Mayor Green shared with everyone he and Mrs. Odom went to Marion County and met with Commissioner Kathy Bryant, Mounir Bouyounes, Angel Roussel and Jim Couillard. He commented it was a very productive meeting. He explained they discussed the financial obligations regarding Blue Run Park and the importance of the City' s commitment to funding road repairs. He said he inquired if they would be willing to renegotiate the Blue Run Park

City Council Workshop August 05, 2024 Page 3 of 11 Operational Agreement. He announced the County team offered to assume control of the park with the understanding they would follow the City' s Ordinances. He advised Council the County has similar agreements with other municipalities. He invited Commissioner Bryant and Mr. Couillard to speak on the topic. Commissioner Bryant agreed the meeting went well and she understands the need to make our dollars stretch. She acknowledged the City and County are both growing by leaps and bounds and said she believes making this change is the best thing the City can do. She explained as Councils change so do priorities, which can make things harder to manage. She advised Council Mr. Couillard, and his team have always done a phenomenal job partnering with the municipalities and they are here to help. She stated it would be a lot easier for everyone if there was only one entity responsible for the management of the park. Councilwoman Hanchar asked if the Council chose to implement another Ordinance, would they be required to consult with the County. Commissioner Bryant replied the biggest Ordinance issue she can foresee would be swimming at the ramp. She said if the City chose to make changes, the County would appreciate coordination. She added they would appreciate a conversation on anything which would change the operation of the park, but they have no authority over what we choose to do. Councilman Lehmann spoke about the County making money through the launching of tubes and kayaks at KP Hole. He asserted because the County doesn' t share the revenue, the City doesn' t have the resources to maintain Blue Run Park. He remarked if we turn the park over to them, we become just another person in line when something needs to be fixed. He said he doesn' t want to give up all our rights. Commissioner Bryant replied the City wouldn' t give up any rights because there are Ordinances in place and the County would be managing the park only. Councilman Lehmann spoke about the number of people being allowed on the river. Mr. Couillard replied they shut down an illegal tubing business operating out of KP Hole and the County has reduced the number of people they allow on the river. He explained the total reduction of people launching has been approximately 70% since 2020. He added this year they have raised their rates and will not allow an increase in the current number of patrons. Commissioner Bryant commented they need to keep in mind the County isn' t the only operation who operates a tubing operation on the river. She added they are researching ways to create a shorter trip which will reduce the number of people who end up at Blue Run Park. Vice- Mayor Inskeep stated he thinks it' s a great idea to allow the County to manage Blue Run Park. He asked what the next steps would be in the process and how to make this happen. Commissioner Bryant replied she will bring it to the Commission for discussion. She said if they agree, then they will begin working on an agreement to put this in place. Mayor Green stated he will devote as much effort as necessary to help move this forward. He said he wants people to feel welcome at the park and welcome to visit our businesses. He thanked Commissioner Bryant and Mr. Couillard for attending the meeting.

