What This Bill Does

Utah enacts HB 188, which takes effect on May 6, 2026, requiring schools to directly refer minors to court for third-time drug possession offenses on school property, setting strict criteria for school-to-law-enforcement referrals, and establishing civil and criminal immunity for school employees reporting offenses or conducting administrative searches.

Why it matters

Changes how local education agencies and courts handle student misconduct by altering diversion eligibility, mandating specific administrative steps before law enforcement is notified for minor infractions, and expanding reporting metrics for juvenile recidivism.

Frequently Asked Questions

When can a school refer a student to law enforcement for a minor infraction?
A school administrator or resource officer may only refer a minor to law enforcement or a court for a class C misdemeanor, infraction, or status offense if the minor allegedly committed an offense on a previous occasion and was already referred to an alternative intervention for that prior offense.
Are school employees protected from lawsuits if they report a student offense?
Yes. Any school employee or principal who in good faith reports information regarding a student offense or conducts an investigation under this part is granted immunity from civil or criminal liability.
What happens if a student commits a drug possession offense at school?
The principal may conduct an administrative investigation and search before notifying law enforcement. If the minor has allegedly committed a drug possession offense on at least two previous occasions on school property, the school must refer the minor directly to a court.
Can school employees' email addresses be shared with outside parties?
No. The state board may not disclose employee email addresses to third parties, though they must provide them upon request to the president of the Senate and the speaker of the House for limited official legislative communications.
