thanks. I about that. I just moved recently just this weekend. A number, you know, moving. It's a little hectic. Some here to talk about nomination the reasons why I fit in well fitted for this position has you know, I first and foremost, a veteran. I serve my country with United States Navy and I'm here to also serve my city. This was my last station a port. I was with uss Way City. And fell in love with the The city has only given me great things. Here to find a way to give back. I I 4 different companies here in Jacksonville cleaning plumbing, air conditioning. And electrical. They'll start with essential. Also starting small real estate portfolio. So as you can rooted in this and the Welcome I do want to speak a little bit behalf of Mister Terry Call. Well, that was just here this case. It is a very unfortunate. Event to happen. There's a few things that, you know he He missed out are left out probably on purpose. But the recent it is justice. It is just unfortunate. What just happened around I have spoken with mother personally. And, you know, fortunately, MISTER Caldwell has decided to go into a rampage of Macean throughout all different platforms. I We end up but doing the installation through a home warranty. I don't know if you guys are familiar with home warranties or not, but with contractor, some home warranties is very difficult. Process. That a lot of restrictions, you know, just due to finances. But nevertheless, he is absolutely correct. We in that but performing the job without a permit at the beginning. We were in the impression that the home warranty was going to pull the permit. He is. He was one of our one of our first installations under home warranty. So we were not particularly familiar with the procedure later on. We end up pulling the permit. We end paying the fines and then once it was all cleared, we end up in moving forward with the process of installing and get it inspected and everything like that back in and to the permitting. As you can see, the insulation was successful. Sorry, it was successful in time. Anything else you want to? Know it's a I got my 3 minutes up. Sorry. Think >> I've got a couple members in the queue go to Rovers. >> Thank you, MR. Chair through chair. Sir, how long have you been in business about 4 years now? 4 Is this the only complaint that you had? And yes, frontier level of service? Yes, And this was about 2 to 3 years ago. Through the chair. Did I hear you correctly saying that you work toward a resolution? The resolution? Honestly we haven't had one just yet. We are having to figure it out with with the actual person that we made the contract with which is I Betty Jo Cowell. It's his mother she is the one that we have talked to directly. And I have a given her the you know, I will take care of everything. I just need MR. Cowell Terry Kabul to be out of our way. We have had some altercations before by getting our inspector for the city kicked out from the from from the for the home. I have had my crew kicked out from the home well, MR. Khalil has. A little short temper say, you know, I don't have any felonies my record and you can find But, you Mark about the through the chair. How soon do you see this resolution coming in to buy what I would like to say within a month? Because I know Caldwell is in hospice. I know she has a temporary ac unit in the room. I just would like to be able to conclude that we're not going to have any altercations whatsoever. It can see MR. Cowell. It's it's been a little difficult be honest with you. So you're telling this committee today within a month? Yes, sir. 2 more What is the size of customer base? >> I'm sorry. The size of your customer base out many customers to you. You think within the companies that you've created that you've made. Got hundreds. And it's I mean, we messed we mostly focus 60% commercial. >> And 40% residential. And then I have worked in all other Florida. You know, successfully install anything when it came down to any kind of trace that we perform. So just happens to be my last. My family. >> One So you said. >> This is your the only outstanding complaint. If I pull you up on the Better Business Bureau. Yes, it is. That the only thing I'm going Yes. Thank you, MR. Chair. Thank you, sir. And the reason I ask these questions, so I appreciate the fact that you're putting yourself forward. But the reality is this, that you're putting yourself in a position where your character has to be somewhat impeccable. Because you're putting yourself in a position of oversight of those within the industry. And if there's any evidence that there's something wrong, I think it would be puts you in that position so far. You have satisfied my questions this morning. We'll see how it goes. Thank you for coming forward. Thank you, MISTER Thank Councilmember part Murray. Thank you. Chair can come back. Please. Good morning. Good morning. I'm sorry, ma'am. >> That's So you didn't my questions in your dialogue with Councilmember Morrow. So warning about volunteer service. Do you volunteer to have do you into or any of your employees volunteer in the community? Have you provided light work with any like have a Jax any of the other entities that provide to is or build homes. Have you want to volunteer record and are essential electric? >> We have actually a project for Habitat for Humanity. This was about 2. I want to say 2 and a half years haven't had the pleasure to go back into. Actually. It was a great experience. But having had a I have had the the the the moment actually go back and actually the something else. >> So 2 so 2, you have a d what about your employees? >> My employees haven't had any volunteer initially. They just go with the hall. You know, pass I go kind of So, but but I mean, the volunteer will happen to my business and myself and not be the one that gives up the time for it. And then of course, I will pay them accordingly to what it is. >> Thank you. Thank you. Chair. All right. Thank I have no other speakers in the queue. I. Appreciate MR. Lawyer are coming forward and put yourself. >> MISTER