City Council Workshop August 05, 2024 Page 4 of 11 Commissioner Bryant stated Blue Run Park is an integral part of the trail system and the bathroom is important, because it affects the visitor experience. She said we need a place for people to stop and be able to meander into Dunnellon. She asserted it' s going to be great for the entire community. Council agreed to add this topic to the meeting agenda. 7. b) Vice- Mayor Inskeep Council approved Agenda Item 7. b) to be moved up on the agenda. Vice- Mayor Inskeep shared there is a problem with people going down the hill on the side of the bridge to access the river for swimming, fishing, building campfires, and hanging things off the pipes. He asserted it is out of control and asked Commissioner Bryant if there is something they could do to help. Commissioner Bryant replied she had spoken with the Sheriff' s Department and they agree we have educated people long enough. She asserted now it is about enforcement. She suggested posting no trespassing signs and authorizing the Police Department to start issuing out tickets. Vice- Mayor Inskeep stated they have been issuing tickets, but they haven' t been able to keep up. He asserted it is a phenomenal drain on resources and most of the violators aren' t local. Captain Bray added many of them are entering from an area of the river which is not City property and they are lawfully allowed to be there. Commissioner Bryant asked who the water pipe belongs to. Vice- Mayor Inskeep replied it is a storm water pipe and it belongs to the County. Commissioner Bryant stated they will look into it. Mayor Green asserted fencing on both sides of the bridge will help solve the problem. 5. a) Agreement# AGR2024- 20, Waste Management Inc. of Florida Council approved this agenda item to be moved up. Mrs. Odom provided background information regarding this agreement stating she and Attorney Hand have reviewed it thoroughly. She explained the rates incorporated into the contract match those proposed by Waste Pro, which means the residential rates have come down a little but there is a . 47% increase to the commercial customers. Vice- Mayor Inskeep recommended adding this topic to the consent agenda. Doug McCoy, with Waste Management, thanked Council and stated they are thrilled to be able to service the community for another five years. He said they will order the carts as soon as the contract is executed with the hope they are delivered before the October 1St start date. Councilwoman Hanchar asked what the citizens should do with their old cans. Mr. McCoy explained Waste Management will not take them unless there is a clear note informing them to do so.

City Council Workshop August 05, 2024 Page 5 of 11 4. b) Evaluations City Clerk Police Chief Mrs. Odom thanked the Council for her evaluation, stating she appreciates their comments. Chief Scaglione agreed with Mrs. Odom and didn' t have any further comments. Councilman Lehmann and Councilwoman Hanchar thanked them both for making the evaluation process easy. Vice- Mayor Inskeep stated he has an issue with a Councilmember who would utilize the City Clerk' s evaluation to try to stop proven good practice. He spoke about the process he utilizes outside of City meetings to assist staff in their decision making. He provided several examples of successful implementation of major projects, which had not been resolved until staff received assistance from a Councilmember behind the scenes. Mayor Green stated he has the utmost confidence in Mrs. Odom. He said he has recently gotten to know Chief Scaglione and is happy with his work and dedication to the City. Mrs. Odom suggested they add this topic to the consent agenda with a recommended merit increase. She provided the recommended increases made by each Councilmember. Council discussed wage increase options and agreed with a 3% increase for both Mrs. Odom and Chief Scaglione. 5) Regular Agenda Items 5. a) Agreement # AGR2024- 20, Waste Management Inc. of Florida The Council agreed to move this item and item 7. b up on the agenda. 5. b) Agreement # AGR2024- 21, eda consultants, Inc. Mrs. Odom explained the process completed for the Planning Services RFP and the reasoning behind the recommendation made to Council for the approval of eda Consultants, Inc. She stated Council directed staff to move forward and obtain a contract. She said the contract has been reviewed by Attorney Hand for legal sufficiency. Vice- Mayor Inskeep asked about their rates compared to what the City currently pays. Mrs. Odom replied upon review of our current fee schedule, eda Consultants revised their rates to be more in line with current fees. Council agreed to add this to the consent agenda. 6) Staff Agenda Items 6. a) City Clerk— Mandy Odom