Game and have a just one minute. Just to kind of like put it out there because I know the gentleman brought up the Better Business Bureau. Sure, just just a quick Mr. Couple try sue us through the city. Obviously the find report as to the business with Better Business Bureau. And of course, you know, if the other complaints and the platforms social media platforms, the once Better Business Bureau never know everything that's happened has came clear just by having a conversation with them and obviously no basis of of the pursue of. Of his base of the complaint. Things put it out there. >> And as I was saying, you know, appreciate you coming forward. Put up for volunteer commend you on service to the country but moving in regards to this position. I have received information from the construction trades qualify Board and code enforcement with their concerns and MR. Bull in your own. Okay. You want to go ahead speak before. Going further. Thank you, MR. Up for a long, opportunity I wanted actually threw the chair to MR. Dennis, if you could speak to decision on the part of the ministration to forward. >> And you're and your comments with respect to the concerns that were raised today. >> each year to council Boylan, MR. Julio came through the actual the construction trade port refer MR. Julio to us. He met all of the the requirements complaint didn't come until later. And so I had conversation with the CHAIRMAN Gay last week and also with MISTER Julio, because if there's point in, you know, Tony, understand been construction industry and I've shared with the CHAIRMAN That, you know, of hundreds of customers, you're going to have one customer, the complete. You can't make all of them happy. CHAIRMAN Myself share with CHAIRMAN CHAIRMAN Gay to allow this to Julio to come and explain his case and then it'll be up to this committee, whether, you know, his explanation is good enough to move forward. Administration feels confident you know, that he could serve and serve in a very objective way in this And you know, the administration, we support move for MISTER Julio and seeing that he put on the record that he would have this issue rectified 30 days. We You know, if you also and approve him, you know, we will. You notice following make sure that that you know, he follows up with his commitment, if not, you know, move forward to bring someone else for this position. >> okay to let me the q light. Nothing in so let me Council member will end. >> Thank you, CHAIRMAN Through the to the committee. So yeah, this one was more talking with our be. So again, just reviewing the resume like I did. I see someone who you all know how I feel about veteran entrepreneurship. I seen a veteran that got out and like my 2 grandfathers state here, start a small business in Jacksonville. That being said, I threw the chair to MR. Dennis and I'm just throwing this out there for the committee. Is this a time sensitive position to fill? Because if the only outstanding issue is the fact are waiting to resolve something which we've kind of heard, both sides of the stories. Sounds like the bbb already said there's nothing to it. Sounds like there's still some work done to tie it up. I just threw out there if it's not a time sensitive position rather than approving it now, is there an option to where we get the update in 30 days rather we approve someone to a board and then find out that it was even bigger issue than we thought. Now we have someone out there on a city pointed board with a really big issue following him around. >> Of through the chair to COUNCILMAN Lane and it's not a time sensitive, but it is a time sensitive and there's some additional information that I like to share with the committee, but prefer to share with the committee members individually >> and so I've been I've shared with ethics. There's you know, there's there's some issues there. So so again, as far as as far as nominee, theirs, there is a, you know, we support You know, I would just ask if you all would approve him on today and and allow me to meet me with each member. >> At chair, MISTER Dennis. If there's something else to share with us one on one night. I wish that would have happened prior to this. I do not think I got a request to talk about the specific candidate other than just being said, his resume and everything. So chair, that's just where it sounds like there's a lot more to discuss. Announcer doses saying potentially a one-on-one setting. So I'm at the point I would prefer not to vote today if we do based on what I've seen, I will support the Navy veteran that got out and start a small business here in Jacksonville. >> All right. Thank you. Let me go to Doctor Salem. >> I'm threw the chair to the issue has nothing to do with this. Gentleman has to do now put out has to do with the CHAIRMAN Of the board to see who he's replacing, who has been on the on the board since 2011. And every time we go to put it, someone up, make seems like there's a concerted effort between the taking Richter in the the CHAIRMAN To find something on various nominees. I didn't want to put over here but has nothing to do with this gentleman here has something to do with the makeup of the board. And so and so, yeah, just leave that on the record not to get into any more detail. >> And to the that that really has no bearing This this of what we're voting on here today really. Understand you want to bring that to the committee, but it has no bearing on what we're voting on the day. We're looking at a candidate based on his qualifications. Merit Anderson community responsibility. So I just I just want to put that out there as well. So now let me go to doctor Sale. Thank you, chair. I agree with everything Councilmember Lane and said, but its last sentence. >> And that I would not be comfortable supporting him today with what I've heard, I would prefer to wait the 30 days where he's committed to getting this resolved and then bringing back and then it's very clean at that point. I don't want to appoint somebody and then have a problem and then have to deal with that. That if it doesn't appear to be an emergency or extremely time sensitive. That would appear to be the prudent thing to do is different. MISTER Chair would be 2 different 30 days. 45 days, whatever it is, giving ample time to resolve it and then come back. Thank you. All right. >> Thank you. Go to Councilmember Morrow. >> Thank you, MR. I'm just going to say they do to COUNCILMAN Salem's position. Obviously you're the chair. If you want to the I do believe the administration. Its true to its word when says that they will ensure that this issues result within 30 days. So that's the for me. That's a big stumbling block. If we can get also always. Appreciative of individuals who put themselves forward to a public service, especially in the in the atmosphere where and where no one wants to do anything but sit on the sideline and criticize. That's my position. >> All right. Thank you. Ella MAY back to Councilmember >> Thank you, MR. CHAIRMAN, Ashley, you can answer this question. Intended to replace Clifford Snow. Is he not the CHAIRMAN Of CHAIRMAN Mr distances. Threw the chair the council. That is correct. >> So it does have some relevance, the conversation make that's clear. >> Okay. Let me go Councilmember Pittman. And to a chair. Can you tell me how many members are on that board? Threw the chair to COUNCILMAN Pittman is 15 members on board. How many, 15, if teens, and is he the only one being replaced at this time? >> We do have another appointee that's this year today for your confirmation. Okay. I would just say for me, for my comfort. >> As well. I'd rather for him to get all of his issues. That our concerns. So we want to be back here again. And I think for you, you'll have feel better about what's going on. Not thanking some things, you know, over your head. I want to say, I do appreciate you bringing forth. They're coming for and willing to serve. At at this point with so much going on and we want to make sure that you are the right candidate and that you will follow up. So give you those 30 days to be able to do that. And as I said, it's clean and we don't have to worry about it. I just a quick sentence So because of the home warranty that we have. >> You know, we work through. We were a 3rd party to them. The equipment was provided by the home warranty. This is why hesitation has been has lasted this long has been because we do. We did not provide the equipment. We were only hired to install the unit. That's why MR. Cole saying You know, that they couldn't it's not working. Unfortunately, sometimes is faulty. Sometimes things happen I just wanted just put it out there. Do you think within 30 days that's enough time for uta. >> Clear this. The compressors bad it takes about 45 minutes to change a compressor. It's under warranty. We just took the loops that we're running into is just making sure that wanted to give us the correct part for it. But I'm very confident that once we have the part on hand, we can replace a right away. As we don't have any issues. You the home and I'm not trying you know, get deep into it, course. But I just want to make sure you have enough time so you can combat. >> And we can. We can vote on. All right. Thank you. All right. Thank you. Let me go to visiting Councilmember Carlucci. >> Thank MARCH era. Not sure sure you've got the buddy, but I'm not a member. The committee. So I don't have a vote. Yes, sir. I've been in business 45 years and I've run into a happy customer time or 2. I did my very best there was a misunderstanding. No matter what you do yeah. Doesn't saying. That. That can it worked out easily. I've always found it difficult to say. I have resolved in 30 days because that sounds like a volatile situation when you have a loved one and health and hospice. And then there's lot of emotions involved. But I to me chair, I've been climb to vote for him. And try to find out a little bit more about it until council meeting. Because anybody has been in business. Or not for profit. There are times when you have a customer that MAY not be happy. They MAY be prompted at a time of opportunity for the person. They're not happy with leverage that. So I suspect there's probably a few of us up here that might even have an unhappy constituent. But we still got elected. Thinking out loud. Yes, I'd vote for this gentleman about was a. I was privileged. Did not earn enough to be on rules committee, but I do have a boat. But that's just my way of thinking. And none of us up here. Perfect. And as a businessman, 45 and a half years now. If I was held hostage, every unhappy customer I've ever had. Although Murray reviews pretty good on Google Kay check. There is one is mighty unhappy with me on there. And one thing I could do to make her happy cause I couldn't. I vote for this gentleman. He seems like he's got the right heart. Got the right intentions I gave him a chance. That's just my way Thank you. And I like recognize vice PRESIDENT, Joe Carlucci jaundice and Councilmember Lusso has joined us as well. >> Alright, I don't have any other speakers in the queue as I was saying before MR. Are you the actual qualifying agent of your company? Yes, sir. And that's a state state license. >> And it's a register license registered yes okay. And with that licensed, did you have to take a a business? The exam? Yes, well, absolutely. So in that business exam, it clearly specifies that if you are doing the work you yourself as a licensed contractor responsible for pulling permits. So there's no other. I was working for somebody else who work or somebody else. You are the one that's required to pull the permits. So you say you've done hundreds project so we go to the patient apartment. They don't have hundreds of permits in there and the not a practice of years to go to war, to work without a permit. >> I don't I don't even do home warranties anymore because of that. That specific. Event that happened with MISS A column. I know better. I learned a lot and unfortunately what I said. This was in that unfortunate. And only here in the city of Jacksonville, you can see my businesses and the permits being