City Council Workshop August 05, 2024 Page 6 of 11 Finance Officer Appointment Mrs. Odom stated she interviewed two candidates for the position and recommends Schonna McLean be appointed to the position. She reminded Council she sent an email to them asking for their consideration in bringing her onboard prior to October 11t. She explained she would like Mrs. McLean to be a part of the BS& A implementation meetings, since the new ERP program is scheduled to go live in October. She asked Council to approve an August 19, 2024, start date. She provided Council with an estimated budget impact and explained future savings in Munis expenses and Mrs. Smith' s budget for consulting services to compensate for the additional cost. Council agreed with Mrs. Odom' s recommendation. 6. b) Police Department— Chief Scaelione School Zone Project Captain Bray stated Vice- Mayor Inskeep and Attorney Hand have a copy of the contract, which is under review. 6. c) Public Work Manager— Chad Ward The Granada Roadway Project Contingency Mr. Ward stated this is regarding a second change order request. He said two sections of road, one located on Maple Street and the other on Myrtle Street, have cracks and holes which would undermine the work being accomplished on The Granada. He explained adding these two intersections will complete the road and utilize more ARPA funds. Ms. Leonard added there is a recommended action to establish an additional contingency of $ 55, 000 to cover unexpected costs. Vice- Mayor Inskeep stated this change order will use all but $ 18, 000 of the ARPA funds. He suggested Mr. Ward and Mrs. Odom be authorized to jointly approve change orders up to the project' s contingency amount. He said without this they would have to wait for a meeting to obtain approval, which will create costly delays. Council agreed to add the current change order and authorization for Mr. Ward and Mrs. Odom to approve future change orders to the consent agenda. 7) Council Agenda Items 7. a) Councilwoman Hanchar FGUA Commercial Water Connections Councilwoman Hanchar brought up an issue of multiple social media posts regarding the new businesses in town who have not yet been able to open. She stated she would like the public to know the City of Dunnellon has been trying to figure out why there has been a delay getting the water connections completed. She said there seems to be a problem with FGUA' s processes. She suggested Vice- Mayor Inskeep speak with Mr. Fontaine to see if he can assist in the process. Vice- Mayor Inskeep replied FGUA had just gone out to the businesses today and they now have everything they need to install the meters. Councilwoman Hanchar explained the consequences to Dunnellon if we had not sold the utility.

City Council Workshop August 05, 2024 Page 7 of 11 Mayor Green commented every time he has reached out to FGUA, he received a response within hours. He said they have been trying to rectify the situation as well. He stated social media seems to be the vehicle where people vent about these issues, but he discovered neither the businesses nor FGUA were part of these discussions. He asserted it is not the business of the City to insert itself into the affairs of private businesses. Vice- Mayor Inskeep shared, he had spoken with John Worrell about the three businesses which were not open, and Mr. Worrell explained it was simply coincidental they are all having similar issues. He stated the biggest issue was their contractors and engineering firms who had submitted incomplete plans to FGUA. He advised Council Mr. Worrell had gone out to the sites himself to assist. He said part of Take 5 Car Wash' s problem is they illegally moved a fire hydrant. He stated as of last Friday all three businesses have been approved to move forward with obtaining their water meters. He added FGUA has a process which must be followed via State regulations and if it isn' t, they will not get moved forward in the process. He asserted FGUA has done everything possible to assist. 7. b) Vice- Mayor Inskeep Livestream & Captioning Services for Historic Board and Planning Commission— Discussed during the Special City Council/ CRA Budget Workshop Pennsylvania Avenue Multi- Modal Trail & DRA Fencing- Discussed after item # 4. a. DCBA Christmas Parade & Special Events Expense Vice- Mayor Inskeep spoke about special events and road closures. He said there hasn' t been a process in place and there were a lot of questions last year. He explained the City used to prepare the plans and then it reverted to the DCBA. He said he found out the City is actually required to prepare the plans, or they can contract it out with the Police Chief' s approval. He advised there was a question regarding barricades and it was discovered an MOT qualified person must perform pre and post event acceptance, as well as be present at the event. He added volunteers can put up barricades under the direction of the MOT qualified person. He explained there must be four electronic message boards out to notify drivers of road closures. Vice- Mayor Inskeep provided a list of things which need to be accomplished for any City-wide event and those responsible for performing each function. He commented we will work out the bugs during the Christmas event and will be ready for the Boomtown event. Mayor Green advised everyone opening day of little league is coming. He said he doesn' t know the date yet, but it will be sometime in February. He expressed concern because the bingo hall has been sold and it is where they have been staging their floats for the parade. Chief Scaglione stated they parade down Pennsylvania Avenue and they must follow the same plan regarding road closures. Mayor Green asserted this is the kids' biggest event and we want to uphold it. Councilwoman Hanchar said she reached out to the Dunnellon Little League President and they would like to come to a meeting to discuss the traffic issues. She suggested adding the topic to the September Workshop. Chief Scaglione suggested they speak with him before they come to the meeting. Council agreed with Chief Scaglione and the discussion at the September Workshop. Councilwoman Hanchar agreed to share the information with them.