pulled. You can see all throughout the state. Because I have I have done represent city through every county that I have more time work with. Most recent one bus in pace, Florida. >> And so what you bringing to the committees. But, you know, awareness here is that. >> You hasn't exams and you're licensed. >> Based on following the rules on the call the requirements of the local jurisdiction. And so with that, that that's where. Our local. Code enforcement. Contacted me which they never do. And the this is such a issue that they are not in support of not construction trade qualify more but I code enforcement. That's that's where I've got the biggest I would like to pauses all different for 30 45 days and where where this can go. See if you can get with code enforcement to make make amends to be able to get. Let's get passes >> and Jessica mask, what what should I be doing? Tours code enforcement. I know that I went to them when this happened. Another were fines and things would lift it. But I don't know. What are the other steps that we should I should be taking tours court inforcement. >> With the the >> this issue of waters and is not resolved. >> So you're saying that the has I defy has been paid. Even spoke with the on talking about the the actual ward, the repair of >> this hole is the unresolved. Every pair part of obviously has not been recent off. It. But I mean, when it comes to the penalty it was fined and and everything. All the fisa court where paid. And as far as I understood, even with the attorney general, the contact me about this, things were already concluded because this happened a while back. This isn't this is not something recent besides that. Have completed successfully finished and unexpected work and that and So. That has I mean, the unit has been installed and has has part of permittee successfully finalize. >> Okay. We'll break. Get given clear on this is not you finish the work, but it's not finished. >> a different work has finished. The only problem is the compressor going bad. This is this is where the issue happens as I can look So that's what and that the equipment that was provided to me, not something that I have purchased or guaranteed. >> And so what what challenged with here now is we're getting into a construction trade. >> Issue that really needs to be resolved before it comes to this. This committee. Mike, my concern is that you've been in business for For 4 years. You know, we we really need to make sure we've people on this board the or fully aware and understand everything is regards to that trade that are specialist in that area. So that that's that's the concern that I have. If I want to vote on it today, I would vote no, but I'm going to defer it and give us some time to see if we can get some. Resolution here to be able to move forward with that, you know, support small businesses. I want to see you succeed. I think that the best situation for us today is will be deferred it and Mr, Denison, they're working get back to me will look at moving forward with it. So appreciate you coming down today. Thank you. Next item. Thank you. That will go to this honor. Our agenda sheet here item number 9, 2026, 0, 5, 4, 5, getting to motion to withdraw. Second, I've got a motion a second to withdrawal. No speakers in the Queue Open about record your vote. MR. Dennis, can you explain the reason Mr? Doctor Salem is a in If you that accounts and Salem to the committee. >> This individual decided not to pursue the nomination because there's a financial commitment he was. So this financial commitment, which we for the Culture Council, which talked with the ethics and city boys. You're not required to give money to a particular board. And so because of he doesn't want to move forward and then being being told by the Cultural Council that he has he's obligated to give money. So he decided to step away and support the cultural Council the best way he can't professionally. Thank you. >> Ok, now the cute council over land. >> Thank you. Chair there, chair MISTER Does. Can you elaborate on that? There's a financial commitment to be on the Cultural Council board. >> There's not a financial commitment. He was told there was a financial commitment by the executive director of a culture council, which we've gotten that correct. It. And so, you know, that's the reason MISTER Tony, that he does not want to move forward. >> All Doctor, Salem. Thank you chair. Is this a financial commitment to a campaign? Threw the chair to council Salem note to the board, you know, most nonprofit boards. They have their board member, Sam Financial commitment. This particular, as you know, the culture counts squad site city. So the city of appointees, which we have 6 on this particular board. They the whole like 15 members. The coach made a decision to ask them for some type of commitment which again doesn't apply to the city appointees. And so so this particular nominees decided to step back because he could not. If I can continue. I mean, obviously that's very common for outside boards. >> To to ask for a financial commitment to to be appointed the board. I've never heard that suggestion for a city board of any type and we need to make sure that clearly squashed. >> Threw the chair to Salem at and we have. We've made it clear to the executive director MISS Diana that is inappropriate a board are not obligated or should not be asked to make a financial commitment. >> Thank you, chair. All right. Thank you go to Councilmember pavement. To the chair and to MR. Dennis, do you know if this is the first >> time that this has happened because I know over the years as as Doctor Salem say, most nonprofits, as for Contra, the go, get or give. On a board. >> Through the through the chair to counsel and Pittman. We have had multiple conversations the executive director about that. And so I'm not I'm not exactly sure by the translation did not. You know what was missed in the translation once again. But but but we of corrected, corrected that. And and as far as far I know, no board member nominee from under this administration has given a financial contribution. Okay. Thank you. >> Thank you. Let me go to Councilmember Bowl. >> Thank you. MISTER Chair. It was docked. I couldn't get out of there. You the story or the history of the Cultural Council far different than the psg Council. Cultural Council was created independent of and was contracted by the city to administer Cultural Council grants. It's not like psg and I think there is an expectation and maybe it was the language of MISS Donovan. You used that board members would be supportive of the organization has a 501, c 3 nonprofit organization that is contracted by the city to the U.S. So I just want to make sure people understand the differentiation. This is not a city board, but part of the relationship that the Cultural Council, the entity has with the city. In terms of administering the Cultural Council grants is the fact that they have opportunity for appointment and approval of the its members principal. So I I suspect and I appreciate something back from this. Hopefully Donovan makes clear and clear from my colleagues. The situation is not the same as or other quick. What's board? Because it, in fact, is not city board. >> Thank you. Right. Thank you. Let me go to council PRESIDENT Helena. Thank you, MR. CHAIRMAN, glad we're about to just withdraw this and get it out of the way. But in the meantime, Carla, if you wouldn't mind digging up. >> Or someone in otc digging up where there might be protections. There's got to be in a city board created in part or entirely by city Council and or with representative board members nominated and approved by City Council. We have to have something there that says that those board members can't have any obligation financially to that port. Otherwise, I don't want to be in the business approving So if you can find that and then maybe report to rules that a future committee where that protection exists, if it doesn't, we can figure out how to make it happen. Thanks. >> All right. Thank you. Let me go to Councilmember Morrow. Thank you, MR. Chair just a quick comment. Councilmember Boylan, thank you for the contacts. >> It has given me a different challenge. Here's that the process, these are individuals who are being nominated by the administration coming through this body to sit on this board, get paid, be independent of. And so that's where difficulties are. And so I'm Glad Council PRESIDENT Howland. It's now asking for for some clarity there because we all know that with nonprofits, bring your time, your treasure and your talents. You know, we all know that. But you should not feel if you doing. A public service work, but you still have to be committed financially to an entity, even though, again, as you describe the structure, the entity is not a city entity. So I we have heard the administration said they've made it clear perhaps it needs to be as COUNCILMAN Council, PRESIDENT Palin says established in policy and legislative for concrete clarity. So thank you. >> All right. Thank Let's go to doctor Sale. Thank you. Chair to the chair Borland. Does the Cultural Council? >> Do other. >> Grant's outside of the city's grants. The reason I bring that up and I'll give you an example. Police athletic league has abort. They except city money, but they accept a lot of outside city money. And I know board members that go on pow are expected to make a contribution to pow. And I'm very comfortable with that. But if if the entity is purely doing city grant only I think there is a concern there. >> Through CHAIRMAN's primate actually. They don't. I don't believe they do other grants, but they spend a lot of resources and advocating and promoting the arts in our communities. So the that they have expended certain expenses beyond the administration of the grants, the csu program. So yes, they do raise other money for the purpose supporting arts as a whole and promoting the art in our community. That helps. Ok, thank you. Thank you, everyone. So I've got a motion MR. Dennis. >> Threw the chair to council Salem. We do not have any appointments. There no mayoral appointments to the police athletic league. So I'm not exactly sure how their board members are a but yeah, I think it's, you know, inappropriate for a board member, a nominee to come through this body to be on a city board or commission to then turn around to to be required for a financial commitment to that you know, that's the position and I'm pretty sure her Carla kind of mentioned that she thinks is important into a look it up. But that's very inappropriate. >> Okay. No other speakers on the queue. So I've got a motion a second on the bill to withdrawal. Open the ballots, record your vote. >> 8 yeas, 0 nays. >> By your actions to prove the withdrawal of 2026, 0, 5, 4, fa. So now takes us to our 3rd. I do. Go to page number 10 item, number 14. 2026, 0, 6, 3, 0, emotion on the bill. I've got a motion in a second wood. MR. Takes us to our next item the agenda. We're going go to page 9 of Will. 2026, 0, 5, 9, 0, could get a motion on the amendment. Given I've got a motion a second on the amendment. MISTER Chair. >> Through this year to the committee, the amendment will strike some additional language that needs to be removed from the code in order to comply with the Florida statutes. All right. Thank you. >> PRESIDENT, how long are you on the amendment the bill? under Ms Murray on the amendment. No, I haven't amendment for the bill. Okay. Let me go ahead and take care of this amendment all in favor. The amendment say I any opposed like was none amendment cares, MR. Hart, Maria, you're recognized. >> Thank you, chair. So you have a handout. It is in pink. I think that's appropriate. So very simply at the end of this, this bill, it states that the mayor and it says like he will. I think it's fitting that we at the language or she. And it's indicates where it should be added to the bill. >> All right. I've got a motion a second on the climber Amendment. Council. PRESIDENT >> Thank you. I support blunt amendment. I would just want to make sure that Michelle d c is happy with