City Council Workshop August 05, 2024 Page 8 of 11 Police Department Structure Vice- Mayor Inskeep spoke about Police Department reporting. He stated when they began reporting to the Council directly, there wasn' t a policy put in place to set up basic reporting requirements. He suggested Council create a policy which includes audit report status, quantity of officers, quantity of administrators, officers who aren' t working for the City of Dunnellon but are on the City payroll, how many vehicles we should have, nightly business checks, and monthly reports to Council. He said this will keep the Council informed and keep the Police Department working legitimately. Councilwoman Hanchar asked Attorney Hand if there is a policy already in place somewhere they can use for the framework. Attorney Hand replied he isn' t aware of one. Mayor Green stated creating this policy is an effort to ward off a future problem and is no reflection on the department' s current administration. Chief Scaglione stated open communication, his evaluation, and holding him responsible for bringing the information to them should be sufficient. He asserted he doesn' t believe a policy is necessary. He said they only need to tell him what they want and he will provide it. He added if anyone has a question, they can come sit down with himself and Captain Bray. He declared a policy of this type will be too restrictive for Council. Vice- Mayor Inskeep stated the reason he is suggesting it is because of what Chief Scaglione, Captain Bray, and the Council walked into after the last regime. He said he is speaking about basic duties and he would like them in writing. He provided further reasons for this suggestion. Councilman Lehmann suggested Chief Scaglione put together a list of things which weren' t done before and a new list of things which are being done now, to be sure all the main points are covered. Chief Scaglione stated he has joined the Florida Police Chief' s Association and they are developing an entire format for Police Chief' s, which pertains to Vice- Mayor Inskeep' s suggestions. Councilwoman Hanchar asked Mrs. Odom how Council governs her and her department. She advised what requirements put in place for the Police Department should be put in place for the Clerk' s Department. Mrs. Odom replied management of the Police Department is somewhat different than general administration. There was further discussion regarding expectations, the differences between the two positions, discussion between Council members regarding whose responsibility it is to govern the Police Department, and the creation of basic of standards. Council agreed to defer further discussion until Chief Scaglione presents the information he receives from the Chief of Police Association. Police Department A/ C Repair Vice- Mayor Inskeep stated the server room in the Police Department does not stay cool enough and the issue needs to be fixed as soon as possible. He said he received one quote for