that because they drafted this whole Amendment to be. To ensure that the city remaining compliant presumptive Florida statutes and not avoid getting lawsuit by Florida. Kerry. The chair, the council PRESIDENT, Howland. >> to see is fine with this amendment. It just changes how we have heard of the mayor and I think it's a prudent amendment. But thank you. >> All right. Thank you. Let me go to Councilmember Morrow. Thank you, MR. Chair. I'm going to support the amendment, but I think it's in. >> And I'm not an English major, but usually when he is written, the inference is for he, she and everybody. So. >> Right in this court, Murray, I promise you. I'm not going to And, you know, the chair to Councilmember Morrow, you are right. And that is where those of us who actually understand grammar and perhaps studied it. But in this day and age where the word. >> Woman support. It's been has been announced. Women and that's the singular. I think that it's important to just add that language. Thank you, chair. >> All right. Thank sale. >> Thank you, chair. I just want to make it clear. I'm wearing pink because we are installing a female to the stacks will city COUNCILMAN In hour. So that's the purpose of my Thank you. Thank you. Allred. I've got >> motion is second on the Clark, Maria man all in favor say Aye in a pose. Mike was none. The motion mimic carriers. We can roll them up into one amendment. >> And can't get a motion in a second on the bill as amended second, I've got a motion second on the bill as amended council PRESIDENT Helena, thank you, MR. Tyrrell make this quick. Everybody received a letter from Florida Kerry back in the first week of JULY afforded by one-way communication. >> About a week ago. But the letter notes various places in our code where we potentially violate the state of Florida's preemptive statute, which renders void local laws regulating gun ownership. Noted about 7 instances in our code. And I juicy to take a look at it and you guys have been provided with Oji Seas response. But otc says indeed each of the side of provisions does, in fact violate Florida's preemptive statute. And it recommended the simplest way to avoid all such liability in the future is an ordinance which removes avoid provisions. They drafted that ordinance for me. That's what you have here. It's just been once by the auditors and second with murder as Clerk Mary, which I might say she could have had a an even stronger amendment. Just replacing he was she and we'll see what would have done. But she that to their. So if anyone has any MR. Granite is here. And I MISS Shell could answer them to thank you. >> All right. Let me go to Councilmember >> Thank you, MR. Chair. I suspect on a fully expect that we I will support this bill. However, just a comment and a question. The comments, just another strike against home rule state of Florida imposing upon a Second Amendment was standing. And notwithstanding rather also, you know, the question is when does comments cut sense come into play? So it's a were allowed now people out now to carry guns that cause quote on, quote, serious injury into our port. It the craziness just baffles me. Thank you. All right. No other Nick, you got a motion a second on the bill as amended. >> And I want to thank MISS Court Murray for her amendment for us that are not English majors. With that open about record your 0 nays by you're actually recruit Twenty-twenty 6, 0, 5, 9, 0, Next item was going do was. PRESIDENT, but he used it the way. Oh, go ahead and go to. Next time will be number 15 item number 15 on Page 11. MR. So thank you, chair. Just appreciate based on the item that we have here. It shows that item number 7 is next on the agenda. >> Which happens to be my bill. And it's I think a really quick one win. I'm going to that one 0st. Okay. I was going by my yellow sheet, but we we can accommodate. So let's go to item number 7 on Page 5 from MR. Palou >> They get there. >> item number 7 2026, 0, 3, 7, 6, motion on the sub to >> We got motion. And second, I've got a motion a second on the subject, too. The scare. >> Threw the chair to the committee. This is a technical substitute in working gc. There are some formatting errors, Co titles and scrivener's errors that needed to be corrected just more efficient to handle them. They're a substitute rather than amendment. >> All right. So do need to get motion a second on the substitute? Voice vote. Okay, MR. Bowen on the substitute. All in favor of a substitute any opposed like was none substitute care's going. Get a motion on the bill. As that we have motion second on the bill Marble. >> Thank you, MR. Chair there the chair is probably Could you give me a quick thumbnail? i'm just. I don't understand. This bill really, really aren't is itself. Summer doesn't really offer any kind of insight. What specifically are does this bill do? A couple of sentences. >> Threw the chair to Councilmember Boylan believe we have the attorney that drive to this bill. MISTER Harvey from Ogc who could probably give you a good synopsis of it. I would defer to him. >> Good morning. I am not the attorney who drafted That was my predecessor. Dylan. Buying go. But essentially what this bill does is puts us in conformity with state law, their ordinances that we excuse me certain parts of our code that by late that home occupancy law that was recently passed. So this is just putting us compliance with the state. New site for me that. You're a couple of examples of what >> that means. Sure. So, for example, in our Springville overlay, there is a bunch there are a bunch of cold regulations that we have that are contrary to what the state would allow. So they restrict certain things that the state does not restrict in home occupation. So, for example, they restrict what types home occupations you're allowed to have to use is restrict the location and things like that. Whereas new home occupation law that came through to Florida basically says that there shall be no regulation by home by any municipality on those types of uses. >> Threw the chair with statutes