City Council Workshop August 05, 2024 Page 9 of 11 approximately$ 16, 000. He added they need to install two return vents and replace the mini unit for the server room. He said they are working on another quote and he hopes to have it by next week. 8) Ordinance# ORD2024- 07, Alcoholic Beverages Attorney Hand stated this Ordinance mirrors the County Ordinance regarding the sellable hours, except the City' s Ordinance allows Sunday sales. He said he also changed the alcohol definition to meet State requirements. There were no Council questions or comments. 9) Resolutions 9. a) Resolution # RES2024- 21, Personnel Manual Amendment Mrs. Odom stated the salaries and classifications need to be updated due to the September minimum wage increase to $ 13. 00. She said upon the recommendation of Kelly Wyen, the Planning and Zoning Clerk job description has been updated because the duties are more involved than a Permit Clerk. She explained the salary range for the Planning and Zoning Supervisor has been amended and the changes will become effective on October 1, 2024. 9. b) Resolution # RES2024- 22, Surplus Equipment Mrs. Odom stated there is a 1985 crane sitting at the sewer plant which is inoperable. She said we have no use for it and it should have been disposed of years ago. She advised Weeks Auction will have to come get it because it is too large for us to deliver. There were no Council questions or comments. 10) Department Reports Mrs. Odom stated she received a request for a Proclamation. She reminded Council they passed a Resolution which limits the number and subject matter of Proclamations. However, she said the request from the Daughters of the American Revolution, Rainbow River Chapter, is a simple Proclamation which we could mail to them. She quoted the Resolution and explained they are not located within the City limits, but are local. Council agreed to allow Mrs. Odom to prepare the Proclamation. Ms. Leonard stated Kathy Dunn approached her, on behalf of the volunteer group, stating they will have a table at the Volunteer Expo hosted by the DCBA. She said Mrs. Dunn would like to invite any Council member who is interested in attending. She explained it is a free event and details are published on the City web site. Vice- Mayor Inskeep replied he would be interested in attending. Mrs. Odom announced the City has received restitution of $ 11, 000 from the legal action taken against Central Florida Pole Barns regarding the City Beach shade pavilions. She advised we are still due another $ 2, 223. 82 in investigation costs, but the defendant has 30 months to pay this portion. Mrs. Odom spoke about the surplus Resolution for the two lots on Ohio Street. She stated one parcel' s address is actually on Chestnut Street. She said staff will be publishing an ad to begin

City Council Workshop August 05, 2024 Page 10 of 11 accepting offers. She announced she would like to have it published next week and will reach out to the owners of Practical Behavior Solutions to let them know it is listed. She advised Council they are not required to accept the highest offer received. Attorney Hand added there are extra considerations when accepting below market value, but we can do whatever we want with above market value as long as it abides by the CRA Plan and statutory requirements. Mr. Ward announced Public Works has received the rest of their replacement equipment and they are fully up and running. He stated they processed 2, 800 sandbags for the community but lost one shed and a basketball court fence in the storm. 11) Council Comments Mayor Green announced he went to a meeting for the Florida League of Mayors and the agenda was well worth it. He said they had presenters from Jacksonville, Marion County, and Citrus County who spoke on mental health for veterans, active and inactive service members, first responders, and youth. He commented the presenters were very good. He advised Council he will not attend next week' s meeting because he is going to the Florida League of Cities conference. He advised there is no expense to the City because the association has covered his costs. He commented it' s an opportunity to renew old acquaintances and he is looking forward to absorbing as much information as he can. Mrs. Odom asked Councilman Lehmann if there is a possibility he will be out next week as well because of the storm. She expressed her concern with the possibility of not having a quorum. Councilman Lehmann replied he can leave when needed, therefore he will be back for the meeting. Vice- Mayor Inskeep stated he went to an FGUA meeting regarding the status of the Rainbow Springs wastewater plant decommissioning. He said they expect to stop treating waste at the site within the next couple weeks. He shared this is the last of the three treatment plants which will be decommissioned and the Dunnellon plant has been upgraded to handle the additional capacity. 12) City Attorney Comments Attorney Hand stated he has had discussions with Chief Scaglione and Mrs. Odom regarding the City Noise Ordinance. He explained to Council issues on the river have brought this discussion about and the Ordinance hasn' t been amended since 1985. He shared there was a Supreme Court ruling in 2012 and the City' s Ordinance was not amended to be in line with it. He advised Council this must be addressed. He said there is a compliance Ordinance in Flagler Beach which would be a good fit for Dunnellon, with only some minor adjustments. Vice- Mayor Inskeep asked about attorney fees related to implementing the new Ordinance. Attorney Hand replied it should be minimal. Mayor Green commented he doesn' t see an issue. Council agreed to allow Attorney Hand to prepare the Ordinance.

City Council Workshop August 05, 2024 Page 11 of it Attorney Hand stated he will have a full legislative update in writing soon, to include several changes which will affect Dunnellon.