that recently adopted by the legislature that actually went into effect last last year. And we were this was if you look back at the bill, this was introduced back in MAY. So we're just now catching up to clean this up. But it was already enacted back in 2024. For 2025, I believe yet another example of impacting home rule. >> No other speakers in the queue got a motion. A second on the bill. A substitute open about record your vote. >> a yeas, 0 nays. >> But you're actually recruit Twenty-twenty 0, 3, 7, 6, Thank you, MR. Putin flew south for letting us get you out of the way. All right. The next item will go to will be item number 15 on Page 11. >> Getting to motion on 2026, 0, 6, 3, 5, Amendment mend. So got a motion second on the Amendment. MISTER Chair. >> Threw the chair to the committee. The amendment will correct the council district for this roadway to reflect council district 5. We'll revise the on file documents to remove documents that are not relevant to this bill includes some documents that were missing. We'll correct the number of affected properties to 5 incorrect. Some scrivener's errors with the bill. >> All right. No speakers on the amendment all in favor of amendment say Aye. Aye, any oppose like was known mimic cares. Motion. Second on the bill as amended. I've got a motion a second on the bill as ended. Councilmember >> Thank you, chair through the chair. I guess my question go to Councilmember Matt Curley. Question is it's in council district 4 and between introduce Ersan co-sponsors, the District Council members not there says want to make sure the district Council member is aware and good with this renaming threw the chair 2 COUNCILMAN Land. It shows that it's introduced by the District Council. Kohut reduced by myself and the District Council person U.S. District 5, correct. It's the district board. >> In the chair to the committee, that was one of things improved in the amendment that to correct the council district district 5. >> Threw the chair. Thank you, Michelle. Okay. That was my confusion right there at the top of said District for now. I said we've that was part of the amendment. We just approved. So I have no questions. No. >> All right. No other speakers in the queue. Let me go to Councilmember Bowl. Keep that I'd like to be a co-sponsor, please. All right. Thank you. Councilmember Morrow. Thank you, MR. Chairs MISS Paula Care. Some questions were raised about the waiver. I'm going to support the legislation to have school through my professional career. I can tell you what he's done. >> For this community is a measurable. Some questions were raised about the waiver of the 5 years. The concern was being consistent. Consistent making an application to get every. Policy that comes forth requesting renaming. Are you satisfied with this going forward? >> Cherry p# # Office of General Counsel. Yes, I am satisfied we have had waivers similar to this waiver where the the honoree is still alive. This is not a new waiver. We've done it in the past. So I'm satisfied with it. >> And I thank you for sharing that because the in my short tenure here of Saturday on of also heard significant pushback on other applicants. And and this body agreed then and that night that so. You know, I just want to be sure what the position is from the office. And again stated I'm going to support it because familiar with the Haskell and and the work he's done in this community. >> All right. Thank you them to go to Councilmember Pittman. So we'd like to be added to the bill. Please. All right. Thank you. All right. Let me go visit in councilmember, but past PRESIDENT Carlucci. >> The on past temps to name streets after folks. I have always voted for them just for the record. The I understand the original intent of the 5 year moratorium and that goes back to days. Pretty consolidation. I get it. Understand that. I know have happened better than anybody here. Does. But I like to sometimes honor those who are still able to enjoy that. This is, by the way, kind of tricky because we're there's a the idea is to keep this somewhat surprise. The recipient of this honor. And so we don't ever know what media might do with things. But but that's the intent. So and you're going comings and goings you can kind of keep that consideration of conversations. David Doctor is one of my. Wonderful friends in life. And I he would like this to be a surprise. So that. All right. Thank you. Want to say thank you. >> I have no other speakers in the queue. Just like to reference that we did previously in my district for MR. Jd Thompson. And so I'm supportive of it. So I've got a motion is second on the bill as amended U.S. Open about record your vote. >> 7 yeas, 0 nays. >> By your actions approved 2026, 0, 6, 3, I would like to go ahead in turn to Page 7 and go ahead and take up item number while we get jso here and we get them. Out of the way. Michael work. Item number 10, 2026, 0, 5, 7, 0, emotional. The bill. I've got motion a second on the bill MR. Bull. >> Thank you, MR. Actually, I want offer an amendment. In advance of that and you have a packet in front of you. Suggest initially a substitute. But in order for us to help you and understanding what the amendments are following. The red line of the ordinance. There is a second page. That delineates all 8 changes. We're me making to the bill. So you take it must take a look at that. I also wanted to then show with you. Hand out a one-page that there was actually a 41 page report that was done by the beaches with respect to e-bikes northward, to as part of that process as well. And then lastly, there is a one sheet. They're talking about something that but published by Wilson Children's Hospital. Where then dissipate a significant increase. Incidents, traumatic bike injuries as they call them by the end of this calendar year. Quick story about this bill. I was back in OCTOBER when I first was approached by a couple of different constituents suggesting that we need something done. And I look at this really is a starting point in the conversation. We stood down on that when Senate Bill State Senate bill 382, I believe was called. It was vetoed by the governor and then stepped our efforts up to introduce this bill shortly thereafter. We made some effort to take a look at what the state bill look like and what our bill look like and have some comparisons. They're the same. Actually, there is a little more stringent in terms of the speed limit than ours. On hosted a notice me which a couple of my colleagues joined. During the course of that conversation. I should it in advance of that and met with both the plane department and the chief of the Bike Safety. Also with ogc and a few others. MAY change is projected changes to the bill that you just read. Following. I met with Chief Strong Co and Commander Damone shortly thereafter. They made it clear to me they would not or could not support either the speed limit. Of 10, which we had initially at that time and or the age limit. At the meeting on the 17th. We let people know that we were going to strike the age limit from the built-in campana recognition of the concern raised by jso. However, the speed limit, although there are some very ones different points and this process. There is we felt very strongly that 28 miles per hour on a sidewalk or a shared pathway simply was not appropriate and not a safe or secure way to operate. So we wanted to pose speed limit. There is a state statute that limits. If a city or municipality juices take a pin or it's like this one that the most we can put in terms of the speed limit on the high end. For sidewalks and sidewalk areas is 15 miles per hour. So we've adjusted this bill to reflect a 15, 15 mile an hour. Speed limit. And chief Frank, I'm sure will probably want to speak to this, but he made pretty clear. And I phone conversation over the weekend with Tyler. They just felt it was too difficult to enforce. My answer to that question, is this really really I think its having a 15 mile an hour speed limit on a sidewalk and our sons share pathway is actually easier enforce them. 28. Don't expect them to put radar guns on people like victims and family members say understand it's 15 miles an hour. So if you go 16, 17, 20. You know, maybe you're going faster than 20 police officer could see by by simple. I that this person as well of the conceding the 15 mile an hour speed limit. So the bill as it's drafted right now as substitute, if you will, not as amended, does speak those issues. And I encourage your support of it. As I mentioned to the folks that jso of all the bills I've introduced of the course of my 7 plus years on the council. This one has gotten the most important across the board and support. I might add so and I think it's a good starting point in this process. It doesn't incorporate an education component. I wish it did because we don't have the wherewithal to do that. We've got to start someplace with putting some kind of reasonable expectations of those who operate e-bikes in our communities. And for a lot of folks, it doesn't mean. We're in their ability to do so. If the young man on a bike with a helmet on want to go. 28 miles an doing the road. Just can't do it on the sidewalk. In the context of this bill. So I encourage or support of this Bill. I appreciate the conversation we're going to have about it. Thank you, MR. Chair the same. So that's why moving the substitute got a motion a second on the subject to I'm sorry. It's not. It's often the Amendment Amendment. Yes. This Michelle. >> They're the chair to council rebel. And I think be better taking up as a substitute. It's a comprehensive. I agree. That was not the advice that Milo Corey had received from. MR. 5 but I I would I would agree should be a substitute offer. The bill as the red line bill as a substitute. >> Okay. Okay. I've got a motion a second on the substitute. >> And >> MR. Lennon, are you on the substitute to the chair? Yes, some of us have I think my questions apply to all that. So if term MR. Boylan a thank you for all this information. I apologize for not being at the notice meeting. So I'm a little bit behind us by do have a number of questions. First, I'm glad you put this year use path in here, but one of my concerns is people getting to and from you enough. So you have a lot of complexes on Saint Johns Bluff as well as Kiernan. And right now they go from sidewalk to shared use path back down the sidewalk. And plus, there's construction going on or actually building a shared use path to go all the way. 3 unf to connect the town centre in Kern bicyclists. I got to believe go fast and 15 miles per hour. And the shared use path. So that is where the questions I had. Why would you limit the speed to something power that potentially is going to be less than what non powered is going to be going by. You. The second question, signage. We got speed limit signs everywhere. Is there some he's over. It costs. This will be to have to put signs out there and let me know if you want to answer these one by one. If you want to answer the science question. >> All Take the first question. We were very person purposeful and putting the shared pathways in there. It can come out that's an issue for some of my colleagues with respect to design. It is something we talk about, the pain department, cetera. Yes, there will be a cost associated with it. There's nothing right now. Quite honestly, that speaks to a vehicle to to address that. But it is a matter. We've got to start someplace. And this is where I'm starting this process and I have to sit down, figure out what they're going to cause at some point in time to put up those kinds speed limit signs and you know, so that's a starting point in this 2 processes. >> So in a chair MR. Boiler. That immediate concern that this is a perfect example of approving something before know what the cost Because I just think of all the sidewalks we did a project the other year, the inventory, all the sidewalks in the city of forget how many miles. I think it's something thousands of miles. So so that's another one that concerns I have

Thank you. All right. Thank you. But I just w
